The Enduring Lives Of False Legislative Facts: Asset Forfeiture, Brian Kelly, Taylor De Lavagea
The Enduring Lives Of False Legislative Facts: Asset Forfeiture, Brian Kelly, Taylor De Lavagea
Buffalo Law Review
Federal courts have found asset forfeiture constitutional by relying on assertions that have been accepted as true without being established at trial. These “legislative facts” play a central and enduring role not only in jurisprudence but in the broader public policy debate over forfeiture. To date, these assertions have not been subject to careful empirical review. We test three central legislative facts frequently offered as providing a compelling government interest for the use of forfeiture: (1) that forfeiture provides vital funding for law enforcement activities; (2) that forfeited funds are used to reimburse the victims of crime; and (3) that …

Postcensorship In Streaming: Political Alienation Of Millenials And Centennials Toward Audiovisual Productions, Carlos Fernández-Rodríguez, Luis Miguel Romero Rodríguez, Bárbara Mercedes Castillo Abdul Hadi
Artículos científicos
This study examines the degree to which political alienation viewers consider themselves to have audiovisual productions. To understand the preferences of millennials and centennials in the Spanish-speaking world, a survey was conducted with 998 individuals from Spain and Mexico, two countries with high rates of OTT consumption. The survey revealed that young people feel justified in expressing their discontent with audiovisual productions on social media, potentially leading to an "audience dictatorship, " which stifles creative freedom and expression. In this sense, young people with discursive power in social networks to change and censor production see it as plausible to use …

Civilians Under Siege In War-Torn Ukraine: Human Rights Ngo And Faith-Based Responses, Mark R. Elliott
Occasional Papers on Religion in Eastern Europe
A central tenet of international humanitarian law states that in armed conflict, “It is unlawful to target civilians.” Stressing this prohibition in the case of the Russian assault on vulnerable Ukrainian civilians is not only the United Nations but the European Union, the World Health Organization, the Office of Security and Cooperation in Europe (OSCE), and the Humanitarian NGO Platform in Ukraine, representing 75 Ukrainian and international NGOs assisting Ukraine in the present war. Zaher Sahloul, president and co-founder of MedGlobal, argues in favor of a recognition of Russia’s current efforts “to erase Ukrainian identity and culture” as a genocide. …

UNLV Theses, Dissertations, Professional Papers, and Capstones
Since the 1800s, psychopathy has been regarded as the absence of morality. The goal of our study was to explore whether psychopathic traits can affect the moral decision-making process in sacrificial moral dilemmas. Participants completed multiple self-report measures of psychopathic traits, utilitarian tendencies, and 16 sacrificial moral dilemma vignettes. After each hypothetical vignette, participants decided whether they believed it was morally right, permissible, and whether they behaviorally intended to sacrifice one person to save five people. Positive correlations emerged among all variables, which allowed us to perform a mediation analysis. Instrumental Harm – the idea of sacrificing one individual to …

Mining Gambling Data For Modeling Gambling Behavior Patterns, Piyush Aniruddha Puranik
UNLV Theses, Dissertations, Professional Papers, and Capstones
Understanding player behavior for responsible gambling research is a difficult task due to the lack of data on players’ activities. Past studies in this area are largely limited to publicly available behavioral data or aggregated players data. Problem gambling in gamblers is typically identified only after they have already been addicted or have already been engaging in problematic gambling behavior. Furthermore, “risky” gambling behavior has historically been difficult to define due to the varying patterns of gambling activity that could potentially be attributed to it.In this dissertation we illustrate the methodology and algorithms used to engineer financial data for further …

The Role Of Cognitive Dysfunction In Late-Life Depression, Matthew Schurr
The Role Of Cognitive Dysfunction In Late-Life Depression, Matthew Schurr
UNLV Theses, Dissertations, Professional Papers, and Capstones
Depression is one of the most common psychiatric concerns in older adults. Because of the intersection of biological, emotional, social, and cognitive factors that are at play in depression, symptoms are often heterogeneous in presence and severity. In combination with the expected changes in cognitive abilities as one ages, late-life depression can be additive to these changes. The higher risks of neurodegenerative processes and vascular events in later life can cause, magnify, or accelerate cognitive decline. As such, individuals with late-life depression often present with a complex array of problems that can impact cognition and functioning, and thus complicate the …

UNLV Theses, Dissertations, Professional Papers, and Capstones
Introduction. Research has found that low provider culture knowledge leads to poor mental health outcomes for Latine clients (Duke et al., 2011). Further, the 2017 APA Multicultural Guidelines emphasize the need for clinicians and researchers to conceptualize clinical and empirical data from a culturally competent lens, especially considering clinician and researcher bias while understanding a psychological phenomenon. Despite this, limited research exists categorizing the unique factors that affect mental health symptoms among Latine living in the United States (U.S.) especially as it pertains to trauma stress and discrimination (Marmot, 2005; Nadal, 2018). As such, the current study used meditational statistical …
