Granting Rights To Nature: Environmental Personhood In The U.S. And Worldwide, Daxton W. Summers

This project explores the concept of granting legal personhood to natural environments, with a focus on the Clark Fork River in Missoula, Montana. Granting legal personhood rights to the environment has been used around the world to recognize and protect rivers, mountains, and other environmental entities. However, the U.S. legal systems have been slow to adopt this approach. This research essay examines why the U.S. has been lagging, analyzes foreign legal frameworks that have granted personhood to environmental entities and examines if any could be adapted to grant rights and protections to the Clark Fork River.

Daca’S Impact On Recipients: Interviews With Three Daca Recipients From Michigan, Jazmin Moron

This thesis explores the lived experiences of three Deferred Action for Childhood Arrivals (DACA) recipients residing in Michigan. It examines how DACA has impacted their lives across three distinct phases: pre-DACA, while applying for DACA, and post-DACA. Through qualitative, semi-structured interviews, this research uncovers key themes: normal childhood, proof of presence, skeptical DACA future, and restricted immigration pathways. While DACA offered recipients increased opportunities in education, employment, and stability, it also imposed systemic challenges such as costly renewals, limited career growth, and continued legal uncertainty. By focusing on Michigan—a state with a relatively small Hispanic/Latino population—this study highlights the unique …

Trempealeau County faces issues knowledge gaps and health literacy. A Punishment That Harms Everyone And Benefits No One: An Analysis Of The Use Of Solitary Confinement Under Common Sociological Theories Of Punishment, Allison Lampert

In the United States, experts estimate that nearly 100,000 incarcerated individuals are held in solitary confinement. While individuals can be held in solitary confinement for a variety of reasons, many are placed in lockdown because they have untreated mental illnesses, have committed some sort of minor disciplinary infraction, are need of protection, or for unpopular personal beliefs. In other words, solitary confinement is used as a broad catch-all to a wide range of low-level and nonviolent misbehaviors. This note argues that solitary confinement is an unjustifiable mode of punishment as analyzed under two commonly cited sociological theories of punishment: retributivism …

In this holdover nuisance case, the tenant moved to dismiss for improper service. The landlord's process server testified to substitute service on a person allegedly residing at the apartment, but the tenant asserted she lived alone and knew no such individual. The court found the process server's testimony not credible, citing his failure to maintain GPS records, logbooks, or adhere to terms of prior consent orders mandating compliance with legal service procedures. The court emphasized that his complete lack of records, inconsistent testimony, and prior disciplinary issues undermined the validity of service. If You Cannot Afford An Attorney, None Will Be Appointed For You: Exploring Rates Of Representation By Counsel In Texas Misdemeanor Courts, Andrew Davis, Shelby Sirivore, Victoria Smiegocki
Journal of Criminal Justice and Law
All misdemeanor defendants in the United States have the right to be represented by a lawyer if they are facing the possibility of incarceration. Yet implementation of that right is often left to local policymakers, and rates of non-representation (defendants proceeding without lawyers) vary enormously. Through an examination of data from Texas counties in 2019, we find non-representation rates were highest in the state’s poorest and most rural counties. But we also find signs that local policy choices matter. Amicus curiae brief submitted by 775 law professors in support of Susman Godfrey LLP's motion for summary judgment and request for declaratory and permanent injunctive relief in Susman Godfrey LLP v. Executive Office of the President. The brief argues that Executive Order 14263 unlawfully targets a law firm based on its clients, advocacy, and litigation activities, in violation of the First Amendment, Fifth Amendment, and Sixth Amendment. The amici contend that the order constitutes impermissible viewpoint discrimination, interferes with the right to counsel, and threatens the independence of the legal profession and the rule of law.

From 180 To 30: A Case For Shortening The Asylum Ead Clock, Faith Hegstad

This article explores the challenges posed by the mandatory 180-day wait for work authorization for asylum applicants in the United States, and evaluates the potential solutions offered by the Asylum Seeker Work Authorization Act and the ASPIRE Act. Although these proposed bills have expired, this article posits that Congress should pass future bills modeled after either the ASPIRE Act, the House version of the Asylum Seeker Work Authorization Act, or both.

Research on rural access to justice tends to appeal to a romantic conception of rural lawyers as accessible generalists who serve the public through pro bono, low bono, and community service, and some characterize rural private practice as public interest work. Many commentators call for law school, bar, and government programs to attract law graduates to rural practice and at least 15 states have implemented such programs. Yet we know very little about modern rural legal markets or the recipes for sustainable private practice in rural places. The purpose of this capstone is to explore the role of service animals in schools and to develop foundational training modules for educators and school staff. The presence of service animals in educational settings is a growing reality, yet many schools lack clear policies and staff training on how to effectively integrate them. This capstone reviews the legal protections surrounding service animals, including federal laws such as the Americans with Disabilities Act (ADA) and the Individuals with Disabilities Education Act (IDEA), as well as Mississippi-specific regulations. The long-term effects that individuals suffer because of childhood sexual abuse may impact their physical, mental, emotional, spiritual, and social health. Treatment providers and helping professionals working with childhood sexual abuse survivors offer a unique insight into the impact of the trauma based on the gender of the survivor. The purpose of this qualitative study was to explore integrative treatment providers’ perceptions of treating male versus female adult survivors of sexual abuse. Seligman’s positive psychology was used for the theoretical framework of the study, and the conceptual framework was based on Engel’s biopsychosocial model. The data for this study were …
