Regulatory Personhood: The Elixir For Redundancy Between The Sec And The Pcaob, Sarah Williams

Faculty Scholarly Works

The Public Company Accounting Oversight Board (“PCAOB” or “Board”) is a quasi-governmental regulatory agency created by Congress in 2002 in response to revelations of widespread financial fraud at major public companies. Since its creation, the agency has experienced significant challenges. Litigants have challenged its constitutionality, the Trump administration challenged its very existence, and legislation was introduced in 2021 to transfer its responsibilities to the U.S. Securities and Exchange Commission (“SEC”).

Proposals to eradicate the Board asserted vague concerns about the redundancy of its responsibilities with those of the SEC, and alleged resultant monetary waste. This Article, written in 2022, provides …

New generative artificial intelligence (“AI”) tools can increasingly engage in personalized, sustained, and natural conversations with users. This technology has the capacity to reshape the financial services industry, making customized expert financial advice broadly available to consumers. However, AI’s ability to convincingly mimic human financial advisors also creates significant risks of large-scale financial misconduct. Which of these possibilities becomes reality will depend largely on the legal and regulatory rules governing “robo-advisors” that supply fully automated financial advice to consumers.

This Article consequently critically examines this evolving regulatory landscape, arguing that current U.S. rules fail to adequately limit the risk that …

Improving Detection Capabilities Of Traditional Machine Learning (Ml) Algorithms Against Data Poisoning Attacks On Image Data, Sabrina Perry Jan 2025

Improving Detection Capabilities Of Traditional Machine Learning (Ml) Algorithms Against Data Poisoning Attacks On Image Data, Sabrina Perry

Electronic Theses and Dissertations

Machine learning (ML) algorithms play a critical role in automated decision-making systems across domains such as healthcare, finance, and autonomous systems. However, these models are increasingly vulnerable to adversarial threats, particularly poisoning attacks that manipulate training data without the knowledge of the ML developers. As ML models are often trained on publicly available data, data poisoning is trivial for attackers to perform, with no way to determine if training data is legitimate, poisoned during data collection, or poisoned during training in the current ML training pipeline.

This dissertation investigates data poisoning attacks, with a focus on label flipping and gradient …

Criminal Investors, Andrew K. Jennings Jan 2025

Criminal Investors, Andrew K. Jennings

Faculty Articles

This Article reassesses the culpability of those who invest in law-breaking firms. Prosecutors currently treat investors as victims of corporate wrongdoing rather than as actors who might bear responsibility for it. This Article observes, though, that investment can facilitate, and even cause, illicit corporate activity. When investors intentionally contribute to those effects, substantive criminal law imposes liability on them just the same as it does on accomplices, conspirators, or principals in other contexts. Despite this formal parity, however, investor criminal liability is more a theoretical proposition than a practical reality.

This Article questions that status quo by asking whether and …

Least Squares Support Vector Data Description With Adaptive Optimizers, Daniel Markwei Jan 2025

Least Squares Support Vector Data Description With Adaptive Optimizers, Daniel Markwei

Graduate Thesis and Dissertation post-2024

One-class classification has emerged as a powerful technique for data description, enabling a model to learn exclusively from data belonging to a single (target) class. By focusing solely on patterns within this class, this classification procedure is implemented in order to successfully assess whether incoming input deviates or is part of the target group. This approach develops a sophisticated understanding of the defining characteristics of the target data in relation to other groups. Consequently, any data point that deviates from the target group is flagged as an anomaly because it diverges from the learned distribution. One way to explore the …

How To Catch A Con: The Rhetorical Strategies Of Fraudulent Political Leaders, Lukas Huntington

CMC Senior Theses

The United States faces persistent challenges in controlling political fraud. Government agencies exhibit the second-highest fraud rate of any industry, and corruption levels have only worsened over the last decade, contributing to declining public trust in national leadership. Current fraud detection efforts generally catch late-stage, large-scale fraud, highlighting the need for earlier-detection mechanisms. One way this could be accomplished involves identifying rhetorical patterns that are commonly used by political frauds in order to flag high-risk individuals. Leaning on the Theory of Planned Behavior, it was hypothesized that political frauds would exhibit more rhetorical appeals to fear, blame, pathos, and self-promotion …
