Buddhism As Caricature: China And The Legitimation Of Natural Religion In The Enlightenment, Jeffery D. Burson Jan 2014

Buddhism As Caricature: China And The Legitimation Of Natural Religion In The Enlightenment, Jeffery D. Burson

Religion in the Age of Enlightenment

Europe was unusually familiar with the ancient civilizations of East Asia, but however familiar China may have seemed, European missionaries and those who utilized and subverted their accounts in the literature of the eighteenth century made sense of China through their own hermeneutical lenses. David Porter's work Ideographia: The Chinese Cipher in Early Modern Europeargues that Jesuit missionaries and Enlightenment philosophers imposed upon China their Eurocentric quest for "representational legitimacy;' which Porter defines as "the presence of an originary wellspring of meaning that gives rise to a succession of grounded signifiers in which the living image of the origin …

The Manipulus Florum, Johannes Nider’S Formicarius, And Late Medieval Misogyny In The Construction Of Witches Prior To The Malleus Maleficarum, Chris L. Nighman Jan 2014

The Manipulus Florum, Johannes Nider’S Formicarius, And Late Medieval Misogyny In The Construction Of Witches Prior To The Malleus Maleficarum, Chris L. Nighman

History Faculty Publications

This article demonstrates and analyses Johannes Nider’s reception of Thomas of Ireland’s Manipulus florum, a popular early fourteenth-century florilegium, in composing the fifth book of his Formicarius, a very influential text for the development of the gendered witch stereotype in the fifteenth century. It also examines the lemmata “Mulier” and “Coniugium” in the Manipulus, arguing that Thomas of Ireland’s construction of those topics was essentially misogamous, rather than misogynous, though its reception by Nider was informed by misogyny.

Conscience And Community: Exploring The Relationship Between Conscience Formation And Systemic Corruption (In Nigeria), Augustine E. Ebido Jan 2014

Conscience And Community: Exploring The Relationship Between Conscience Formation And Systemic Corruption (In Nigeria), Augustine E. Ebido

Electronic Theses and Dissertations

This research focuses on the impact of the moral community (or social context) on the formation of conscience and its implication for moral responsibility. It is an interdisciplinary approach to theological reflection that is particularly attentive to psychological, philosophical, sociological, and neurobiological viewpoints showing how these have either distorted or broadened our understanding of conscience in its relation to community and social responsibility, or its formation in relationship to our moral development. It stresses reciprocity of conduct (for we are "responders") and the complementarities of internal and external sanctions. It insists that the influence of conscience on behavior is undermined …

Freedom Of Conscience As Religious And Moral Freedom, Michael J. Perry Jan 2014

Freedom Of Conscience As Religious And Moral Freedom, Michael J. Perry

Faculty Articles

In another essay being published contemporaneously with this one, I have explained that as the concept "human right" is understood both in the Universal Declaration of Human Rights and in all the various international human rights treaties that have followed in the Universal Declaration's wake, a right is a human right if the rationale for establishing and protecting the right-for example, as a treaty-based right-is, in part, that conduct that violates the right violates the imperative, articulated in Article i of the Universal Declaration, to "act towards all human beings in a spirit of brotherhood." Each of the human rights …

Can Policy Analysis Remain Above The Fray Of Politics? Intentions, Beliefs, And Settings In Berger And Neuhaus's Mediating Structures, Michael Gouin-Hart Jan 2014

Can Policy Analysis Remain Above The Fray Of Politics? Intentions, Beliefs, And Settings In Berger And Neuhaus's Mediating Structures, Michael Gouin-Hart

SPNHA Review

This article discusses the history of mediating structures theory in the American context. It focuses on the 1977 essay To Empower People: The Role of Mediating Structures in Public Policy by Berger and Neuhaus and those authors’ claim that their policy analysis constituted an apolitical set of policy prescriptions. This paper examines that claim in light of historical, philosophical, ethical, and policy-analysis perspectives, through the work of Deborah Stone, and through the lens of virtue ethics; namely, in the work of Aristotle and Alistair MacIntyre.

Reflections On Teaching The History Of Early Modern European Law, Crime, And Punishment To Undergraduates, Michael Conforti Jan 2014

Reflections On Teaching The History Of Early Modern European Law, Crime, And Punishment To Undergraduates, Michael Conforti

SOLON Law, Crime and History (previously SOLON Crimes and Misdemeanours: Deviance and the Law in Historical Perspective)

Teaching the history of early modern European law and crime presents a number of possible obstacles to student learning. These include exposure to an unfamiliar historical narrative, encounters with different conceptions of social norms, deviancy, discipline, social control, illegality, and dispute resolution which are foreign to the experience of today's students, and confrontations with complex legal ideas, vocabulary, writing conventions, and methods of analysis. In some institutions of higher learning, these challenges may be magnified by curricular requirements mandated by the institution itself. One way to overcome these potential impediments to student learning is to adopt teaching methods which incorporate …

Toward The Development Of Roman Catholic Teaching About Contraception In Light Of The Experience Of South Korean Catholic Women, Taeeun Kim Jan 2014

