Following China’s Operation National Sword in 2018, the politics and economics of recycling have increasingly come under scrutiny as many examine whether it remains a worthwhile endeavor. Differences across municipalities, changing prices of goods, contamination, mislabeling, and involvement by the plastics industry has further confused the issue. This paper examines to what extent a national recycling policy would be effective and what form it may take using several case studies - whether it be mandatory recycled content minimums, extended producer responsibility, or allowing the industry to phase out completely,

Throughout the early 20th century, the relationship between higher education and the spread of epidemic disease evolved in the United States. Two notable epidemics of scarlet fever in 1915 and 1920 serve as a lens through which the larger roles of disease and higher education can be analyzed. By assessing the roles both the administration and the students played at Gettysburg College, then Pennsylvania College, historians can understand the process of combating health crises in the future. Hyperbaric Oxygen Therapy (HBOT) has been around since the 1860s and is now a well-established form of treatment. HBOT has been proven to be a safe therapeutic option and has been successful in treating non-healing wounds, traumatic wounds, and radiation-induced wounds. There has also been success in treating other conditions such as inflammatory bowel disease, carbon monoxide poisoning, and decompression sickness with HBOT. The way HBOT works is by exposing the body to 100% pure oxygen in a closed chamber, which exceeds normal atmospheric pressure by two to three times. With HBOT, large amounts of oxygen enters the body, which …

The Links Between Relationship Maintenance Strategies And Psychological Well-Being In The Context Of Ambivalent Relationships, Stephen M. Yoshimura, Danielle Farley, Kellie Hofstetter, Hillary Loney, Randi Wichman

This study examined the extent to which maintaining ambivalent relationships with specific types of relationship maintenance behaviors relates to states of psychological distress and well-being. Survey data from 206 participants indicated that ambivalence toward a relationship partner associated with increased negative affect, and although ambivalence by itself did not relate to any specific relational maintenance behavior, the reported use of positivity to maintain such relationships inversely related to levels of negative affect and depression, whereas the use of openness related to increased levels of negative affect, increased depression, and reduced levels of overall life satisfaction. Thousands of bills are introduced in state legislatures every year and there are a multitude of reasons as to why some of those bills become law and some do not. Female sponsorship and the intersectionality of female sponsors are the focus of my research. Previous research has found variable impact of these characteristics; however, little work has been done on the combined effects of race, gender, and partisanship on bill passage rate. The novel coronavirus significantly impacted the lives of people worldwide. In the United States, the lives of children and youth were disrupted with school closures and lack of access to afterschool programs they previously attended. African American and Hispanic boys attending an after-school program in Franklin County, Kentucky, called Please Call Me Mister, were among the young people affected. A study was conducted to assess the impact of the afterschool program. The boys were surveyed at the start of the program in November 2017 and again in November 2020 to assess their injury risk, substance use, future orientation, resilience, and …

Surviving COVID19 (Increased Domestic Violence, Marginalized Communities, and Innovative Solutions) Domestic violence generally refers to violence occurring between residences within one single location. Intimate partner violence is domestic violence by a current or former spouse or partner in an intimate relationship against the other spouse or partner. IPV can take several forms, including physical, verbal, emotional, economic, and sexual abuse. Non-Profit organizations must find ways to divide their budgets between staff wages and program services, as well as paying their staff a living wage. Unlike for-profits who can increase prices for consumers when they need to increase staff wages, non-profits do not have this luxury. The goal of this project was to collect data on how non-profits manage their budgets and if they provide staff with living wages. A survey was sent out with a total of eight responses, giving a breakdown of various non-profit’s budgets and if they pay a living wage. Overall, seven out of eight non-profits pay …

