Social Belonging In Post-Resettlement Refugees: The Role Of Aid Organizations In The United States, Jessica Jean Byers
Social Belonging In Post-Resettlement Refugees: The Role Of Aid Organizations In The United States, Jessica Jean Byers
Theses and Dissertations
Since 1975, an estimated 3.6 million refugees have entered the United States (USA Facts, 2024). The months and even years following resettlement can be difficult and isolating for refugees. Previous research has shown that creating connections with others can enhance well-being, feelings of security, and self-reliance, all of which are especially needed for vulnerable populations such as refugees (Archambault et al., 2022; Giovanetti et al., 2022). Using the theory of social network analysis and semi-structured, in-depth interviews with aid organization leaders, this study seeks to understand the relationship between refugees and aid organizations during the post-resettlement phase. It also explores …
A Statutory Proposal To Remove Divorce From The Courtroom, Stephen R. Feldman
A Statutory Proposal To Remove Divorce From The Courtroom, Stephen R. Feldman
Maine Law Review
Over the past decade the divorce rate in the United States has more than doubled. Although the reasons suggested for this rapid rise are varied, the resultant impact on the judicial system is clear: divorce cases greatly overburden the courts. Presently they account for about one half of all civil cases filed. Unlike most other civil suits of which nearly half are dismissed or settled, divorce requires a court decree for relief unless the parties reconcile and abandon their suits. In addition to the actual granting of the divorce decree, court time is needed for pre-divorce motions for temporary support …

All Decisions
In this expired license holdover proceeding, Respondent moved to dismiss on the ground that the subject SRO building is subject to the Good Cause Eviction Law and Petitioner had not alleged cause to evict. The court dismissed the petition because Petitioner, though claiming the small landlord exemption under RPL § 231-c, failed to plead in the petition or predicate notice the ownership disclosure required by RPAPL § 741(5-a) and (5-b).
Small Claims Mediation In Maine: An Empirical Assessment, Craig A. Mcewen, Richard J. Maiman
Small Claims Mediation In Maine: An Empirical Assessment, Craig A. Mcewen, Richard J. Maiman
Maine Law Review
In recent years considerable attention has been paid in the United States to the development of informal "alternatives to court" as part of a world-wide access to justice movement. Of these alternatives to courts, mediation contrasts most sharply with adjudication and, in theory, promises much by way of decreasing the alienation of citizens when it is made an adjunct to the formal judicial process. The contrast and promise stem largely from the participatory and consensual character of the mediation process. A third party to the dispute—the mediator—encourages the parties to find a mutually agreeable settlement by helping them to sharpen …

Evolution Of Buyer Representation: Factors Reshaping Real Estate Transactions In The Boston Area, Hunter Wolters
Honors Projects in Management
This study investigates the evolving factors influencing real estate buyers' decisions to engage with real estate agents in the Boston area. By focusing on agent characteristics, legal considerations, market trends, and technological advancements, this research aims to understand how these elements are reshaping the role of buyer agents. As factors reshaping buyer’s decisions in real estate transactions remain fluid especially in the wake of the NAR Settlement, this study will research current opinions of both homebuyers and real estate agents. The objective is to provide insights into the shifting standards of buyer representation in the real estate industry and their …

Prison Privatization And Its Impacts On Inmate Quality Of Life: An Analysis Through Logan's Eight Dimensions Model, Hafsa Ahmed
Prison Privatization And Its Impacts On Inmate Quality Of Life: An Analysis Through Logan's Eight Dimensions Model, Hafsa Ahmed
Master in Public Administration Theses
This capstone paper delves deeply into the ramifications of prison privatization on inmates' quality of life in contracted immigration detention facilities. With the increasing inclination towards privatizing correctional institutions, especially immigration detention centers, a rigorous evaluation is indispensable to ascertain the ramifications of such privatizations on the welfare of incarcerated individuals. In this exploration, Logan's quality of confinement model is meticulously applied to selected immigration detention centers to scrutinize the living conditions and reveal profound insights into the quality of life experienced by inmates. This model allows a structured assessment of various dimensions such as safety, order, care, activity, management, …

The Gaps Between The Pillars And Practice: Prevention Of And Responses To Gender Based Violence In South Africa, Madeleine Morrison
The Gaps Between The Pillars And Practice: Prevention Of And Responses To Gender Based Violence In South Africa, Madeleine Morrison
Independent Study Project (ISP) Collection
This study investigates how gender-based violence (GBV) is understood, prevented, and responded to in South Africa, with a focus on national frameworks, institutional practices, and broader sociopolitical dynamics. Grounded in feminist, decolonial, and intersectional methodologies, the research draws primarily from document and discourse analysis—centered on the National Strategic Plan on Gender-Based Violence and Femicide (NSP on GBVF)—alongside a written interview with a professional working in the gender justice field. Despite outreach to over 40 individuals and organizations, direct participation was limited, reflecting wider issues of burnout, institutional gatekeeping, and resource constraints in the GBV sector.
The findings reveal that while …

