What We Talk About When We Talk About Race: Racial Discourses, Nationalism And Identity In Nineteenth Century Ireland, Timothy Werlinger Jan 2025

What We Talk About When We Talk About Race: Racial Discourses, Nationalism And Identity In Nineteenth Century Ireland, Timothy Werlinger

CGU Theses & Dissertations

The 19th century witnessed the rise of race and racism as a dominant framework of worldwide identity politics. These politics shaped the various social hierarchies and nationalist contexts across Europe and the world. Racial constructs adopted cultural, economic, and political components and did not rely exclusively on biological determinism. This had the effect of reinforcing or hardening boundaries between groups. This dissertation examines how racial identity was negotiated within an Irish context. It does this by considering social, scientific and nationalist discourses that engaged race as a device of inclusion and exclusion. By examining how racialized language permeated the Irish …

Tech-Neutrality Or Tech-Sensitivity? Emerging Principles Of Crypto-Asset Regulation In The U.S. And The E.U., Firat Cengiz Jan 2025

Tech-Neutrality Or Tech-Sensitivity? Emerging Principles Of Crypto-Asset Regulation In The U.S. And The E.U., Firat Cengiz

Loyola Consumer Law Review

Crypto assets are subject to financial and bespoke regulations in the United States (US) and the European Union (EU). Regulatory effectiveness requires assets to be subject to the regulatory regime that addresses their risks best, whilst regulatory fairness requires market participants to be able to identify the regulatory standards they need to comply with. Whilst comparing the interplay between financial and bespoke crypto-asset regulations in the US and the EU, this article finds that the two polities might be embarking on different paths of crypto-asset regulation. The former moves in the direction of tech-sensitivity, whereas the latter sticks with strict …

Quantifying Multidimensional Effects Of Physicochemical Parameters On Pfas Adsorption Using A Hybrid Response Surface Methodology-Machine Learning Approach, Harsh V. Patel, Jazmin Green, John Park, Stephanie Luster-Teasley Pass, Renzun Zhao Jan 2025

Quantifying Multidimensional Effects Of Physicochemical Parameters On Pfas Adsorption Using A Hybrid Response Surface Methodology-Machine Learning Approach, Harsh V. Patel, Jazmin Green, John Park, Stephanie Luster-Teasley Pass, Renzun Zhao

Engineering Management & Systems Engineering Faculty Publications

Per- and polyfluoroalkyl substances (PFAS) contamination has posed a significant environmental and public health challenge due to their ubiquitous nature. Adsorption has emerged as a promising remediation technique, yet optimizing adsorption efficiency remains complex due to the diverse physicochemical properties of PFAS and the wide range of adsorbent materials. Traditional modeling approaches, such as response surface methodology (RSM), struggled to capture nonlinear interactions, while standalone machine learning (ML) models required extensive datasets. This study addressed these limitations by developing hybrid RSM-ML models to improve the prediction and optimization of PFAS adsorption. A comprehensive dataset was constructed using experimental adsorption data, …

The Climate-Arbitration Nexus: How Legitimate Expectations Shape Investor Claims In A Decarbonizing World, M. Uzeyir Karabiyik Jan 2025

The Climate-Arbitration Nexus: How Legitimate Expectations Shape Investor Claims In A Decarbonizing World, M. Uzeyir Karabiyik

American University International Law Review

The global push for climate change mitigation, particularly through renewable energy promotion and fossil fuel phase-out, has sparked a surge in investor-state arbitrations. At the heart of these arbitrations lies the concept of “legitimate expectations,” which is considered by arbitral tribunals as a cornerstone of the fair and equitable treatment (FET) standard. This Article conducts a comprehensive analysis of diverse approaches adopted by arbitral tribunals in interpreting legitimate expectations in the context of climate action. It then delves into specific interpretations of this concept within two categories: disputes related to states’ renewable energy promotion policies and those that stem from …

No Right To Exclude: The European Union’S Reparative Migration Obligations, Steffi Colao Jan 2025

No Right To Exclude: The European Union’S Reparative Migration Obligations, Steffi Colao

American University International Law Review

In this article, I unify the diverse but related ways that scholars, activists and people on the move have demanded migration as a form of reparations. I first compare (mostly U.S.-based) theoretical arguments for migration as a form of reparations for colonization, military occupation, and climate harm. I then turn to international legal traditions of reparations to highlight the ways that reparative migration might be actualized in response to human rights violations.

