Chimeric Contacts And Consent: The Ill-Reasoned Expansion Of Corporate Jurisdictional Exposure, James P. George Nov 2025

Chimeric Contacts And Consent: The Ill-Reasoned Expansion Of Corporate Jurisdictional Exposure, James P. George

William & Mary Business Law Review

Two recent Supreme Court decisions have imposed aspects of general jurisdiction in a way that exposes corporations and possibly other legal actors to litigation in spuriously connected forums. One case—Ford Motor Company v. Montana—reached a fair result but with strained reasoning that will support unfair results. The second case—Mallory v. Norfolk Southern Railroad Company—was wrong on the facts and the law, imposing general jurisdiction based on a vaguely worded corporate registration statute validated by a more than century-old precedent based on Pennoyer v. Neff’s limited territorial model.

Both decisions were the result of conceptual corners …

Department of Otolaryngology - Head and Neck Surgery Faculty Papers

Study Objectives: To evaluate the safety and efficacy of a novel bilateral hypoglossal nerve stimulation (HNSBL) device for the treatment of obstructive sleep apnea.

Methods: Adult patients with moderate-to-severe obstructive sleep apnea who refused, failed, or did not tolerate positive airway pressure therapy underwent implantation and nightly use of HNSBL. The coprimary endpoints at 12 months were (1) a minimum of 50% reduction in the 4% apnea-hypopnea index (AHI) from baseline with a final AHI of less than 20 events/h, and (2) a minimum of 25% reduction in the 4% oxygen desaturation index. Objective secondary endpoints …

Gerunds In Irish Sign Language: An Exploratory Analysis, Zaid Mohammed Nov 2025

Gerunds In Irish Sign Language: An Exploratory Analysis, Zaid Mohammed

Doctoral

In sign languages (SLs), e.g., American Sign Language (ASL), gerunds help express the meaning of ongoing actions and activities conveyed by verbs (Klima & Bellugi, 1979, p. 295). In spoken languages, a gerund is a form of the verb that functions as a noun and expresses the state of being or an ongoing action (Maekelberghe, 2020). Gerunds are complex constructions as they have nominal-verbal nature (Travis, 2005, p. 321) and morphological similarity with present participle or progressive aspect (Siegel, 1998). This research is motivated by the challenging nature of distinguishing gerund constructions at the morphological level, and research in sign …

How Local Is Local Development? Evidence From Casinos, Ari Anisfeld, Jordan Rosenthal-Kay Nov 2025

How Local Is Local Development? Evidence From Casinos, Ari Anisfeld, Jordan Rosenthal-Kay

Economics Faculty Publications and Presentations

One rationale for place-based policy is that local development produces positive productivity spillovers. We examine the employment spillovers from a large local development project: opening a casino. Comparing employment in neighborhoods that won a casino license to runner-up neighborhoods that narrowly lost, we find that casinos create jobs in their immediate vicinity. However, we estimate net job losses overall when considering the broader neighborhood. Employment gains concentrate in the leisure and hospitality industry, suggesting spillovers are industry-specific or are driven by demand-side forces like trip-chaining. We develop theory to show that our estimates imply a rapid spatial decay of productivity …

Leave Them To Their Own Devices: When Employee Informal Power In Strategically Core Roles Enhances Organizational Performance, Alexandru Roman Nov 2025

Leave Them To Their Own Devices: When Employee Informal Power In Strategically Core Roles Enhances Organizational Performance, Alexandru Roman

American Business Review

In this empirical study, I develop theorizing on the conditions under which employees’ informal, competence-based power in strategically core roles enhances organizational performance. I propose that in contexts characterized by high task specialization and interdependence, employees with high informal power positively influence performance through higher motivation and improved coordination. However, this effect is weaker when managers also hold high informal power or emphasize hierarchical structures, as these factors create power conflicts that undermine employees’ informal influence. Conversely, the positive effect is stronger when employees receive negative performance feedback, which they perceive as a challenge to their competence, leading to stronger …

