Background: Community engagement is crucial for the design and implementation of community-based early childhood development (ECD) programmes. This paper aims to share key components and learnings of a community engagement process for an integrated ECD intervention. The lessons shared are drawn from a case study of urban informal settlement with embedded refugees in Nairobi, Kenya.

Methods: We conducted three stakeholder meetings with representatives from the Ministry of Health at County and Sub-County, actors in the ECD sector, and United Nations agency in refugee management, a transect walk across fve villages (Ngando, Muslim, Congo, Riruta and Kivumbini); and, six …

Constitutional Cautions Post-Covid-19: A Proposal For 5th Amendment Protection From Police Power Overreach, Ethan Finster, Jessica Dofelmire, Editor Apr 2022

Constitutional Cautions Post-Covid-19: A Proposal For 5th Amendment Protection From Police Power Overreach, Ethan Finster, Jessica Dofelmire, Editor

Brigham Young University Prelaw Review

The invocation of police powers by state governments throughout the Covid-19 pandemic to restrict business activity created a legal protection around government action that prevents 5th Amendment claims. This protection persists whether or not those actions fit within precedential criteria for takings. While police powers are certainly an important aspect of governance in times of crisis, the infringement of individuals’ constitutional rights that accompanied their utilization must be addressed. Moreover, their use during the pandemic set a potentially dangerous precedent for their use in future emergencies. Considering the growing concern surrounding the adequacy of Takings Clause precedent for preventing government …

Ambiguity In Legal Non-Conforming Use Statuses, Zeke Peters Apr 2022

Ambiguity In Legal Non-Conforming Use Statuses, Zeke Peters

Brigham Young University Prelaw Review

Legal nonconforming uses have similar definitions and codes throughout the United States. However, certain restrictions and rules can vary so much that ambiguity makes the truth harder to see. Many nonconforming uses are limited in their “expansion” or “enlargement.” However, what defines these terms is unclear in various codes across state lines. This paper proposes a framework for cities to adopt to have a more uniform definition with some exemptions of these terms. While planning and land use code should vary based on the specific needs of each municipality, this framework definition can help create a more concrete definition for …

Adult Conservatorship In The United States: Flaws And Proposed Solutions To The Legal System, Margaret Sheffield, Alex Stevens Apr 2022

Adult Conservatorship In The United States: Flaws And Proposed Solutions To The Legal System, Margaret Sheffield, Alex Stevens

Brigham Young University Prelaw Review

Despite attempts to protect incapacitated adults in the United States, financial exploitation of the elderly and disabled remains a serious problem. Adult conservatorships are often established to offer incapacitated adults protection. However, many cases of adult conservatorships lead to increased abuse due to lack of accountability from conservators. This paper provides a brief overview of abuse towards incapacitated adults and proposes a solution in the form of a federal office entitled the Office of Adult Conservatorship and Guardianship Enforcement (OACE) which would be established under the United States Department of Health and Human Services.

Modernizing The Birds And The Bees: New Standards For Sexual Education, Ashley Whetten, Katie Whitehead Apr 2022

Modernizing The Birds And The Bees: New Standards For Sexual Education, Ashley Whetten, Katie Whitehead

Brigham Young University Prelaw Review

Conversations surrounding sexual education usually revolve around comprehensive sexual education curricula and abstinence-only until marriage curricula. These conversations and the federal funding budgets that developed from these programs prevent innovation and modernization of sexual education programs. Furthermore, research has demonstrated major flaws in both curricula. This paper does not argue for one approach to sexual education over another; instead, the proposals in this paper aim to bridge long-standing disputes on sexual education by creating a new standard of sexual education that also addresses the major downfalls of both current curricula. In order to qualify for funding the program would require …

The Shadow Docket: What Is Happening And What Should Be Done, Collin Mitchell Apr 2022

The Shadow Docket: What Is Happening And What Should Be Done, Collin Mitchell

Brigham Young University Prelaw Review

In light of recent emergency decisions made by the Court ranging from issues addressing the COVID-19 pandemic, religious freedom, abortion rights, and polarized redistricting plans, the Supreme Courts use of the shadow docket has come under renewed scrutiny. This paper argues that the Court's use of the shadow docket, while permissible in the past, is threatening the legitimacy of the Supreme Court and unduly burdening the American Judicial System at large. Due to these effects, this paper advocates to reduce the Supreme Court's use of the shadow docket through the creation of a new specialized court system to handle emergency …

Making The Case For Paid Parental Leave In The United States, Jane Johnson, Sarah Calvert Apr 2022

Making The Case For Paid Parental Leave In The United States, Jane Johnson, Sarah Calvert

Brigham Young University Prelaw Review

Despite being one of the most influential countries in the world, the United States is still one of only three developed countries that does not mandate paid parental leave on a federal level. Although some federal legislation does offer unpaid leave, these laws are insufficient to meet the needs of working parents. This paper examines existing parental leave laws to highlight the duration of leave and methods of funding used by some U.S. states and other countries worldwide. We also review multiple studies that demonstrate benefits of paid parental leave for both parents and children. This paper ends with a …

