What Lies Ahead? Future Directions For Grandparent Caregiving Research, Bert Hayslip Feb 2025

What Lies Ahead? Future Directions For Grandparent Caregiving Research, Bert Hayslip

GrandFamilies: The Contemporary Journal of Research, Practice and Policy

Clearly, as a perusal of the literature will support, interest in the lives of grandparents raising grandchildren among practitioners and researchers has increased dramatically over the last decade. As we approach 50 years since the appearance of Meredith Minkler and her colleagues’ classic work on grandparent caregivers raising their grandchildren amid the crack cocaine epidemic, I take this opportunity at the 10th anniversary of GrandFamilies to reflect on what directions grandfamily research might take in the future.

Trauma-Informed Bilingual Counselor Education: Factors To Guide Professional Mental Health Training With Spanish-Speaking Students, Fernando Estrada, Miguel A. Arana Feb 2025

Trauma-Informed Bilingual Counselor Education: Factors To Guide Professional Mental Health Training With Spanish-Speaking Students, Fernando Estrada, Miguel A. Arana

Journal of Counselor Preparation and Supervision

Latine immigrants confront various forms of violence that increases their risk for traumatic stress and post-traumatic stress disorder. There is a need to advance the training of counselors who can work with Spanish-speaking clients exposed to trauma. The goal of this study was to articulate a literature-based conceptualization of trauma-informed bilingual counselor education. The results of a content analysis facilitated a synthesis of the relevant scholarship that highlighted four main facets: (i) integrative translanguage pedagogy, (ii) immigrant trauma exposure and reaction, (iii) culturally responsive socio-emotional interventions, and (iv) bilingual supervisory alliance. These factors can help guide professional graduate training. Implications …

Navigating Turbulent Skies: Class Action Waivers In The Airline Industry And The Quest For Passenger Justice, Macarena Alejandra Bazan Hidalgo Feb 2025

Navigating Turbulent Skies: Class Action Waivers In The Airline Industry And The Quest For Passenger Justice, Macarena Alejandra Bazan Hidalgo

University of Miami Business Law Review

In the ever-evolving skies of the airline industry, airline passengers have continued to benefit from distinctive safeguards, even in the wake of deregulation. As its principal protector, the Department of Transportation has consistently demonstrated its commitment to treating airline customers as a distinct and significant group of consumers. However, these well-intentioned regulations often go unchecked, inadvertently paving the way for airline companies to exploit loopholes, leading to unjust practices. This, in turn, inflicts significant harm upon one of the most crucial consumer segments in the United States. A prime example of this issue is the collaborative effort by airline companies …

Doing More, Doing Better? A Critique Of The Criminalization Of Coercive Control, Janet Mosher, Shushanna Harris, Jennifer Koshan, Wanda Wiegers Feb 2025

Doing More, Doing Better? A Critique Of The Criminalization Of Coercive Control, Janet Mosher, Shushanna Harris, Jennifer Koshan, Wanda Wiegers

Journal of Law and Social Policy

Canada stands on the verge of ushering in a new criminal offence related to coercive control in the context of intimate relationships. In this paper we critically evaluate this development, drawing out lessons from past criminalization efforts and in particular, their impact on Black women and their communities. Our analysis raises significant questions about the potential of the proposed offence to deliver on the promises held out by its proponents. We argue that not only will these promises go largely unrealized, but the ongoing harms of criminalization–harms that manifest not only in the criminal law sphere but in child welfare …

The Renaming Of A Tennessee Region, John Morgan, Leonard W. Brinkman Feb 2025

The Renaming Of A Tennessee Region, John Morgan, Leonard W. Brinkman

The Geographical Bulletin

The northeastern section of Tennessee has been known as Upper East Tennessee since the 1840s. During the last few years, however, a new regional label, Northeast Tennessee, has been promoted as a more appropriate regional name. The push for a shift from the use of Upper East Tennessee to Northeast Tennessee has been spearheaded by agencies whose missions are to increase tourism and to attract new industry in the region. The local medianewspapers, radio, and television-have played key roles in the renaming process. Although there is some opposition to the new name, a campaign to designate the region as Northeast …

