Generations Of Abuse: Exploring The Sexual Assault Epidemic On Native Land, Carly White Apr 2024

Generations Of Abuse: Exploring The Sexual Assault Epidemic On Native Land, Carly White

Lincoln Memorial University Law Review Archive

The United States government has a long history of extending its reach into the affairs of Native people. Yet, it has consistently failed to protect Native women from rampant violence and abuse. Native American women have the highest rates of sexual abuse in the country. The federal government has the decision to either mend its long-standing indifference toward Indigenous women or allow them to continue to suffer under the current system. This note explores the sexual assault crisis on Indian land and seeks to bring positive change to historically marginalized women. Specifically, this note highlights the need for Congress to …

A Framework For Managing System Resources And Pricing In Multi-Provider Edge Computing Environments, Matthew Paul Salcido Apr 2024

A Framework For Managing System Resources And Pricing In Multi-Provider Edge Computing Environments, Matthew Paul Salcido

Electrical and Computer Engineering ETDs

Multi-provider multi-user multi-access edge computing provides a recent market driven networking paradigm facilitating the user data offloading process. In this thesis, we introduce the AGORA framework, which employs a sophisticated multi-leader multi-follower Stackelberg game that jointly optimizes the data offloading, computing resource allocation, and computing resource pricing, all facilitated through a non-cooperative game-theoretic approach. In order to support the aforementioned modeling and approach, a novel utility function that quantifies the users satisfaction, factoring in the computing service cost, and an innovative profit function for the MEC providers is introduced, emphasizing the market penetration and the computing service provision costs. Numerical …

Barcoding Bodies: Rfid Technology And The Perils Of E-Carceration, Jackson Samples Apr 2024

Barcoding Bodies: Rfid Technology And The Perils Of E-Carceration, Jackson Samples

Duke Law & Technology Review

Electronic surveillance now plays a central role in the criminal legal system. Every year, hundreds of thousands of people are tracked by ankle monitors and smartphone technology. And frighteningly, commentators and policymakers have now proposed implanting radio frequency identification (“RFID”) chips into people’s bodies for surveillance purposes. This Note examines the unique risks of these proposals—particularly with respect to people on probation and parole—and argues that RFID implants would constitute a systematic violation of individual privacy and bodily integrity. As a result, they would also violate the Fourth Amendment.

All Aboard: Understanding Property Rights In Texas After Texas Central, Asher K. Gregg Apr 2024

All Aboard: Understanding Property Rights In Texas After Texas Central, Asher K. Gregg

Texas A&M Journal of Property Law

Our forefathers intended the United States Bill of Rights to protect individuals from government overreach. Specifically, the Fifth Amendment, as applied to the States via the Fourteenth Amendment, in part protects individuals from unnecessary takings. Eminent domain authority—its more common name—has long been recognized as a power to be used cautiously and only when necessary. Although most often associated with government exercise, states are permitted to grant this unyielding authority to private entities via their state constitutions and statutes. Despite Texas serving as a beacon for individual property rights, the Texas Supreme Court’s recent decision in Miles v. Texas Central …

Using Virtual Reality Technologies In Built Environment Education, Rebekah Floyd, Kayla Walters, Stuart Werner Baur Apr 2024

Using Virtual Reality Technologies In Built Environment Education, Rebekah Floyd, Kayla Walters, Stuart Werner Baur

Undergraduate Research Conference at Missouri S&T

Virtual reality (VR) offers transformative potential in built environment education, including human-made surroundings like buildings and infrastructure. This review explores VR's benefits, challenges, and trends in this field. VR fosters immersive learning, allowing students to explore architectural designs and urban planning scenarios. It provides hands-on experiences, enhancing spatial understanding and critical thinking. Simulations enable safe experimentation with design ideas and construction techniques without the real-life limitations or risk holding students back. However, challenges include high costs, technical limitations, and the need for educator training. Ensuring accessibility for all students is crucial. Despite challenges, VR's potential to revolutionize built environment education …