Crossing Borders: The Overlap And Conflict Of International And Domestic Laws Regarding Refugees And Asylum Seekers, Yunha Hwang, Belle De La Rosa, Editor Apr 2022

Crossing Borders: The Overlap And Conflict Of International And Domestic Laws Regarding Refugees And Asylum Seekers, Yunha Hwang, Belle De La Rosa, Editor

Brigham Young University Prelaw Review

The policies of the United States regarding refugees and asylum seekers within the past decade have consistently conflicted with international standards, in regards to the 1951 Refugee Convention and the following 1967 Protocol. Especially in recent years, the United States has been producing a line of increasingly exclusive policies and caps that hinder the resettlement process and as a result, has been causing increased violations against the principles listed in Article 14 of the Universal Declaration of Human Rights (1948). The paper analyzes the discrepancy and overlap between international laws and domestic laws in the United States. Especially at a …

The Constitutionality Of The Title Ix Religious Exemption, Madelyn Jacobsen, Rebecca Batty, Editor Apr 2022

The Constitutionality Of The Title Ix Religious Exemption, Madelyn Jacobsen, Rebecca Batty, Editor

Brigham Young University Prelaw Review

Petitioners in Hunter v. Department of Education questioned the constitutionality of the Title IX religious exemption as the basis of their 2021 class-action lawsuit. They claimed that more than 30 religious schools maintained discriminatory policies against LGBTQ students under the exemption. The religious exemption, often painted as unconstitutional discrimination, permits religious schools' adherence to sincerely held religious beliefs—and promotes a distinctive religious education that secular schools lack. This paper examines legal precedents relevant to religious freedom, higher education, and discrimination that demand the Title IX religious exemption remains in effect.

Administrative Investigations, Aram A. Gavoor, Steven A. Platt Apr 2022

Administrative Investigations, Aram A. Gavoor, Steven A. Platt

Indiana Law Journal

This Article establishes the subject of federal administrative investigations as a new area of study in administrative law. While the literature has addressed investigations by specific agencies and congressional investigations, there is no general account for the trans-substantive constitutional value of administrative investigations. This Article provides such an account by exploring the positive law, agency behaviors, and constraints pertaining to this unresearched field. It concludes with some urgency that the Administrative Procedure Act of 1946—the statute that stands as a bill of rights for the Administrative State—does not serve to regulate administrative investigations and that Article III courts have held …

The "Divisive Concepts" Laws And Americans Of Asian Descent, Ilhyung Lee Apr 2022

The "Divisive Concepts" Laws And Americans Of Asian Descent, Ilhyung Lee

SMU Law Review Forum

In the past year, a number of states have enacted laws that prohibit public schools from teaching certain lessons about race. The main target of these laws appears to be “critical race theory,” once a theory advanced in legal academia that has now become a “catchall term” for discussions of race and racism. The states mean business and seek to enforce their new or proposed laws by prohibiting state funding for teaching the banned content, withholding funding to local educational agencies or schools in violation, subjecting offending teachers to disciplinary action, and allowing those aggrieved to bring an action at …

Pharmacy

The heterogeneous nature of multiple sclerosis (MS) and the unavailability of treatments addressing its intricate network and reversing the disease state is yet an area that needs to be elucidated. Liraglutide, a glucagon-like peptide-1 analogue, recently exhibited intriguing potential neuroprotective effects. The currents study investigated its potential effect against mouse model of MS and the possible underlying mechanisms. Demyelination was induced in C57Bl/6 mice by cuprizone (400 mg/kg/day p.o.) for 5 weeks. Animals received either liraglutide (25 nmol/kg/day i.p.) or dorsomorphin, an AMPK inhibitor, (2.5 mg/ Kg i.p.) 30 min before the liraglutide dose, for 4 weeks (starting from the …

The Role Of Whole Blood Transfusions In Civilian Trauma: A Review Of Literature In Military And Civilian Trauma, Shane Kronstedt, Joon Lee, David Millner, Connor Mattivi, Halli Lafrankie, Lorenzo Paladino, Jeffrey Siegler

Open Access Publications

Resuscitation techniques for the management of adult trauma patients have evolved over the 20th century. Whole blood transfusions were previously used as the standard of care, whereas blood component therapy is the current method employed across most trauma centers across the United States. Prior to the transition, no studies were conducted to show improved efficacy of hemostatic potential in trauma patients. Recent conflicts in Iraq and Afghanistan have challenged the dogma that whole blood transfusions are not the standard of care and have shown potential as the superior transfusion product for adult trauma patients. The purpose of this review is …

The Best Data Plan Is To Have A Game Plan: Obstacles And Solutions To Reaching International Data Privacy Agreements, James Y. Wang Apr 2022

The Best Data Plan Is To Have A Game Plan: Obstacles And Solutions To Reaching International Data Privacy Agreements, James Y. Wang

