Examining Liberty In France And The United States Through Religious Accommodations In Education, Carly Hitchcock Apr 2024

Examining Liberty In France And The United States Through Religious Accommodations In Education, Carly Hitchcock

Honors Projects

Liberty is a key value of the United States of America and France as seen in their key phrases « Liberté, Égalité, Fraternité, » and “Life, Liberty, and the Pursuit of Happiness”. Liberty can be broken down into two forms, positive liberty, or the freedom to something, and negative liberty, or the freedom from something. The separation of church and state is a primary pillar of both France and the United States, as it determines how the government of each country interacts with different religions. Public education is a primary socialization experience of citizens in both countries, where …

The Impact Of Mental Health On Recidivism: A Logistic Regression Analysis Examining Federal Probation Outcomes, Stephanie Kowal

University of Montana Conference on Undergraduate Research (UMCUR)

My research study examines the relationship between mental health and a person’s success in probation. I used secondary data that was sourced by the Criminology research group at UM that collected probation data from the Feder Probation District in Montana during 2022. I wanted to specifically understand whether probationers that were receiving mental health treatment were more likely to recidivate while in the probation program. In this study, recidivism refers to an instance in which a probationer violated a condition of their release and was sent back to prison. From the binary logistic regression analyses I estimated, I discovered that …

Toros, Moros, and Empire: The Sixteenth-Century Spanish Bullfight

By David A. González-2023

Relying on the methodological tools provided by New Historicism and Critical Race Theory, this paper evaluates the primary texts of Franciscan minor Francisco de Alcocer’s Tratado del Juego (1559) and the Spanish aristocrat Luis Zapata de Chaves’ Carlo Famoso (1566) and Varia Historia: Miscelania (c. 1595) to assess the extent of non-Europeans’ role and impact on the development of the early modern bullfight. These texts highlight the conflicting views over the bullfight’s European legitimacy. As such, they shed light on the larger debates between church and aristocracy over …

A Multi-Site Qualitative Analysis Of The Juvenile Justice And Child Welfare Systems: Implications For Dual System Youth, Lauren Morgan Apr 2024

A Multi-Site Qualitative Analysis Of The Juvenile Justice And Child Welfare Systems: Implications For Dual System Youth, Lauren Morgan

Dissertations

Researchers have been studying juveniles who experience both child maltreatment and delinquency for decades. These studies document the prevalence, outcomes, and demographics of youth who navigate child welfare and juvenile justice systems, also known as dual system youth. However, there is a lack of investigation into the complex processes occurring at the intersection of these two systems. This dissertation aims to fill that gap by building on previous research, organizational theory, and the growing area of punishment literature in criminal justice. The goal is to better understand how juvenile justice and child welfare systems organizationally manage dual system youth. Specifically, …

Chapter 4: Safeguarding U.S. National Interests In The Maritime Environment

International Law Studies

The Commander’s Handbook on the Law of Naval Operations is used in the United States and throughout the world as a restatement of U.S. doctrinal law positions on matters affecting the operations of the U.S. Navy, the U.S. Marine Corps, and the U.S. Coast Guard. Judge advocates and legal advisers have occasion to conduct deeper research to identify the context and source of the rules reflected in the Commander’s Handbook. Responding to this need, an Annotated Supplement to The Commander’s Handbook was produced in 1997 and published as volume 73 of International Law Studies. In the intervening decades, …

The Motivation Paradox: Exploring Copyright’S Assumptions About Creativity And The Allocation Of Creative Resources, Alina Ng Apr 2024

The Motivation Paradox: Exploring Copyright’S Assumptions About Creativity And The Allocation Of Creative Resources, Alina Ng

Texas A&M Journal of Property Law

Copyright is instrumental in promoting the progress of science by encouraging authors and other creators to produce and disseminate creative works by granting them an exclusive property right over the creative resources they produce. However, only some copyrighted works correlate with this goal. Some works do not promote a better society, while others harm society’s well-being. The existence of these works demonstrates that the legal structures in copyright law are somehow encouraging the production of works that do not correlate with the goals of progress. One reason might be that the law has not adequately defined the word “progress.” The …

Sisolak V. Polymer 80, Inc., 140 Nev. Adv. Op. 30, 546 P.3d 819 (Apr. 18, 2024), Keegan Davis

Nevada Supreme Court Summaries

In 2021, the Nevada Legislature promulgated, and Governor Sisolak signed into law, NRS 202.253(9), NRS 202.3625, and NRS 202.363 as an extension to the federal Gun Control Act (“GCA”). The statute criminalizes the sale or transfer of unfinished firearms lacking serial numbers, known as “ghost guns.” Respondent, Polymer80, Inc., is a Nevada company whose primary business is the sale of unfinished firearm components. Respondent sued Governor Sisolak and other named defendants claiming that the new ghost gun statute was vague and therefore unconstitutional. The district court agreed with Polymer80, granted summary judgment, and declared the statute unconstitutional. Appellants appealed to …

Machines Like Me: A Proposal On The Admissibility Of Artificially Intelligent Expert Testimony, Andrew W. Jurs, Scott Devito Apr 2024

Machines Like Me: A Proposal On The Admissibility Of Artificially Intelligent Expert Testimony, Andrew W. Jurs, Scott Devito