The Winter Olympics, 1924–2026, Stephen Essex, J. R. Gold, M. M. Gold

School of Geography, Earth and Environmental Sciences

This chapter documents and reviews the role of the Winter Olympics in changing and modernizing the built environment of its hosts, together with its long-term legacies. It identifies five sequential phases in the development of the event to offer a framework for organizing and understanding the experiences of the past twenty-four hosts of the Winter Olympic Games from 1924. With its focus on urban centres and regions as hosts, the Winter Olympics now emulates the Summer Olympics in its ability to stimulate regeneration. The concept of the Winter Olympics continues to evolve in its more challenging economic, social, and environmental …

Constitutional Rights Of Artificial Intelligence, Mizuki Hashiguchi Apr 2024

Constitutional Rights Of Artificial Intelligence, Mizuki Hashiguchi

Washington Journal of Law, Technology & Arts

On February 8, 2022, the Italian Parliament approved constitutional amendments to protect the environment. A member of Parliament stated that the environment is an element of Italy, and that safeguarding the environment means safeguarding humans. The need to protect the environment seems to have become a critical component of public conscience. Likewise, if society perceives that artificial intelligence is vitally important for humanity, does constitutional law allow constitutional rights for artificial intelligence to be created?

Extending constitutional rights to artificial intelligence may be consistent with the jurisprudential history of rights. Constitutional rights have undergone metamorphosis over time to protect new …

All Eyez On Rap & Hip-Hop: Analyzing How Black Expression Is Criminalized And The Language Of The Rap Act Of 2022, Maia Young Apr 2024

All Eyez On Rap & Hip-Hop: Analyzing How Black Expression Is Criminalized And The Language Of The Rap Act Of 2022, Maia Young

Washington Journal of Law, Technology & Arts

The Black existence, in the United States of America, has always been regarded as a conditional right. Conventionally, Blackness must always be nonviolent and non-disruptive to safely exist. Because of this, Blackness cannot be confined to restraints and disrupts these conventions with acts of joy and creative expression. Black creativity is both unconventional and sacred. Black creative expression documents, preserves, and unifies cultural lived experiences, from a first-hand lens of those oppressed. Creative and artistic expression celebrates the myriad of stories that are a part of the collective Black experience. Yet, Black creative expression is now being weaponized by prosecutors …

The Value Of Constitutional Environmental Rights And Public Trusts, John C. Dernbach Apr 2024

The Value Of Constitutional Environmental Rights And Public Trusts, John C. Dernbach

Pace Environmental Law Review

As part of the modern environmental movement of the 1970s, five states (Hawaii, Illinois, Massachusetts, Montana, and Pennsylvania) adopted constitutional amendments recognizing a right to a quality environment, a public trust for public natural resources, or both. Half a century later, there is a renewed interest in constitutional environmental rights, inspired in no small part by the failure of existing laws to adequately address the climate crisis. A sixth state (New York) recognized a constitutional right to a quality environment in 2021, and more than a dozen states are considering such amendments. Still, the great majority of environmental protection at …

130 Years And Counting Into Forever — New York's Forever Wild Constitutional Amendment And Lessons For Modern Green Amendments, Timothy E. Cox Apr 2024

130 Years And Counting Into Forever — New York's Forever Wild Constitutional Amendment And Lessons For Modern Green Amendments, Timothy E. Cox

Pace Environmental Law Review

In the 135 years of New York’s Forever Wild Amendment’s existence, it has been challenged by a range of court cases and thereby interpreted by courts throughout New York. The results of these cases frequently have upheld the heart of Forever Wild: to protect New York’s Forest Preserve land. This Article provides a history of the Forever Wild Amendment, an analysis of the courts’ and New York Attorney General’s interpretations of the Amendment, and a discussion of how this information can guide the future of New York’s Green Amendment.

How Much Does It Cost To Operate Tiny Home Villages For People Experiencing Homelessness, Celeste Benitez, Cooper Conway, Declan Maddern Apr 2024

How Much Does It Cost To Operate Tiny Home Villages For People Experiencing Homelessness, Celeste Benitez, Cooper Conway, Declan Maddern

School of Public Policy Capstones

Los Angeles is in a homelessness crisis. Millions of dollars are poured into preventing its causes and curtailing the increased medical costs and crime rates that stem from it. The solutions vary, but one new solution in the form of tiny home villages hopes to provide a cheap and effective way to get people experiencing homelessness off the streets.

