The Shifting Sands Of Soft Power: Comparing Soft Power Influences On U.S. Foreign Policy In The Middle East., Jackson T. Grasz Jun 2022

The Shifting Sands Of Soft Power: Comparing Soft Power Influences On U.S. Foreign Policy In The Middle East., Jackson T. Grasz

Pepperdine Policy Review

Throughout the 21st century, the United States has acted as the preeminent power broker in the Middle East. While the United States’ ability to influence the region is well-studied, it is less understood how Middle Eastern nations are able to influence the actions of the United States in reverse given their substantially smaller populations, militaries, and economies. Traditionally, international influence is measured by a country’s ability to coerce or induce other nations to act according to its preferred set of actions. Sources attributed to this influence, referred to as “hard power,” include military strength and economic prowess. However, these sources …

Immigration Reform For The American Worker, Gabriel J. Millar Jun 2022

Immigration Reform For The American Worker, Gabriel J. Millar

Pepperdine Policy Review

The United States immigration system needs to be comprehensively reformed. Previous attempts at immigration reform have focused on benefiting immigrants and businesses in the United States, but not the American worker. By utilizing foreign labor, the United States has increased income inequality and exacerbated the problem of stagnant wages in the United States. There is a tremendous need for the government to address the economic situation that it has created. This work highlights immigration’s negative impact on native workers and advocates for immigration reform that benefits native workers. This paper is divided into four sections. First, it will give a …

Policy Solutions For Affordable Housing In Cuenca Ecuador, Jordan B. Parrish Jun 2022

Policy Solutions For Affordable Housing In Cuenca Ecuador, Jordan B. Parrish

Pepperdine Policy Review

An increase in migrant population from wealthier countries is raising concerns of displacement of less affluent local populations in less wealthy countries. This is a worldwide phenomenon (Hayes and Zaban, 2020) and is especially prevalent in Cuenca, Ecuador, which has become a regional center of retirement migrants from North America and northern Europe. As Cuenca’s leadership embraces the global market, it should prepare for the disruptive changes to its economy by setting a precedent of being pro-housing and pro-income diversity, and it can do this best by facilitating the buildout of multiple housing types. Local land use restrictions should not …

Fault Tolerance Analysis Of An Adaptive Neuro-Fuzzy Inference System For Mandatory Lane Changing Decisions In Automated Driving, Matthew Vechione, Ruey Long Cheu Jun 2022

Fault Tolerance Analysis Of An Adaptive Neuro-Fuzzy Inference System For Mandatory Lane Changing Decisions In Automated Driving, Matthew Vechione, Ruey Long Cheu

Civil Engineering Faculty Publications and Presentations

Past research has developed a binary decision model for mandatory lane changes based on the Adaptive Neuro-Fuzzy Inference System (ANFIS). This ANFIS Decision Model (simply called ADEM), developed and tested with the Next Generation Simulation (NGSIM) data, mimics the sensory inputs and decisions of human drivers. This research assumed that ADEM will be implemented as part of the automated lane changing system in Automated Vehicles (AVs). The system in AVs will depend on active radar sensors to make measurements. The sensor outputs will be converted into the input parameter values of ADEM. This research tested ADEM's performance when the sensors …

Generic Ab Initio, James A. Heilpern, Earl Kjar Brown, William G. Eggington, Zachary D. Smith

Buffalo Law Review

From comic conventions to disbanded dioceses, courts continue to struggle with a unique but puzzling question of trademark law. Federal law protects certain terms that refer to a product or service from a specific producer instead of to a product generally. Terms that refer to products are considered generic and cannot receive protection. Courts have also held that a term that was generic at the time the party adopted the mark cannot receive protection, even if the public later views it as being specific to a particular producer. But, many marks were adopted decades or centuries ago. As a result, …

The Intersection Of Student Engagement And Student Achievement: A Study To Determine The Strength Of The Relationship Between The Level Of Athletic Participation And Student Achievement, Matthew Kukoda Jun 2022

The Intersection Of Student Engagement And Student Achievement: A Study To Determine The Strength Of The Relationship Between The Level Of Athletic Participation And Student Achievement, Matthew Kukoda

Seton Hall University Dissertations and Theses (ETDs)

