The Educational Trajectories Of Latinx Undocumented Students: Illegality And Threats To Emotional Well-Being, Alessandra Bazo Vienrich, Rosalie A. Torres Stone
Sociology
For undocumented students, the high school–to–college pipeline is filled with social, economic, and psychological stressors. Yet very little is known about the impact of legal status on the experiences of undocumented Latinx college students living in states without tuition equity policies. Using qualitative data from 37 interviews exploring undocumented college students’ educational trajectories in Massachusetts and North Carolina, the authors examine the impact of legal status on the emotional well-being of undocumented Latinx students, including those who benefited from Deferred Action for Childhood Arrivals. The findings show that even when undocumented students gain access to higher education, barriers to legal …
A Bonded Case Study Of Missouri Secondary Criminal Justice Program Curricula, James Barnes, James Oren Barnes
A Bonded Case Study Of Missouri Secondary Criminal Justice Program Curricula, James Barnes, James Oren Barnes
Murray State Theses and Dissertations
This exploratory case study measured the Missouri Secondary Criminal Justice Program instructors' perception on the impact of Missouri technical standards, the Industry Recognized Credential/Technical Skills Assessment (IRC/TSA), Career and Technical Student Organizations (CTSOs), individual cumulative career experience, and advisory boards on their curricula. As a local autonomy state, Missouri has no statutorily mandated curricula to guide instructors. Six secondary criminal justice instructors agreed to be interviewed on their perspectives regarding the factors that impact curricula. The research found that instructor experience had the most substantial impact on curricula. The instructors used the technical standards as a scope and sequence for …

The Democratic (Il)Legitimacy Of Assembly-Line Litigation, Jessica Steinberg, Colleen Shanahan, Anna Carpenter, Alyx Mark
Faculty Articles
In response to Daniel Wilf-Townsend’s Assembly-Line Plaintiffs we take a panoramic picture of state civil courts, and debt cases in particular, and name specific features of the courts that must be taken into account in crafting reform prescriptions. In doing so, we question both the democratic legitimacy of debt collection courts and the adequacy of incremental reform that targets the structure of litigation. Part I contributes two critical components to Wilf-Townsend’s rich description of consumer debt cases: pervasive intersectional inequality among pro se defendants and a record of fraud among top filers. We add a sharper focus on the racial, …

Out Of This World: 3d Printing And Space Law Regulation, Caitlyn Fischer
Out Of This World: 3d Printing And Space Law Regulation, Caitlyn Fischer
Catholic University Journal of Law and Technology
3D printing will be a valuable asset in the exploration and human expansion into space. This comment examines the current international treaties and U.S. domestic laws that may affect and impose requirements on 3D printing manufacturers seeking to print in space. These treaties are self-executing and therefore leave it up to Congress to take action to keep the U.S. in compliance with international space law. Congress can do this by granting agencies like the FCC and FAA authority to regulate. In order to utilize 3D printing technology in space and reap the benefits it has to offer, the U.S. should …

America’s mass incarceration crisis does not end at the prison gates. While an estimated two million people are presently incarcerated, nearly twice that number of people are subject to probation, parole, and other forms of community supervision. This Article documents one particularly troubling aspect of this system of “nonincarceration mass incarceration”: the widespread use of supervision conditions that separate people on parole, probation, and supervised release from their families. Courts regularly approve supervision conditions that categorically bar supervisees from contacting or interacting with their family members. Although these conditions are sometimes justified, they are used indiscriminately without individualized analysis of …
Meeting Water Affordability Challenges In The Era Of The Unexpected, Amy Hardberger
Meeting Water Affordability Challenges In The Era Of The Unexpected, Amy Hardberger
Saint Louis University Journal of Health Law & Policy
The vast majority of Americans depend on a public water supply for the procurement and delivery of their water. Water providers are tasked with securing water supplies for the future, building and maintaining the infrastructure needed for delivery, and ensuring service is available for new customers. This system has worked for many decades in part because the costs of water and construction were relatively low; however, in the past twenty years, water rates have increased at twice the rate of inflation. At the same time, income has remained stagnant. Water services now require a larger percentage of household budgets than …

Many organizations are currently experiencing the impact of employees quitting their jobs, this reality has left organizations, including police departments, wondering how to slow down the effects of turnover. Employee turnover is witnessed when employees decide to leave their position at the organization and end their work relationship. Turnover can have a detrimental impact on an organization’s finances, employee performance, worker productivity, and customer service. Additionally, turnover is critical to communities since decreased police forces are related to increases in crime. Furthermore, police resignations are higher than ever and are predicted to continue increasing, however, it is not pernicious to …

Reference Re Genetic Non-Discrimination Act: How To Make Space For Some Certainty, Hoi L. Kong
The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference
In the Reference re Genetic Non-Discrimination Act (Reference) the Supreme Court of Canada divided three ways, reproducing the divisions from the Reference re Assisted Human Reproduction Act (AHRA), decided a decade earlier. AHRA did not provide a majority statement of the rule for determining what constitutes a valid exercise of the section 91(27) criminal law power. Neither did the Reference. As a consequence, uncertainty in this area of the law persists. This article suggests arguments that, if adopted, would resolve this uncertainty. Part I summarizes the Reference, including the three sets of reasons written by Karakatsanis J., Moldaver J. and …
Tribal Land, Tribal Territory, Katherine Florey
Tribal Land, Tribal Territory, Katherine Florey
Georgia Law Review
In the summer of 2020, two significant events brought into focus the relationship between Indigenous nations in the United States and the land they govern. First, in a controversy that made national headlines, several tribes in South Dakota clashed with Gov. Kristi Noem about their power to impose Covid-19-related checkpoints on state highways passing through Indian country. Borders have potent symbolism; by detaining drivers even briefly at theirs, the South Dakota tribes made plain that travelers were entering a separate jurisdiction in which different rules and policies applied. At the same time the checkpoint controversy was brewing, the Supreme Court …
The Contested "Bright Line" Of Territorial Presence, Shalini Ray
The Contested "Bright Line" Of Territorial Presence, Shalini Ray
Georgia Law Review
For this symposium on “Immigrants and the First Amendment,” this Essay considers the current scope of First Amendment protection for noncitizens abroad. Courts have interpreted the constitutional rights of noncitizens to vary with factors including status, ties, and location. But in a recent case, Agency for International Development v. Alliance for Open Society International, the Supreme Court announced that the First Amendment simply does not apply to noncitizens abroad. This Essay considers this new rule and its implications, concluding that a bright-line rule based on territorial presence masks more complex questions about the meaning of “here” and “abroad.”

Terror attacks pose a serious threat to public safety and national security. New technologies assist these attacks, magnify them, and render them deadlier. The more funding terrorist organizations manage to raise, the greater their capacity to recruit members, organize, and commit terror attacks. Since the September 11, 2001 terror attacks, law enforcement agencies have increased their efforts to develop more anti-terrorism and anti-money laundering regulations, which are designed to block the flow of financing of terrorism and cut off its oxygen. However, at present, most regulatory measures focus on traditional currencies. As these restrictions become more successful, the likelihood that …
