(Semi)Automated Approaches To Data Extraction For Systematic Reviews And Meta-Analyses In Social Sciences: A Living Review, Amanda Legate, Kim Nimon, Ashlee Noblin

Human Resource Development Faculty Publications and Presentations

Background

An abundance of rapidly accumulating scientific evidence presents novel opportunities for researchers and practitioners alike, yet such advantages are often overshadowed by resource demands associated with finding and aggregating a continually expanding body of scientific information. Data extraction activities associated with evidence synthesis have been described as time-consuming to the point of critically limiting the usefulness of research. Across social science disciplines, the use of automation technologies for timely and accurate knowledge synthesis can enhance research translation value, better inform key policy development, and expand the current understanding of human interactions, organizations, and systems. Ongoing developments surrounding automation are …

The Importance Of Theory And History In Understanding And Developing The Common Law Of Contract – Some Further Preliminary Reflections, Hon. Andrew Phang Jun 2024

The Importance Of Theory And History In Understanding And Developing The Common Law Of Contract – Some Further Preliminary Reflections, Hon. Andrew Phang

Singapore Law Journal (Lexicon)

In a previous essay, an attempt was made to demonstrate the important role that both theory and history play in helping us to understand and develop the common law of contract. As pointed out in that essay, a comprehensive treatment of the subject would require lengthy discourse in a book or even several books. This essay follows-up on that previous essay, again by way of preliminary reflections only, to correct the dominant perception that the development of the common law in general and contract law in particular is premised mainly on doctrinal development based on logic and analogy with the …

Veil Piercing In Singapore: A Proposed Approach, Ivan Wu Hwan Tang Jun 2024

Veil Piercing In Singapore: A Proposed Approach, Ivan Wu Hwan Tang

Singapore Law Journal (Lexicon)

Since 2013, the English courts have departed from the Singapore courts in their approach towards the doctrine of veil piercing. Notwithstanding this departure, as well as the general increase, over the years, in the number of cases in Singapore where veil piercing has been argued, the English approach has yet to be considered definitively by Singapore’s Court of Appeal. The other Singapore courts have thus generally also been unwilling and unable to decide on the applicability of the English approach in Singapore. Against this context, this article aims to consolidate and analyse the law on veil piercing in Singapore and …

The Effect Of Choice Of Court Agreements On Third Parties, Tiong Min Yeo Jun 2024

The Effect Of Choice Of Court Agreements On Third Parties, Tiong Min Yeo

Singapore Law Journal (Lexicon)

The effect of choice of court agreements on the exercise of jurisdiction of the Singapore court between contracting parties at common law has received clarification in Singapore law in recent years. The position is also clear under SICC Rules and the Choice of Court Agreements Act. The effect on third parties is less clear. In this article, the effect of choice of court agreements on the position of third parties under the legal regimes above will be considered, from the perspective of both conflict of laws and the Contracts (Rights of Third Parties) Act in domestic Singapore law. This article …

Doctrinal Basis Of Delay As A Bar To Equitable Rescission Of Contracts, Tse Loong Ryan Low Jun 2024

Doctrinal Basis Of Delay As A Bar To Equitable Rescission Of Contracts, Tse Loong Ryan Low

Singapore Law Journal (Lexicon)

The 2015 EWCA decision of Salt v Stratstone Specialist Ltd (t/a Stratstone Cadillac Newcastle) [2015] EWCA Civ 745 casts doubt on the proposition that an inordinate lapse of time alone could operate as a bar to rescission. The court grounded the operation of delay in the doctrine of laches, but as this paper will find, laches is an unsatisfactory explanation for the effect of mere delay on one’s powers of rescission, requiring something more than lapse of time alone. Other competing theories like reference to the Limitation Act 1959 by analogy, and the Sale of Goods Act 1979, have been …

An Updated Account On The Similar Fact Rule, Siyuan Chen Jun 2024

An Updated Account On The Similar Fact Rule, Siyuan Chen

Singapore Law Journal (Lexicon)