Background: Creating a positive experience for the new nurse during the orientation period is vital in ensuring safe practice, employee satisfaction, and improved self-efficacy and retention of the employee long-term. Problem: At a 245-bed acute care hospital in the southeastern United States, nursing retention and preceptor practices have surfaced as an opportunity for improvement. Methods: A quality improvement project involving the implementation of an evidence-based preceptor program with formal preceptor education, preceptor application, and a standardized feedback tool was evaluated to determine the effect on preceptor/preceptee self-efficacy, intent to stay, and preceptor engagement. Listeria monocytogenes is a foodborne pathogen commonly found in ready-to-eat deli and dairy products. This foodborne pathogen is responsible for the disease listeriosis, which disproportionately impacts immunocompromised individuals. This research aims to evaluate how natural intestinal environments influence the pathogenesis of Listeria. One particular environmental condition that has a well-documented effect on Listeria is varying levels of oxygen. Specifically, anaerobic exposure during the growth of Listeria greatly impacts subsequent intracellular pathogenesis. When grown and adapted under anaerobic conditions, Listeria overall exhibits decreased intracellular survival and decreased cell to cell spread. However, the presence of propionate, a natural byproduct of fermentation …

There are few civil procedure laws broadly authorizing trial courts in the United States to consider presuit requests seeking protection from discovery sanctions or spoliation claims in later civil actions. There should be more laws on presuit protective orders addressing information maintenance, preservation, and production.
New presuit protective order laws are most apt where there have been demands by potential adversaries involving alleged information preservation duties under civil discovery laws or under substantive spoliation laws; where the recipients have strong reasons to secure early judicial clarifications; and where the availability and use of presuit protective orders will serve both private …

Gig work—the selling or renting of labor, effort, skills, and time outside of traditional employment—is a long-standing feature of the U.S. economy. Today, millions of “online gig workers” sell goods and services, or rent rooms, houses, vehicles, and other assets using app-online and app-based platforms (for example, Uber, Lyft, Rover, DoorDash, eBay, Etsy, Postmates, VRBO, and Airbnb) to connect with customers. Millions more of “offline gig workers” run errands; walk dogs; care for children and the elderly; do housework, yardwork, and other occasional jobs; rent rooms; and sell goods at outdoor markets and roadside stands—without using online platforms to connect …

In this Article, I propose a new standard for determining what constitutes assent, as a matter of contract formation, within the domain of electronic consumer contracting. The threshold test should reject the “take-it-or-leave-it” arrangement dominant in the marketplace and reified by recent proposals before the American Law Institute (“ALI”) under the moniker “blanket assent.” The new standard should reject blanket assent in favor of a default rule that would require any electronic form proposing contract terms to permit at least a minimal amount of negotiation around terms seeking waiver of rights from consumers. Lawyers’ ethical duty of confidentiality is a fundamental aspect of the attorney-client relationship. It is also an extraordinarily broad duty; indeed, it is broader than the attorney-client privilege. So extensive a duty of confidentiality is necessary to encourage clients to trust their lawyers and to be candid with them. Determining The Appropriate Reach Of Escobar's Materiality Standard: Implied And Express Certification, Jake Summerlin

In 2016, the Supreme Court altered the landscape of the False Claims Act by recognizing implied certification as a viable theory of liability. Before the Court decided Universal Health Services, Inc. v. United States ex rel. Escobar, courts disagreed over the scope and legitimacy of the theory, arguing that it could create runaway liability if not held in check. The Court, although recognizing that implied certification expanded the reach of the False Claims Act, reassured itself and government contractors by reinforcing the common law antecedents of fraud, namely, that misrepresentations and omissions must be material to the government’s decision …

The area of products liability has been the subject of intense debate for the past half-century, perhaps never more strongly than the decades comprising the second half of the twentieth century. Specifically, the 1970s was the decade that introduced the judicial community to this debate. In the 1970s and a few decades prior, consumerism skyrocketed to levels never seen before in the United States and in the world. In Israel, as in other developed countries, mental health problems are common among older adults who are members of disadvantaged ethnic minorities that are experiencing cultural and social changes. The main goals of the current study were: (a) to examine gender differences in the levels of psychological distress and social support among Bedouin elders, and (b) to examine the moderating role of gender in the associations between social support indices and psychological distress.
