Prism Vol. 10, No. 2, Center For Complex Operations

PRISM (Full PDF Issues)

This issue of PRISM—titled “Forward Defense”—examines the security transformations taking place in these diverse but aligned countries. As distinct as these nine countries are they are each reinforcing, or in some cases rebuilding, their armed forces and reviving the Total Defense or Comprehensive Defense concepts they embraced during the Cold War. Total or Comprehensive Defense is a strategic approach that recognizes the multidimensional threat posed by autocratic countries and the existential threat to the liberal, rules-based world order. It understands that effective deterrence depends on both resistance and resilience and codes those into the respective security and defense strategies.

Law School As Straight Space, Swethaa S. Ballakrishnen Mar 2023

Law School As Straight Space, Swethaa S. Ballakrishnen

Fordham Law Review

In honoring Professor Deborah L. Rhode’s commitment to making space for the marginal in legal education and clarifying the “no-problem” problems in our midst, Professor Ballakrishnen’s Essay focuses on one strain of nonnormative experience—that of genderqueer persons—to clarify the ways in which law schools reinforce linear hierarchies of identity and performance. Professor Ballakrishnen catalogues ethnographic student interview data to highlight perspectives of genderqueer law students, the result of which suggests that “normal” professional practices in law school reinforce the rigidity of the gender binary. They conclude by suggesting that paying attention to these student subpopulations is crucial to reform legal …

Mentored: On Leaders, Legacies, And Legal Ethics, Renee Knake Jefferson Mar 2023

Mentored: On Leaders, Legacies, And Legal Ethics, Renee Knake Jefferson

Fordham Law Review

Professor Renee Knake Jefferson shares insights on mentorship and legal ethics gleaned from her relationship with Professor Deborah Rhode. The Essay, written as part of the Fordham Law Review colloquium in Professor Rhode’s memory, argues that the stories of women and minority lawyers—regardless of whether one had a personal relationship with them—are an unrealized, valuable source of informal mentorship. It lays the groundwork for formalizing mentorship as an ethical obligation of leaders in the legal profession and beyond.

The Reality Of Materiality: Why A Heightened Adversity Standard Has No Place In Title Vii Discrimination Claims, Abigail Mccabe Mar 2023

The Reality Of Materiality: Why A Heightened Adversity Standard Has No Place In Title Vii Discrimination Claims, Abigail Mccabe

Fordham Law Review

Title VII of the Civil Rights Act of 1964 forbids discrimination in the workplace. Except, according to certain lower courts’ limiting interpretations, for when it does not. Circuit courts have spent decades imposing an extratextual materiality requirement onto Title VII in contravention of its broad remedial purpose. Accordingly, countless victims of discrimination are unable to seek recourse because their alleged harm was purportedly too insignificant to constitute actionable discrimination under Title VII. This materiality requirement not only presents an additional substantive hurdle for plaintiffs, but also leads to inconsistency and unpredictability, as each circuit fumbles to define what conduct is …

First Amendment Speech Protections In A Post-Dobbs World: Providing Instruction On Instructional Speech, Samantha Mitchell

Fordham Law Review

In its June 2022 opinion, Dobbs v. Jackson Women’s Health Organization, the U.S. Supreme Court overruled Roe v. Wade and Planned Parenthood of Southeastern Pennsylvania v. Casey, thus revoking the constitutional right to abortion. As states continue to pass laws outlawing abortion to varying degrees, not only has Dobbs led to uncertainty for medical professionals and those who might want to seek an abortion, but it has also prompted questions for internet users across the world. May an organization or an individual post instructions on the internet regarding how to obtain an abortion if a resident of a …

Impact Of The Dimethyl Sulfoxide Reductase Superfamily On The Evolution Of Biogeochemical Cycles, Michael Wells, Minjae Kim, Denise M. Akob, Partha Basu, John F. Stolz

UK CARES Faculty Publications

The dimethyl sulfoxide reductase (or MopB) family is a diverse assemblage of enzymes found throughout Bacteria and Archaea. Many of these enzymes are believed to have been present in the last universal common ancestor (LUCA) of all cellular lineages. However, gaps in knowledge remain about how MopB enzymes evolved and how this diversification of functions impacted global biogeochemical cycles through geologic time. In this study, we perform maximum likelihood phylogenetic analyses on manually curated comparative genomic and metagenomic data sets containing over 47,000 distinct MopB homologs. We demonstrate that these enzymes constitute a catalytically and mechanistically diverse superfamily defined not …

