"He Is Not A Monster": Himpathy And Sexual Assault, Christabel L. Rogalin, Saige M. Addison

Himpathy occurs when privileged men accused of sexual assault or harassment receive extra attention and sympathy (Manne 2018, 2020). While himpathy is closely associated with the #MeToo movement, little research has explicitly explored this concept. In this review, we explore the literatures on rape myths, victim blaming and attributions, detailing the empirical work that provides support for the theoretical claims of himpathy. Sexual violence is a widespread problem, and as such, it is important to understand himpathy may underlie how the numerous (male) perpetrators of these crimes are able to reframe the allegations against them.

Although the role of prisoners and ex-prisoners has recently received significant attention in restorative justice research, the literature typically treats them as the ‘offending’ party within restorative justice processes. This article instead focuses on ex-prisoners as facilitators of restorative justice, highlighting their ability to lead such programmes. Using a case study from Northern Ireland, the article examines the way that experiences of incarceration have directly influenced practitioners’ skills and their ability to uphold restorative justice principles. It is contended that qualities developed and honed in the prison environment ultimately translate to unique characteristics that can improve the restorative process. As …

Public Perceptions And Legal Dimensions Of Juvenile Sexting, Corey Call

Journal of Social, Behavioral, and Health Sciences

The sending of sexually explicit messages, or “sexting” has been recognized as a common practice among youths. As sexting may involve the creation and distribution of sexually explicit images and videos, juvenile sexters can be charged with offenses related to child pornography. This study examined public attitudes toward juvenile sexting and demographic influences on these views. Based on a quantitative survey of 1,023 U.S. adults, the majority of respondents (51.8%) disapproved of criminalization in cases of consensual sexting, but 80% supported legal repercussions for nonconsensual sharing. Respondents primarily favored educational interventions (67.4%) and restrictions on technology use (53.4%) over harsh …

This article looks at eudaimonic happiness and political ideology seen in terms of liberalism and conservativism. It appears that these two ideologies are driven by different temperaments that have been broadly viewed as Platonic and Aristotelian. It is often said that Aristotle is the master of those who know as Plato is the master of those who dream. Temperament is composed of a number of sub-traits that are highly heritable which, separately and together, move us to perceive the world in certain ways and thus help to forge worldviews that are emotionally attractive to us. In the United States correctional education programs are part of the federal and state prisons effort to rehabilitate offenders. Prisoners may be rehabilitated by learning skills that can prepare them for reintegration into society post-release. This study explored the value of correctional education programs in assisting formerly incarcerated women in avoiding recidivism in New York state. The qualitative interpretive study used semi-structured interviews of 10 formerly incarcerated women released from a New York state jail or prison during 2017 – 2022. The results of this study suggest that low school attainment is one of the educational risk factors associated with …

Police officers play a significant role in the criminal trial process and are unlike any other witness who will take the stand. They are trained to testify, and jurors find them more credible than other witnesses, even though officers may have more incentive to lie than the ordinary witness. Despite the role of police officers in criminal proceedings, state statutes say virtually nothing about evidence used to impeach police officers, often contained in the officer’s personnel file. The general perception that country music aligns itself with the political right is perhaps most exemplified by the songs, “Courtesy of the Red, White, and Blue (The Angry American)” by Toby Keith and “Okie from Muskogee” by Merle Haggard. Both songs speak of patriotic values that are traditionally associated with that side of politics. The juvenile justice system can process youth in myriad ways. Youth who are formally processed, relative to being informally processed, may experience more public and harsh sanctions that label youth more negatively as “deviant.” Drawing on labeling theory, the current study evaluates the relative effect of formal justice system processing on the interpersonal dynamics of youth peer networks. Using data from the Crossroads Study, a multisite longitudinal sample of first-time adolescent offenders, the current study applies augmented inverse probability weighting and generalized mixed-effects models to estimate the effects of formal processing on friendship selection processes of homophily and withdrawal and …

This Article presents evidence that some state prosecutors use their discretion to reduce racial disparities in criminal sentences. This finding challenges the prevailing view that prosecutors compound disparities. Given prosecutors’ positions as mediators in a sequential system, this Article analyzes how prosecutors respond to disparities they inherit from the past—and interprets their impacts in light of the accumulated disparities that already exist when they first open their case files. Specifically, I estimate how the sentencing penalty for prior convictions differs by defendant race using North Carolina state court records from 2010 to 2019. I find that the increase in the …

This purpose of this qualitative study was to explore shared characteristics and local challenges of trauma-informed youth sport program design and implementation through the voices of ten program facilitators (e.g., director, trainer; 8 women, 2 men; average age of 36.2 years, SD = 6.03) across four U.S. regions. Within a postpositivist approach and through thematic analysis of semi-structured interviews (average length of 53 minutes), shared characteristics identified by facilitators included promoting a safe and supportive environment, cultivating healthy relationships among adults and peers, and intentional psychological and social skill-building (e.g., attentional cues). While the Fair Housing Act prohibits housing discrimination because of race, gender, religion, sex, disability, family status, and national origin, it allows housing providers to discriminate on the basis of criminal history. Prior research shows that housing providers disproportionately deny housing to ex-offender applicants and single parent applicants with young children. An ex-offender parent’s inability to acquire safe and affordable housing decreases the potential for reunification with their children and increases the risk of lost custody or parental rights termination. From prohibition to legalization, Marijuana has had a storied legal history in the United States, but its story is not quite over. A new gray area is coming to the forefront of the legal field: Marijuana is illegal federally but legal in many states. This Note discusses how some states, including Illinois, are operating in that gray area to better their political and economic goals, but the Constitution places a barrier to do so with the Dormant Commerce Clause. The Supreme Court shocked the world at the end of its 2021–22 term by issuing landmark decisions ending constitutional protection for abortion rights, expanding gun rights, and weakening what remained of the wall between church and state. One thread uniting these cases that captured the public’s attention is the rhetoric common of originalism—a backwards-looking theory of constitutional interpretation focused on founding-era meaning and intent. This Article identifies the discriminatory intent doctrine as another powerful tool the Court is using to protect the social norms and hierarchies of a bygone era, and to build a conservative Constitution.

Indian tribes have some freedom to develop their own approach to cannabis agriculture, but what is the nature of that freedom, and how have tribes acted upon it?

This Article investigates the current legal framework surrounding tribal cannabis agriculture and tribal participation in legal cannabis markets. It is generally believed that tribes have some authority to determine the legality of cannabis cultivation on their lands, and to create rules and regulations governing that practice.
