Teaching Local Difficult History Through Primary Sources: Exploring Tensions In Teachers’ Pedagogical Reasoning, Alex Honold, Logan Eiland Jan 2025

Teaching Local Difficult History Through Primary Sources: Exploring Tensions In Teachers’ Pedagogical Reasoning, Alex Honold, Logan Eiland

Education Faculty Articles

Teaching about local, difficult pasts can center students, their communities, and civic action. However, doing so poses personal and professional challenges. Drawing from Critical Historical Inquiry and Activity Theory, this study explored how six experienced secondary social studies teachers reasoned about selecting primary sources to teach the history of policing and activism in Detroit. As teachers developed their text-sets, they navigated a variety of tensions related to their instructional goals, beliefs, and knowledge of students’ identities and communities. We focus on two common areas of tension: how to teach the racialized history of Detroit policing while positioning students as sense-makers …

Introducing Sustainable Development Goals In College Curricula: A Way Forward, Christy Ashley, Jason D. Oliver, Hillary Leonard Jan 2025

Introducing Sustainable Development Goals In College Curricula: A Way Forward, Christy Ashley, Jason D. Oliver, Hillary Leonard

Markets, Globalization & Development Review

The commentary proposes a blueprint to help guide curriculum innovations, partnerships, and teaching interventions that incorporate the United Nations sustainable development goals (SDGs) into the curriculum. It suggests the utilization of AACSB’s Societal Impact Canvas with Ancona et al.’s (2007) Leadership Capabilities (Sensemaking, Relating, Visioning, Inventing) to provide a blueprint for mission-aligned SDG integration at a local level. It provides an illustrative example from the University of Rhode Island (USA), where the focus is on the Blue Economy. It aims to provide practical guidance for how a college or university can efficiently organize to gain stakeholder input that helps enhance …

How Can You Turn Adversarial Attorneys Into Quasi-Mediators?, John Lande Jan 2025

How Can You Turn Adversarial Attorneys Into Quasi-Mediators?, John Lande

Faculty Publications

This article grows out of an educational program sponsored by the St. Louis chapter of the Association of Attorney-Mediators, which functioned as a focus group. It describes mediators’ experiences with attorneys in mediation who were cooperative and adversarial.

It describes things that mediators can do to make adversarial attorneys behave as “quasi-mediators.” Attorneys acting as quasi-mediators help their clients realistically understand the other side’s perspectives. The attorneys also promote their clients’ interests by enlisting the mediators’ help and encouraging the other side to adjust their positions. Attorneys who sometimes act as quasi-mediators tailor their techniques to their clients’ preferences and …

Choosing To Use Good Language In The "Adr" Field, John Lande

Faculty Publications

On October 30, 2024, Debra Berman posted a message on a listserv encouraging colleagues to drop the word “alternative” from “ADR.” Her post quickly prompted 24 responses. This article summarizes the listserv discussion about the term “ADR,” and demonstrates serious misconceptions embodied in popular concepts of “BATNA” and “facilitative” and “evaluative” mediation as well as other problematic language that we frequently use.

Language is a shared resource that can enable people to understand each other accurately and to improve our ideas and techniques. This article describes the many ways that language has huge effects on people’s thoughts and actions, and …

When Is Discrimination Harmful?, Sandra F. Sperino Jan 2025

When Is Discrimination Harmful?, Sandra F. Sperino

Faculty Publications

In Muldrow v. City of St. Louis, the Supreme Court held that Title VII does not require a plaintiff to establish material harm to prove employment discrimination. Instead, any action that is negative and affects a term, condition or privilege of employment is sufficient, if the employer took the action because of a protected trait.

At first glance, Muldrow appears to be a middling case focused on a technical aspect of discrimination law. This Article argues that Muldrow has the potential to be one of the most important modern discrimination cases. If taken to its natural conclusion it will …

Church Autonomy, Textualism, And Originalism: Scotus's Use Of History To Give Definition To Church Autonomy Doctrine, Carl H. Esbeck Jan 2025

Church Autonomy, Textualism, And Originalism: Scotus's Use Of History To Give Definition To Church Autonomy Doctrine, Carl H. Esbeck

Faculty Publications

Church autonomy is a First Amendment doctrine altogether distinct from the more familiar causes of action brought under the Establishment Clause and the Free Exercise Clause. The principle of church autonomy was first recognized by the Supreme Court of the United States in the post-Civil War case Watson v. Jones, holding that civil courts must not be drawn into resolving religious questions or settling disputes over church polity. And early this century, in the unanimous decision Hosanna-Tabor Evangelical Lutheran Church & School v. EEOC, the theory of church autonomy took on its most fully developed form as a constitutional immunity …

Resolving American Semiconductor Challenges Through Making The Itc A Preferred Forum, Emma Donnelly Jan 2025

