Laws For The Support Of Transgenders In Argentina And Brazil, Elias Choclin
Laws For The Support Of Transgenders In Argentina And Brazil, Elias Choclin
Modern Languages, Philosophy and Classics Theses
In the last decade, the feminist and LGBTQ+ movements have shown the challenges transgender people face in different countries of the world. Specifically, Brazil and Argentina have proposed different regulations and laws that protect these individuals from violence and that intend to incorporate them into the job market. However, these countries have vastly different policies regarding healthcare for transgenders such as transition medication and surgeries, which will be further identified and explained in the paper.
Of Rights And Regulation, Stephen W. Sawyer, William J. Novak
Of Rights And Regulation, Stephen W. Sawyer, William J. Novak
Book Chapters
This chapter explores the development of social provisioning as a matter not of right but of democratic administration in France and the United States in the nineteenth century. The authors take issue with conventional chronologies of rights development, which see civil and political rights being developed in the eighteenth and nineteenth centuries, with social rights appearing in the twentieth. Such categories and sequencing obscure the ways in which democratic administrations took the problem of social provisioning seriously. A history of socio-economic rights cannot be distinguished from the less formal technologies of socio-economic regulation that were an integral part of the …

The Law Of Space Cyber Operations: Gripping Mysteries, Entangled Frontiers, And Security Challenges, Roy Balleste
Journal of Law, Technology, & the Internet
The developments of technologies applicable to cyberspace and outer space offer new opportunities. Each nation, institution, and individual must be involved in the security of cyberspace in order to secure outer space activities, while reinforcing the legitimacy of that commercial process. The stories that follow consider the intersection of outer space law and cybersecurity, describing vulnerabilities and the limitations of implementing international norms. The article assesses the cyberthreat landscape while offering recommendations. The article's subsequent sections are organized as follows: Part II, The Cruel Sky, considers a historical mystery to better understand the contradictory world of cyber operations. Along the …

Orgasm Is Impossible Without Go Rams: The Need For Comprehensive, Inclusive, Accessible, & Trauma-Informed Sexual Health Education Among College Students, Jai-La M. Aponte
West Chester University Master’s Theses
This thesis will be exploring the crucial need for comprehensive, inclusive, and trauma-informed sexual health education at the collegiate level for undergraduate and graduate students. Using a critical action approach, I propose the implementation of a designated sexual health education student service office to provide sexual health education programs, initiatives, support, and education for their students, titled the Sexual Education Xploration Center (SEX-C). This intervention is meant to provide student support throughout the academic year in the similar way more traditional student offices offer resources, education, connection, and training to students on an array of subjects. Using Kimberle Crenshaw’s theory …

In the twentieth century, the Food and Drug Administration ("FDA") rose to prominence as a respected scientific agency. By the middle of the century, it transformed the US. medical marketplace from an unregulated haven for dangerous products and false claims to a respected exemplar of public health. More recently, the FDA's objectivity has increasingly been questioned. Critics argue the agency has become overly political and too accommodating to industry while lowering its standards for safety and efficacy. The FDA's accelerated pathways for product testing and approval are partly to blame. They require lower-quality evidence, such as surrogate endpoints, and shift …

A Formative Evaluation Of Washington Prison Animal Programs, Kim Satterfield
A Formative Evaluation Of Washington Prison Animal Programs, Kim Satterfield
Master of Arts in Criminal Justice Theses
With the ever-growing prison population in the United States, it is imperative to continue to examine programs that may foster reductions in recidivism rates. In the minimal observatory studies that have been conducted on animal programs in prison, it has been concluded that these programs have a positive effect on the inmates, prison environment, the animals, and the community. Implementations of these programs are in place nationwide, but thorough research and evaluation of methods and outcomes of these programs remain scarce. The purpose of this thesis is to gather data through interviews about the personal and community impacts of such …

