This article will discuss the de minimis doctrine in light of its current (and often varied) application in several important cases. While the focus will remain on infringements occurring in electronic media, the application of the analysis is by no means limited to that area alone. This article concludes by proposing the addition of a notice rule within the current copyright scheme. This rule would bar a would-be infringer from raising a de minimis defense once access to the copyrighted work at issue has been conclusively proven. Part IV addresses the practical considerations of litigating child pornography and obscenity cases. In addition, Part IV provides a quick lesson in the language of computers to facilitate a discussion of practice pointers and cautionary tales. In this paper, the balance between the rights of authors, publishers and users will be explored to see how the technology affects their particular interests, and how various laws tip the balance of their rights in different directions. This paper also includes an analysis of two recent proposals for adapting copyright law to the new technology. This paper is about the promise that intellectual property holds for generating wealth from international trade. The U.S. government and U.S. corporations have employed various means to secure the benefits of selling intellectual property abroad. The most flexible and useful method of transferring this form of property is the licensing agreement. A model of regulation is being developed in response to the passage of the Telecommunications Act of 1996. That model could be based on the motion picture industry’s system of self-regulation, which may at first seem to be less threatening to the First Amendment rights of the Internet users. On March 21, a special three-judge federal court panel in Philadelphia began hearing testimony in a proceeding to determine the constitutionality of the Communications Decency Act (“CDA”). The statute enacted as part of the Telecommunications Act of 1996, criminalizes the transmission of “indecent” and “patently offensive” material via the Internet in a manner that makes it available to minors. Judicial review of the CDA is destined to result in a landmark Supreme Court decision defining, for the first time, the applicability of the First Amendment to emerging interactive communications media. State Bar of Arizona, attorney advertising, once anathema to the profession, has become tolerated, if not entirely welcome fixture of the landscape. Regulations of attorney advertising have passed the intermediate scrutiny of the Supreme Court on a number of occasions with a recent Supreme Court victory of the Florida Bar over an advertising attorney defining the outer limits of permissible attorney conduct in targeted direct mail advertising. This study investigates postgraduate (PGs) and faculty needs concerning academic writing (AW) tutors’ qualifications in an English as a Foreign Language (EFL) context. Tutors are the core element of a writing center (WC) (Hays, 2010). These professionals listen to (Burns, 2014), advise, and exchange information (Reid, 1993, in Hays, 2010) collaboratively so students can resolve their writing issues (Hays, 2010). However, in EFL contexts, scant research exists about WCs, writing programs (Molina & López, 2019), and qualifications to recruit tutors (Özer, 2020). Today about 80 million tonnes of municipal solid waste (MSW) is annually incinerated in Europe. One of the solid residues from the municipal waste incineration (MSWI) plant is fly ash (FA). FA is classified as hazardous waste due to the high content of soluble salts, potentially toxic elements (Zn, Pb, Cd, Cr, Cu, Hg, Ni, As, and Sb), and trace organic pollutants (e.g. dioxins, furans, etc.) and, therefore, must be disposed of in special landfills [1]. Natural killer cells protect against virus infection and tumors. Although initially recognized as a part of the innate immunity, several recent studies have revealed NK cells exhibit immune memory to pathogens and haptens. NK cell memory has also been observed after exposure to combination of cytokines (IL12, IL15, IL18). The cytokine induced memory like NK cells exhibited potent antitumor immunity. To understand the role of cMyc in effector function of cytokine induced memory like NK cells, the effects of cMyc chemical inhibitor and Myc gene deletion by Crispr/Cas9 were studied. Dropout is a problematic phenomenon which wastes community, clinician, client, and researcher resources. Clients who dropout from therapy end up the same, or worse than, those who did not seek out therapy at all. While there is a relatively deep and broad understanding of dropout from individual therapy, an exhaustive review of couple therapy dropout literature reveals a very inconsistent and non-conclusive body of research. The self-creation of Black spaces in America has been a form of resistance and reclamation, as well as a way to forge an identity and make room for community. This thesis argues for a use of improvisational African American music as a tool to create space. One of the defining characteristics of our current epoch—the Anthropocene—is modification of nutrient cycles. At regional to global scales, humans have fundamentally reshaped the availability of carbon, nitrogen, and phosphorus. These changes are particularly apparent in freshwater ecosystems, which receive surface and groundwater inputs of nutrients from agriculture, fossil fuel use, and wastewater. In this thesis, I investigated how the addition of nutrients affects microbial community and biogeochemistry in two extreme environments: the hypereutrophic shallow Utah Lake and nutrient-limited Arctic permafrost streams.