Resolving American Semiconductor Challenges Through Making The Itc A Preferred Forum, Emma Donnelly

The University of Chicago Business Law Review

This Comment demonstrates the need in United States’ semiconductor policy for the United States to establish itself as a preferred IP litigation forum. The paper notes three obstacles to be solved in current semiconductor IP policy: IP Theft, Semiconductor Counterfeiting, and Balanced Licensing. The paper next argues why the International Trade Commission (ITC) is an ideal United States forum for these concerns and addresses general benefits and shortcomings of ITC litigation. Lastly, this paper evaluates potential policy changes to ITC procedure and application to entrench the ITC as the premier legal forum for semiconductor policy. The paper argues that changes …

Horizons Of Risk: Climate Stress And The Federal Reserve, David A. Wishnick Jan 2025

Horizons Of Risk: Climate Stress And The Federal Reserve, David A. Wishnick

The University of Chicago Business Law Review

Contemporary financial supervision depends on knowledge about risk. Threats to bank soundness and financial stability abound, but they present themselves in amorphous ways. How should supervisors assess their significance? This Article examines a process being employed by the Federal Reserve (Fed) to assess threats posed by climate change. The process, climate scenario analysis (CSA), models the impact of hypothetical climate-related events on financial market participants. Descriptively, the Article argues that the Fed’s approach to CSA hews closely to the most prominent supervisory innovation to emerge from the Global Financial Crisis: stress testing. With its CSA experiments, the Fed is adapting …

Event Contracts Are A Step Too Far For Derivatives Regulation, Ilya Beylin Jan 2025

Event Contracts Are A Step Too Far For Derivatives Regulation, Ilya Beylin

The University of Chicago Business Law Review

This Article develops two branches of history towards understanding derivatives markets and their regulation. First, using a comprehensive database of derivatives products that the Commodity Futures Trading Commission (CFTC) has authorized, this Article traces stages in the development of derivatives products. The empirical study examines key evolutionary steps from the birth of agricultural futures in the second half of the 1800s to where traders now bet on how long Taylor Swift’s most recent album dominates the Billboard 200, whether the President will pardon specific individuals, or how many times Bill Ackman (a notable hedge fund manager) accuses MIT professors of …

Generative Ai Meets Section 230: The Future Of Liability And Its Implications For Startup Innovation, Megan E. Cistulli Jan 2025

Generative Ai Meets Section 230: The Future Of Liability And Its Implications For Startup Innovation, Megan E. Cistulli

The University of Chicago Business Law Review

The rapid advancement of generative artificial intelligence (AI) is testing the limits of Section 230 of the Communications Decency Act, a statute that has long shielded online platforms from liability for user-generated content. This liability shield helped shape the modern internet, but AI’s ability to create its own content blurs the traditional distinction between platforms acting as passive hosts and those functioning as active publishers. As a result, courts and lawmakers are reexamining the scope and future of Section 230. This Comment examines how proposed reforms to Section 230 could impact startups and emerging tech companies that use generative AI …

A Large Electroencephalogram Database Of Freewill Reaching And Grasping Tasks For Brain Machine Interfaces, Bhoj Raj Thapa, John Boggess, Jihye Bae

Electrical and Computer Engineering Faculty Publications

Brain machine interfaces (BMIs) offer great potential to improve the quality of life for individuals with neurological disorders or severe motor impairments. Among various neural recording modalities, electroencephalogram (EEG) is particularly favorable for BMIs due to its noninvasive nature, portability, and high temporal resolution. Existing EEG datasets for BMIs are often limited to experimental settings that fail to address subjects’ freewill in decision making. We present a large EEG dataset, containing a total of 6808 trials, recorded from 23 healthy young adults (eight females and 15 males with an age range from 18 to 24 years) while performing reaching and …

The Martyrdom Of Nadezhda Kurchenko: Soviet Hero Cults And The Spiritual Turn In Late Socialism, Steven E. Harris Jan 2025

The Martyrdom Of Nadezhda Kurchenko: Soviet Hero Cults And The Spiritual Turn In Late Socialism, Steven E. Harris

History and American Studies Articles

This article argues that the spiritual turn in Soviet atheism under Brezhnev provided a meaningful solution to the problems of producing heroes when self-sacrificing martyrs were losing their appeal. To support this claim, I examine the story of Nadezhda Kurchenko, a nineteen-year-old flight attendant killed by two hijackers on an Aeroflot plane in October 1970. This article traces the heroic and spiritual dynamics of Kurchenko’s martyrdom through her funeral, hagiographies, iconic photograph, and sacred spaces. The spiritual turn enabled the authors of her story to free it from the shadows of wartime youth martyrs and ground it in the conservative …

The Media Framing Of India’S Nuclear Weapons Discourse, Sitakanta Mishra, Hely Desai Jan 2025

The Media Framing Of India’S Nuclear Weapons Discourse, Sitakanta Mishra, Hely Desai