Magnetic Nanocomposites For The Remote Activation Of Sulfate Radicals For The Removal Of Rhodamine B, Pranto Paul, Marissa Nicholson, J. Zach Hilt

UK CARES Faculty Publications

The widespread presence of numerous organic contaminants in water poses a threat to the ecological environment and human health. Magnetic nanocomposites exposed to an alternating magnetic field (AMF) have a unique ability for magnetically mediated energy delivery (MagMED) resulting from the embedded magnetic nanoparticles; this localized energy delivery and associated chemical and thermal effects are a potential method for removing contaminants from water. This work developed a novel magnetic nanocomposite—a polyacrylamide-based hydrogel loaded with iron oxide nanoparticles. For this magnetic nanocomposite, persulfate activation and the contamination removal in water were investigated. Magnetic nanocomposites were exposed to AMF with a model …

Faculty Research 2023

BACKGROUND/OBJECTIVE: As the obesity epidemic continues, the understanding of macronutrient influence on central nervous system function is critical for understanding diet-induced obesity and potential therapeutics, particularly in light of the increased sugar content in processed foods. Previous research showed mixed effects of sucrose feeding on body weight gain but has yet to reveal insight into the impact of sucrose on hypothalamic functioning. Here, we explore the impact of liquid sucrose feeding for 12 weeks on body weight, body composition, caloric intake, and hypothalamic AgRP neuronal function and synaptic plasticity.

METHODS: Patch-clamp electrophysiology of hypothalamic AgRP neurons, metabolic phenotyping and food …

Faculty Research 2023

The molecular bases of how host genetic variation impacts the gut microbiome remain largely unknown. Here we used a genetically diverse mouse population and applied systems genetics strategies to identify interactions between host and microbe phenotypes including microbial functions, using faecal metagenomics, small intestinal transcripts and caecal lipids that influence microbe-host dynamics. Quantitative trait locus (QTL) mapping identified murine genomic regions associated with variations in bacterial taxa; bacterial functions including motility, sporulation and lipopolysaccharide production and levels of bacterial- and host-derived lipids. We found overlapping QTL for the abundance of Akkermansia muciniphila and caecal levels of ornithine lipids. Follow-up in …

Department of Earth and Environmental Studies Faculty Scholarship and Creative Works

During the past decades, multiple remote sensing data sources, including nighttime light images, high spatial resolution multispectral satellite images, unmanned drone images, and hyperspectral images, among many others, have provided fresh opportunities to examine the dynamics of urban landscapes. In the meantime, the rapid development of telecommunications and mobile technology, alongside the emergence of online search engines and social media platforms with geotagging technology, has fundamentally changed how human activities and the urban landscape are recorded and depicted. The combination of these two types of data sources results in explosive and mind-blowing discoveries in contemporary urban studies, especially for the …

Unbelievable: How Narrative Can Help Vulnerable Narrators Overcome Perceived Unreliability In The Legal System, Cathren Page Mar 2023

Unbelievable: How Narrative Can Help Vulnerable Narrators Overcome Perceived Unreliability In The Legal System, Cathren Page

Articles

This article examines how advocates can champion vulnerable narrators’ truths. First, advocates must prime the audience by educating the audience about the ways the vulnerability manifests; this process helps to allay credibility questions. Second, advocates must reframe seemingly untrustworthy behavior by showing how the behavior is consistent with someone in the vulnerable narrator’s situation. Third, advocates must create what fiction writers call verisimilitude—a sense of reality—by including concrete details that logically fit together in the legal narrative. Finally, advocates must label the tactics commonly used to discredit vulnerable narrators so that the audience can see those tactics for what they …

An Analysis Of College Students’ Stories About How Their Religious Backgrounds Impacted Their Sexual Attitudes, Brookelyn Bochenek

Communication Studies

The goal of this paper was to examine the impact of college students’ religious background on their sexual attitudes. Grounded in the Narrative Paradigm (Fisher, 1984), qualitative interviews were conducted to allow participants to share their experiences. Thematic analysis of the data (Braun & Clarke, 2006) was conducted to uncover the themes that animated their narratives. The themes that emerged were a) conceptualization of sex, b) exploration of sexuality and dating, and c) negotiation of religious identity and beliefs. Findings were consistent with and corroborated past research regarding sexual socialization and religious dualities. Study limitations and directions for further research …