Biglaw's Race Problem, Angela Onwuachi-Willig, Anthony V. Alfieri
Biglaw's Race Problem, Angela Onwuachi-Willig, Anthony V. Alfieri
Articles
Ever since the 1970s when BigLaw firms began to hire Black lawyers into their associate ranks, these firms have wrestled with problems in both recruiting and retaining Black associates. During the ensuing decades, BigLaw firms have minimally increased the low numbers of Black attorneys who have become partners, particularly equity partners, within their organizations. Numerous scholars have explored how racial bias and discrimination, both within BigLaw firms and greater society, have contributed to such failures in the recruitment, retention, and promotion of Black lawyers. In his new book The Black Ceiling: How Race Still Matters in the Elite Workplace, Professor …

If You Cannot Afford An Attorney, None Will Be Appointed For You: Exploring Rates Of Representation By Counsel In Texas Misdemeanor Courts, Andrew L. B. Davies, Shelby Sirivore, Victoria M. Smiegocki
Deason Center Reports
All misdemeanor defendants in the United States have the right to be represented by a lawyer if they are facing the possibility of incarceration. Yet implementation of that right is often left to local policymakers, and rates of non-representation (defendants proceeding without lawyers) vary enormously. Through an examination of data from Texas counties in 2019, we find non-representation rates were highest in the state’s poorest and most rural counties. But we also find signs that local policy choices matter. Counties with public defender offices, and those with less restrictive policies on financial eligibility for indigent defense services, appointed lawyers to …
Rulemaking Behind Closed Doors: Governor Abbott’S Secret Rulemaking. Worse Yet, All State Agencies Are Colluding With The Governor, Ronald Beal
SMU Law Review Forum
In 2019, the Texas Legislature granted the Governor new powers to review the rulemaking process for certain state agencies. Since then, the Governor has apparently extended this authority of review over the rulemaking process to more agencies than he was authorized to. Some journalists and scholars, including this Author, have attempted to access the proposals and comments submitted to the rulemaking process by the Governor’s Office—and yet the records are withheld by the Texas Attorney General under claimed exceptions to the Texas Public Information Act. Despite the Attorney General’s claims, this Author and others maintain that any records of these …

