Trauma-Informed Judicial Practice Meets Therapeutic Jurisprudence: Compassionate Written Judgments In Child Protection Cases, Shelley Kierstead

Articles & Book Chapters

Trauma arises from profoundly distressing life events, and manifests in a range of often overwhelming physical and psychological symptoms. The legal community is increasingly recognizing that clients living with trauma need trauma-informed services—that is, services that “recognize, understand and minimize” the long-term impact of trauma. A trauma-informed approach acknowledges that “effective interventions with people require both the avoidance of retraumatization and the presence of respectful and supportive interventions that help people rebuild their lives.”

Efta Coverage Of Modern Consumer Wire Transfers: Consumer Financial Regulation In The Wake Of Loper Bright, Benjamin Gygi Mar 2025

Efta Coverage Of Modern Consumer Wire Transfers: Consumer Financial Regulation In The Wake Of Loper Bright, Benjamin Gygi

Fordham Law Review

The rise of online banking has led to a proliferation of consumer fraud. Schemes aimed at stealing consumer funds using wire transfers executed through online banking portals have proven particularly devastating to consumers because of a perceived loophole in the Electronic Fund Transfer Act (EFTA) that leaves consumers with full liability for funds stolen through wire transfers. Consumer advocacy groups, and most notably the New York Attorney General, have recently argued that this loophole does not really exist; they claim that the EFTA’s text conclusively covers certain parts of modern wire transfer processes initiated through online banking portals. Considering the …

Fee-Shifting Shortcuts, Maureen Carroll Mar 2025

Fee-Shifting Shortcuts, Maureen Carroll

Articles

Federal fee-shifting statutes, which allow certain prevailing plaintiffs to recover a reasonable attorney’s fee from the defendant, are critically important to civil rights enforcement. When it comes to the interpretation of these statutes, however, a wide gap separates the doctrine articulated by the Supreme Court and the decisions issued by lower courts. According to the Supreme Court, the calculation of a feeshifting award requires a highly contextualized inquiry, specific to the plaintiff’s attorneys and claims; in the lower courts, by contrast, judges take a set of welltrodden shortcuts that flatten many of the differences the case law makes relevant.

Research estimates that government funding accounts for 30% of nonprofit revenue. Our findings show that executive orders and other federal policy changes have a significant impact on nonprofits in our region, affecting a wide range of causes and missionsincluding:

Reasons And Reasoning In Arbitral Awards, Eugene Thong, Yunwen Yvonne Guo Mar 2025

Reasons And Reasoning In Arbitral Awards, Eugene Thong, Yunwen Yvonne Guo

Research Collection Yong Pung How School Of Law

While the need for international arbitral awards to be supported by reasons appears self-evident, a closer analysis of relevant treaty and statutory provisions as well as tribunal practice reveals a surprising lack of consensus as to the extent to which arbitral awards should be reasoned. Through an analysis of the factors for and against reasoned awards and the reasons for the evolution towards reasoned awards in international arbitration, this article considers the practical implications of dispensing with such reasons and analyses what standard of reasoning is generally recommended in arbitral awards. It concludes with several broad principles on the recommended …

Urban Studies and Planning Faculty Publications and Presentations

Most eviction research focuses on large cities, leaving us with limited knowledge of evictions in smaller cities. Our analysis of evictions in three small and mid-sized cities in Oregon reveals that these cities can also experience severe eviction crises. By collecting and hand-coding data from justice courts, we provide a comprehensive view of evictions in these cities–including the role different types of courts play–for the first time.

Apostille Convention And Its Ramification Following The Accession Of The Indonesian Legal Practices, David Tan Feb 2025

Apostille Convention And Its Ramification Following The Accession Of The Indonesian Legal Practices, David Tan

Padjadjaran Jurnal Ilmu Hukum (Journal of Law)

Indonesia has acceded to the 1961 Hague Apostille Convention in early 2021. The government decided the move based on the current endeavors to enhance the quality of civil services, investment rate, government transparency, and recovery efforts after the worldwide pandemic. At the same time, Indonesia’s initiative to accede to the convention is surprisingly unimpressive, considering the benefits for Indonesia due to its urgency. The study reinforces the present perspective of apostille to contribute to the handful of scholarly papers dealing with the apostille in the realm of private international law. This study employed a normative juridical research method with secondary …

Cycling tests were performed under ambient conditions (~22 degrees Celsius) and were interrupted approximately every 3.5 days (~100 cycles, depending on the charge rate, discharge rate, and depth of discharge) to perform a reference performance test (RPT). During the RPT, the cell’s remaining capacity is measured, and 100-second-long, 1C constant-current pulses are conducted at nine states of charge (SOC): 10%, 20%, …, and 90%. The cycling and RPT data are sampled at 1Hz and span over 35 weeks of testing. Additional …

