The prohibition of cruel and unusual punishment in the Eighth Amendment of the U.S. Constitution requires that execution methods avoid “superadding pain.” The U.S. Supreme Court has held that the imposition of a death sentence should include no additional pain beyond that needed to kill. That means, for example, that while pain may be inherent in the method of killing, torture is prohibited. As concerns about the pain involved in lethal injections has increased, states have begun executions by shooting inmates in the heart and by suffocation through gas mask. Still Uncertain After All Of These Years: Constitutional Rights Of Guantanamo Detainees Tried By Military Commission, Michael D. Ross

This article explores whether Guantanamo detainees are entitled to constitutional protections at military commission trials. In 2006, Congress passed the Military Commissions Act (“MCA”). Its goal was to establish a fair system to try foreign detainees accused of war crimes. The ensuing nineteen years have revealed that the system needs reform. The most important cases, such as the 9/11 and U.S.S. Cole prosecutions, are still bogged down in pre-trial litigation that has lasted over a decade. But before policy makers consider reforms, they should know what constitutional protections apply at a military commission. Federal courts have not answered that question. …

The Prison Litigation Reform Act is celebrating its 30th birthday this year. It was designed to make it harder for incarcerated people to file lawsuits challenging the constitutionality of their conditions of confinement and to restrict their remedies even when they do so successfully. It has been wildly effective at achieving those objectives. It has also propped up mass incarceration and facilitated the persistence of dismal conditions of confinement in carceral facilities in the United States.

The PLRA’s exhaustion requirement—arguably its most damaging provision—silences carceral voices without regard for the merit of their complaints. It does so by mandating …

Combustion instability is one of the leading factors in limiting the progress and innovations of liquid rocket engines and power plants. Under certain operating conditions, unsteady heat release and acoustic wave interactions can couple and lead to instabilities, such as self-sustaining pressure oscillations, that can lead to reduced combustor performance and potentially hardware damage. In this project, the thermoacoustic effects of controlling the equivalence ratio of a single-element natural gas combustor were modeled and analyzed. [Objective] Aiming at the limitations of low operating efficiency, high energy consumption, and poor stability in traditional trajectory planning of Delta robots during food sorting, this study proposes an optimized trajectory scheme to effectively reduce operation time, lower energy consumption, and improve operation stability. The mechanisms underlying tumor cell-myeloid cell interactions in the tumor microenvironment (TME) remain unclear, and predictive biomarkers for patient response to myeloid checkpoint blockade are lacking. This study identified specific binding between tight junction claudins (CLDNs) and leukocyte immunoglobulin-like receptor subfamily B2 (LILRB2) and LILRB5. In multiple human cancer cohorts, the spatial proximity of LILRB2-positive macrophages to CLDN-expressing cancer cells correlated with clinical outcomes, highlighting this spatial relationship as a potential biomarker. In syngeneic LILRB2-transgenic and humanized mouse models, CLDN18.2-LILRB2 interactions triggered bidirectional signaling, enhanced the immunosuppressive activity of myeloid cells, and accelerated tumor progression. Wrongful convictions are representative of errors in the criminal justice system. Often reflecting broad patterns of social inequality, prior research suggests that structural factors may influence the likelihood of conviction and access to legal resources. This project investigates how these social equality indicators correlate with wrongful convictions at the county level across the United States. Using data from the National Institute of Health and the National Registry of Exonerations, we aggregate measures of education, poverty, and non-English-speaking populations normalized by population density and combine them with exoneration records to create a series of comparative maps. Fallow Ground refers to the agricultural practice of intentionally leaving a field unseeded for a year or more in order to restore fertility and interrupt cycles of depletion. Although fallowing is a beneficial and necessary practice, the term has also come to signify waste or a lack of productivity. This double meaning is central to the work, reflecting a central contradiction: that withdrawal can be as vital as effort, and that rest, like labor, can function as a deliberate and sustaining act. The early screening and continuous monitoring of cardiovascular diseases need effective acquisition and smart processing of electrocardiogram (ECG) signals. In this article, we introduce a compact platform designed for the acquisition of low-noise ECG signals and classification of the signals using a one-dimensional convolutional neural network (1D-CNN). Our compact platform consists of a low-noise analog front-end (AFE), including an instrumentation amplifier and a chain of analog filters, along with a data acquisition component designed to ensure effective suppression of baseline wander and high frequencies. Systemic neoadjuvant chemotherapy, often combined with immunotherapy, is the standard of care for early-stage, non-breast cancer susceptibility gene (BRCA)-mutant triple negative breast cancer (TNBC). However, up to 70% of patients retain residual disease after treatment, which is linked to recurrence and mortality within 5 years. To define mechanisms of resistance, we performed single-cell RNA sequencing on orthotopic TNBC patient-derived xenografts during a cycle of treatment with doxorubicin and cyclophosphamide (AC). Clustering identified four tumor epithelial cell populations, with basal cells enriched in residual tumors. Infancy represents a period of rapid neural development during which early temperamental traits begin to emerge. Fearful reactivity, a core dimension of temperament, has been linked to later risk for anxiety and related internalizing outcomes. The present study examined developmental patterns of frontal alpha-band electroencephalographic (EEG) coherence across infancy and tested whether neural connectivity within frontal regions was associated with fearful temperament. Participants were 61 infants recruited through a multisite longitudinal study conducted at Florida Atlantic University, Washington State University, and Virginia Tech. This dissertation argues that Nietzsche thought he was a genuine philosopher despite seeming at times to suggest that he was not. I arrive at this conclusion by comparing his thoughts on genuine philosophers with his thoughts about himself in an effort to show that his self-professed task is identical to theirs.

