The purpose of this study is to examine the potential impacts that mandatory police trainings, such as de-escalation tactics and use of force trainings, have on the number of suspects who are injured, shot and killed, and citizen complaints of unnecessary force used by police officers. An examination on training programs specifically aimed at responding to incidents involving people with mental illnesses will determine if the use of these trainings results in fewer suspect injuries and reported unnecessary force incidents. Conduct Relating To The Practice Of Law: Aba Model Rule 8.4(G) And Its History In Light Of The Constitution, Nathan Moelker
St. Mary's Journal on Legal Malpractice & Ethics
The ABA adopted a revision to the Model Rules in 2016, prohibiting harassment and discrimination against a list of protected classes. The Rule, while well-intentioned and targeted at a serious problem, was broadly phrased to include a large category of protected speech and behavior. The Rule has already faced extensive and well-crafted challenges from the perspective of the Free Speech Clause. This article argues that two additional provisions of the First Amendment—the Free Exercise Clause and Freedom of Association—further illustrate the failure of the Rule and the alarmingly wide-ranging effects of such a prohibition on attorney conduct.

Federal administrative agencies that enforce workplace laws have dual responsibilities: (1) to prevent or remedy noncompliance with the underlying workplace law and (2) to prevent or remedy noncompliance with the law’s antiretaliation provisions. Disparities based on race, sex, and their intersection exist with respect to both of these types of employer noncompliance, as female workers and workers of color experience more violations of the substantive provisions and the retaliation provisions of these laws. While effective enforcement is vital to preserving workplace regulation as a whole, there is also an equity component to enforcement. Because workplace law violations disproportionately harm women …

COVID-19 pandemic orders were weaponized by state and local governments in Black neighborhoods, often through violent acts of the police. This revealed an intersection of three centuries-old patterns— criminalizing Black movement, quarantining racial minorities in public health crises, and segregation. The geographic borders of the most restrictive pandemic order enforcement were nearly identical to the borders of highly segregated, historically Black neighborhoods.
The right to free movement is fundamental and, as a rule, cannot be impeded by the state. But the jurisprudence around state power in public health emergencies, deriving from the 1905 case Jacobson v. Massachusetts, has practically resulted …

Assessing The Relationship Between True Crime Documentary And Podcast Consumption, Fear Of Crime, And Protective Behaviors, Lauren A. Tremblay

This study examines how the consumption of true crime documentaries and podcasts is linked to the fear of crime and the adoption of protective behaviors. Building upon prior research that explores these relationships, this study aims to evaluate the impact of true crime content consumption and fear of crime on individuals’ engagement in protective behaviors. Using a cultivation theory framework with an analytic sample of 665 American adults, three Ordinary Least Squares (OLS) regressions and one structural equation model are used to evaluate the relationship between true crime documentary and podcast consumption, fear of crime, and protective behaviors. Importance Drug use and incarceration have a substantial impact on rural communities, but factors associated with the incarceration of rural people who use drugs (PWUD) have not been thoroughly investigated.
Objective To characterize associations between recent incarceration, overdose, and substance use disorder (SUD) treatment access among rural PWUD.
Design, Setting, and Participants For this cross-sectional study, the Rural Opioid Initiative research consortium conducted a survey in geographically diverse rural counties with high rates of overdose across 10 US states (Illinois, Wisconsin, North Carolina, Oregon, Kentucky, West Virginia, Ohio, Massachusetts, New Hampshire, and Vermont) between January 25, 2018, and March 17, …

Two early service teachers and one pre-service teacher offer strategies for creating a more effective, inclusive ELA classroom experience. The approaches include writing as a process, unification of behavioral management through class assignments, and a restorative approach to communication. Implementing these strategies can revive productivity in the ELA classroom.

In April 2018, the Washington Supreme Court became the first in the nation to adopt a court rule to combat implicit bias in the jury selection process. 2 General Rule 37 (“GR 37”) eliminates the need to raise an inference of purposeful discrimination, lists presumptively invalid reasons for exercising a peremptory strike that are historically associated with racial stereotyping, and uses an objective standard to determine if race or ethnicity could be viewed as a factor in the strike. 3 These changes address growing concerns that the current framework for evaluating biased peremptory strikes has failed to combat discrimination while …

There is a growing global recognition that, in order to address the current access to justice crisis, more research, together with a better understanding of data, is needed. This article, through an examination of existing legal aid research primarily in the area of criminal law, explores some of what we know and do not know about the relative benefits and costs of providing different kinds of criminal legal aid services. Although not a comprehensive review of all available research, this article identifies data strengths and gaps and the need for further research and reforms.

It lays bare the motivations of aggressors who wish to subjugate nations or groups of people and corporate executives and government bureaucrats who make discretionary decisions that harm people. Along with cataloging mass killings by despots and soldiers, the book includes stories about Ponzi-schemers and the deaths of automobile drivers and passengers who were killed by vehicle defects known to the manufacturer. The initial critical event precipitating the problem of practice at my school was the repercussions of the mass shooting at Marjorie Stoneman Douglas High School, Parkland, Florida on February 14, 2018. This shooting and the resulting legislative mandates of Florida Senate Bill 7026, led to my administrative decision to adopt Restorative Practices at my school, a school for students with disabilities. Restorative Practices purport to encourage the development of positive relationships, repair and restore existing relationships thereby decreasing the chance of a repeated offense and improving school climate (Zehr, 2015).
