The Principle Of Double Effect: Act-Types And Intentions, James G. Murphy
Philosophy: Faculty Publications and Other Works
Objections to the principle of double effect usually concern its first and second conditions (that the act not be evil in itself, and that the good effect and not the evil effect be intended). The difficulties often arise from a rejection of the idea that acts have a moral nature independent of context, and a tendency to interpret intention as purely psychological. This article argues that the “act itself” should be understood as the act-type, and suggests that examples of evil act-types are not hard to find. It argues that the notion of intention is involved in both conditions, but …

Toward A Theology Of Infertility And The Role Of Donum Vitae, Kathryn Lilla Cox

A theology of infertility is needed to help couples and the broader ecclesial community understand the theological implications of infertility. Infertility raises questions about human freedom, finitude, embodiment, childlessness, and parenthood. In this article, dominant cultural assumptions surrounding each of these areas when considering reproductive technologies are sketched. Official Roman Catholic teaching on reproductive technologies (Donum Vitae), while rejecting most forms of such technologies, does provide a viable response to the presupposition that reproductive technologies resolve infertility. Given the dominant cultural assumptions and insights from Roman Catholic teaching, this article advocates for several ecclesial changes when considering infertility. …

Cyclic oral contraceptive and continuous oral contraceptives have many similarities yet a few distinct differences. One of the major differences between cyclic and continuous oral contraceptives is that cyclic oral contraceptive pills have twenty one active pills and seven inactive pills versus the new continuous oral contraceptive pills which have 28 active pills and no inactive pills. However, though cyclic and continuous oral contraceptives do have a few differences, both types of oral contraceptives affect a woman’s body in similar ways. When choosing between cyclic and continuous oral contraceptives, it is important for women to be informed about the advantages …

This dissertation is located within the larger conversation about ecclesiology as it is emerging in our post-Christian era. Its effort is both theoretical and practical. Not only will it provide a theological account of the church, but it will do so for the sake of reflective practitioners who are looking for guidance in navigating and negotiating our post-Christian culture in the effort to form faithful Christians. J.R.R. Tolkien, Sub-Creation, And Theories Of Authorship, Benjamin Saxton
Mythlore: A Journal of J.R.R. Tolkien, C.S. Lewis, Charles Williams, and Mythopoeic Literature
Tolkien is unfortunately underrated as a theorist in literary studies—in fact, alas, generally invisible to the mainstream. This essay draws attention to his ideas about sub-creation and allegorical “dominion” of the reader, contrasting Tolkien’s stated and implied theories with those of Roland Barthes, and elucidating Tolkien’s concern with “the delicate balance between authors, authority, and interpretive freedom.” Saxton draws on “Leaf by Niggle,” The Silmarillion, and The Lord of the Rings for examples of Tolkien’s theories in action.

At the core of the human being is a longing to live a meaningful and integrated life. In an effort to understand what the integrated life entails, this thesis compares theological, legal, and spiritual sources in order to understand the practical human faculty known as the conscience. The interdisciplinary dialogue is significant because it takes into account the multiple facets of conscience and how it relates to decision-making. The comparison between these different sources reveals the necessary balancing between an individual’s internal and external worlds. This thesis critically examines the cases of Vatican intervention with the Leadership Conference for Women Religious (LCWR) and Charles Curran to explore the question of whether legitimate dissent is possible as an act of conscience. The Doctrinal Assessment of the Leadership Conference for Women Religious released by the Congregation for the Doctrine of Faith, as well as the exchange between Sr. Pat Farrell, then-president of the LCWR, and Bishop Blair, the one who conducted the investigation on the LCWR, on “Fresh Air,” a radio show on National Public Radio raise questions about how the Church is to understand truth, obedience, …

Since the Supreme Court’s decision in Roe v. Wade, scholars have been preoccupied with the test that ought to be applied to abortion regulations. Debate has swirled around the question of whether laws that burden the abortion right should be reviewed with strict scrutiny, rational basis review, or some other multi-factor or categorical test and at what point during pregnancy these tests are appropriate. Moreover, since Planned Parenthood v. Casey, in which the Court replaced Roe’s trimester framework with the undue burden standard, commentators have questioned the propriety of this new test. This article investigates how German Benedictines in the eighteenth century tried to reform monastic life and Catholic theology by adopting various aspects of Enlightenment lifestyle and thought. In an effort to assess the latest thinking in the Roman Catholic Church on economic matters, we examine the newest encyclical by Pope Benedict XVI, Caritas in Veritate (Charity in Truth) for guidance concerning marketing and business strategy. Core ethical values, consistent with historical Catholic Social Teachings (CST), are retained. However, some important nuances are added to previous treatments, and, reflecting the mind of the current Pontiff, certain points of emphasis are shifted to account for recent global developments. Juan Valera And Juan Ruiz: The Reliance Of Pepita Jiménez On The Libro De Buen Amor And La Celestina, Thomas R. Franz

Pepita Jimenez (1874) traces a religious young widow’s seduction of Don Luis de Vargas, a relatively naïve, young seminarian. The novel utilizes many allusions to literature of the fourteenth through the sixteenth centuries in order to illustrate the type of rhetoric the young man uses in order to obscure his cooperation with her evolving plan (Lott 71-146; Amorós 35-36, 178-79). As Hoff states, “Luis’s writing […] implies that his erotic desires lie hidden, to be discovered or ferreted out by the discerning reader” (215). Lawyers have had a hand in virtually every financial scandal in recent news. These lawyers are hired to advise clients about how to structure hedge funds, financial products, and financial transactions. Because global economies are becoming more interconnected, when large and risky financial transactions fail, they shake the stability of markets around the world.

International law generally prohibits military forces from intentionally targeting civilians; this is the principle of distinction. In contrast, unintended collateral damage is permissible unless the anticipated civilian deaths outweigh the expected military advantage of the strike; this is the principle of proportionality. These cardinal targeting rules of international humanitarian law are generally assumed by military lawyers to be relatively well-settled. However, recent international tribunals applying this law in a string of little-noticed decisions have completely upended this understanding. The Supreme Court has failed to define the concept of “reasonable doubt” with any precision. The Court tolerates conflicting definitions of “reasonable doubt.” It permits some jurisdictions to forbid any definition of “reasonable doubt,” while giving others wide latitude to define the concept in ways that are contradictory. If the Court truly regards the “proof beyond a reasonable doubt” standard to be an “ancient and honored aspect of our criminal justice system,”1 a “bedrock ‘axiomatic and elementary’ principle whose ‘enforcement lies at the foundation of the administration of our criminal law,’”2 then the Court cannot continue to tolerate the current …

This dissertation explores the role of justice in the writings of Catholic ethicist Lisa Sowle Cahill. Since 1990, Cahill has supported theological voices participating in the public forum, which she describes as a meeting ground for diverse intellectual and religious traditions. Good argumentation is necessary but not sufficient to resolve ethical dilemmas within the politically liberal context in which Cahill makes her claims. Instead, her commitment to justice underwrites those narratives and practices which demand one's fullest possible participation in contributing toward the common good. Cahill's notion of justice develops correlatively to the degree that she integrates the principles of …

Catholic theological thought in the field of racial justice has evolved considerably during the 20th century--and even more so over the past twenty years. I analyze changes in Catholic racial justice concerning the use of black Catholic sources and the role for African American Catholics in working toward a more racially just society. In order to properly critique and augment more recent developments in the field of Catholic racial justice, this work retrieves the life and writings of Dr. Arthur Grand Pré Falls (1901-2000), a black Catholic medical doctor who worked ceaselessly for racial justice within the Catholic, political, educational, …