Looking at EU and international legal standards on remedies, I show how these arguments are not necessarily radical but, in fact, could be at least partially possible under …

Juror Certainty About Firearm Evidence: Examination Effects, Dr. Amelia Shooter, Dr. Paraic Scanlon, Professor Sarah L. Cooper Jan 2025

Juror Certainty About Firearm Evidence: Examination Effects, Dr. Amelia Shooter, Dr. Paraic Scanlon, Professor Sarah L. Cooper

Criminal Law Practitioner

Firearms examiners can evaluate associations between suspect ammunition and ammunition test-fired by a suspect firearm by microscopically comparing tool marks on both projectiles. This practice has been criticized, including by the National Academy of Sciences, yet firearms examiners routinely testify as experts in the United States. Jurors must determine the weight of expert evidence, which lawyers can aim to discredit on cross-examination or rehabilitate on redirect-examination. Using online vignettes, the authors investigated how both cross-examination and redirect-examination affected potential U.S. jurors' certainty about expert firearms evidence.

Participants (n=114) were asked to rate their certainty (on a scale of 0-100) about …

Defining “Delineation”: How The Circuit Split On The Delineation Test For The Copyrightability Of Fictional Characters Can Be Fixed, Kurt Bauer Jan 2025

Defining “Delineation”: How The Circuit Split On The Delineation Test For The Copyrightability Of Fictional Characters Can Be Fixed, Kurt Bauer

American University Law Review

The standard for the copyrightability of fictional characters needs clarification. Courts have long relied on the delineation test to determine whether a character is sufficiently developed to merit protection separate from its underlying work, yet the circuits diverge on how this test should be applied. The Ninth Circuit’s Towle test relies on overruled precedent, treats characters as static, imposes an originality threshold beyond that required by the Copyright Act, and risks extending protection to inanimate props. In contrast, the Second Circuit has tied delineation more clearly to the Act’s core requirements of originality and fixation, offering a more principled approach. …

Introductory Remarks, Dana Welch Jan 2025

Introductory Remarks, Dana Welch

American University Business Law Review

The year 1925 proved to be eventful for the United States and for the world. The Scopes Monkey Trial placed evolution in the spotlight. The New Yorker published its first issue. The "Grand Ole Opry´ premiered on the radio as the WSM Barn Dance. And fascism threatened Europe as Benito Mussolini dissolved the Italian Parliament and declared himself "Il Duce," the dictator of Italy, while Adolf Hitler published the first volume of Mein Kampf, written from prison. On a lighter note, Washington, D.C., saw the first National Spelling Bee, won by Frank Neuhauser, an eleven-year-old from Kentucky who correctly spelled …

The Right To Arbitrate(?): Integrating Consumer Protection Into Judicial Review Of The Mccarran-Ferguson Act And The New York Convention, Rachel Bamberger Jan 2025

The Right To Arbitrate(?): Integrating Consumer Protection Into Judicial Review Of The Mccarran-Ferguson Act And The New York Convention, Rachel Bamberger

American University Business Law Review

International commercial arbitration has grown increasingly popular as an alternative method of dispute resolution. This Comment explores the struggle courts face when they must determine whether to apply the New York Convention, an international treaty that recognizes and compels arbitration agreements, or a federal statute known as the McCarran-Ferguson Act, which delegates authority to the states to regulate insurance. Conflict arises when foreign insurers seek to compel arbitration under the New York Convention in states with antiarbitration insurance laws, and courts must choose between upholding domestic state laws or honoring the Treaty.

This Comment examines the method of analysis used …

A Proposal For One “Super” Independent Accountability Mechanism, Daniel D. Bradlow Jan 2025

A Proposal For One “Super” Independent Accountability Mechanism, Daniel D. Bradlow

Perspectives

This essay will discuss how the MDBs- for example, the World Bank Group, the African, Asian, and Inter-American Development Banks, and more recently the European Bank for Reconstruction and Development, Asian Infrastructure Investment Bank, and the New Development Bank – are dealing with the issue of accountability. It will argue that, although the MDBs have been leaders in promoting international organizational accountability, their mechanisms of accountability are not keeping up with the evolution in their operations. In the interests of promoting new and creative thinking about these issues, it will also make an ambitious proposal for how the MDBs jointly …

Book Review The Making Of A Justice: Reflections On My First 94 Years By John Paul Stevens, Stephen Wermiel

Book Reviews

The autobiography of Justice John Paul Stevens, published just a few months before he died, is an enticing travelogue for Supreme Court nerds. Other travelers may want to pick a different landscape.

