This research thesis reflects on the choreographic practices of care and unlearning that were implemented in choreographing a piece on personal narratives of immigration, indigeneity, conformity, rejection and celebration of ethnic and cultural pride. The author is a danzante of the Danza Azteca ceremonial practice. She explains the importance of handling the art form with care by learning its history and unlearning the misconstrued histories that have been told about the Mexica and Nahua people who practice the ceremonial danza. In an essay called ‘Shakespeare’s Ovid’, scholar Johnathan Bate wrote that “the first encounter between the English dramatist and the Roman poet probably occurred in the classroom of the grammar school at Stratford-upon-Avon” (Ovid, Golding, Bate, xli). Of course, the two would continue to meet many times in the concluding years. Shakespeare would have long conversations with Ovid’s Metamorphoses, especially through the voice of his characters as they jumped back and forth from his mind to the page. The drawing effect, wherein drawing enhances information recall compared to writing, has been established for words and short phrases. Previous research has emphasized the efficacy of the drawing effect, particularly for long-term memory, and previous research has shown the enjoyable nature of arts integration into education. This study investigates the applicability of the drawing effect to lecture-based information and assesses the impact of arts integration, like drawing, on learning. Participants in the experimental condition learned and utilized a visual note-taking technique known as sketchnoting, while those in the control group took standard written notes. It is a compendium of lesson plans and activities that have been successfully put to use in the classrooms of Universidad San Francisco de Quito (USFQ), the first private university in Latin American whose educational philosophy is specifically focused on the liberal arts. Convertible debtor-in-possession ("DIP") financing is symptomatic of a paradigm shift in the control of large bankruptcy cases. During the prior era of lender control, distressed investors used DIP financing to shape the trajectory of bankruptcy cases and extract monopolistic rents at the expense of other constituencies. Enter the original loan-to-own: a common strategy commenced with a DIP loan, continued with a stalking-horse bid, and culminated in an acquisition of the debtor's assets. More recently, private equity sponsors ("Sponsors") and other sophisticated insiders are usurping control of bankruptcy cases. Convertible DIP financing (Loan-to-Own 2.0) is a byproduct. The proliferation of bankruptcy directors represents a controversial shift in the corporate governance landscape. Delegating corporate decision making to bankruptcy directors insulates conflicted transactions and claims from the elevated scrutiny provided by derivative standing and entire fairness. However, critics have questioned their independence and cleansing effect. Are bankruptcy directors really independent when their role includes negotiation with and/or investigation into the same parties who appoint them? Should their decisions be given deference when their appointment is associated with lower recoveries for creditors? Many articles have explored the Founders' intentions regarding the constitutional text. Much less attention has focused on the Founders' ideas regarding the traits needed of the leaders in a constitutional republic. The Constitution focuses on governing structures, many of which relate to the electoral process. The Constitution does not spell out the ideal traits of the leaders elected pursuant to those processes. Nonetheless, the Founders possessed clear views about the virtues and qualifications that ideal political leaders required. Vehicle bills are used by many state legislatures, including the South Dakota Legislature. These bills serve as empty shells to be amended with substantive text later in the legislative session. Critics charge that such vehicles allow legislators to meet the filing deadline with an essentially meaningless bill that gets amended late in the session, thereby depriving the public and opposition legislators from adequately investigating and debating the newly amended bill. This article examines how, and to what extent, the South Dakota Legislature has used vehicle bills over the past decade. In so doing, the article may provide some insight into …

Reinvigorating Congress's Role In The Administrative State: What The Major Questions Doctrine Suggests About Nondelegation, Patrick Garry, Sidney J. Hardy

In its recent decision in West Virginia v. EPA, the U.S. Supreme Court struck down administrative rules attempting to dramatically transform the electrical power generating industry. The Court's decision rested on its major questions doctrine, which states that on important enough matters the intent of Congress must be clearly expressed. This doctrine goes against the prevailing trend of deference toward the administrative state, as expressed through the permissive nondelegation and Chevron doctrines. While the major questions doctrine seeks to retain some congressional control over important issues, it nonetheless attracts much criticism on an array of grounds. This article proposes an …

Civic And Community Engagement Among Poor Rural Women In Bihar: A Pilot Study, Kirk Leach, Mirivel Julien, Tusty Ten Bensel, Avinash Thombre

Civic and community engagement is often crucial for the successful development of rural areas and a catalyst of personal transformation. This article examines changes in civic and community engagement among women in rural Bihar, India. Using an exploratory factor analysis of survey data from n = 815 respondents who participated in Heifer’s Values-Based Holistic Community Development [VBHCD] training, the study identifies three factors that constitute civic and community engagement. Next, the study assesses the efficacy of VBHCD’s impact on participants’ civic and community engagement relative to participants’ duration in the program and type of self-help group. Climate considerations must become an element of procedural analysis. Scholars, rule makers, legislators, and judges have historically prioritized procedural values including cost, speed, and accuracy. More recent waves of scholarship—including critical perspectives—have emphasized participation as a further procedural goal. Yet this list has grown stale. Current environmental realities force all areas of law, including civil procedure, to reckon with climate change. In the future, proceduralists will be forced to integrate climate-aware thinking into their analyses, proposals, and discussions. This study responds to the need to explore and/or propose models of leadership for Christian early childhood education and care (ECEC) settings in New Zealand (NZ). While previous studies identify love and care as a priority there is a need to define and prioritize Biblical understandings of love that may align with the principles of the national ECE framework. The study represents an alternative narrative to the neo-liberal influences which dominate areas of ECEC leadership through the marketization and standardization of children’s services nationally and globally.