The number of local decisions on the similar fact rule has increased quite significantly in the last few years. However, fundamental questions, ranging from the foundational (such as the existence or operation of any residual judicial discretion to exclude relevant evidence) to the discrete (such as whether the rule works differently in civil proceedings as compared to criminal proceedings, and how the rule operates vis-à-vis related rules of evidence), continue to be answered in rather different, arguably irreconcilable ways by the courts. This article analyses some of the recent key decisions in the light of established precedents and proposes that …

The Application Of The Totality Principle In Singapore, Zi Yang Wong Jun 2024

The Application Of The Totality Principle In Singapore, Zi Yang Wong

Singapore Law Journal (Lexicon)

When dealing with an offender who has been convicted of two or more distinct offences, the Court is faced with the issue of determining an appropriate aggregate sentence to be imposed. An aggregate sentence may offend the totality principle if it exceeds the length of the sentence imposed for the most serious offence, or if the sentence is “crushing” and not in keeping with the offender’s past record and future prospects. In deciding whether to vary a sentence on the grounds of the totality principle, the Courts have considered an offender’s overall criminality, advanced age, precedents and the possibility of …

An Abiding Commitment To The Death Penalty? Centrality Of The Rule Of Law In The Administration Of Capital Punishment In Singapore, Eugene K. B. Tan Jun 2024

An Abiding Commitment To The Death Penalty? Centrality Of The Rule Of Law In The Administration Of Capital Punishment In Singapore, Eugene K. B. Tan

Singapore Law Journal (Lexicon)

Capital punishment remains in use in Singapore. The Singapore government’s position is that the death penalty works in deterring the most serious crimes. Public trust and confidence remains healthy that the death penalty regime in Singapore has the requisite deterrent effect on criminals and has sufficient safeguards to prevent any miscarriage of justice. In 2012, the Singapore Parliament made significant amendments to the Penal Code and the Misuse of Drugs Act, marking a shift from the longstanding mandatory to a discretionary death penalty system for some of the most serious crimes. It demonstrates the authorities’ belief that the mandatory death …

The Limits Of Reliance On Reliance Damages? Case Comment: Liu Shu Ming And Another V Koh Chew Chee, Yu Jie Isabelle Lim Jun 2024

The Limits Of Reliance On Reliance Damages? Case Comment: Liu Shu Ming And Another V Koh Chew Chee, Yu Jie Isabelle Lim

Singapore Law Journal (Lexicon)

In Liu Shu Ming v Koh Chew Chee [2023] 1 SLR 1477 (“Liu Shu Ming (AD)”), the Court considered two questions on damages. These were, firstly, when a claimant would be able to claim reliance damages and secondly, whether a claimant would be able to claim reliance damages in the alternative to expectation damages. After considering these two issues, the Court seemingly expressed a preference for limiting claims for reliance damages to where it would be “impossible” or “extremely difficult” to prove expectation damages and not permitting claims for reliance damages in the alternative to expectation damages, or at the …

Moving Beyond Human Capital: Constructivism, Critical Pedagogy, And Interdisciplinary Collaboration In A Building And Construction Pathway, Ryan James Lundell Jun 2024

Moving Beyond Human Capital: Constructivism, Critical Pedagogy, And Interdisciplinary Collaboration In A Building And Construction Pathway, Ryan James Lundell

Social Justice in Educational Leadership EdD Dissertations

The silo structure and neoliberal rationality of Career Technical Education (CTE) pathways limit student learning and propagate the purpose of education as the creation of human capital, not a socially aware citizenry (Brown, 2017; Jacobs, 2010). Despite its history of racial tracking, CTE pathways still neglect critical thinking/dialogue around social/environmental justice issues, drastically hurting workers’ ability to confront these inequities (Darder, 2017; Oakes & Saunders, 2011; Shor & Freire, 1987). Using a qualitative research design that employs ethnographic elements, this study found that constructivism, critical pedagogy, and interdisciplinary collaboration can positively impact the experience, participation, and critical consciousness of students …

Jugaatronics, Monica Bhyrappa Jun 2024

Jugaatronics, Monica Bhyrappa

Masters Theses

Jugaatronics is a body of work that aims to address the current e-waste issues by designing consumer electronics that are repurposable, creating new electronics and objects. This project is born from the cultural practice of 'Jugaad' - the practice of repurposing everyday objects to extend their usability, a form of frugal innovation deeply embedded in my upbringing in India.