Efficiency Of Liberal Arts Colleges: A Dea Analysis Of Non-Elite Lacs, Joshua C. Hall, Joylynn Pruitt, Daniel Bonneau Nov 2025

Efficiency Of Liberal Arts Colleges: A Dea Analysis Of Non-Elite Lacs, Joshua C. Hall, Joylynn Pruitt, Daniel Bonneau

American Business Review

The demographic cliff, the effects of COVID-19, and shifts in regional preferences for higher education pose an important threat to Liberal Arts Colleges (LACs). While other studies have examined the efficiency of top-ranked LACs, this paper examines the colleges most challenged by the current environment. Using Data Envelopment Analysis (DEA) and 6-year graduation rate as the outcome of interest, our results show that the average LAC outside the top 100 ranked schools (according to U.S. News & World Report) operates at about 74 percent efficiency. Many schools within the sample score closer to 50 percent. These rankings are then evaluated …

Impact Of Resilience On Emotional Intelligence & Burnout Among Academicians: A Mediation Study, Shwati Sudha, Shrejal Kumari, Govind Swaroop Pathak Nov 2025

Impact Of Resilience On Emotional Intelligence & Burnout Among Academicians: A Mediation Study, Shwati Sudha, Shrejal Kumari, Govind Swaroop Pathak

American Business Review

Resilience is examined as a mediator between emotional intelligence and burnout. The study also investigates the implications of emotional intelligence on burnout. An empirical investigation was conducted among 257 academicians employing purposive sampling. Primary data were obtained using a 5-point likert scale, incorporating validated tools, including the Maslach Burnout Inventory (MBI), Nicholson McBride Resilience Questionnaire (NMRQ), Mindful Attention Awareness Scale (MAAS), Self-Regulation Inventory (SRQ), Intrinsic Motivation Inventory (IMI), and Interpersonal Reactivity Index (IRI). The analysis was performed using Hayes (2018) SPSS Process Macro Model 4. Burnout was found as positively correlated with resilience and emotional intelligence, while emotional intelligence also …

Sharing Leadership In The Context Of Socioeconomic Diversity: Combining Shared Leadership And Socioeconomic Diversity For The Greater Good, Rebekah Dibble, Carlos S. Baradello Nov 2025

Sharing Leadership In The Context Of Socioeconomic Diversity: Combining Shared Leadership And Socioeconomic Diversity For The Greater Good, Rebekah Dibble, Carlos S. Baradello

American Business Review

Shared leadership involves a collective effort where multiple identities, perspectives, skills, and experiences are incorporated into relational and decision-making processes. As such, we argue that diversity is a critical consideration in the presence of shared leadership. Specifically, we argue that socioeconomic diversity is an important consideration when engaging in collective forms of leadership; nevertheless, organizational research has yet to adequately understand shared leadership in this context. We identify this as a critical gap and draw upon qualitative data in our study of a large non-profit organization in Latin America to extend and develop theory on shared leadership in the context …

Recovery As Relational Care: Integrating Policy, Education, And Community Resilience In Rural Appalachia, Jon Dance, Josh Thompson Nov 2025

Recovery As Relational Care: Integrating Policy, Education, And Community Resilience In Rural Appalachia, Jon Dance, Josh Thompson

The Rural Educator

Despite national media attention and significant policy investment, substance use epidemics continue to impact Central Appalachia. Inequities affecting rural communities and persistent stigma create significant barriers to well-being and recovery. Recovery, however, is more than a healthcare issue; it is a relational and community-rooted process that must involve education, policy, and care. In this article, we reframe deficit-oriented conceptions of recovery to highlight the vital role of relational care and community collaboration in promoting wellness in rural Appalachia. We offer the Community Resiliency Model (CRM) as a practical, evidence-informed strategy to foster emotional regulation, coregulation, and community resilience. We call …

Exploring Career Development Through Situated Learning Experiences Of Highly Skilled Business Postgraduate Migrants, Rasidat Adedayo Adeniji Oseni

