Swallowing Its Own Tail: The Circular Grammar Of Background Principles Under Lucas, Gregory M. Stein Feb 2021

Swallowing Its Own Tail: The Circular Grammar Of Background Principles Under Lucas, Gregory M. Stein

Scholarly Works

The exception to the rule the United States Supreme Court established in Lucas v. South Carolina Coastal Council states that a regulation that deprives a landowner of all economically viable use of its land is a taking per se unless “the proscribed use interests were not part of [the owner’s] title to begin with.” This article, a review of two other articles, makes three grammatical arguments to demonstrate that the Court’s exception is actually an essential ingredient of the main rule, and a partially contradictory one at that.

First, the so-called exception is not an exception because it assumes an …

Michigan COVID-19 Testing Turnaround Data

The COVID Testing Turnaround Time page was obtained from Michigan's COVID-19 data page: https://www.michigan.gov/coronavirus/0,9753,7-406-98163_98173-545615--,00.html.

This report was created by the Michigan Department of Health & Human Services, providing data for the past 14 days on the average time it takes for a diagnostic COVID-19 laboratory test to be reported to the state health department. Testing turnaround time data will be updated weekly on Friday mornings.

MDHHS receives results from commercial labs, hospitals, and public health labs. However, public health laboratories perform limited diagnostic testing and disease surveillance for infectious diseases. Total turnaround time is calculated from the difference of …

The Need For Dedicated Microbiology Leadership In The Clinical Microbiology Laboratory, Linoj P. Samuel, Glen T. Hansen, Colleen S. Kraft, Bobbi S. Pritt Feb 2021

The Need For Dedicated Microbiology Leadership In The Clinical Microbiology Laboratory, Linoj P. Samuel, Glen T. Hansen, Colleen S. Kraft, Bobbi S. Pritt

Pathology and Laboratory Medicine Articles

Clinical microbiology laboratories play a crucial role in patient care using traditional and innovative diagnostics. Challenges faced by laboratories include emerging pathogens, rapidly evolving technologies, healthcare-acquired infections, antibiotic-resistant organisms and diverse patient populations. Despite these challenges, many clinical microbiology laboratories in the United States are not directed by doctoral level microbiology-trained individuals with sufficient time dedicated to laboratory leadership. This manuscript highlights the need for medical microbiology laboratory directors with appropriate training and qualifications.

Using Molecular Dynamics Simulations To Understand Receptor-Complex Communication And Signaling, Hannah Margaret Hoag Feb 2021

Using Molecular Dynamics Simulations To Understand Receptor-Complex Communication And Signaling, Hannah Margaret Hoag

Theses and Dissertations

The overarching purpose of this document is to use Computer-aided drug design and Molecular dynamic simulations to better understand elusive drug-receptor interactions, as well as various types of inter-receptor signaling. Chapter One introduces the theory and importance of Computer-aided drug design and the methodology used in both Chapters Two and Three.

Chapter Two uncovers the relationship between the well-studied ABCB1 transporter and a newly identified drug known as Xanthohumol (XN). XN is compared to a commonly used drug, Doxorubicin (DOX), in this chapter. If the ABCB1 transporter can be properly inhibited, cancer-fighting drugs will be able to stay within the …

Snow Ensemble Uncertainty Project (Seup): Quantification Of Snow Water Equivalent Uncertainty Across North America Via Ensemble Land Surface Modeling, Hans-Peter Marshall Feb 2021

Snow Ensemble Uncertainty Project (Seup): Quantification Of Snow Water Equivalent Uncertainty Across North America Via Ensemble Land Surface Modeling, Hans-Peter Marshall

Geosciences Faculty Publications and Presentations

The Snow Ensemble Uncertainty Project (SEUP) is an effort to establish a baseline characterization of snow water equivalent (SWE) uncertainty across North America with the goal of informing global snow observational needs. An ensemble-based modeling approach, encompassing a suite of current operational models is used to assess the uncertainty in SWE and total snow storage (SWS) estimation over North America during the 2009–2017 period. The highest modeled SWE uncertainty is observed in mountainous regions, likely due to the relatively deep snow, forcing uncertainties, and variability between the different models in resolving the snow processes over complex terrain. This highlights a …

From Hector Mine M7.1 To Ridgecrest M7.1 Earthquake. A Look From A 20-Year Perspective, Sergey Pulinets, Marina Tsidilina, Dimitar Ouzounov, Dmitry Davidenko

Mathematics, Physics, and Computer Science Faculty Articles and Research

The paper provides a comparative analysis of precursory phenomena in the ionosphere and atmosphere for two strong earthquakes of the same magnitude M7.1 that happened in the same region (North-East from Los Angeles) within a time span of 20 years, the Hector Mine and Ridgecrest earthquakes. Regardless of the similarity of their location (South-Eastern California, near 160 km one from another), there was one essential difference: the Hector Mine earthquake happened during geomagnetically disturbed conditions (essential in the sense of ionospheric precursors identification). In contrast, the quiet geomagnetic conditions characterized the period around the time of the Ridgecrest earthquake. The …

Coining New Tax Guidance: How The Irs Is Falling Behind In Crypto, David C. Mcdonald Feb 2021

Coining New Tax Guidance: How The Irs Is Falling Behind In Crypto, David C. Mcdonald

University of Miami International and Comparative Law Review

In October 2019, the Internal Revenue Service offered its first guidance on cryptocurrency reporting standards in nearly five years. As digital investments become more commonly accepted, the need for regulation and guidance becomes clearer. Issues such as how to classify cryptocurrencies and how a transaction’s purpose impacts reporting standards are currently being addressed across the globe as governments work to develop protocols that organize this rapidly developing field. This note analyzes the developing reporting standards of select countries and the potential impacts on use as cryptocurrencies become more mainstream as a potential investment and method of payment.

Balancing Trade And Economic Security: Andritz V. United States And The Role Of Customs And Border Protection In Enforcing The Plant Protection Act, Alexandra Khrebtukova

University of Miami International and Comparative Law Review

This paper examines the case of Andritz v. United States—first filed in the U.S. Court of International Trade then transferred to the U.S. District Court for the Southern District of Texas—as a demonstrative case study highlighting the collaboration between U.S. Customs and Border Protection (CBP) of the Department of Homeland Security and the Animal and Plant Health Inspection Service (APHIS) of the Department of Agriculture. CBP is charged with facilitating legitimate trade and travel while safeguarding the borders of the United States to protect against, inter alia, the entry of dangerous goods, including through agricultural import and entry inspection. …

Assessing The Psychological Impact Of Covid-19 Among College Students: An Evidence Of 15 Countries, Kavita Batra, Manoj Sharma, Ravi Batra, Tejinder P. Singh, Nena Schvaneveldt

School of Medicine Faculty Research

Mental health issues among college students is a leading public health concern, which seems to have been exacerbating during the COVID-19 pandemic. While previous estimates related to psychological burden among college students are available, quantitative synthesis of available data still needs to be performed. Therefore, this meta-analysis endeavors to present collective evidence discussing the psychological impact of COVID-19 among college students. Bibliographical library databases, including Embase, Medline, CINAHL, Scopus, and PsycINFO, were systematically searched for relevant studies. Titles, abstracts, and full articles were screened, and two reviewers extracted data. Heterogeneity was assessed by I-2 statistic. The random-effects model was utilized …