In 1971, Sarah Weddington argued Roe v. Wade as a class action on behalf of pregnant women living in Texas, many of whom, including herself had to flee the State to obtain an abortion in Mexico. In 2021, Texas enacted S. B. 8, otherwise known as the Texas Heartbeat Act, which created a private cause of action for injunctive relief and statutory damages awards against any person assisting in and any physician accused of performing an abortion, thus reigniting the cross-border flows that historically have made Mexico a haven for runaway enslaved people and pregnant persons heading south to freedom. …

Emotional well-being is an important component of mental and physical health that includes both positive emotions and an absence of emotional symptoms (e.g., depressive- and anxiety-related). In this study, we examine psychological mechanisms that help to explain the effects of an digital mindfulness-based intervention (MBI) on emotional states. We conducted a randomized controlled trial wherein undergraduate student participants vulnerable to decreased positive and increased negative affect received a 2-week smartphone-based MBI or a structurally equivalent coping control intervention. Background: Heart disease remains a leading cause of death in the country, with significant ethnic disparities. Filipino Americans (FAs), the third-largest Asian subgroup in U.S., face an elevated burden of dyslipidemia, a primary modifiable risk factor for heart disease. Objectives: This community-based study addresses critical knowledge gaps by characterizing the cardiometabolic and genetic factors contributing to dyslipidemia among FAs and implications for personalized cardiovascular drug therapies, particularly statin pharmacogenomics (PGx). Methods: We characterized dyslipidemia prevalence in FAs and major ethnic subgroups using nationally representative NHANES data. Global amphibian populations have been declining since the late 20th century; one of the most significant contributors to these declines is a genus of viral pathogens known as Ranavirus (Rv). Frog virus 3 is one of these viral agents and is currently found affecting frog populations throughout NJ, MD, PA, DE, and VA. Human circadian rhythms are widely observed to fluctuate across the 24-hour circadian period, spanning cognitive, behavioral, and physiological domains. Circadian rhythm (CR) systems, particularly the sleep-wake cycle, are widely studied. Dysregulation of the sleep-wake cycle, common in shift work and mood disorders, diminishes mood regulation, resulting in increased negative mood or inappropriate mood responses. Although emotions have been investigated in the context of circadian variability in the sleep-wake cycle, circadian effects on emotional state per se have infrequently been examined. This essay ties both the repetition and doubling found in Vladimir Nabokov’s Lolita with the art of retelling to find a means of a center origin in Jacques Derrida’s “Structure, Sign, and Play in the Discourse of the Human Sciences.” This essay argues how unreliable narration works to substitute and redefine a center origin of/for the novel, and in doing so, pulls the reader further from any reliable foundation from which to draw conclusions. In schools, literacy is often positioned as a fixed set of reading and writing skills. This can limit what counts as an academically acceptable literacy practice despite the complex and nuanced ways people communicate in their personal and social contexts. With this tension around conceptions of literacy in mind, I wondered how teachers thought about literacy in their lives and in what ways (if any) their personal conceptions of literacy crossed the boundary into their classrooms. Jennifer Egan’s website greatly rewards readers and literary critics interested in A Visit from the Goon Squad and The Candy House. It hosts an interactive timeline filled with details like when and where she wrote each chapter of Goon Squad, a digital counterpart to her famous PowerPoint chapter, and excerpts from her handwritten first drafts of The Candy House. New Jersey’s offshore wind energy sector may provide an opportunity to advance the seaweed farming industry through ocean multi-use. Yet, opportunities, constraints, and knowledge gaps for seaweed farm-offshore wind co-location remain largely uninvestigated. Here, I determine the suitability of native seaweed species for offshore cultivation in New Jersey and conduct a quick scoping review (QSR) to assess the knowledge base surrounding seaweed farm-offshore wind multi-use. Saccharina latissima and Fucus vesiculosus were identified as native species with commercial value for cultivation in New Jersey. This research focuses on Music Genre Classification (MGC) using Convolutional Neural Networks (CNNs) and various datasets, including raw audio files (WAV) and extracted features such as Mel Spectrograms (MS), Mel-Frequency Cepstral Coefficients (MFCC), and Chroma Features (CF). The study employs Explanatory Sequential Mixed Methods (ESMM), combining qualitative research and experimental analysis to explore different model inputs and their performance. Several CNN-based models, including 2D CNN, 2D CNN-LSTM, 1D CNN, and 1D CNN-LSTM, were tested. However, the models generally underperformed, with most achieving accuracy of 10% or lower, and the best model (raw audio 1D CNN) reaching only 20%. The research …