Most electronic devices are often discarded at the first sign of malfunction—deemed unnecessary. My thesis highlights this throwaway culture by integrating the concept of Jugaad(repurpose) into the lifecycle of electronic products, demonstrated as a hairdryer.

By showcasing potential repurposing opportunities at …

Selection Of Host Plants For Production Of Clanis Bilineata (Lepidoptera: Sphingidae), Xiaofeng Li, Mingming Guo, Kebin Li, Song Li, Honglin Feng, Jiwei Fan

Faculty Publications

Clanis bilineata Walker (Lepidoptera: Sphingidae), a burgeoning edible insect, is experiencing rising demand in China and other regions. Despite this interest, larval production is currently constrained by the limitations of artificial production technologies, particularly the selection of optimal host plants. This study rigorously evaluated the performance of C. bilineatha larvae on four main host plants: round-leaf soybean, pointed-leaf soybean, black locust, and kudzu. Preference tests demonstrated that the larvae were most attracted to black locust (34.76 ± 4.65%), with subsequent preferences for kudzu (25.00 ± 6.12%), round-leaf soybean (23.17 ± 2.79%), and pointed-leaf soybean (14.02 ± 4.74%). No significant preference …

Consumer Engagement In Fashion Circularity In China: Exploring Consumer Online Fashion Resale Through The Lens Of Social Practice Theory, Sujun Liu, Chuanlan Liu, Chunmin Lang Jun 2024

Consumer Engagement In Fashion Circularity In China: Exploring Consumer Online Fashion Resale Through The Lens Of Social Practice Theory, Sujun Liu, Chuanlan Liu, Chunmin Lang

Faculty Publications

Fashion resale has emerged as a notable strategy for the fashion industry to reduce its environmental footprint by promoting fashion circularity. Despite extensive research on consumer awareness of resale and the purchase of pre-owned items, there remains a gap in understanding the factors that influence consumers’ participation in resale markets, encompassing both selling and buying practices. Drawing on social practice theory (SPT), this qualitative study examines the nuanced factors influencing consumers’ online resale practices and investigates how online fashion resale practices (OFRPs) have become integrated into their daily consumption patterns. In-depth interviews were conducted with thirty experienced Chinese consumers engaged …

The Relationship Between Force Majeure Clauses And The Excuse Defenses, Gregory Crespi Jun 2024

The Relationship Between Force Majeure Clauses And The Excuse Defenses, Gregory Crespi

SMU Law Review Forum

Many commercial contracts include force majeure clauses that excuse the parties from performing some or all of their obligations upon the occurrence of specified supervening events. The law is unclear as to the proper relationship between such clauses and the assertion of common law or statutory excuse defenses such as impossibility, impracticability, or frustration of purpose with regard to supervening events that are outside of the scope of such clauses. In particular, under what circumstances, if any, should a force majeure clause be regarded as preclusive of these excuse defenses with regard to those supervening events that the clause does …

Reconstruction Of The Neglected: Bringing Life Back To The Old Powerhouse, Zoe A. Macmillan

Architectural Engineering

The Powerhouse is the oldest extant structure on Cal Poly campus and is currently abandoned. Built in 1910, it was in use as a power supply for Cal Poly Campus until the 1940s. Then, the School of Architecture and Environmental Design was granted permission to use it for class purposes. From 1967-1990 it was used as studio, guest lecture, and office space. In 1990 it was deemed structurally unstable and was left empty, slated for demolition. In 1993, a student lead movement placed it on the National Register of Historic Structures. Since then, it has been in a state neglect, …

Investigating The Relationship Between Malingering And Institutional Misconduct: Is Psychopathy The Link?, Lily A. Reed Jun 2024

Investigating The Relationship Between Malingering And Institutional Misconduct: Is Psychopathy The Link?, Lily A. Reed

