Drawing from legal pedagogy, litigation practice, and teaching experience, this article seeks to compile a set of key considerations for inclusive language decision-making in the clinical setting. Using a multi-factor framework--accuracy, precision, relevance, audience, and respect-this analysis explores the process for deciding on terms to use in practice and the potential implications of those choices on student learning, case outcomes, and attorney-client relationships. A Balanced Prescription For More Effective Environmental Regulations, W. Kip Viscusi

Government agencies increasingly base the structure and approval of environmental regulations on a benefit-cost test. For regulations that pass this test, total benefits exceed total costs. Under a benefit-cost framework, the degree of regulatory stringency is set at an economically efficient level whereby the tightness of the regulation is increased up to the point where the incremental benefits equal the incremental costs. Setting regulatory standards to achieve the efficient degree of pollution control does not fully discourage entry into polluting industries, provide compensation to those harmed by pollution, or establish meaningful incentives for effective enforcement. This Article first explores the ambiguous relationship between natural law and the rights of property owners in American history. It points out that invocation of natural law principles was frequently conflated with English common law guarantees of property rights in the Revolutionary Era. Reliance on natural law as a source of protection for private property faded during the nineteenth century and was largely rejected in the early twentieth century. The Article then considers the extent to which natural law principles are useful in addressing contemporary issues relating to eminent domain and police power regulation of private property. What is psychosis? The term itself is relatively recent. Yet clinicians and religious figures have tried to explain ‘psychosis’ from pathological and nonpathological perspectives for hundreds of years. From an allopathic, medical standpoint, psychotic disorders are devastating diseases. Up to 3% of the world’s population struggle with hallucinations, delusions, and cognitive impairments that make it difficult or impossible to function in society. Tibetan Buddhism does not have an exact analogue to the clinical term ‘psychotic disorders’. Nevertheless, Tibetan medicine understands some cases of psychosis as pathological. This Note argues that the FDA should revamp its criteria for regulating medical devices to unambiguously include smart wearables. Specifically, this Note calls for the FDA to amend its definition of “medical device” to focus on what a device is technologically capable of rather than its intended use.

Part I will examine the established legislation regarding medical devices; in particular, it will examine the relationship between FDA regulations and the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule and argue that when taken together, HIPAA creates a strong presumption that smart wearables should be regulated by the FDA. Coastal land loss driven by erosion and subsidence, and amplified by climate change, has forced the abandonment and resettlement of the remote Louisiana Indigenous community of Isle de Jean Charles. This relocation, to a relatively ‘safer’ site inland has led to division among the residents and will inevitably cause irreparable damage to the culture and traditions of the Houma and Biloxi Chitimacha Confederation of Muskogees peoples who called this small, isolated island home. Driven to the water’s edge by European colonization of south Louisiana, this community developed a dynamic subsistence lifestyle based on agriculture, hunting, and fishing which survived undisturbed …

The Zanjeras Of Ilocos In The Northern Philippines: A Legacy Of Sustainable Resource Management, José A. Rivera Ph.D

Zanjeras are farmer-managed irrigation systems that have endured for centuries in the Ilocos region of northern Luzon in the Philippines. These cooperative irrigation societies emerged during the Spanish regime when Augustinians were deployed to congregate indigenous populations into pueblos, convert them to Christianity, and raise tributes for the Crown. Zanjeras evolved from a blending of two traditions: the Iberian model of irrigation and indigenized practices of water-for-land exchanges with landowners and atar-holdings to distribute shares among the members. This essay offers a rhetorical reading of Congressional hearings investigating the Center for Medical Progress’s (CMP’s) videos falsely accusing Planned Parenthood of selling fetal tissue. Despite the suspect nature of the allegation at the time it was levied, and subsequent investigations rejecting the CMP’s claims, the notion that Planned Parenthood profits from the sale of fetal tissue has persisted alongside accelerated antiabortion jurisprudence and vitriolic rhetoric. This acceleration and persistence may be the result of what I term “rhetorical laundering” wherein suspect evidence is justified as worthy of study in a credible public forum, only to have its treatment in …

Replacing Notorious: Barret, Ginsburg, And Postfeminist Positioning, Calvin R. Coker

