Toward Improved Shared Micromobility Implementation: A Data-Driven Approach To Overcome Challenges And Explore Next-Generation Acceptance, Myriam Zakhem Apr 2024

Toward Improved Shared Micromobility Implementation: A Data-Driven Approach To Overcome Challenges And Explore Next-Generation Acceptance, Myriam Zakhem

Civil and Environmental Engineering Theses and Dissertations

Rapid transportation advancements over the last several years have resulted in new personal mobility modes, such as shared micromobility (e.g., e-scooters, bikes, and e-bikes). These short-term rental vehicles expand transportation mobility by offering affordable, convenient, and efficient options that are easy to access. The rapid expansion of dockless micromobility systems presents major opportunities and challenges for cities, leading some to ban these services within their jurisdiction. To enhance the effectiveness of dockless shared micromobility services, address challenges created by these services, and achieve better implementation performance, cities need efficacious strategies to tackle major challenges. This dissertation contributes to the body …

Beyond The Library: The Role Of Academic Libraries’ Chat Reference In Answering Campus Questions, Erin Owens, Vanessa Arce, Darcy Del Bosque, Robin Fowler, Silvia Sheffield

Publications and Research

Even before the COVID-19 pandemic drove most users online, chat was establishing itself as a core service for asking library-related questions of many types, from basic directional and reference to research queries of a more sophisticated nature. This investigation seeks to provide insight into how academic libraries are seen not only as a source of library assistance, but also as a means of filling an information gap on a wider subject: the university campus at large. The study’s methods involved analyzing chat transcripts from five large four-year public universities during a two-year period (2019- 2021), noting the frequency of campus-related …

The Witch-Hunt For Spies - A Critique Of The China Initiative And National Security’S Outsized Influence In Equal Protection Analysis, Winni Zhang Apr 2024

The Witch-Hunt For Spies - A Critique Of The China Initiative And National Security’S Outsized Influence In Equal Protection Analysis, Winni Zhang

Washington and Lee Journal of Civil Rights and Social Justice

The U.S. Government has increased its focus on Chinese espionage in the last decade in a randomized and unpredictable way. Primarily targeting Chinese scientists and academics, the “China Initiative” has resulted in widespread targeting of individuals based on their race, ethnicity, and national origin. The program was formally terminated and said to now be a part of a broader approach to nation-state threats. However, the outcomes and effect of the economic espionage charges in the last 15 years has greatly skewed towards prosecuting Chinese individuals irrespective of the name of the program. While protections typically exist in the law to …

Reflections Of A Non-Abolitionist Admirer Of The Police Abolition Movement, Corey Stoughton Apr 2024

Reflections Of A Non-Abolitionist Admirer Of The Police Abolition Movement, Corey Stoughton

Washington and Lee Journal of Civil Rights and Social Justice

To acknowledge that the abolition movement made reform better is not to reduce the movement to that purpose. For the non-abolitionist, the end of reform is better policing. For the abolitionist, reform is at best “a strategy or tactic toward transformation,” meaning contesting and ultimately eliminating policing. These are not compatible visions. But even if the collaboration between holders of these visions is just a tactical alliance, it is a tactical alliance that is producing good results. Perhaps those good results will lay a foundation for abolition, or perhaps they will seed in abolitionists’ fertile imaginations a positive vision of …

Fitting A Block Into A Sphere Mold: The Inadequacy Of Current Data Privacy Regulations In Protecting Data Privacy Within The Blockchain Space, Jenny Yang Apr 2024

Fitting A Block Into A Sphere Mold: The Inadequacy Of Current Data Privacy Regulations In Protecting Data Privacy Within The Blockchain Space, Jenny Yang

Washington and Lee Journal of Civil Rights and Social Justice

Despite global imposition of data privacy laws and regulations, data privacy is a nonexistent luxury amongst the data-charged world we live in. Data privacy has long been established as a fundamental right. Entities have successfully established robust methodologies around existing data privacy laws and regulations to utilize past consumer behavior to predict, impact and manipulate current and future consumer behaviors. This phenomenon has been commonly coined as “corporate surveillance.” Emerging spaces arising through technological developments have greater access into consumer data to impact economic choices. Specifically, the blockchain space, through its unique open-source and permanent traits, has been able to …

Tort Liability For Physical Harm To Police Arising From Protest: Common-Law Principles For A Politicized World, Ellen M. Bublick, Jane R. Bambauer Apr 2024

Tort Liability For Physical Harm To Police Arising From Protest: Common-Law Principles For A Politicized World, Ellen M. Bublick, Jane R. Bambauer

UF Law Faculty Publications

When police officers bring tort suits for physical harms suffered during protest, courts must navigate two critically important sets of values—on the one hand, protesters’ rights to free speech and assembly, and on the other, the value of officers’ lives, health, and rights of redress. This year courts, including the United States Supreme Court, must decide who, if anyone, can be held accountable for severe physical harms suffered by police called upon to respond to protest. Two highly visible cases well illustrate the trend. In one, United States Capitol Police officers were injured on January 6, 2021, during organized attempts …