First Among Equals: How The Curtilage Doctrine Bars A Terry Stop And Frisk Inside The Curtilage After Jardines And Collins, J. Ross Hamrick
First Among Equals: How The Curtilage Doctrine Bars A Terry Stop And Frisk Inside The Curtilage After Jardines And Collins, J. Ross Hamrick
University of Memphis Law Review
History and tradition confirm that the curtilage’s heightened pro-tections are a Fourth Amendment fixture. In Collins v. Virginia, the Supreme Court reaffirmed that understanding and relieved the tension between two strands of Fourth Amendment caselaw: the curtilage doc-trine and the automobile exception. The Court decided the automobile exception did not authorize warrantless entry into a person’s curtilage because extending the rule would detach the rationale from its original justifications. The curtilage, like a home, garners the highest Fourth Amendment protection. So when an officer trespasses onto the curti-lage, the privacy intrusion is far greater than the intrusion arising from a …

The Telephone Consumer Protection Act Of 1991: Adapting An “Odd” Law, Blasing, Marissa J.
The Telephone Consumer Protection Act Of 1991: Adapting An “Odd” Law, Blasing, Marissa J.
Santa Clara Law Review
The Telephone Consumer Protection Act (“TCPA”) was introduced in 1991 before the rise of the cell phone, text messages, and broadband internet. It placed restrictions on then-contemporary technology used to reach consumers in an automated way and its primary purpose was to protect consumer’s privacy interests and public safety. Yet, it has proven to be an odd and increasingly outdated law. The federal government has made a good-faith effort to maintain the TCPA’s relevancy. However, evolving technology and inconsistent interpretations of the law’s fundamental elements have resulted in harm to consumers and businesses. During the COVID-19 pandemic, the law also …

A Qualitative Analysis Of Hospital Nurses' Experiences During The Covid-19 Pandemic Through The Lens Of The Demand-Control-Support Model, Alisha Garner
Honors Undergraduate Theses
Positive social support, realistic job demand, and appropriate levels of control over their responsibilities can mitigate empathy fatigue and burnout among nurses, increase quality care for patients, and lay the foundation for teams to embrace challenges during crises. The COVID-19 pandemic stretched nurses in all these areas, leading many nurses to contemplate changing fields. Failure to address and embrace the difficulties that nurses face during such crises can result in loss of nurses and impact the entire healthcare industry.
The present study used one-to-one interviews to glean insider perspectives of changes in job demand, control, and support nurses experienced as …

The Assessment Of Emergency Preparedness Among University Students, Arliah Cox
The Assessment Of Emergency Preparedness Among University Students, Arliah Cox
All Graduate Theses, Dissertations, and Other Capstone Projects
University students have been an understudied population when it comes to the topic of emergency/ disaster preparedness. While there have been a few studies carried out to examine students’ perceptions of preparedness, the level of preparedness must be determined to be able to close the gap when it comes to barriers preventing them from being prepared. One hundred and eighty-seven undergraduate participants at a Midwestern university completed both online and in-person surveys in March 2022. The survey included questions regarding emergency/ disaster preparedness, perception of being prepared, and barriers which can prevent preparedness. Results showed that a lack of time …

Financial Sustainability Of Florida Cities: Comparative, Retrospective Modeling For Prospective Municipal Financial Health, Terry Henley
Financial Sustainability Of Florida Cities: Comparative, Retrospective Modeling For Prospective Municipal Financial Health, Terry Henley
Electronic Theses and Dissertations, 2020-2023
The Great Recession produced rising debt, deficits, and exposed vulnerabilities for municipalities in a globalist economy. The two-month COVID recession in 2020 accelerated these burdens; a lagging downturn recently added pressures of reduced economic activity, record inflation, and rising costs in 2022. This dissertation studies how local financial sustainability (FS) and financial condition (FC) approaches can work in concert towards a set of indicators with internal and external categorization to explain municipal financial health (MFH). Unassigned fund balance plus select formal stabilizations measure MFH, are conceptually supported in having retrospective (FC) and prospective (FS) value as an intergenerational resource and …
