Plausibly Illiberal: Sua Sponte Dismissals Of Pro Se Complaints Under The Prison Litigation Reform Act, Pierce Edlich
Fordham Law Review
Over a quarter of civil litigants file suit in federal court without an attorney. Most unrepresented litigants are in prison, and many of their cases raise complex, delicate constitutional questions. The number of unrepresented litigants in federal courts rose steadily until the 1990s, when Congress passed the Prison Litigation Reform Act (PLRA) of 1995 to limit the burden of frivolous inmate litigation on federal courts. Since 1996, the PLRA has defined courts’ procedural obligations for inmate and in forma pauperis (IFP) suits, often filed pro se. The PLRA requires that courts screen and dismiss sua sponte cases that are frivolous, …

Integration Of Ai In Project Management World And Impacts, Shravani Ramaiah, Keerthivasan Kumar
School of Professional Studies
In organizations, effective project management is crucial to achieving business objectives. The ability to gain real-time insights from dynamic data across areas such as finance, resource allocation, and performance metrics can significantly enhance decision-making. Instead of relying on manual report generation, the integration of Artificial Intelligence (AI) can enable managers to access actionable insights instantly. AI-driven analytical tools provide live data analysis, allowing managers to make more informed and timely decisions. This is especially important when paired with Agile methodologies, as AI can help streamline processes, reduce manual effort, and maximize efficiency by automating routine tasks and providing predictive analytics. …

Electronic Theses and Dissertations
Each year, eligible schools across the nation receive Title I grant funds through the Elementary and Secondary Act. These funds, justified in pursuit of social justice and educational equity, serve to provide supplemental education services to neglected and delinquent students. While the majority of the awarded schools operate within the traditional school setting, a very small number of schools in the United States operate within the correctional setting. These schools receive Title I Part D Subpart 1 funds. Consequently, most of the guidance pertains to best practices within traditional public schools, which provides no provision on the appropriate use of …

No Conozco A Ninguna Miranda Y Quiero Mi Abogado: The Constitutional Inadequacies Of Translated “Miranda Cards” In Police Interrogations, Sean Werkheiser
University of Miami Inter-American Law Review
This article explores the challenges and complexities surrounding the application of the Miranda warning in the United States and specifically addresses its impact on non– English–speaking immigrants. While many Americans are familiar with these rights, recent immigrants may not fully understand them, particularly if they come from countries that do not offer equivalent legal protections. This article performs a comparative analysis of the right to silence and counsel in Cuba, Haiti, and Colombia—three countries with the largest immigrant populations in Miami, FL. Furthermore, this article examines how Miami-Dade Police address the linguistic barriers inherent in translated “Miranda Cards,” and argues …

Internal Audit Obligations To Combat Money Laundering In Ksa: A Qualitative Study Among Saudi Auditors, Mohammed Alzahrane
USF Tampa Graduate Theses and Dissertations
Money laundering (ML) presents a significant challenge to Saudi Arabia's financial system, hence the need for comprehensive measures for detection and prevention. This study will analyze various aspects of ML within Saudi Arabia, focusing on its complexities, regulatory landscape, and ongoing efforts to combat it. Saudi Arabia, as a key financial center, faces unique challenges in addressing ML due to its strategic location, substantial oil reserves, and intricate financial transactions. The country's dynamic financial sector and technological advancements amplify these challenges, requiring vigilant measures to counter illicit financial flows effectively. The regulatory framework governing anti-money laundering in Saudi Arabia is …

Coping With And Surviving Domestic Violence Among African American Women In A Rural Community, Kimberly Evonne Wimbush
Coping With And Surviving Domestic Violence Among African American Women In A Rural Community, Kimberly Evonne Wimbush
Walden Dissertations and Doctoral Studies
Domestic violence (DV) or intimate partner violence is a widespread public health problem in the United States that knows no boundaries. Previous researchers have found that in the United States, African American women experience more severe effects from DV than women in other ethnic groups. The purpose of this generic qualitative study was to identify the coping strategies used by African American women who have survived DV living in rural areas where there are limited professional resources. Premises from the superwoman schema and adult resilience theory guided this research. Semistructured audio-recorded interviews, conducted via Zoom and face-to-face, were used to …

The landlord sought arrears for a rent-stabilized unit, but the tenant successfully asserted a rent-impairing violation defense under MDL § 302-a. The court found the landlord barred from collecting rent for June 2020–May 2022 due to an uncorrected HPD violation, granting a 100% rent abatement and dismissing the petition. The tenant was awarded the deposited funds, and counterclaims remain for further proceedings.