The Dementia Care Partner Hub: An Innovative Approach To Addressing Unmet Social And Health Needs, Sherril Gelmon, Jenn Reed, Walter D. Dawson Feb 2025

The Dementia Care Partner Hub: An Innovative Approach To Addressing Unmet Social And Health Needs, Sherril Gelmon, Jenn Reed, Walter D. Dawson

OHSU-PSU School of Public Health Faculty Publications and Presentations

The well‐being of care partners of people living with dementia, who are family, friends, or neighbors and often unpaid, is often not addressed explicitly in clinical dementia care. Care partners, especially those from systematically marginalized communities, experience substantial unmet social and behavioral needs. We reviewed role model programs and conducted focus groups and interviews with care partners and representatives of community organizations and government agencies. We developed the concept of a Dementia Care Partner Hub as a “one‐stop shop” to connect dementia care partners and service providers with information and resources, meeting a need that is not currently addressed in …

Mtglq Invs., Lp V. Mendoza Feb 2025

Mtglq Invs., Lp V. Mendoza

All Decisions

In this post-foreclosure holdover proceeding, the tenant moved to dismiss the petition based on the use of an outdated predicate notice. The petitioner, MTGLQ Investors, admitted to a filing error and cross-moved to amend the petition, submitting the correct notice of service. The court, under CPLR §2001, allowed the petitioner to correct the error and deemed the correct notice served nunc pro tunc, denying the tenant's motion to dismiss. The tenant's motion to file an answer was granted, and the matter was scheduled for trial.

The Not-So-Obvious And Inconvenient Truth: Reexamining A Right To Counsel For Parents And Children In Abuse And Neglect Administrative Proceedings, Tiffany Williams Brewer

Widener Commonwealth Law Review

The right to counsel for parents in administrative abuse and neglect cases, as well as for the children that are the subject of these matters, is a necessity that may not be obvious. This Article seeks to elucidate the fundamental interests that are at stake and justify why the sacrosanct protections of the landmark Gideon v. Wainwright right to counsel case should be extended to an administrative proceeding involving parents who are facing inclusion on a state child abuse and neglect registry. The Article also reveals an inconvenient truth–that communities of color are disproportionately impacted by the consequence of adverse …

Undo Process: Examining Agency Procedural Levers To Access To Counsel, Haiyun Damon-Feng Feb 2025

Undo Process: Examining Agency Procedural Levers To Access To Counsel, Haiyun Damon-Feng

Widener Commonwealth Law Review

Every day, through internal adjudicative proceedings, agencies make thousands of rights determinations that affect critical matters such as financial security, family unity, personal safety, and individual liberty. Scholars and policymakers have recognized the significant impact that representation can have on adjudicative outcomes across the administrative state. Many agencies have implemented policies affirmatively seeking to boost an individual’s ability to bring an advocate to assist with the adjudication process. In the immigration context, however, agencies have enacted procedural hurdles that have made it more difficult for individuals to reap the benefits of this assistance.

This Essay uses recent developments in the …

Supportive Programming During A Worldwide Pandemic And Beyond, Rainie B. Jueschke, Charissa Lynch, Anne Stokes, Tracy Van De Vate

GrandFamilies: The Contemporary Journal of Research, Practice and Policy

In the United States, approximately 2.4 million grandparents are the primary caregivers of their grandchildren (Annie E. Casey Foundation Kids Count Data Center, 2024). Relative caregivers provide an important opportunity to keep families together and avoid foster home placement when children are unable to safely be cared for by parents. “Parenting again” comes with its own unique set of challenges, and the COVID-19 pandemic significantly highlighted and exacerbated these difficulties. There are many organizations nationwide that work within the field of relative caregiving, providing diverse programming designed to address the needs of this unique population. Core principles include strategies to …

Building Blocks For New Kinship Partnerships And Coalitions, Kathy L. Dial, Daniel J. Koltz, Janet Salo, Erin Beasley

GrandFamilies: The Contemporary Journal of Research, Practice and Policy

Building successful kinship partnerships and coalitions requires intentional effort to establish trust, align goals, and foster inclusivity. These collaborations are essential for addressing the unique and evolving needs of kinship families, who often face limited access to resources due to the informal nature of many caregiving arrangements. Effective partnerships prioritize clear missions, open communication, and active engagement with stakeholders, particularly those with lived experiences such as kinship caregivers. Research demonstrates that coordinated efforts among organizations enhance resource availability, improve advocacy capabilities, and strengthen service delivery. By integrating diversity, equity, and inclusion principles, coalitions can ensure that diverse perspectives shape solutions …