Queer And Trans Migrations: The Impacts Of Presidential Discourse, Isabella Richards Apr 2024

Queer And Trans Migrations: The Impacts Of Presidential Discourse, Isabella Richards

Women's and Gender Studies Theses

Political discourse, defined as “the totality of all speech acts used in political discussions, as well as rules of public policy, sanctified by tradition and proven by experience” (Valerevna and Rakhmatovna 88) has a profound impact on shaping societal perspectives, policies, and cultural norms. In the United States, historical presidential rhetoric has reinforced ideals like the nuclear family, inadvertently promoting heteronormativity and white supremacy. Consequently, this has led to marginalized groups, such as queer and trans migrants, being unjustly portrayed as outsiders or threats. This research project demonstrates how presidential discourse has framed queer and trans migrants as outsiders or …

Victor Hugo Was Right All Along: Les Misérables, The Tragedy Of A Punitive Parole System, And A Modern Path Forward, Sarah Gerwig Apr 2024

Victor Hugo Was Right All Along: Les Misérables, The Tragedy Of A Punitive Parole System, And A Modern Path Forward, Sarah Gerwig

Mercer Law Review

Les Misérables, Victor Hugo’s tragic novel, was published over 160 years ago and yet it continues to capture imaginations and sympathies worldwide. It was made into an award-winning film over a decade ago. But before that, Les Misérables was one of the most popular Broadway musicals ever produced, having been viewed by over sixty million people, even beyond the viewership of other popular renditions in film and television. Despite (or perhaps because of) its heartbreaking themes, audiences sympathize with the main characters’ quest for redemption. How easy, in the story, to see the struggles and barriers Jean Valjean encounters—and …

The Promise And Perils Of Tech Whistleblowing, Hannah Bloch-Wehba Apr 2024

The Promise And Perils Of Tech Whistleblowing, Hannah Bloch-Wehba

Faculty Scholarship

Whistleblowers and leakers wield significant influence in technology law and policy. On topics ranging from cybersecurity to free speech, tech whistleblowers spur congressional hearings, motivate the introduction of legislation, and animate critical press coverage of tech firms. But while scholars and policymakers have long called for transparency and accountability in the tech sector, they have overlooked the significance of individual disclosures by industry insiders—workers, employees, and volunteers—who leak information that firms would prefer to keep private.

This Article offers an account of the rise and influence of tech whistleblowing. Radical information asymmetries pervade tech law and policy. Firms exercise near-complete …

A Collaborative Campus Community Policing Model: A Case Study In Fostering Collective Efficacy Among Students, Faculty And Staff, Hassan Ramzah

Dissertations and Doctoral Documents, University of Nebraska-Lincoln, 2023–

This qualitative, single case study explored whether and how a campus police agency’s community policing model fostered collective efficacy among students, faculty, staff members and campus police. Using Bandura’s (2000) collective efficacy theory, this study was guided by the following questions: (1) How does a campus police department use a community policing model to build partnerships with students, faculty, and staff? (2) How do police officers, students, faculty, and staff perceive these partnership-building efforts, particularly as it relates to fostering collective efficacy within the campus community? (3) Through what processes have campus police partnerships with students, faculty, and staff contributed …

Whom Do Prosecutors Protect?, Vida Johnson Apr 2024

Whom Do Prosecutors Protect?, Vida Johnson

Georgetown Law Faculty Publications and Other Works

Prosecutors regard themselves as public servants who fight crime and increase community safety on behalf of their constituents. But prosecutors do not only seek to protect those they are supposed to serve. Instead, prosecutors often trade community safety, privacy, and even the constitutional rights of the general public to enlarge police power. Prosecutors routinely advocate for weaker public rights, shield police from public accountability, and fail to prosecute police when they break the law.

This Article will show how prosecutors often protect police at the expense of the public. This Article suggests a novel theory of evaluating the conduct of …

Doctor of Nursing Practice Projects

Background/Purpose: There continues to be a rise in workplace violence in healthcare, specifically in the form of bullying and incivility. Workplace bullying in nursing is a serious and concerning issue that has garnered increasing attention in recent years. It not only affects nurses in the form of staff turnover and burnout, but also poses risks to patient care and overall workplace morale. In Massachusetts, data collected on the prevalence of workplace violence shows an increase in incidence. There is a lack of regulation to guide organizational policies addressing incivility in the nursing work environment and ensure accountability.

