A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward
A Right To Be Heard: A Proposal For Independent Victim’S Counsel For Sexual Assault Survivors, Madelyn Hayward
Southern Illinois University Law Journal
In the last two decades, there have been several helpful and progressive reforms dedicated to changing the landscape of sexual violence. Yet, survivors of sexual assault lack a voice in the criminal justice process. The support offered by victim advocates and coordinators allows victims to be seen but not heard by the court. This Note contends that the progressive step the criminal justice system must take is an independent victim’s counsel program similar to the United States military. This Note proposes model legislation establishing an Independent Victim’s Counsel program in federal and state criminal justice systems. It is time for …
Earned Wage Access: A Loan By Any Other Name?, Matthew Johnson
Earned Wage Access: A Loan By Any Other Name?, Matthew Johnson
Northwestern Journal of Law & Social Policy
Over the past decade, a new financial product called earned wage access (EWA) has emerged and is being marketed to workers. These products allow workers to access wages they have already earned but have not yet received in a paycheck, usually incurring a fee for the advance. While the companies selling these products claim to financially empower workers who live paycheck to paycheck, consumer advocates have noted EWA’s concerning similarities to payday lending. As EWA use has proliferated, regulators have begun addressing it head on. The primary debate is whether to consider these products loans subject to federal and state …

“All They Did Was Change The Name”: Evaluating Reforms To Solitary Confinement, Laura Mcfeely
Northwestern Journal of Law & Social Policy
In the last decade, the United States has seen a wave of efforts to greatly reduce or eliminate the use of solitary confinement. In the light of growing international recognition that such treatment amounts to torture, these efforts are certainly encouraging and have contributed to a reduction of the number of people held in long-term isolation. But it is worthwhile to examine the extent of these reforms and what solitary confinement now looks like in states that have implemented such changes.
A robust literature exists on the harms of solitary confinement and ideas for reforming or eliminating its use. This …

The San Francisco Cultural Districts Program: A Potential Answer To Fighting Gentrification And Uplifting Culture And Neighborhoods, Boston Rizal Palacios
The San Francisco Cultural Districts Program: A Potential Answer To Fighting Gentrification And Uplifting Culture And Neighborhoods, Boston Rizal Palacios
Undergraduate Honors Theses
As San Francisco neighborhoods are rapidly changing due to gentrification and displacing longtime residents and small businesses, the San Francisco Cultural Districts Program was established in 2018 with the goal to disrupt gentrification by prioritizing the voices of people within these disinvested neighborhoods. Through analyzing government documents, news articles, and conducting personal interviews, I am conducting a hypothesis-generating, qualitative case study on one of the cultural districts, SOMA Pilipinas. This is to determine if the San Francisco Cultural Districts Program is an effective model in giving impacted communities more of a role in decisions about how to best protect their …

Maine's Iolta Proposal: A Source Of Supplemental Funding For Legal Services, J. Gordon Scannell Jr.
Maine's Iolta Proposal: A Source Of Supplemental Funding For Legal Services, J. Gordon Scannell Jr.
Maine Law Review
Lawyers often hold certain client funds for short periods of time. Generally, those funds must be kept separate from funds belonging to the lawyer or law firm. Occasionally the clients' funds are deposited in individual, interest bearing accounts and the interest generated is credited to the particular client, but more often the amount or length of the deposit does not warrant the opening of an individual account and the funds are aggregated in a general, noninterest bearing trust account. A number of states have implemented programs, commonly referred to as Interest on Lawyers' Trust. Accounts (IOLTA), which allow attorneys to …

Nursing Leadership in Community Engagement Projects
Introduction
Our team of nursing students collaborated with a university's security office and health services to educate the campus community on sexual assault and gender-based violence. According to the University’s Annual Security and Fire Safety Report, there was a 550% increase in rape cases from 2022 to 2023 (personal communication, 2024). This increase in rape cases indicated a need for increased education and awareness of sexual assault and gender-based violence. Our educational sessions aimed to provide the campus community with education and resources on sexual misconduct and consent to promote healthier relationships on campus.

How Sexual Assault Survivors Perceive Their Experiences With Victim Advocates, Stephanie Miller
Walden Dissertations and Doctoral Studies
Programs incorporating sexual assault victim advocates have become a prominent resource in assisting survivors gain access to necessary services to aid in their recovery. Although these efforts provide needed support to survivors, the programs are developed without the input of the survivors. This qualitative phenomenological study explored the relationship between victim advocates and survivors from the perspective of the survivor. Semistructured interviews were conducted with 13 sexual assault survivors regarding how they perceived their relationship with their advocates, what they experienced as helpful or not helpful in that relationship, and what they thought might improve that relationship. Thematic analysis was …