International Journal of Nuclear Security

The Indian media has had an immense role in framing public perceptions of nuclear weapons within the Indian subcontinent. Examining the largely nationalistic tone of news coverage helps analyze how the media has shaped India’s idea of its status as a nuclear weapon state. Examining the sociocultural discourse around the bomb, this paper analyzes the major influence that the Indian media has in information distribution and how that influence translates to the formation of the atomic attitudes of the masses. In situating the Indian media’s approach to nuclear weapons at large, this work studied the framing of domestic nuclear weapons …

Implementation Of International Nuclear Counterterrorism Legal Instruments: The Case For Nuclear Forensics, Jerry S. Davydov Jan 2025

Implementation Of International Nuclear Counterterrorism Legal Instruments: The Case For Nuclear Forensics, Jerry S. Davydov

International Journal of Nuclear Security

In the past three decades, the international community and national governments have made great strides in addressing the threat posed by non-state actors or terrorist groups acquiring and maliciously using nuclear or other radioactive material. Although many argue that accomplishments have adequately addressed nuclear security threats, major gaps still remain within the global nuclear security system. Predetonation nuclear forensic science, commonly referred to as nuclear forensics, like all forms of forensic science, supports the implementation of national laws and statutes and international legal instruments through investigative science. Nuclear forensics provides law enforcement and nuclear security investigators with a technical …

Addressing The Rural Firearm Suicide Crisis: The Impact Of Culture, Mental Health, And Approaching Change, Sasha Ghofrani, Erik E. Langenau

PCOM Capstone Projects

Background. Firearm suicide rates are a growing public health concern, disproportionately impacting rural U.S. communities. This literature review explores risk factors contributing to this crisis.

Methods. This narrative literature review synthesizes research on the primary risk factors for firearm suicide in rural U.S. communities.

Key Findings. Key findings identify four central challenges: (1) a deeply rooted firearm culture based on identity and heritage in rural communities, which often resists traditional safety messaging; (2) prevalent unsafe firearm storage practices that increase the risk of firearm suicide; (3) high rates of social isolation, which are linked to both unsafe …

An Ecofeminist Approach To Climate Risks, Angela Hefti Jan 2025

An Ecofeminist Approach To Climate Risks, Angela Hefti

Michigan Journal of International Law

Climate change poses significant risks to the human right to life. However, international adjudicators have either neglected to examine right to life claims in the context of climate risks or dismissed them as prospective and speculative. International human rights bodies have long applied the standard of imminence to determine whether a threat to the right to life exists and the extent to which it constitutes a violation. In climate change cases, this standard has hardened, requiring a tight temporal connection between climate risks and a violation of the right to life. This article argues that failing to recognize the impact …

Transparency, Accountability, And Influence In The International Investment Law System, Jarrod Wong, Jason Yackee Jan 2025

Transparency, Accountability, And Influence In The International Investment Law System, Jarrod Wong, Jason Yackee

Michigan Journal of International Law

This article offers the first interdisciplinary critique of transparency in international investment law (“IIL”) that draws on transparency-skeptical and accountability scholarship in political science and public administration. Not only has the expansive IIL literature overlooked these disciplines, but much of it fails to define the core concept of transparency. Building on contributions from the fields of administrative law, international relations, and system theory in classic political science, we provide a novel functionalist account of transparency that traces a line from transparency to accountability to influence in the IIL system.

We make three arguments. First, transparency involves access to data that …

Automating International Human Rights Adjudication, Veronika Fikfak, Laurence R. Helfer Jan 2025

Automating International Human Rights Adjudication, Veronika Fikfak, Laurence R. Helfer

Michigan Journal of International Law

International human rights courts and treaty bodies are increasingly turning to automated decision-making (“ADM”) technologies to expedite and enhance their review of individual complaints. These tribunals have yet to consider many of the legal, normative, and practical issues raised by the use of different types of automation technologies for these purposes. This article offers a comprehensive and balanced assessment of the benefits and challenges of introducing ADM into international human rights adjudication. We argue in favor of using ADM to digitize documents and for internal case management purposes and to make straightforward recommendations regarding registration, inadmissibility, and the calculation of …

A Call For North Carolina To Allow Children To Express Their Wishes In Child Custody Proceedings, A Given Right Established In Binding Precedent, Katelynn Gallimore

Campbell Law Review

The purpose of this Comment is to advocate for amending North Carolina’s child custody statute, N.C. Gen. Stat. section 50-13, to require the court to consider a child’s preference as to their custody arrangements to further align with legal precedent. This Comment illustrates the importance of allowing a child to express their wishes to determine the custodial arrangement that is in the best interests of that child. This Comment uses statutes from other states as guidance for proposing reform to the North Carolina General Assembly to consider and propose new legislation. In addition, the right of a child to express …