Doctoral

This study investigates the career development journey of highly skilled Nigerian, Ghanaian, Kenyan and Tanzanian business postgraduate migrants in Ireland, focusing on the interplay among learning experiences, systemic barriers, and career shocks. Drawing on Social Cognitive Career Theory (SCCT), Situated Learning Theory (SLT), and Career Shock (CS), the study examines how self-efficacy develops through participation in Communities of Practice (CoPs) and how resilience enables skilled migrants to overcome shocks as they progress from education to employment in a Global South to Global North context. It further explores the transfer of knowledge acquired in Ireland to the migrants’ home countries. The …

Hey, Bruh . . . I Mean, Your Honor—The Evolution (Or Devolution) Of Legal Communications In Modern Times, Michael J. Fleck

Northern Illinois University Law Review

The ability to effectively communicate, whether such communication is oral or written, is a primary tool in any lawyer’s toolbox. How we communicate is a reflection on our level of professionalism, both as individual attorneys, and as the legal body at large. It is how we convey ideas with our client, with our colleague, and with the court. It is how we persuade through legal reasoning. There is no doubt that the style of communication has evolved over time. One need only to read legal opinions from a century ago to see what was acceptable as proper communication. The standard …

Electronic Will Legislation: A Comparison Of The Uniform Act And Illinois, Jada Stephens Nov 2025

Electronic Will Legislation: A Comparison Of The Uniform Act And Illinois, Jada Stephens

Northern Illinois University Law Review

The Illinois Wills and Remote Witnesses Act is a body of law that was created in response to evolving technology and the COVID-19 pandemic. It addresses how electronic wills and remote attestations should occur in Illinois. Picking up where the executive order allowing for remote attention in Illinois left off, the passing of this Act solidifies processes that allow for different modes of estate planning and attestation to occur. Pennsylvania will be examined as a state that exemplifies the consequences of a lack of electronic will legislation. Illinois is not the first and most likely will not be the last …

A Systematic Review And Integrative Framework Of Psychotherapy Microprocess: Linking The Science Of Psychological Interventions With The Art Of Moment-To-Moment Practice, Xiaochen Luo, Alytia A. Levendosky Nov 2025

A Systematic Review And Integrative Framework Of Psychotherapy Microprocess: Linking The Science Of Psychological Interventions With The Art Of Moment-To-Moment Practice, Xiaochen Luo, Alytia A. Levendosky

Counseling Psychology

Despite advancements in psychotherapy research on effectiveness and critical therapy processes, there remains a significant gap between the science and the art of psychotherapy, specifically on how to understand what to do moment-to-moment with each patient. A burgeoning research literature addresses this question by examining psychotherapy microprocesses, which typically referred to within-session changes of therapy processes, aiming to bridge psychotherapy research with clinical practice. In this pre-registered systematic review, we reviewed 86 empirical quantitative studies examining observational psychotherapy microprocesses over 35 years. We extracted 28 microprocess constructs across six categories (affective/emotional, behavioral, cognitive, relational/interpersonal, linguistic, and movement), four key methodological …

From Prohibition To Preparation: Reframing Academic Integrity In The Age Of Ai, James Hutson Nov 2025

From Prohibition To Preparation: Reframing Academic Integrity In The Age Of Ai, James Hutson

Faculty Scholarship

This study analyzes how U.S. universities reconfigure academic integrity during the 2024–2025 cycle in response to widespread generative AI adoption. The analysis foregrounds three loci: student ignorance and metacognitive blind spots; the expanded remit of Academic Integrity Officers prioritizing education over punishment; and deliberate AI-enabled misconduct that exposes the evidentiary limits of detection technologies. A mixed-methods design integrates a multi-site review at Arizona State University, Montclair State University, and Cornell University with synthesis of surveys, policies, and faculty development guidance. Findings show that detector outputs function as conversational prompts rather than adjudicative proof, necessitating dialogic resolution standards, process evidence, and …