The purpose of this study was to examine the relationship between high school students’ athletics participation, mediated by engagement, and their academic achievement. The study sought to determine if increased athletics participation, and a self-reported increased sense of engagement at school, resulted in higher SAT test scores for high school students. In addition to this, predicators of race and gender were also incorporated into the statistical analysis of the relationship between sports participation and SAT scores. Using the High School Longitudinal Study of 2009 (HSLS:09), this study analyzed the survey respondents scale of student engagement, participation in organized sports and …

Cafo’S Are A Public Health Crisis:The Creation Of Covid-19, Helena Masiello Jun 2022

Cafo’S Are A Public Health Crisis:The Creation Of Covid-19, Helena Masiello

University of Miami Law Review

Concentrated Animal Feeding Operations (“CAFO’s”) are largely unregulated by State or Federal Laws in the United States. As a result of this lack of oversight, they are a breeding ground for deadly infectious diseases. The COVID-19 epidemic has demonstrated the threat that diseases pose to the United State like H1N1, SARS, and Ebola.
The USDA needs to regulate CAFOs under the mandate given to them by congress in the AHPA to ensure that they are not the epicenter of the next wave of deadly infectious diseases. Scientists have been warning about the disease potential of CAFOs for the last decade, …

Sinking Mink: An Argument For Ending The Mink Industry In Nova Scotia, Sarah Frame Jun 2022

Sinking Mink: An Argument For Ending The Mink Industry In Nova Scotia, Sarah Frame

Dalhousie Law Journal

Nova Scotia produces more mink pelts than any other province, but its fur farming industry imposes costs disproportionate to its benefits. These costs include the substantial financial aid given to mink farms, the toxic algae blooms in some lakes, the frequent spread of viruses from mink to humans and wildlife, the regular and wasteful mass culls of diseased mink, and the animal suffering caused by captivity, neglect, and abuse. Federal and provincial legislation does not and cannot provide meaningful protection to mink because of innate species characteristics and the cruelties inherent in the fur industry. Due to the association between …

Material Development Toward An Index-Matched Gadolinium-Based Heterogenous Capture-Gated Neutron Detector, Aaron J. Thorum Jun 2022

Material Development Toward An Index-Matched Gadolinium-Based Heterogenous Capture-Gated Neutron Detector, Aaron J. Thorum

Theses and Dissertations

Neutron detection is important in several fields, especially detection of illicit nuclear material. Historically, 3He has been the basis for these technologies. Modern realities have necessitated the development of new technologies and the exploration of new materials to meet this need. One potential solution is known as capture-gating, which is a measurement approach that is good at differentiating between incident neutrons and gamma rays. The key issue is that materials used in current capture-gating devices can suffer from poor optical performance. This is due to the fact that the these detectors, whether composed of a heterogeneous or homogeneous mixture of …

Children’s Nutrition Research Center Staff Publications

Background: Epidemiologic observations suggest increased potato consumption correlates with weight gain, adiposity, and diabetes risk, whereas nut consumption is associated with weight control and metabolic health. Randomized controlled trial (RCT) data indicate humans respond to changes in energy intake in single dietary components and compensate for extra energy consumed.

Objectives: We completed an RCT testing whether increased daily potato consumption influences energy balance [specifically, fat mass (FM)] compared with calorie-matched almond consumption.

Methods: A 30-d RCT of 180 adults prescribed calorie-matched (300 kcal/d, n = 60 participants/group) than consumed 1 of the following: 1) almonds (almond group), 2) French fries …

The More Things Change ... Governance And Resistance Along The Mexico–Guatemala Border, Carla Angulo-Pasel Jun 2022

The More Things Change ... Governance And Resistance Along The Mexico–Guatemala Border, Carla Angulo-Pasel

Political Science Faculty Publications

With the politics of borders, the socio-economic divide between the United States and Mexico is evident. The geographic proximity to the U.S. makes the Mexico–Guatemala border an extension of the U.S. border enforcement regime. This article argues that the politics surrounding the U.S.–Guatemala border have not necessarily changed, because, at the core, the main objective of these border governance practices is to stop the movement of undesirable bodies (Khosravi 2011). Further, the article argues that the practices of containment force migrants to resist through their movement and seek strategies of survival. By comparing the administrations of Peña Nieto and López …

