Doctoral Dissertations and Projects

Graduate medical education now places a greater emphasis on learning efficiency and effectiveness. The increased use of advanced technology for modern learners and resident work hour restrictions have played a central role. An otolaryngology core curriculum has recently been introduced for use by otolaryngology training programs. The sample population is composed for otolaryngology residents from four otolaryngology residency programs. Data will be collected for each participant via anonymous review from each program. This paper examines the impact of the otolaryngology core curriculum and its use of advanced technology on resident learning as measured by learner satisfaction scores (Educational Practices Questionnaire …

Faculty, Staff and Students Publications

Xylazine is a veterinary sedative increasingly found in the U.S. illicit drug supply and is a growing public health concern due to its association with overdose events. To investigate its spatial distribution and relationship with fentanyl use, we analyzed 124 wastewater samples from four treatment plants serving the City of El Paso, Texas, over 13 months (June 2023 to July 2024) using liquid chromatography tandem mass spectrometry. Xylazine detections varied across sewersheds, with detection rates of 29.0%, 12.9%, 9.7%, and 0% and peak loads of 110±40 μg/day/1000 people. Norfentanyl (a primary fentanyl metabolite) was detected in all samples (100%), reaching …

Proportionality And Theft, Christopher T. Wonnell Feb 2026

Proportionality And Theft, Christopher T. Wonnell

San Diego Law Review

Criminal law can serve a variety of utilitarian purposes including deterrence, incapacitation, and rehabilitation.  Nevertheless, there is broad agreement among criminal justice scholars that the pursuit of these purposes should be constrained by a requirement that punishment not be disproportionately severe relative to the offense charged.  The proportionality constraint is likely to be especially important when considering the less heinous predatory crimes such as nonviolent thefts.  Recent years have seen experiments by progressive prosecutors who deemphasize theft offenses as well as statutory schemes that treat many thefts as misdemeanors.  With some empirical support, critics charge that these experiments have increased …

Passive Choice And The Fourth Amendment, A. Shea Daley Burdette Feb 2026

Passive Choice And The Fourth Amendment, A. Shea Daley Burdette

San Diego Law Review

Does the Constitution allow waiver of Fourth Amendment rights through passive choice? What about through the choice of others? Based on current Supreme Court precedent, the answer is frustratingly unclear. For example, a copious amount of information is constantly disclosed to phone companies. The Supreme Court has recognized that having a cell phone is an inescapable choice today and that disclosing one’s location information to the cell phone company is automatic in nature. Each fact is considered relevant to determining whether an individual has a reasonable expectation of privacy in the information disclosed to third parties—which then affects whether the …

What Is Happening In The World Today And Why: Humanity’S Evolving Consciousness And The Role Of Archetypal Energies As Guides During An Unfolding, Carroy U. Ferguson

Journal of Conscious Evolution

What is happening in the world today and why? Humanity is evolving its consciousness at individual and collective levels. Given these seemingly tumultuous times, as of this writing (January 2026), to make such a statement may sound like a strange thing to say. However, I suggest that if you are alive today and if you are reading these words, these are the very times for which you were born—to assist Humanity as it evolves its consciousness with your unique gifts, whatever they may be. That is, this period of our individual and collective human being-ness may be characterized as an …

Unilateral Pulmonary Edema Following Minimally Invasive Valve Surgery Via Right Thoracotomy: A Word Of Caution, Arifi Aa, Ahmed Munir Metwaly, Fayez F. Al Mutairi, Bandar Zamzami, Islam Shalaby

Journal of the Saudi Heart Association

We report the first case of unilateral pulmonary edema (UPE) in our series of 150 patients undergoing minimally invasive mitral and tricuspid valve surgery via right thoracotomy. A 30-year-old female with rheumatic heart disease developed UPE requiring temporary extracorporeal membrane oxygenation (ECMO) support postoperatively. The patient recovered uneventfully and was discharged on postoperative day 15. This case underscores the importance of recognizing and mitigating UPE in minimally invasive cardiac surgery (MICS).

Father Of The Bride: Vindicating Deanda’S Claim Against 42 C.F.R. § 59.10(B), Matthew S. Mcguire

Helms School of Government Undergraduate Law Review

Across the judicial landscape of U.S. Circuit Courts of Appeals, no state shall deprive any person of life, liberty, or property, without due process of law or at the prerogative of Congress and HHS. Veiled behind the complexity of administrative law, 42 C.F.R. § 59.10(b) precludes parental consent notifications for all Title X services for all parents. In 2020, the HHS Final Rule came to light after the District Court for the Northern District of Texas vacated the directive. Although the 5th Circuit affirmed and reversed in part, HHS does not enforce § 59.10(b) in Texas. For the rest of …

Fi-Fractured Policy: Problematic Preemption Provisions Under The Epa’S Fifra, Eric Mathemeier

Helms School of Government Undergraduate Law Review

The American people have long believed that nutrition is the main factor they should consider when purchasing produce. However, Americans are starting to worry that pesticides are infiltrating their food, namely their fruits and vegetables, and they would not be incorrect. Across many studies, surveys consistently find that 60% of Americans believe pesticides are bad for their health and have admitted to refraining from buying produce due to pesticide labeling. Only one in four Americans trusts the federal government with the responsibility of trustworthy and safe pesticide use.

Because of this, the United States Environmental Protection Agency (EPA) has worked …

Building And Sustaining Chosen Family Amongst Low-Income First-Generation Engineers, Justin C. Major Feb 2026

Building And Sustaining Chosen Family Amongst Low-Income First-Generation Engineers, Justin C. Major

First-Generation Symposium

Support is integral for low-income first-generation student success in and out of engineering, particularly because of the role support plays in building belonging. Students receive support from many individuals including their traditional and chosen families. While traditional family are those family “assigned at birth,” chosen family are those family you pick and choose, inclusive of teachers, friends, and others. Our research group’s (ASPIRE) extensive work on the topic has documented how chosen family come to be and why they are important for low-income first-generation success. Amongst many components, we have found that chosen family are more trustable given their authenticity …
