The Pledge Of Allegiance And Compelled Speech Revisited: Requiring Parental Consent, Caroline Mala Corbin Apr 2022

The Pledge Of Allegiance And Compelled Speech Revisited: Requiring Parental Consent, Caroline Mala Corbin

Articles

Since the Supreme Court decided West Virginia State Board of Education v. Barnette in 1943, free speech law has been clear: public schools may not force students to recite the Pledge of Allegiance. Nevertheless, in two states -Texas and Florida- students may decline to participate only with parental permission. The Eleventh Circuit Court of Appeals upheld the law on the grounds that the parental requirement furthered parents' substantive due process right to control the upbringing of their children.

The Eleventh Circuit decision is flawed both in its understanding of the First Amendment right to be free of compelled speech and …

Obstetrics, Gynecology and Women's Health Services Articles

Blue rubber bleb nevus syndrome (BRBNS) is a rare vascular disorder characterized by recurrent, multifocal venous malformations throughout the skin, soft tissue, and numerous internal organs. Pregnant women with BRBNS are at high risk of morbidity and mortality, and thus their care requires careful planning and surveillance. This report highlights the case of a 21-year-old woman, gravida 1, para 0, with BRBNS who was cared for by a multidisciplinary team of providers in obstetrics, maternal-fetal medicine, obstetric anesthesia, hematology, dermatology, gastroenterology, and otorhinolaryngology. The report provides a comprehensive guide to the multidisciplinary management of pregnancy and delivery for patients with …

Suspected Vitamin K-Dependent Coagulation Factor Deficiency In Pregnancy: A Case Report, Mariam Ayyash, Meera Chitlur, Johannes Oldenburg, Majid Shaman

Obstetrics, Gynecology and Women's Health Services Articles

Hereditary combined vitamin K-dependent clotting factor deficiency (VKCFD) is a rare autosomal recessive congenital bleeding disorder. There are no established guidelines for the care for pregnant women and newborns within the context of VKCFD. A 39-year-old multigravida woman with a family history of VKCFD was referred for high-risk maternal fetal medicine care. Prenatal testing for fetal VKCFD was declined. The patient received vitamin K1 from 36 weeks of gestation and had an uncomplicated vaginal delivery. The baby had normal head ultrasound results, vital signs, and physical examination, with no signs of bleeding: factor levels and coagulation factors were within reference …

Ghosts’ Stories: Addictive Behaviors And Complicated Grief In George Saunders’ Lincoln In The Bardo, Jc Leishman Apr 2022

Ghosts’ Stories: Addictive Behaviors And Complicated Grief In George Saunders’ Lincoln In The Bardo, Jc Leishman

Criterion: A Journal of Literary Criticism

When experiencing the natural motions of the grieving process, some individuals encounter an inability to pass this process by a phenomenon known as complicated grief. To deal with the cyclical trauma this causes, the human mind seeks to engage in addictive behaviors (both substantive and behavioral) that work to artificially and momentarily circumvent grief. This process, as it appears in George Saunders' experimental novel, Lincoln in the Bardo, reveals a depth of commentary on human attachments and grieving processes through the lives and narratives of ghosts found in the bardo.

To Put Her In Her Place: An Interrogation Of Death And Gender In Shakespearean Tragedy, Isabella A. Zentner Apr 2022

To Put Her In Her Place: An Interrogation Of Death And Gender In Shakespearean Tragedy, Isabella A. Zentner

Criterion: A Journal of Literary Criticism

This analysis investigates the gendered implications of Shakespearean heroines' deaths. Using Macbeth, Antony and Cleopatra, and Titus Andronicus as case studies, evidence is drawn from the text. This evidence is then supported by extensive historical research and reference to external critical studies of these tragedies. By identifying the gendered aspects of these heroines’ deaths, one can gain a greater understanding of Shakespeare’s view of female autonomy and power. The deaths Shakespeare inflicts often act as a punishment for the heroines' betrayal of traditional gender roles and forcibly return the heroines to the feminine sphere.

"Do Democratic Presidents Increase The Frequency Of Climate Change Risk Disclosure?", Shawn Connell Apr 2022

"Do Democratic Presidents Increase The Frequency Of Climate Change Risk Disclosure?", Shawn Connell

Gabelli School of Business Honors Thesis Collection

I examine whether having a Democratic president in office has a statistically significant impact on the frequency of climate change risk disclosures from 2012 through 2020. My research aims to evaluate the need for standardized disclosures as proposed by the SEC in March 2022. Using textual analysis, I determine the frequency of climate change risk disclosure in 10-K reports filed with the SEC from 100 Fortune 500 companies. I utilize a linear regression model to determine the impact of having a Democratic President in office on the frequency of the climate risk disclosure while controlling for size, cash, research and …