Toward The Development Of Roman Catholic Teaching About Contraception In Light Of The Experience Of South Korean Catholic Women, Taeeun Kim

Dissertations

In recent decades, the morality of artificial contraception has been hotly debated in the Roman Catholic Church. Many theologians and ethicists have challenged the hierarchical church teachings in the last fifty years. The opening chapter of the dissertation reviews Catholic Church teachings on birth control throughout history, and in Chapter Two I explore the theo-ethical reflections on artificial contraception from two different approaches (traditionalist and revisionist) and support the revisionists' perspectives, findings, and arguments. Then, in order to lay the context for my interpretations of my ethnographic interviews with ten participants, in Chapter Three I explore South Korean sexual culture …

The Ethics Of Vision And Black Theology And Experience, Angelo Sylvester Riley Jan 2014

The Ethics Of Vision And Black Theology And Experience, Angelo Sylvester Riley

Dissertations

To this day, philosophical ethics and dominant discussions in Christian ethics have paid insufficient attention to how vision shapes the moral life. Too much focus is given to moral decision-making and action, while too little focus is given to the way vision and patterns of attentiveness ground our capacities for genuine morally responsible action. Therefore, in this study, I draw on important works in philosophical and Christian ethics to examine both the ethics of responsibility and the central role that an ethics of vision plays in our attempts to live responsibly. I use the "ethics of vision" as method and …

Here Come The Nones! Pluralism And Evangelization After Denominationalism And Americanism, William L. Portier Dec 2013

Here Come The Nones! Pluralism And Evangelization After Denominationalism And Americanism, William L. Portier

Theology and Religious Studies Faculty Publications

This essay begins with a four-part overview of American Catholic history focused on the building and dissolution of an immigrant Catholic subculture. The final period, “Catholics and the Dynamics of Pluralism (1968-present)” leads naturally into a discussion of the demography of Catholics in the United States. Particular attention is given to the trend to disaffiliation among millennials and how best to interpret it. Pastoral and theological reflections on the demography of disaffiliation emphasize the need for the church in the United States to take on an evangelical form more suited to a pluralism that is post-denominational and post-Americanist, and how …

Universal Goals & Local Application: Theological Field Education At St. John Vianney Seminary, Germaine Bruno Nov 2013

Universal Goals & Local Application: Theological Field Education At St. John Vianney Seminary, Germaine Bruno

Electronic Theses and Dissertations

This study presents a curriculum history of theological field education at Denver's Roman Catholic seminary, St. John Vianney. The study utilizes archival material and the historical method to construct an educational historiography of the evolution and development of theological field curricula from 1910-2010. The research questions focus on two areas: the role of the Catholic Church in shaping seminary curricula and the adaptation and application of these Church guidelines by practitioners in the local context.

The study utilizes the conceptual tools of Kelly Ritter (2009) to analyze the findings in the light of socio-historical forces which shape curricula. According to …

Voices In The Wilderness: Catholic Ngos And The Challenge Of Human Rights, Kevin Ahern Oct 2013

Voices In The Wilderness: Catholic Ngos And The Challenge Of Human Rights, Kevin Ahern

Biennial Conference: The Social Practice of Human Rights

For over fifty years, Catholic nongovernmental organizations have been actively engaged in the promotion and protection of human rights around the world. From grassroots training programs to targeted advocacy work in Geneva, these organizations are helping to shape both scholarly discourse and political policy.

Given the growing role played by civil society actors, this paper will critically consider the ethical and theological significance of human rights NGOs, in particular Catholic organizations, in three parts. It will begin with a brief sketch of the present reality and historical relationship of Catholic NGOs to the human rights movements. Following Vatican II and …

Targeting And The Concept Of Intent, Jens David Ohlin Oct 2013

Targeting And The Concept Of Intent, Jens David Ohlin

Cornell Law Faculty Publications

International law generally prohibits military forces from intentionally targeting civilians; this is the principle of distinction. In contrast, unintended collateral damage is permissible unless the anticipated civilian deaths outweigh the expected military advantage of the strike; this is the principle of proportionality. These cardinal targeting rules of international humanitarian law are generally assumed by military lawyers to be relatively well settled. However, recent international tribunals applying this law in a string of little-noticed decisions have completely upended this understanding. Armed with criminal law principles from their own domestic systems, often civil law jurisdictions, prosecutors, judges and even scholars have progressively …

Jordanian Ethical Perceptions Of Preimplantation Genetic Diagnosis, Sarah C. Miller Oct 2013

Jordanian Ethical Perceptions Of Preimplantation Genetic Diagnosis, Sarah C. Miller

Independent Study Project (ISP) Collection

Preimplantation Genetic Diagnosis (PGD) is a procedure that can be done during In Vitro Fertilization (IVF), involving genetic and chromosomal screening of fertilized embryos prior to implantation into a woman’s uterus. After PGD, only the embryos possessing the desired characteristics are implanted, while the other embryos are frozen for future use, or discarded. PGD is used for family balancing (gender selection for balancing the gender dynamic within a family), gender selection to screen out sex-linked diseases, or a broader genetic screening for diseases known to be present in the patient’s family history.

Many ethical questions have been raised about PGD, …