The Intersection Of Socio-Cultural System And Legislation: Family Protection Laws In Palestine And Gender Equality, Muayad K. Hattab, Fayez A. Mahamid
An-Najah University Journal for Research - B (Humanities)
Arabic and Muslim societies still fear every new proposition or change that could lead to the enhancement of women’s economic liberation or could undermine male domination over women. The social and religious panic associated with the proposed law on “Family Protection Law from Violence” that has been witnessed in Palestine, is a clear illustration of this fear. Objective: The aim of this study is to examine the impact that religious and social culture has on promulgating new laws that are directly connected to issues of women’s rights and gender equality in the Muslim community, where Palestine is the example …

Challenging Myths & Addressing Intimate Partner Sexual Violence In Lgbtq+ Relationships, Nora K. Whitten
Challenging Myths & Addressing Intimate Partner Sexual Violence In Lgbtq+ Relationships, Nora K. Whitten
SPARK Symposium Presentations
Intimate partner violence (IPV), including intimate partner sexual violence (IPSV), is a public health crisis that disproportionately affects members of the LGBTQ+ community. This paper draws upon related, though limited, research to identify the five prevalent myths surrounding IPSV in LGBTQ+ relationships, addressing the following misconceptions: 1) IPSV can only occur in heterosexual relationships, 2) IPSV in LGBTQ+ relationships is not as severe, 3) Women cannot commit acts of sexual violence, 4) The more “masculine” partner is always the perpetrator, and 5) IPSV is a “mutual fight” among partners of the same sex. These myths perpetuate victim-blaming, minimize the severity …

Journal of Human Sciences and Extension
There are an estimated 2 million farmworkers who are essential to the food system in the United States; however, they are exposed to hazardous environmental conditions with limited access and/or use of Personal Protective Equipment (PPE). The primary purpose of this research is to evaluate community-based organizational efforts to provide farmworkers with apparel-textile basic needs, such as face masks. A primary goal is to address the research gap regarding common environmental factors that impact farmworkers, including pesticides and the pandemic, their use of available PPE, and community-based efforts to improve access to face masks as basic PPE. We consider the …

Addressing The Issue Of Public Defender Excessive Caseload In Low-Income Communities, Moises Reynoso Colin
Capstone Projects and Master's Theses
The Monterey County Public Defender’s Office plays a vital role in providing legal representation to low-income individuals, ensuring their constitutional rights are upheld. Although the office effectively fulfills its mandate, it aims to enhance defense support by exploring ways to reduce attorney workloads and improve service quality. This project was developed to assess attorney-to-client ratios, identify staffing needs, and evaluate the potential benefits of integrating paralegals into the team. Using a mixed-methods approach, the project included interviews with attorneys to gather insights on workload challenges and identify tasks that could be delegated to paralegal staff. Findings revealed that certified paralegals …
The Workings Of Legal Exceptionalism: Arbitration As A Portal To Stateless Law-In-Action Regimes, Thomas Schultz
The Workings Of Legal Exceptionalism: Arbitration As A Portal To Stateless Law-In-Action Regimes, Thomas Schultz
Buffalo Law Review
This Essay seeks to explores the fertility of thinking about arbitration as a portal to stateless legal regimes. Using the distinction between law in books and law in action, as well as the concepts of social and political disembeddedness and quiet politics, it argues that under the current paradigm of arbitration, it operates as a porous portal, getting corporate and natural citizens to escape into stateless law-in-action legal regimes (though in practice not into a law-in-books stateless legal regime). This raises questions of control of and accountability for the political effects of such stateless law-inaction legal regimes on the rest …

Marriage, Courts, And Substantive Equality: A Transformative Interpretation, Kushagr Bakshi
Marriage, Courts, And Substantive Equality: A Transformative Interpretation, Kushagr Bakshi
Michigan Law Review
Courts in various jurisdictions have relied on either the right to privacy or the right to equality to offer protections to the LGBTQ+ community. The use of different rights to achieve similar ends may seem like an empty distinction. But the differences in the nature and function of each right evince the differences in the construction of rights across jurisdictions. In the traditional liberal method of conceptualizing rights, privacy is typically a negative right, restricting the state from interfering in intimate relationships between individuals. Courts operating within a transformative framework of rights interpretation, however, rely on the positive right to …

Next Steps In Online Courts: Accelerating Access To Justice Through Court Technology, J.J. Prescott
Articles
For more than a decade, state courts have been expanding access to justice by adopting online dispute resolution (ODR) platforms and other outward-facing communication technologies. At a deep level, these reforms aim at improving society by bolstering the rule of law. At a surface level, these innovations recognize that the justice system works better when courts and law are easier and less costly to understand and use. In important respects, these efforts have been a success. The accessibility of many state courts is considerably more robust today than it was ten years ago, at least for small-stakes cases, like traffic …