This essay offers a rhetorical reading of Amy Coney Barrett’s confirmation hearings to make sense of how widespread outrage over replacing the late Ruth Bader Ginsburg with a conservative idealogue was resolved through the invocation of postfeminist motherhood. I argue that GOP Senators and Barrett herself positioned her nomination as the achievement of feminist goals, justified through rhetorics of choice and the idealization of (white) motherhood. These strategies cement Barrett as the logical and defensible successor to both Ginsburg’s seat and her legacy of feminist work. I conclude with the implications of this circulation of postfeminist motherhood, with focus on …

Pithecellobium dulce (PD) (Leguminosae) is conventionally used for many diseases. The objective of this present study intended to assess the anti-obese and hypolipidemic properties of petroleum ether (PEPD), ethyl acetate (EAPD), and methanolic extract (MAPD) of leaves of aerial parts of PD in high-fat diet (HFD)-induced obesity and hypolipidemic effect in obese animals. This thesis explores connections and contradictions within the songs, correspondence, and poems of Scotland’s bard, Robert Burns. A selection of works from each of these categories is presented to compare the ways Burns writes verse, lyrics, and letters. Through this thesis, I analyzed his work looking at subject matter, use of the Scots dialect, structure, and poetic devices in order to offer holistic commentary on Burns’ style in a way that includes his letters more heavily than most other Burns scholarship. Tolkien’s wizards are some of the most interesting and impactful characters in The Lord of the Rings, sent to Middle-earth to inspire the free peoples to resist Sauron. Principal among the Istari are Gandalf and Saruman, both of whom feature prominently in the events of The Lord of the Rings. A much more minor role, however, is played by Radagast the Brown, who appears only in passing mentions in The Hobbit and serves almost as a messenger in The Lord of the Rings. Delamanid and bedaquiline are recently approved drugs for the treatment of multi-drug resistance tuberculosis (TB). It was found that the concomitant use of both drugs helped in treating patients with high drug-resistant strains. Fixed dose combination of delamanid and bedaquiline can be a possibility to control drug resistance TB. The Thai Journal of Pharmaceutical Sciences

This study evaluated the repro-protective potentials of MOF6 (isolated from Moringa oleifera leaves) and Trimyristin (TR) (isolated from Myristica fragrans seeds) in sodium arsenite (SA)-induced toxicity in rats. Sixty-five adult male rats were randomly divided into 13 groups (n = 5). Groups 1 and 3 received 9-week administrations of physiological saline and olive oil, respectively. Group 2 received 20 mg/kg bodyweight SA-only for 3 weeks and was untreated for 6 weeks. Groups 4–7 received a 3 week SA dose, followed by 6 weeks post-treatments with 5 mg and 7.5 mg/kg bodyweight MOF6, 15 mg, and 30 mg/kg bodyweight TR, respectively. …

Background/Aim: Cleome rutidosperma is traditionally used as a remedy for several diseases such as diabetes and malarial. The phytochemical screening and influence of hydroethanol extracts of C. rutidosperma parts (leaves and roots) on hyperglycemia, hyperlipidemia, and parameters of oxidative stress in streptozotocin (STZ)-induced diabetes in male albino rats were investigated. Materials and Methods: Qualitative phytochemical assays for the extracts were done by standard procedures. Different doses (75, 150, and 300 mg/kg body weight) of the extracts were administered to STZ-induced diabetic rats. Background: Given the demand for vaccination coverage to ease the pandemic situation and restore normal life in the university, evidence for examining the level of knowledge, attitudes, acceptance, and willingness to pay (WTP) for Coronavirus disease 2019 (COVID-19) vaccine among undergraduate students is required. Therefore, this study examined the level of those aspects among undergraduate students. Methods: A cross-sectional survey study was carried out among 434 participants between March 1, 2022, and March 31, 2022. Madagascar’s mangrove forests are intertidal ecosystems that provide numerous valuable ecosystem services but are nonetheless under pressure from large amounts of deforestation. On the southwestern coast of Madagascar, the village of Ambondrolava practices community led management of the mangrove and its resources. This research project studied the evolution of the mangrove area using GIS data, and investigated, through interviews, the relationship between the local community of Ambondrolava and the organizations that manage the mangrove ecosystem. Poverty-stricken migrant women, named ‘Kayayei or Kayayo’ because of the nature of their job in the informal sector, have high birth rates and are said to have many barriers affecting their access to maternal health resources. In this study, Kayayei in Madina Market were interviewed and both quantitative and qualitative data were gathered to determine whether a relationship exists between access to maternal health and the obstetric complications and outcomes experienced by Kayayei.