Courtroom Workgroup Dynamics And Implementation Of Three Strikes Reform, Elsa Y. Chen, Emily Chung, Emily Sands Apr 2024

Courtroom Workgroup Dynamics And Implementation Of Three Strikes Reform, Elsa Y. Chen, Emily Chung, Emily Sands

Political Science

In 2012, California's voters passed a ballot initiative that scaled back the state's “Three Strikes” sentencing law and permitted certain individuals who were serving 25-to-life prison terms to petition for resentencing and potentially release. Using analysis of original qualitative interview data supplemented with court administrative records, this study examines how characteristics of courtroom workgroup members; their intergroup dynamics; political, professional, and administrative considerations; and allocated resources were perceived by court officials to facilitate or impede the implementation of this reform in county courts. Availability of staff and budget was associated with a higher proportion of completed case dispositions in the …

The Elements Of Governance And Their Association With Aviation Safety Oversight Effectiveness, João Souza Dias Garcia Apr 2024

The Elements Of Governance And Their Association With Aviation Safety Oversight Effectiveness, João Souza Dias Garcia

Doctoral Dissertations and Master's Theses

States and their respective national civil aviation authorities promote the improvement of the global civil aviation system by developing and enforcing safety regulations for aircraft design, operations, personnel training, infrastructure, and air traffic management, among other topics. For many years, the International Civil Aviation Organization (ICAO) has driven the continuous improvement of states’ safety oversight functions, supporting them in evaluating the effectiveness of these functions by conducting audits under the Organization’s Universal Safety Oversight Audit Program (USOAP). While the benefits of these assessments have been broadly recognized, scholarly literature on the factors commonly associated with safety oversight effectiveness across states …

The Use Of Virtual Reality Training Environments For Procedural Training In Fourth-Generation Airliners, Mark Edgar Mccullins

Doctoral Dissertations and Master's Theses

This study examined the effectiveness of using virtual reality training environments for procedural training in fourth-generation airliners. Its goal was to assess whether the training outcomes from a recurrent training course for FAA certificated Airframe and Powerplant (A&P) technicians, which used a Full Flight Simulator (FFS) to deliver and assess training, differed from the same training delivered using a Virtual Reality (VR) device.

The study used an experimental design with three groups and two within-group measures of training effectiveness. The control group followed the current training program and was assessed in the FFS, while the second group was trained using …

Answering The Dam Question: Visitor Perspectives On Removing And Maintaining Dams In Wilderness, William L. Rice, Christopher A. Armatas

Society and Conservation Faculty Publications

Managers of designated wilderness in the United States are challenged by the complex issue of how to address existing dams and water storage. Dams can exist in wilderness, as they are considered a special provision that can provide a variety of benefits to society; however, dams are also considered a potential threat to wilderness character. We review the issue of dams in wilderness, and then present the results from a study in the Rattlesnake Wilderness in Montana where visitor opinions around dam removal or maintenance were assessed. Our aim through this present research is to examine public agreement or disagreement …

The Right To Violence, Sean Hill Apr 2024

The Right To Violence, Sean Hill

Utah Law Review

Scholars have long contended that the state has a monopoly on the use of violence. This monopoly is considered essential for the state to assure the safety and security of its citizens. Whereas public officers have the broadest authority to deploy violence, in order to make arrests or to inflict punishment, private citizens allegedly have severe restrictions on their use of force. Specifically, the state is said to only authorize private violence when civilians face an imminent threat of unlawful force or when civilians are attempting to prevent a crime.

Yet the state explicitly authorized private violence against enslaved people …

First Amendment Fetishism, John Kang Apr 2024

First Amendment Fetishism, John Kang

Utah Law Review

This Article has not argued for the propriety of restricting speech as a good in its own right. Rather, it argues the Supreme Court has gone too far in protecting the right of highly offensive speech. Instead of weighing the value of such speech in relation to its harms on the community, the Court has eagerly embraced a fetishistic attitude toward the right of speech. This Article has suggested, however, that said fetishism is inconsistent with the original understanding of the right of speech. This Article culled the insights provided by the original understanding of the right of speech and …

Circumventing The Fourth Amendment: The Unconstitutional Nature Of Geofence Warrants, Shelby Stender Apr 2024

Circumventing The Fourth Amendment: The Unconstitutional Nature Of Geofence Warrants, Shelby Stender

Utah Law Review

Federal and state law enforcement agencies are using a new tactic for gathering evidence: geofence warrants. These warrants allow law enforcement to gather historical location data collected by third party companies including Google, Facebook, Amazon, and Apple. Armed with a geofence warrant today, law enforcement agencies can track the previous location of an individual at any point from the moment they acquired a cell phone—so long as the location history is turned on. The tactic has grown in popularity since 2019 and has been used to uncover suspects in cases where police had few leads. Troublingly though, the tactic has …

Expanding Drug Courts And Alternative Justice Courts In West Virginia: Implementing Innovative And Restorative Justice Practices, Emily Ogden Apr 2024

Expanding Drug Courts And Alternative Justice Courts In West Virginia: Implementing Innovative And Restorative Justice Practices, Emily Ogden

West Virginia Law Review

The United States has the highest incarceration rate of any country in the world. Alarmingly, West Virginia’s incarceration rate is even higher. West Virginia’s staggering incarceration rate can largely be attributed to the increased criminalization and prosecution of individuals experiencing addiction. This Note considers what actions can be taken to limit incarceration and recidivism in West Virginia. The solutions proposed by this Note also aim to limit the collateral consequences of incarceration in West Virginia because many of West Virginia’s current issues are only exacerbated by incarceration. This Note reviews alternative justice methods and notable alternative justice courts across the …