In 2021, Los Angeles began opening tiny home villages, also referred to as cabin communities, for unhoused people during the COVID-19 pandemic. There are currently 11 tiny home villages in Los Angeles, operated in a joint effort between the government and …

The Anti-Racist Imperative Of Infancy, Laura Cohen Apr 2024

The Anti-Racist Imperative Of Infancy, Laura Cohen

Northwestern Journal of Law & Social Policy

In 2019, a widely disseminated video of the arrest of a six-year-old girl in her Florida elementary school provoked outrage across the country. The footage shows the girl sobbing as an armed police officer in full uniform and bullet-proof vest handcuffs and leads her from the principal’s office to a waiting patrol car. Her crime was having a temper tantrum in class after a sleepless night. When it was revealed that another six-year-old was arrested at the same school by the same officer on the same day and for similar reasons, media pundits and the general public debated questions of …

“I Saw Guns And Sharp Swords In The Hands Of Young Children”: Why Mental Health Courts For Juveniles With Autism Spectrum Disorder And Fetal Alcohol Spectrum/Disorder Are Needed, Michael Perlin, Heather Cucolo, Deborah Dorfman Apr 2024

“I Saw Guns And Sharp Swords In The Hands Of Young Children”: Why Mental Health Courts For Juveniles With Autism Spectrum Disorder And Fetal Alcohol Spectrum/Disorder Are Needed, Michael Perlin, Heather Cucolo, Deborah Dorfman

Northwestern Journal of Law & Social Policy

In this Article, we offer—we believe for the first time in the scholarly literature—a potentially (at least partially) ameliorative solution to the problems faced by persons with autism (ASD) and fetal alcohol disorder (FASD) in the criminal justice system: the creation of (separate sets of) problem-solving juvenile mental health courts specifically to deal with cases of juveniles in the criminal justice system with ASD, and with FASD. There is currently at least one juvenile mental health court that explicitly accepts juveniles with autism, but there are, to the best of our knowledge, no courts set up specifically for these two …

Utilizing Large Language Models In Tribal Emergency Management, Srishti Gupta, Yu-Che Chen, Chun-Hua Tsai Apr 2024

Utilizing Large Language Models In Tribal Emergency Management, Srishti Gupta, Yu-Che Chen, Chun-Hua Tsai

Information Systems and Quantitative Analysis Faculty Publications

This paper explores the unique challenges faced by tribal communities in the context of emergency management, encompassing natural disasters and the preservation of their rich cultural heritage. The study aims to investigate both the potential advantages and hurdles associated with the adoption of large language models (LLMs) in tribal emergency management. Our primary goal is to qualitatively assess Indigenous perspectives on the suitability and acceptability of deploying an LLM-powered chatbot in this specific domain. To achieve this objective, we employ a think-aloud interview methodology involving 18 tribal members. This qualitative research approach captures participants’ cognitive processes and decision-making as they …

Supply, Demand, And Fiscal Sustainability Of Outdoor Recreation In Utah, Jordan W. Smith, Chris Monz Apr 2024

Supply, Demand, And Fiscal Sustainability Of Outdoor Recreation In Utah, Jordan W. Smith, Chris Monz

Environment and Society Faculty Publications

Because Utah's outdoor recreation destinations are managed by several different federal and state agencies, there is no comprehensive and consistent information on the amount and types of outdoor recreation resources available within the state. Additionally, there has been no research to date on how state programs whose revenues are dependent on outdoor recreation activity, are likely to fare in the coming years. This report begins to address these limitations by: 1) compiling and synthesizing data that characterize the amount and location of outdoor recreation resources throughout the state; and 2) presenting the results of a suite of econometric forecasting models …

Public Value And Procedural Policy Instrument Specifications In “Design For Service”, Adam Wellstead, Michael Howlett Apr 2024

Public Value And Procedural Policy Instrument Specifications In “Design For Service”, Adam Wellstead, Michael Howlett

Michigan Tech Publications

Strokosch and Osborne and others have recently argued the essence of effective service delivery in and by government increasingly involves the re-orientation of top-down service delivery toward enhanced co-design and co-creation. This new emphasis on what Strokosch and Osborne term designing and managing “for” services is seen to be increasingly replacing or augmenting an older emphasis on these tasks in the design “of” services. Analyzing and managing service design and delivery in this way, however, requires a steady eye to be maintained on the different ways in which “public value” is generated through each service process and upon the different …