Michigan Technology Law Review

The modern digital world relies on the instantaneous transfer of data. This digital highway is essential for the growth of the modern digital economy and contributes to the rise of globalization. In order to facilitate these data transfers, ground rules must first be put into place. To date, there are few, if any, binding international data privacy agreements. This is in part due to practical considerations, such as high administrability costs, inadequate enforcement agencies, and complex jurisdictional procedures. More fundamentally, however, this is due to competing incentive structures, as countries are incentivized to protect their own digital sovereignty by limiting …

Exploring Discourse Markers As A Treatment Outcome Measure For Aphasia, Anna K. Cedoz Apr 2022

Exploring Discourse Markers As A Treatment Outcome Measure For Aphasia, Anna K. Cedoz

Masters Theses

Discourse Markers (DMs) are communicative tools or resources that people use to organize conversations. The use of DMs among individuals with aphasia has been documented to support their communicative competence (Simmons-Mackie & Damico, 1996). Further research on the use of DMs by individuals with aphasia has been limited. The current study features a secondary analysis using existing data from Devanga (2020), which studied the effects of Collaborative Referencing Intervention (CRI; Hengst et al., 2010) on three participants with chronic aphasia. This study analyzed 18 conversation probes from one participant across baseline, treatment, and maintenance phases with clinician and spouse partners. …

Baroreflex Sensitivity In Facioscapulohumeral Muscular Dystrophy, Miguel Anselmo, Shandon Coffman, Mia Larson, Kathryn Vera, Emma Lee, Mary Mcconville, Michael Kyba, Manda L Keller-Ross Apr 2022

Baroreflex Sensitivity In Facioscapulohumeral Muscular Dystrophy, Miguel Anselmo, Shandon Coffman, Mia Larson, Kathryn Vera, Emma Lee, Mary Mcconville, Michael Kyba, Manda L Keller-Ross

Department of Medicine Faculty Papers

Facioscapulohumeral muscular dystrophy (FSHD), a common form of muscular dystrophy, is caused by a genetic mutation that alters DUX4 gene expression. This mutation contributes to significant skeletal muscle loss. Although it is suggested that cardiac muscle may be spared, people with FSHD have demonstrated autonomic dysregulation. It is unknown if baroreflex function, an important regulator of blood pressure (BP), is impaired in people with FSHD. We examined if baroreflex sensitivity (BRS) is blunted in patients with FSHD. Thirty minutes of resting BP, heart rate, and cardiovagal BRS were measured in 13 patients with FSHD (age: 50 ± 13 years, avg …

Ten-Year Safety Of Pluripotent Stem Cell Transplantation In Acute Thoracic Spinal Cord Injury., Stephen L Mckenna, Reza Ehsanian, Charles Y Liu, Gary K Steinberg, Linda Jones, Jane S Lebkowski, Edward Wirth, Richard G Fessler

Department of Medicine Faculty Papers

OBJECTIVE: The purpose of this study was to evaluate the safety of oligodendrocyte progenitor cells (LCTOPC1) derived from human pluripotent stem cells administered between 7 and 14 days postinjury to patients with T3 to T11 neurologically complete spinal cord injury (SCI). The rationale for this first-in-human trial was based on evidence that administration of LCTOPC1 supports survival and potential repair of key cellular components and architecture at the SCI site.

METHODS: This study was a multisite, open-label, single-arm interventional clinical trial. Participants (n = 5) received a single intraparenchymal injection of 2 × 106 LCTOPC1 caudal to the epicenter of …

Student Publications

Chen Zi-Ang was a young man who had long black hair and black eyes. When appearing in public, as long as he had the conditions to do so, he bound his long, black hair in the common hairstyles among his contemporary Chinese men. Nevertheless, when in situations such as resting in his bed because of his long-term illness, his long, black hair was often untied. For a long time, Chen was very thin, and he had suffered from long-term physical illness. Chen's physical appearance further included most if not all of these characteristics: a light skin color, a comparatively soft …

Social Security Benefits Continue To Fall Short Of Covering Cost Of Basic Needs For Older Americans, 2021, Jan Mutchler, Nidya Velasco Roldán

Center for Social and Demographic Research on Aging Publications

Social Security benefits fall short of what is required to cover the basic cost of living across the United States, according to new estimates based on the Elder Index, a county-by-county measure of the income older adults need to secure an independent lifestyle. Nationally, the average Social Security benefit covers just 68% of basic living expenses of housing, food, transportation, and health care for a single renter in 2021, and 81% for an older couple. The gap between Social Security benefits and what it takes to get by is especially problematic for older adults who rely largely or entirely on …

Brown Fat In Humans: The Significance Of Thermogenic Active Tissue, Brett T. Swanson Apr 2022

Brown Fat In Humans: The Significance Of Thermogenic Active Tissue, Brett T. Swanson

Student Publications

Brown adipose tissue is a metabolically active form of fat in the body that performs a crucial function in non-shivering thermogenesis. It can be compared to the prevalent white adipose tissue which is generally understood to be energy storage in the body, with brown tissue performing an opposing role. The tissue itself contains unique gene and protein markers such as uncoupling protein 1 (UCP1) which allows for the thermogenic process inside the cell, burning lipids to do so. These gene and protein markers have proven to be crucial in the detection of brown adipose tissue, which had previously been thought …