Pepperdine Law Review

With the rapidly expanding sophistication of artificial intelligence systems, their reliability, and cost-effectiveness for solving problems, the current trend of admitting testimony based on artificially intelligent (AI) systems is only likely to grow. In that context, it is imperative for us to ask what rules of evidence judges today should use relating to such evidence. To answer that question, we provide an in-depth review of expert systems, machine learning systems, and neural networks. Based on that analysis, we contend that evidence from only certain types of AI systems meet the requirements for admissibility, while other systems do not. The break …

How Does Childhood Exposure To Toys And Video Games Relate To Young Adult’S View On Gun Control?, Shelby Wilmot

Honors Theses

The present study investigated the factors influencing support for gun control and attitudes toward gun control restrictions on individuals, specifically violent video games and toys. From the 119 total responses collected, 78 (65.5%) of the participants identified as female, 34 (28.6%) of the participants identified as male, and 7 (5.9%) of the participants identified as nonbinary. Regression analyses were conducted to examine the relationships between various independent variables and the dependent variables representing these attitudes. For the dependent variable measuring support for gun control, the model summary revealed a moderate correlation

(r = .610), with approximately 37.2% of the variability …

Aging And Depression: Identifying Strategies To Prevent Suicide And Restore Integrity, Nekka A. Herbert Apr 2024

Aging And Depression: Identifying Strategies To Prevent Suicide And Restore Integrity, Nekka A. Herbert

Walden Dissertations and Doctoral Studies

Researchers have documented a projected increase in the older adult population and a foreseeable increase in older adult suicides associated with shortcomings in the mental health field related to providing adequate mental health treatment to individuals 65 and older. Researchers have concluded that these shortcomings are due to ageism, lack of awareness, lack of knowledge in gerontology, and inadequate training for professionals entering the field. Studies have highlighted the growing number of older adult suicides but have lacked effective treatment strategies to reduce depressive symptoms and suicidal thoughts/behaviors, specifically in the older adult male population, which has the highest number …

Rethinking Legislative Facts, Haley N. Proctor Apr 2024

Rethinking Legislative Facts, Haley N. Proctor

Notre Dame Law Review

As the factual nature of legal inquiry has become increasingly apparent over the past century, courts and commentators have fallen into the habit of labeling the facts behind the law “legislative facts.” Loosely, legislative facts are general facts courts rely upon to formulate law or policy, but that definition is as contested as it is vague. Most agree that legislative facts exist in some form or another, but few agree on what that form is, on who should find them, and how. This Article seeks to account for and resolve that confusion. Theories of legislative fact focus on the role …

The Promise And Perils Of Tech Whistleblowing, Hannah Bloch-Wehba Apr 2024

The Promise And Perils Of Tech Whistleblowing, Hannah Bloch-Wehba

Northwestern University Law Review

Whistleblowers and leakers wield significant influence in technology law and policy. On topics ranging from cybersecurity to free speech, tech whistleblowers spur congressional hearings, motivate the introduction of legislation, and animate critical press coverage of tech firms. But while scholars and policymakers have long called for transparency and accountability in the tech sector, they have overlooked the significance of individual disclosures by industry insiders—workers, employees, and volunteers—who leak information that firms would prefer to keep private.

This Article offers an account of the rise and influence of tech whistleblowing. Radical information asymmetries pervade tech law and policy. Firms exercise near-complete …

Advancing Pretrial Assessments: Development Of The Personal Recognizance Interview & Needs Screen (Prins), Zachary Hamilton, John Ursino, Alex Kigerl Apr 2024

Advancing Pretrial Assessments: Development Of The Personal Recognizance Interview & Needs Screen (Prins), Zachary Hamilton, John Ursino, Alex Kigerl

Criminology and Criminal Justice Faculty Publications

Purpose

Used to reduce detention, bail/bond, and jail, pretrial risk assessments (PRAs) applications have expanded in the last decade. Yet, many PRAs are created with a unique population, adopted ‘off-the-shelf’ in a new location, reducing the tool's accuracy and functionality. Further, many PRAs are created with criminal history indicators, increasing concerns of prediction bias. The current study described the development of the Personal Recognizance Interview & Needs Screen (PRINS).

Methods

Using a multistage development process and large sample (N = 28,147) of defendants, we created a tool that combines static and dynamic indicators, gender-responsive modeling, in the prediction of …

Increasing Multi-Hazard Climate Risk And Financial And Health Impacts On Northern Homeowners, Jennifer Schmidt Apr 2024

Increasing Multi-Hazard Climate Risk And Financial And Health Impacts On Northern Homeowners, Jennifer Schmidt

ISER Articles

Currently, more than half of the world’s human population lives in urban areas, which are increasingly affected by climate hazards. Little is known about how multi-hazard environments affect people, especially those living in urban areas in northern latitudes. This study surveyed homeowners in Anchorage and Fairbanks, USA, Alaska’s largest urban centers, to measure individual risk perceptions, mitigation response, and damages related to wildfire, surface ice hazards, and permafrost thaw. Up to one third of residents reported being affected by all three hazards, with surface ice hazards being the most widely distributed, related to an estimated $25 million in annual damages. …