Investor Justice, Nicole Iannarone Feb 2025

Investor Justice, Nicole Iannarone

Minnesota Law Review Vols. 106:2 onward (2021-present)

There is a systemic flaw in the investor protection landscape. Unrepresented investors face off against well-resourced repeat- player firms that almost always have lawyers. While consumers face similar challenges in civil courts, in forced securities arbitration, the decisionmaker may not have a law degree, is prohibited from conducting any outside legal research, and has no monetary incentive to read materials the parties submit. These realities amplify already-existing informational and resource asymmetries between Main Street investors and stockbrokers and undermine the market-legitimizing function of securities arbitration. Despite being designed to permit investors to recoup losses without the aid of an attorney, …

Solving The Public Defense Crisis In Kansas, Malia N. Brink, Pamela R. Metzger Feb 2025

Solving The Public Defense Crisis In Kansas, Malia N. Brink, Pamela R. Metzger

Deason Center Reports

Kansas has a constitutional obligation to provide counsel to any arrested person who cannot afford to hire a private attorney. But attorney shortages in Kansas threaten this core constitutional right. According to the American Bar Association, there are an average of four attorneys per 1,000 people nationwide. However, only six of Kansas’s 105 counties have two or more attorneys per 1,000 people. In 44 counties, there is just one attorney or fewer per 1,000 residents. The situation is particularly worrisome in rural Kansas. In 2023, nearly half of Kansas’s population lived in rural counties, but 80% of its lawyers lived …

Reforming The Rules: A Proposal For Modifying The Model Rules Of Professional Conduct To Permit Partnerships Between Lawyers And Nonlawyers In The Practice Of Law, Sholom Zeitlin Feb 2025

Reforming The Rules: A Proposal For Modifying The Model Rules Of Professional Conduct To Permit Partnerships Between Lawyers And Nonlawyers In The Practice Of Law, Sholom Zeitlin

Cardozo Law Review

The Model Rules of Professional Conduct prohibit partnerships between lawyers and nonlawyers in the practice of law, a ban that purportedly exists to protect lawyers’ professional independence of judgment. Despite this noble sentiment, the prohibition ultimately hurts the legal market, to the expense of potential clients, by limiting the professional options available at the lawyer’s disposal. The existence of lawyer-nonlawyer partnerships, recently espoused by two states, both decreases the costs and barriers involved in obtaining justice and encourages much-needed legal innovation. While other scholars have proposed schemes that would permit such partnerships without compromising the lawyer’s professional responsibility, their methods …

Silver Tsunami Or Silver Rush? Extracting Value From Elders, Andrew Milne Feb 2025

Silver Tsunami Or Silver Rush? Extracting Value From Elders, Andrew Milne

Suffolk University Law School Faculty Works

I examine how the United States finances elder care, arguing that the legal processes structuring elder care tend to widen economic inequality and divide the interests of lower-income people against each other along generational, gendered, and racialized lines. I begin with two case narratives drawn from my practice experience as a poverty lawyer for older adults. One narrative involves an elder homeowner, while the other involves an elder renter. Both face crises of unmet care needs, the threat of homelessness, and ultimately the outcome that many older people dread most: institutionalization in a nursing home. I use these narratives as …

The Eviction Crisis Is Rampaging: Time To Implement Diversion Programs, Rachel Elliott

Journal of Dispute Resolution

More than 7.6 million renters face the threat of eviction annually.1 In early February 2023, Ivy Hany was at risk of being part of this statistic again.2 Years ago, when Ivy was 19, she and her siblings were forced out of their home into a homeless shelter.3 Now, at 53, she was terrified of becoming homeless again.4 Ivy owed her landlord $2,184.75; she would be evicted if she did not pay.5 Fortunately, Ivy had the option of mediation