Student Theses

Despite the established relationships between psychopathy and malingering, and psychopathy and risk for institutional misconduct, little empirical literature has been devoted to examining the interaction of these three constructs. The current study aimed to clarify this relationship by examining data from a sample of male criminal defendants within a federal prison located in a metropolitan area of the Southern United States. Data including the MMPI-2, PCL-R, diagnostic, institutional records, and demographic information was collected. Statistical analyses reinforced previous literature and theoretical conceptualizations that posit a relationship between psychopathy and malingering behaviors, as well as institutional misconduct. Preliminary findings suggest links …

Digital Social Reading In Second Language Learning And Teaching: Synthesis Of Current Research And Pedagogical Practices, Chiew Hong Ng, Yin Ling Cheung

Journal of English and Applied Linguistics

Growing interest in digital social reading (DSR) has led to research on the use of social annotations in digital learning, but there is yet to be a comprehensive review specifically on DSR for second language (L2). This paper aims to fill the gap by synthesizing 28 research papers published in English-medium refereed journals from 2010 to 2022 to derive these conclusions: (1) The predominant platforms or applications and text types for DSR were Google Docs, eComma, HyLighter, Perusall, and SocialBook. (2) The main L2 studied was English, and the majority of the studies were conducted at the university level. Activities/tasks/pedagogical …

A Qualitative Study Of Closed Captions In English Language Teaching (Elt) Youtube Videos, Queenie Mae G. Hernandez, Monica Louise G. Nacionales, Camilla J. Vizconde

Journal of English and Applied Linguistics

The COVID-19 pandemic reinforced online learning of English using YouTube as a viewing material in the Philippines. Using an adapted checklist evaluation, the study assessed the closed caption (CC) quality of forty-eight (48) YouTube videos dedicated to English language teaching and learning by Filipino content creators from 2020 to 2022. Findings show Filipino-made English language teaching (ELT) videos only used auto-generated captions, which affected the accessibility of the materials, especially for D/deaf learners. Multiple discrepancies were noted in the accuracy of the captions due to their automated properties, namely, in grammar and vocabulary, which hinder learning for those who use …

Utilizing a quantitative research design, the study collected and analyzed baseline data before and after the implementation of Quizlet to evaluate its influence on student results. The analysis sought to identify any statistically significant differences in performance that could be attributed to the use of the MALL tool. The results indicated that while some learners experienced individual progress, there was no conclusive evidence to suggest that Quizlet usage led to a significant improvement in overall …

The Construct Of English Native Speaker In Hong Kong, Ka Long Roy Chan Jun 2024

The Construct Of English Native Speaker In Hong Kong, Ka Long Roy Chan

Journal of English and Applied Linguistics

The paper provides a discussion of the construct of English native speakers among Hongkongers. Beginning with a review of the linguistic landscapes of Hong Kong, including English language education and English usage, followed by an introduction of a debate on the construct of English native speakers, this paper demonstrates the potential inclusion of Hongkongers as native speakers of English, with the use of their English variety, Hong Kong English. Additionally, the paper argues for a revision of the traditional geographically bounded definition of native speaker, drawing upon discussions by Rampton (1990), Kachru (1998), and Hansen Edwards (2017a, 2017b) regarding the …

Cross-Cultural And Cross-Proficiency Analysis Of Selected Cohesion Indices In Student Essays, Audrey Buenavista Morallo Jun 2024

Cross-Cultural And Cross-Proficiency Analysis Of Selected Cohesion Indices In Student Essays, Audrey Buenavista Morallo

Journal of English and Applied Linguistics

Cohesion is important in writing because of its role in writing quality development (Abdi Tabari & Johnson, 2023) and in making texts comprehensible (Ghasemi, 2013). It can differentiate between proficient and deficient writing (Crossley et al., 2016b, 2019), demonstrating its use as an index of language proficiency. Despite being an index of proficiency, little is known about cohesion use in second-language contexts (Abdi Tabari & Johnson, 2023; Crossley, 2020; Crossley et al., 2016a). To address this, this study investigated the use of connectives, givenness, and lexical overlap in essays from the Philippines, Singapore, and China available in a corpus. A …