The "Politics Of Trauma": National Trauma In Poland And Hungary And The Othering Of Queer Identities, Keira Hoeferle Apr 2022

The "Politics Of Trauma": National Trauma In Poland And Hungary And The Othering Of Queer Identities, Keira Hoeferle

Honors Projects

The governments of Poland and Hungary, under the parties Prawo i Sprawiedliwość (Law and Justice) and Fidesz (Alliance of Young Democrats), respectively, have deliberately implemented policies and utilized rhetoric to marginalize the LGBT+ community, a dramatic reversal from years of social progress in the European Union. In investigating this shift, prior scholars have explored social factors and authoritarian, populist politics as causes, yet these cannot explain the extent and viciousness to which both parties attack sexual and gender minorities. In this paper, I demonstrate that both governments have utilized “national trauma” to construct a nationalist space that excludes LGBT+ people, …

An Analysis Of Commentary In Men’S And Women’S Olympic Basketball, Madison Monk Apr 2022

An Analysis Of Commentary In Men’S And Women’S Olympic Basketball, Madison Monk

Honors Projects

The objectification theory suggests that women are subjected to more comments about their appearance than men, but in the field of athletics and sports analysts, newer perspectives suggest that there are fewer distinctions between how male and female athletes are portrayed. The present study examined whether there were differences in broadcast commentary of men’s and women’s Olympic basketball gold medal games, including comments about the players looks and appearance, their physicality and athleticism, and the pattern of name used. The coding method employed was developed based on previous research and used to quantify the frequency of each category. Two coders …

Descriptive, Comparative, And Correlational Study Related To End-Of-Life Care Prior To The Covid-19 Pandemic Outbreak (Time 1) And 12 Months Following Lockdown (Time2), Elizabeth Infante Apr 2022

Descriptive, Comparative, And Correlational Study Related To End-Of-Life Care Prior To The Covid-19 Pandemic Outbreak (Time 1) And 12 Months Following Lockdown (Time2), Elizabeth Infante

Theses & Dissertations

Background

Palliative care has grown in its acceptance nationally and formed the base of a growing number of programs to provide care in a way that recognizes the importance of supporting people with chronic, debilitating, and life-limiting illnesses by focusing on “care” rather than “cure.” This special care warrants an understanding by all nurses and requires education across specialties and disciplines. Despite the increase of palliative care services in hospitals and other settings, long-term care and home care agencies continue to struggle with the education of staff and delivery of care to clients that incorporate the central tenets of what …

Genetic Testing For Non-Major Biology Students, Taylor Banton Apr 2022

Genetic Testing For Non-Major Biology Students, Taylor Banton

Honors Projects

The goal of this Honors Project is to teach non-major biology students (BIOL-100) the concept of genetic testing and the importance of interpreting genetic results. I created a lab manual, a PowerPoint presentation, and quiz assessments to help students easily understand the material while also performing lab techniques that are crucial to scientific research. This is a two-week lab where students will test their own DNA and interpret the results using PCR and gel electrophoresis. In the lab at school, students cannot obtain real genetic results because the lab focuses on a portion of the genome that is not used …

College Students’ Opinions On Climate Change: Do Political Views Matter?, Aileen Hull Apr 2022

College Students’ Opinions On Climate Change: Do Political Views Matter?, Aileen Hull

Honors Theses

Climate change is an ever-impending crisis and the politics surrounding the issue are as contentious as ever, especially in the United States where the political culture is extremely polarized. The polarization of the political parties in the United States makes any environmental policy extremely difficult to pass. Meanwhile, the new generation of young people entering the workforce, voting scene, and public eye are bringing new demands to current climate debates. Youth make up a large share of environmental activism participants and opinion polls show climate change is on the minds of many young people. However, there is a lack of …

Music Therapy In Adult Medical Settings: Recommendations And Advocacy For Sustainable Programs, Margaret Moore Apr 2022

Music Therapy In Adult Medical Settings: Recommendations And Advocacy For Sustainable Programs, Margaret Moore

Honors Theses

This thesis research provides advocacy, strategies, and recommendations for sustainable music therapy program structures in adult medical settings. A review of the related literature justifies the need for and benefits of music therapy programs in adult medical settings. Recommendations for establishing and growing a music therapy program in these settings are based on semi-structured interviews conducted with three music therapists who have successfully implemented cost-effective and sustainable programs. Important considerations identified for program development include what to incorporate in a development pitch, the workload and well-being of the music therapist, and staff perceptions and relationship to the music therapy program.

