Paving Pathways To Legal Status: The Necessary Response To The U.S. Labor Shortage, John J. Arthur Apr 2025

Paving Pathways To Legal Status: The Necessary Response To The U.S. Labor Shortage, John J. Arthur

Line by Line: A Journal of Beginning Student Writing

For this final research paper, I was instructed to explore some dimension of a theme/issue that emerges in the stories of American writer Flannery O'Connor. Based on my reading of O'Connor's short story The Displaced Person, I chose the theme of immigrant labor in the United States in the broader context of the U.S. labor shortage. Through hours of research in Roesch Library and the guidance of librarian Jason Wardell, I built an annotated bibliography that became the framework for my paper. My paper advocates for the reform of pathways towards legal status for immigrant laborers, which can ultimately foster …

Between Attraction And Evasion: Legal Factors Shaping Fdi In Indonesia And Neighboring Countries, Richard C. Adam Apr 2025

Between Attraction And Evasion: Legal Factors Shaping Fdi In Indonesia And Neighboring Countries, Richard C. Adam

Indonesia Law Review

This article examines the internal and external factors that influence foreign direct investment (FDI) in Indonesia, focusing specifically on the legal framework as a key determinant. Internal factors—also referred to as pull factors—include the quality of Indonesia’s Foreign Investment Law, legal certainty, bureaucratic efficiency, and the availability of fiscal and non-fiscal incentives. Meanwhile, push factors represent external elements, such as the attractiveness of neighboring countries’ investment laws, regional economic integration, and global investment trends that encourage capital relocation. Using a normative juridical approach and qualitative analysis of secondary data, this study compares Indonesia’s regulatory environment with that of several Southeast …

National Military Trial Competition: First Competition Of Its Kind Hosted By Syracuse University College Of Law, Elizabeth Kubala, Todd Berger, Anna Lupardo

Voices of Service Symposium

Trial advocacy refers to the skills required of lawyers in order to effectively represent their clients during litigation. This involves all of the methods used in presenting a case in court such as opening statements, direct examinations, cross examinations and closing arguments. Effective trial advocacy requires a combination of legal knowledge, effective communication skills, and the ability to read the dynamics of a courtroom in order to ultimately influence the outcome of the case in the favor of your client. Law students develop their trial advocacy skills through classes, competitions, or personal development. Military justice refers to the legal system …

Legal Services For Homeless Veterans: New Va Grants Aim To Provide Critical Services To Veterans In Crisis, Elizabeth Kubala, Seth M. Owens, Andrew M. Patterson

Voices of Service Symposium

Ending and preventing homelessness among Veterans is a priority for the U.S. Department of Veterans Affairs (VA). In 2022, the VA created the Legal Services for Homeless Veterans (LSV-H) grant program, providing funds for legal services organizations to deliver essential legal aid to homeless veterans and veterans at risk for homelessness. As one of only three law schools that are current LSV-H grant recipients, the Syracuse University Veterans Legal Clinic provides legal aid to homeless veterans in the areas of housing, income support (VA disability), access to healthcare, and requests to upgrade military discharge or dismissal of a former member …

Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr. Apr 2025

Fighting The Hypothetical: Why Law Firms Should Rethink The Billable Hour In The Generative Ai Era, Nancy B. Rapoport, Joseph R. Tiano, Jr.

Washington Journal of Law, Technology & Arts

“Fighting the Hypothetical: Why Law Firms Should Rethink the Billable Hour in the Generative AI Era” analyzes how the emergence and adoption of generative artificial intelligence (GenAI) will fundamentally disrupt the traditional billable hour model that has dominated the industry since the 1960s. Professor Rapoport and Mr. Tiano contend that GenAI’s ability to perform routine legal tasks quickly and accurately will force law firms to shift away from billing structures based primarily on time spent (or inputs) and toward models that better reflect client value (or outputs).

The authors interviewed law firm leaders to gain an “in the trenches” view …

AI products can increase the speed by which you prepare, review, and summarize estate planning related documents, tax returns, and client communications. Likewise, the speed by which you can conduct legal and financial research is faster than ever. This presentation is designed to explain how AI operates, the potential use of AI in your practice, warnings about the use of AI, techniques you may adapt to enhance your AI competency, and how to address the ethical issues that arise when using AI.

Sighting The Scope Of A Lawyer’S Representation, Douglas R. Richmond Apr 2025

Sighting The Scope Of A Lawyer’S Representation, Douglas R. Richmond

St. Mary's Journal on Legal Malpractice & Ethics

Clients engage lawyers for many reasons. Regardless of the circumstances, however, the lawyer and the client need to agree on the scope of the lawyer’s representation, meaning the legal services the lawyer will perform for the client. The client must agree to and understand the scope of the lawyer’s representation as aspects of establishing her objectives for the matter and thereafter evaluating whether the lawyer is achieving those objectives. The client must also understand the scope of the representation to be able to decide whether the matter’s potential expense justifies its pursuit and to gauge the reasonableness of the lawyer’s …

Central Harlem Associates Llc V. Robbins Apr 2025

Central Harlem Associates Llc V. Robbins

All Decisions

In this holdover proceeding involving a LIHTC property, the tenant moved to dismiss on grounds that the landlord failed to serve a Violence Against Women Act (VAWA) notice as required by federal regulations prior to eviction. The landlord conceded the omission but argued no prejudice resulted and that the tenant had prior knowledge of VAWA rights. The court rejected these defenses, holding that predicate notice defects are fatal and not subject to amendment, emphasizing the mandatory nature of VAWA compliance. The petition was dismissed without prejudice. Practice note: In federally subsidized housing, omission of required predicate notices such as VAWA …