In The Making of a Justice: Reflections on My First 94 Years, Stevens who died in July 2019, at age 99, spent 130 pages on his life before he joined the Supreme Court and then 394 pages describing the decisions during his thirty-four year as a Justice. Stevens was an agile writer and did as good a job as anyone can of making the narrative accessible, but it …

Through A Glass Darkly: How Securities Disclosures Give A Distorted View Of The Economy, Gerald F. Davis Jan 2025

Through A Glass Darkly: How Securities Disclosures Give A Distorted View Of The Economy, Gerald F. Davis

Seattle University Law Review

Our understanding of the American economy often relies on stylized facts derived from mandatory disclosures by listed corporations. Data vendors like Standard & Poor’s vacuum up 10Ks and proxy statements into databases, and scholars distill these into tentative maps. This may have been adequate for a postwar economy centered on asset-heavy manufacturers, but it is increasingly out of step with an information-based economy. Companies listed on the stock market are fewer in number and less representative than they were, light in tangible assets and people, and heavy on IP. Basic facts such as what industry they are in are increasingly …

Examining Correlations Between Inhibition Efficiency And Compound Properties For Corrosion Inhibitors On Carbon Steel Rebar In Concrete, Nicole Langenfeld Jan 2025

Examining Correlations Between Inhibition Efficiency And Compound Properties For Corrosion Inhibitors On Carbon Steel Rebar In Concrete, Nicole Langenfeld

Williams Honors College, Honors Research Projects

This project will look to determine if correlations exist between the inhibition efficiency and particular chemical properties of different corrosion inhibitors for carbon steel rebar in concrete affected with chlorides. Examining the inhibition efficiency of different corrosion inhibitors and attempting to find correlations or a general rule of thumb for what denotes a better corrosion inhibitor would be valuable. This similar concept has been seen with Lipinski's rule of 5 where he created a general guide to predict if compounds were orally active in humans. Since little information is readily available and no known correlations exist for corrosion inhibitors on …

Interrogating The Sacred And Special: Engaging Students In Diversifying Special Collections, Susan Falciani Maldonado, Sharon L. Albert Jan 2025

Interrogating The Sacred And Special: Engaging Students In Diversifying Special Collections, Susan Falciani Maldonado, Sharon L. Albert

Faculty Contributions to Books

The answer to the question “What is the future of special collections?” is one that has evolved in scope over the past twenty-five years. Through the late twentieth century, the role of the special collections librarian seemed largely curatorial: to conserve these precious, unique resources—rare books, archival material, and other unique collections— for posterity and for “serious” researchers. While it remains true that the nature of its special collections can distinguish an academic library in ways that its database and print holdings may not, what emerged in the late 1990s and early 2000s was a movement to put rare books …

The Effect Of Computer Monitoring On Employees’ Productivity In Telecommuting Arrangements, Yea Hee Ko, In Gyun Baek Jan 2025

The Effect Of Computer Monitoring On Employees’ Productivity In Telecommuting Arrangements, Yea Hee Ko, In Gyun Baek

Research Collection Lee Kong Chian School Of Business

When employees work from home, organizations have traditionally placed a stronger reliance on output-based controls because of the inability to physically observe its employees. Because of recent advances in technology, however, many organizations now use input-based controls. One such input-based control is computer monitoring, which records the number of hours spent working and leaves out any time in which an employee does not perform work activities. On the one hand, computer monitoring may provide productivity-enhancing benefits by reducing the likelihood of employees experiencing self-control problems, such as procrastination. On the other hand, computer monitoring may motivate reduced effort by decreasing …

An Organizational Theory Of Corporate Law, Emilie Aguirre, Julie Yen, Julie Battilana Jan 2025

An Organizational Theory Of Corporate Law, Emilie Aguirre, Julie Yen, Julie Battilana

Faculty Scholarship

Corporate law is in a moment of vibrant and contentious discussions about potential reforms. As firms exit Delaware, passive investment predominates, private equity expands, and public markets decline, corporate law faces a growing set of challenges that threaten its stability and efficacy. At the same time, the world faces pressing crises, including climate change, social and economic inequalities, and threats to democracy, though corporate law scholars typically consider these crises to be outside corporate law’s remit.

In this Article, we argue that to understand and address the multidimensional crises that face both corporate law and society, we must address shortcomings …

Theories Of Child Development & Theories Of Religious And Spiritual Development (Rsd) In Children, Marjorie Lindner Gunnoe Jan 2025

Theories Of Child Development & Theories Of Religious And Spiritual Development (Rsd) In Children, Marjorie Lindner Gunnoe

University Faculty Publications and Creative Works

This essay introduces readers to the foundational theories of child development and the ways in which these theories have been applied or extended to children’s religious and spiritual development (RSD). By “foundational theories,” I mean the theories introduced in the opening chapters of developmental textbooks. This essay is not a theological critique of psychological theories (for this, see Gunnoe, 2022), nor a “state of the field” review of RSD (for this, see Boyatzis, 2023). Rather, it is a primer on the broad theoretical approaches that scaffold contemporary research on RSD.