Teaching and Learning Faculty Research

The purpose of this study is to investigate the relationships between self-regulated learning skills and smartphone usage in relation to studying. It is unclear whether poor learning habits related to smartphone usage are unique traits or a reflection of existing self-regulated learning skills. The self-regulatory skills (a) regulation, (b) knowledge, and (c) management of cognition were measured and compared to the smartphone practices (a) multitasking, (b) avoiding distractions, and (c) mindful use. First-year undergraduates (n = 227) completed an online survey of self-regulatory skills and common phone practices. The results support the predictions that self-regulatory skills are negatively correlated with …

Quietly Encouraging Saudi Arabia’S Transient Economy, Austin H. Hardman Jun 2022

Quietly Encouraging Saudi Arabia’S Transient Economy, Austin H. Hardman

Pepperdine Policy Review

The Saudi government has made tremendous progress in liberalizing its economy. The Saudi legal system is more business friendly now than ever and many of the legislative changes have occurred in just the past 5 years. Economic obstacles preventing Americans from further investing in Saudi Arabia’s private sector have largely been resolved in theory. This is good news for U.S. policy makers. Economic modernization is believed to bring regional and domestic stability. However, Saudi Arabia has been trending towards becoming a more authoritarian regime. The Saudi Royal authority has supplanted powers allocated for religious authority in the name of economic …

Development Of Cooperative Catalytic Systems And Bimetallic Catalysts For Organic Synthesis, Kelton Guy Forson Jun 2022

Development Of Cooperative Catalytic Systems And Bimetallic Catalysts For Organic Synthesis, Kelton Guy Forson

Theses and Dissertations

The development of new catalysts for organic synthesis is an important pursuit that enables the discovery of new and more efficient reactions and the identification of new reaction mechanisms. Cooperative catalytic systems and bimetallic catalysts represent unique approaches to catalyst development that achieve reactivity that cannot be obtained with a single catalyst or metal. These types of catalysts can activate substrates in unique ways, facilitate reactions under mild conditions, increase substrate scope, and provide access to completely new transformations. The first part of this work describes the development of a cooperative nickel-titanium-catalyzed amination of allylic alcohols. The cooperative effects of …

Transcriptome Analysis Of The Entomopathogenic Fungus Culicinomyces Clavisporus, Dana E. Foresman Jun 2022

Transcriptome Analysis Of The Entomopathogenic Fungus Culicinomyces Clavisporus, Dana E. Foresman

All HCAS Student Capstones, Theses, and Dissertations

Culicinomyces clavisporus is an entomopathogenic fungus that can infect mosquito larvae, such as Culex quinquefasciatus, Aedes aegypti, and Anopheles stephensi. Whereas most fungal entomopathogens infect hosts through the cuticle, C. clavisporus initiates infection through ingestion. This suggests that the C. clavisporus genome may be mined for novel pathogenicity factors with the potential for vector control. To this end, a transcriptome analysis was initiated. The strain C. clavisporus ARSEF 582 was grown in modified PYG liquid cultures that was supplemented with whole, insect larvae (Galleria mellonella) to elicit the expression of genes involved in host-pathogen relationships. Total RNA …

UNO Student Research and Creative Activity Fair

The University of Omaha math department's Problem of the Week was taken over in Fall 2019 from faculty by the authors. The structure: each semester (Fall and Spring), three problems are given per week for twelve weeks, with each problem worth ten points - mimicking the structure of arguably the most well-regarded university math competition around, the Putnam Competition, with prizes awarded to top-scorers at semester's end. The weekly competition was halted midway through Spring 2020 due to COVID-19, but relaunched again in Fall 2021, with massive changes.

Now there are three difficulty tiers to POW problems, roughly corresponding to …

The De Minimis Dilemma: A Bedeviling Problem Of Definitions And A New Proposal For A Notice Rule, Matthew C. Lucas

Journal of Technology Law & Policy

This article will discuss the de minimis doctrine in light of its current (and often varied) application in several important cases. While the focus will remain on infringements occurring in electronic media, the application of the analysis is by no means limited to that area alone. This article concludes by proposing the addition of a notice rule within the current copyright scheme. This rule would bar a would-be infringer from raising a de minimis defense once access to the copyrighted work at issue has been conclusively proven. The notice rule would encourage early negotiation of an optimal licensing arrangement between …