Latinx populations in the USA have grown steadily in recent decades, with significant increases taking place in “new destination communities” of the U.S. South. The focus of our paper is to highlight opportunities for working with these populations, including traditional sociolinguistic ethnographies and community-engaged research. We highlight an initiative named “The SEC Spanish Consortium” which is an interinstitutional collaboration centered on scholarship and service involving Latinx populations in new destination communities of the U.S. South. We show that ongoing and future scholarly work in the U.S. South can act as a mechanism for documenting these emerging Latinx communities while simultaneously …

Attributing Ai Authorship: Towards A System Of Icons For Legal And Ethical Disclosure, Joseph J. Avery, Patricia Sánchez Abril, Alissa Del Riego
Northwestern Journal of Technology and Intellectual Property
Over the past year, the pervasive role of large language models (LLMs) and artificial intelligence (AI) in text generation has precipitated concerns about ethical usage, authorship, and transparent attribution. This has been true in legal practice, academia, and the corporate world, as well as in countless other arenas. In this Article, we identify the gap that has opened between those demanding proper disclosure (we should know when and to what extent AI is an author) and those struggling to respond to these demands. Part of the problem is that there is no system in place, no lingua franca, no set …

In this non-payment case, the tenant moved for summary judgment based on an overcharge claim, asserting that a two-attorney stipulation in a prior case violated the Rent Stabilization Code by setting the rent above what was allowable. The landlord argued that the stipulation, made post-HSTPA, was valid under 9 NYCRR 2520.13, which permits tenants to waive certain rights. The court rejected this argument, ruling that such stipulations, which violated the Rent Stabilization Code, were void as against public policy. Consequently, the landlord was found liable for the overcharge, although the exact overcharge amount was left unresolved pending further proceedings.

Multi-Sided Information Asymmetry In A Single Contract: Why Revocable Living Trusts Go To Court, James P. Wells
Multi-Sided Information Asymmetry In A Single Contract: Why Revocable Living Trusts Go To Court, James P. Wells
USF Tampa Graduate Theses and Dissertations
Revocable living trust documents (trusts) are among the most important documents created in contemporary estate planning. One of the trust’s objectives is to provide clear guidance to the trustees on how to carry out the grantor's intent. When a trust is contested in court, the objective of the trust has clearly failed. Consequently, understanding why trusts go to court and developing approaches that reduce or eliminate the number of trusts in our courts is an endeavor worthy of research and the primary objective of this research effort.
Ideally, with a clearly stated grantor’s intent and clearly executed interpretation of the …

At the onset of the full-scale Russian war of aggression against Ukraine, U.S. law clinic professors worked alongside the leadership of the Association of Legal Clinics of Ukraine. The mutual objective was to support Ukrainian law professors and facilitate the continued legal education of their students, particularly the acquisition of skills typically taught in law clinics. Ultimately, the online partnership that developed focused on skills training and included seven Ukrainian law schools, faculty from over six U.S. law schools and one private law firm, and USAID Justice for All Activity in Ukraine. The overall goals of this collaboration were to …

The Implications Of Chatgpt For Legal Services And Society, Andrew Perlman
The Implications Of Chatgpt For Legal Services And Society, Andrew Perlman
Michigan Technology Law Review
On November 30, 2022, OpenAI released a chatbot called ChatGPT.1 To demonstrate the chatbot’s sophistication and its potential implications, both for legal services and society more generally, most of this paper was generated in about an hour through prompts within ChatGPT. Only this abstract, the preface, the outline headers, the footnotes, the epilogue, and the prompts were written by a person. ChatGPT generated the rest of the text with no human editing. To be clear, the responses generated by ChatGPT were imperfect and at times problematic, and the use of an AI tool for law-related services raises a host of …