Think, Reflect, Refine: Shaping The Modern Lawyer, Camesha Little
University of the District of Columbia Law Review
Modern law students are entering the profession during an era when our society is fraught with many atrocities. These societal challenges come at a time when students are increasingly engaged in more social advocacy. Modern law students are also coming into legal training with skills and resources different from those of generations in the past. Additionally, almost daily, our newsfeeds are littered with headlines about the benefits, challenges, and fears of integrating generative artificial intelligence (“AI”) into our world. The legal system is not immune to this conversation. There have been discussions about how generative AI, such as ChatGPT, will …
Beyond Human Discretion: Reconciling Ai Systems With Traditional Legal Frameworks, Daniel Ikem
Beyond Human Discretion: Reconciling Ai Systems With Traditional Legal Frameworks, Daniel Ikem
University of the District of Columbia Law Review
In February 2023, attorneys representing a plaintiff in a personal injury case against Avianca Airlines submitted a legal brief containing multiple citations to nonexistent judicial decisions generated by ChatGPT. When questioned by the court, the attorneys admitted they had relied on research generated by artificial intelligence (AI) without verification, resulting in sanctions and reputational damage. Mata v. Avianca both represents professional negligence by legal professionals and a complex intersection of human and artificial intelligence. Unlike traditional research tools that retrieve existing information, generative AI (GAI) creates novel content that appears authoritative, introducing unique verification challenges that traditional ethical frameworks did …
Encouraging Expanded Producer Responsibility In Agricultural Labor Relations, Emma I. Scott
Encouraging Expanded Producer Responsibility In Agricultural Labor Relations, Emma I. Scott
William & Mary Environmental Law and Policy Review
Over two million farmworkers provide essential support to the country’s food system. As detailed below, their current working conditions, living conditions, and legal protections do not reflect the importance of their contributions. As regulations and enforcement have fallen short in securing their rights and economic position, public incentive schemes can encourage improvements and equip grower-employers to reverse the race to the bottom and instead become leaders in providing dignified work opportunities. This Article looks at recent attempts and opportunities to leverage federal policies and programs to incentivize this type of leadership. It proposes that the U.S. Department of Agriculture (USDA) …
Beyond Climate Change: A Model Of Sustainable Development For The Maritime Industry, David Adkins
Beyond Climate Change: A Model Of Sustainable Development For The Maritime Industry, David Adkins
Plymouth Business School
Recent discussions on sustainable development in the maritime industry have focused on climate change, emissions reduction, and future fuels. While vital for global trade and climate management, these topics are only part of the broader sustainable development agenda. The United Nations Sustainable Development Goals (UN SDGs) highlight the need to expand this conversation. Through a series of interviews, this study aims to develop a sustainable development model tailored to the maritime industry. Defining the maritime industry, and contextualising sustainable development to the sector provides significant challenges. The industry’s diversity complicates any definition as it encompasses shipping, maritime services, shipbuilding, education, …
Legal Market Decartelization, Milan Markovic, Nuno Garoupa
Legal Market Decartelization, Milan Markovic, Nuno Garoupa
Faculty Scholarship
American lawyers’ grip on the legal market is receding. Scholars and policymakers increasingly agree that the public has little to lose and potentially much to gain from legal market decartelization - the weakening of the lawyers’ monopoly over the legal services market. Harkening to deregulatory initiatives abroad and in Arizona and Utah, reformers contend that removing restrictions on the corporate delivery of legal services and unauthorized practice of law will slash costs and expand access to justice.
Drawing on economic theory and recent market developments, this Article offers a cautionary rejoinder. Understandable concerns about cartelization and lawyer rent-seeking have led …
Abuse, Neglect, And Abandonment: The Need To Protect Immigrant Minors Through Standardized Definitions, Bailey Morris Gurr, Lila Bird Williams
Abuse, Neglect, And Abandonment: The Need To Protect Immigrant Minors Through Standardized Definitions, Bailey Morris Gurr, Lila Bird Williams
Brigham Young University Prelaw Review
Special Immigrant Juvenile Status (SIJS) applications are inconsistently adjudicated across states due to varying definitions of abuse, neglect, and abandonment. This inconsistency creates geographic disparities in protection, leaving vulnerable immigrant minors at risk of deportation; in the worst-case scenario, children who meet the criteria in one state may be denied in another and sent back to unsafe or life-threatening conditions. This paper argues for federal oversight to standardize SIJS criteria by amending the Child Abuse Prevention and Treatment Act (CAPTA) to establish unambiguous definitions of abuse, neglect, and abandonment, ensuring fair and consistent adjudication nationwide. Legal scholars widely recognize the …
Familial Fairness: Guaranteeing The Right To Counsel For Indigent Parents In Juvenile Dependency Proceedings, Jake Toth
Dickinson Law Review (2017-Present)
Fairness principles enumerated in the seminal case Gideon v. Wainwright stand for the proposition that fundamental fairness and due process require appointment of counsel for indigent litigants. However, this principle has been constrained to criminal contexts. Many other types of litigation are just as impactful as a criminal proceeding, including juvenile dependency proceedings. Nevertheless, indigent parents do not enjoy an unqualified representation right.
This Comment traces the history of the representation right and how it has been treated in a juvenile dependency context, beginning with Gideon itself and examining other cases such as Eldridge and Lassiter. It then examines …

Between Borders And Belief: Perspectives Of Aid Workers On Religion In A Migrant Shelter In Mexico, Kendall O. Roy
Senior Theses
This thesis seeks to understand the significance of religion in the Central American migration context through the eyes of humanitarian aid workers. It is based on interviews that I conducted in May of 2024 with staff members at a migrant shelter in Mexico, analysis of prior scholarship, and building upon an understanding of relevant religious history in Latin America. I will delve into trends that the aid workers observed in areas such as religious practices and beliefs of migrants, shelter functions that addressed and nurtured spiritual well-being, and the influence of the Church as an institution on humanitarian aid work. …

You Can Never Have Too Many Flowers: Nature As A Support For Survivors Of Genocide, War, And Conflict, Adam Hettler
School of Education and Leadership Student Capstone Projects
One in five children around the world are surviving war or other violent conflicts. The trauma of disruptions to community, safety, and loss of friends, family, and home can have wide-ranging and life-long impacts on children who survive. While impacts will vary from individual to individual, the trauma can impact mental health, feelings of safety, relationships, ability to learn, and many other aspects of their lives. Many educators in the US and globally are working with refugee students or other students who are navigating the impacts on their brains and bodies of different traumas. This project seeks to answer the …

One More Neighbor: Utilizing Legal Services For Holistic Immigrant Care, Mitch Mcgeath
One More Neighbor: Utilizing Legal Services For Holistic Immigrant Care, Mitch Mcgeath
Christian Ministries Senior Capstone
This paper rests upon the assumption that local churches in the United States have a critical role to play in obeying the command of Jesus to care for immigrants. I argue for a ministry that combines the mission of Jesus with the compassion of Jesus by bringing together immigration legal services with opportunities to disciple our “neighbors,” immigrants who live in close proximity to our church site. One More Neighbor is a ministry within One More, the missions non-profit of Church at the Crossing on the northwest side of Indianapolis, Indiana. The ministry of One More Neighbor is explored systematically …