Job Diversity And Its Impact On Intergenerational Mobility At The County Level, Derek Olson Apr 2022

Job Diversity And Its Impact On Intergenerational Mobility At The County Level, Derek Olson

Honors Theses

This thesis focuses on whether or not the diversity in industries within a county has an impact on the income mobility of children within that county. Data come from the Bureau of Labor Statistics to construct variables measuring job diversity and the degree of industry specialization of a county. Building on Chetty (2017a, 2017b), I find that for children with parents at the 25th percentile of the national income distribution, a one standard deviation increase in a county being less diverse in the presence of industries increases a child’s expected rank in the national income distribution by 2.19% while a …

Hope For The Heartbroken: A Sacred Space For Grace, Patricia Mayes Apr 2022

Hope For The Heartbroken: A Sacred Space For Grace, Patricia Mayes

Doctor of Ministry

This project addresses pathways for hope rising from heartbreaking behaviors of unresolved grief due to a loss from any source that prevents one from a life of peace, love, and future happiness. The audience is those persons and groups experiencing any life event that threatens a sense of well-being and loss of hope for a better future. Some of those events are death of a loved one, job loss, disruption of family dynamics, civic and cultural discord, workplace discord and dysfunctional relationships.

The key insight emerging early was while a local regional need existed, little support existed given current free …

Hidden In Plain Sight: The Dangers Of Environmental Protections Waivers, Olivia Stevens Apr 2022

Hidden In Plain Sight: The Dangers Of Environmental Protections Waivers, Olivia Stevens

Indiana Law Journal

When enacting both statutory and regulatory environmental protections, Congress and various agencies have recognized that emergency situations could arise that would require flexibility in the application and enforcement of those protections. Incorporating waivers into such protections provides that flexibility. However, the current state of waivers leaves them vulnerable to abuse. In this Note, I explore how a lack of procedural and substantive safeguards allows the inappropriate use of waivers to further administrative agendas in a way that poses serious risks to both environmental and human health. I then suggest remedial measures available to Congress that would strengthen environmental protections while …

What’S The Deference? Interpreting The U.S. Sentencing Guidelines After Kisor, Liam Murphy Apr 2022

What’S The Deference? Interpreting The U.S. Sentencing Guidelines After Kisor, Liam Murphy

Vanderbilt Law Review

For more than three decades, the U.S. Sentencing Guidelines have constrained the punishment doled out by federal judges, limiting discretion that was once nearly unlimited and bringing standardization to the penological decisionmaking process. For twice as long, the Supreme Court has constrained judges in a different way—by requiring that administrative agencies receive deference when they interpret the meaning of their own regulations. At the convergence of these two domains sits “commentary,” or interpretive notes the U.S. Sentencing Commission appends to the otherwise congressionally approved Guidelines. In Stinson v. United States, the Court made clear that commentary should be reviewed and …

Embracing Crimmigration To Curtail Immigration Detention, Pedro Gerson Apr 2022

Embracing Crimmigration To Curtail Immigration Detention, Pedro Gerson

Faculty Scholarship

Immigration advocates have long objected to both the constitutionality and conditions of immigration detention. However, legal challenges to the practice have been largely unsuccessful due to immigration law’s “exceptionality.” Placing recent litigation carried out against immigration detention during the COVID-19 pandemic within the context of the judiciary’s approach to immigration, this Article argues that litigation is an extremely limited strategic avenue to curtail the use of immigration detention. I then argue that anti-immigration detention advocates should attempt to incorporate their agenda into criminal legal reform and decarceration efforts. This is important for both movements. Normatively, immigration detention raises comparable issues: …

Corporate Gaslighting: Can Isolated Training Help? A Narrative Study, Jade Singleton Apr 2022

Corporate Gaslighting: Can Isolated Training Help? A Narrative Study, Jade Singleton

Doctor of Education (EdD)

The purpose of this narrative study is to investigate whether isolated anti-corporate gaslighting training, leveraging vignettes, could be of value to organizations. Findings responded to three research questions: (1) How do participants identify when the vignette shifts into corporate gaslighting territory? (2) What perceptions do Learning & Development professionals have of the training experience? (3) What do participants believe the usefulness of this isolated training is for organizations like theirs? Study participants were three professionals across Learning & Development and Human Resource roles. After the anti-corporate gaslighting training session, administering vignette testing, and finally interviewing the group to gauge their …

Paraeducator Experience Participating In Professional Development: A Phenomenological Perspective, Loren K. Sickles Apr 2022

Paraeducator Experience Participating In Professional Development: A Phenomenological Perspective, Loren K. Sickles

Doctor of Education (EdD)

This qualitative research used a phenomenological method to foreground Washington State instructional paraeducator voices describing their experiences participating in state mandated professional development certification program. The participants all received a minimum of 14 hours, out of 98 hours, of the state’s required professional development for the paraeducator certificate program. An unstructured interview method was utilized to allow participants to openly describe their experience participating in the professional development and describe impacts the professional development had on how they understand their role and responsibility as a paraeducator. Analysis of the data was conducted through the lenses of two adult learning theories, …