There are two types of genuine philosophers in Nietzsche’s late works: an old species that relied on a belief in “God” to legislate their values, and a new one that must do so without it. The former cannot perform their task after the death of God, which is why …

Gender-based violence (“GBV”) remains a pervasive human rights issue throughout Botswana. When it comes to gender equality, Botswana’s dual constitutional and customary legal system is a paradox. Despite its commitment to equality and nondiscrimination, Botswana’s Constitution allows customary courts to discriminate freely to preserve traditional practices that disadvantage women. These traditional practices affect women’s right to property, inheritance, marriage, legal representation, and personal safety. Customary law continues to constrain women’s right to economic autonomy and access to justice, leaving many women dependent on the men who abuse them. The figure of the “criminal immigrant” occupies a central place in contemporary U.S. immigration discourse, shaping public perception, enforcement priorities, and legal doctrine. Yet a substantial body of empirical research consistently demonstrates that immigrants—both documented and undocumented—commit crimes at lower rates than native-born citizens. This Note examines why the narrative of immigrant criminality persists despite this evidence and how it influences the development and operation of immigration law. Over the course of the twentieth century, the Roman Catholic understanding of speaking in tongues shifted from viewing the gift as always and exclusively xenolalia (infused knowledge of foreign languages) to a view of tongues as primarily glossolalia (inspired praise not in any known human language). This theological shift is reflected in standard Catholic reference works and in the ordinary teachings of the Catholic magisterium. This article advocates for a globally informed yet locally experienced “Pentecostal theology” rooted in a specific theological approach. This Pentecostal approach shapes and re/shapes lived theology. Lived spirituality-theology is relational, emphasizing proper worship of the living God (orthodoxy), effective witness (orthomartus), and productive work (orthoergon). This represents a lived theology that is both personal and communal. Additive manufacturing with cementitious materials advances rapidly, but predicting structural build-up is critical for 3D printed structure buildability. Various supplementary cementitious materials (SCMs) and fibers are commonly used to enhance structural build-up in 3D printing. Evaluating their effects is necessary for successful printing. In this research, this effect is studied for common SCMs, including fly ash and silica fume, and fibers including polypropylene (0.375% and 0.75% by volume), steel (0.75% and 1.5% by volume), and hemp fibers (0.375% and 0.75% by volume). Modern next-generation sequencing (NGS) projects routinely generate terabytes of data that researchers download from public repositories such as SRA and ENA. Existing download tools typically employ static concurrency settings, leading to inefficient bandwidth utilization and prolonged download times under dynamic network conditions. We introduce FastBioDL, a parallel downloader for large biological datasets with an adaptive concurrency controller. FastBioDL frames downloading as an online optimization problem, using a utility function and gradient descent to adjust the number of concurrent socket streams during runtime. Leadership programming in NCAA Division I athletics is designed to support holistic athlete development, including career readiness, financial literacy, and personal growth. However, participation in selective initiatives like the Student-Athlete Advisory Committee (SAAC) is often limited, raising concerns about equality and access. Through the theory of social reproduction, our study examines how these programs reflet and reinforce structural inequalities. Interviews with athletic staff reveal selection procedures (or lack thereof) privilege athletes who already possess social and cultural capital and therefore reproduce existing hierarchies rather than serve as a developmental tool.