Study On Visibility Promotion For Regional High-End Hotels Based On The Value Co-Creation Theory, Pingan Luo Mar 2023

Study On Visibility Promotion For Regional High-End Hotels Based On The Value Co-Creation Theory, Pingan Luo

Dissertations and Theses Collection (Open Access)

Regional high-end hotels play a great leading role in industry communication, tourism, and consumer culture in the area where they are located. However, regional high-end hotels rely on the area’s industry background and economic development for their survival and operations. Hence, their brand influence seldom spread outside the area. As a result, the limitations of brand awareness have been challenging the rapid development of regional high-end hotels. The existing research has not come to a clear theoretical response to this challenge. To enhance research in this field, this paper grounded on value co-creation theory posed one core question and three …

Employee Beware: Why Secret Workplace Recordings Are Risky Business For Employees, Marc C. Mcallister

Marquette Law Review

This Article examines the risks for employees when secretly recording workplace conversations. Although many employers flatly prohibit employees from secretly recording workplace conversations, case law contains dozens of examples of employees conducting such espionage. In the typical case, employees secretly record conversations to gather evidence to support claims of discrimination, harassment, or whistleblowing, but many of those individuals were likely unaware of the pitfalls associated with their clandestine activities. This Article uncovers various pitfalls for employees when secretly recording workplace conversations. These include being fired by their employer for violating its no-recording policy, finding courts unreceptive to claims of retaliation …

ETSU News

When East Tennessee State University (ETSU) Bill Gatton College of Pharmacy alumnus Hayden Stanton (’22), PharmD, MBA, went to work at Food City Pharmacy in early December, it was just another day in the life of a community pharmacist: verifying prescriptions, giving vaccinations, and counseling patients to aid in taking medications effectively.

But what he didn’t expect was a medical emergency that would have him go beyond his usual community pharmacy role and put his medical training to the test.

Katie Callerhorn, a current medical student at ETSU Quillen College of Medicine, was experiencing what she thought was an allergic …

Unreasonable Royalty: Realigning Economic Incentives Involving Innovation In The Age Of Patent Assertion Entities, Jordan Duenckel

The Business, Entrepreneurship & Tax Law Review

Patent litigation is a high-stakes endeavor when jury verdicts can be in the hundreds of millions or even billions. With this much at stake, the judicial system is ripe for abuse by parties that aren’t inventors or producers: nonpracticing entities. Various steps have been taken to mitigate or discourage the gaming of the system but have not been successful for various reasons. This Article proposes the novel solution of incorporating a federal damages cap into 35 U.S.C. § 284 to shift the underlying economic incentives toward innovation. After discussing some likely challenges to the proposal, this Article concludes that the …

Testing For Disguised Dividends In Compensation For Employee-Shareholder Of Closely Held Corporations: An Analysis Of Federal Court Testing Regimes And Their Impact On The Predictability Of Outcomes, Matthew Edward Lewis

The Business, Entrepreneurship & Tax Law Review

The Internal Revenue Code generally allows for a corporation to deduct compensation paid to its employees. However, in a closely held corporation, where an employee is also a controlling shareholder, compensation paid to the employee-shareholder may be characterized as nondeductible dividends. This paper analyzes the major testing regimes used by the federal circuit courts to test for nondeductible dividends in compensation paid to employee-shareholders of closely held corporations. Further, this paper analyzes whether any of the federal testing regimes provide for more predictable outcomes to both the Internal Revenue Service and taxpayers. Finally, this paper explores whether new regulations would …

Design Principles For App-Based Healthcare Interventions: A Mixed Method Approach, Loknath Sai Ambati Mar 2023

Design Principles For App-Based Healthcare Interventions: A Mixed Method Approach, Loknath Sai Ambati

Masters Theses & Doctoral Dissertations

Despite the ubiquity of mobile health applications (apps), the practical use and success of the apps have been questionable. Design Principles (DP) can affect chronic health app user satisfaction and have been studied for ensuring favorable app usage. However, there is no consensual definition of DP within the preceding literature, which has a technical rather than an end-user-centric focus and lacks a rigorous theoretical basis. Moreover, different levels of DPs’ application can lead to differential user satisfaction as influenced by the user-contextual environment, warranting a quantitative assessment. Accordingly, the overarching question to be addressed is which DP for the self-management …
