Fences, Fields, And Fourth Amendment Rights: Limiting The Powers Of Game Wardens, Ryder Schone Apr 2025

Fences, Fields, And Fourth Amendment Rights: Limiting The Powers Of Game Wardens, Ryder Schone

Brigham Young University Prelaw Review

Since the establishment of the Open Fields Doctrine in 1924, both private and public lands not immediately surrounding a home or commercial building have been open to search and seizure by U.S. game wardens. Owing to a century of access without judicial supervision, the powers of game wardens have expanded to a state of overreach which violates the Fourth Amendment rights and privacy of citizens. This paper proposes a federal statute that clearly delineates the circumstances under which game wardens can enter private property. Legal scholars generally agree on the need for reform; however, current discussions often fail to address …

Rulemaking Behind Closed Doors: Governor Abbott’S Secret Rulemaking. Worse Yet, All State Agencies Are Colluding With The Governor, Ronald Beal Apr 2025

Rulemaking Behind Closed Doors: Governor Abbott’S Secret Rulemaking. Worse Yet, All State Agencies Are Colluding With The Governor, Ronald Beal

SMU Law Review Forum

In 2019, the Texas Legislature granted the Governor new powers to review the rulemaking process for certain state agencies. Since then, the Governor has apparently extended this authority of review over the rulemaking process to more agencies than he was authorized to. Some journalists and scholars, including this Author, have attempted to access the proposals and comments submitted to the rulemaking process by the Governor’s Office—and yet the records are withheld by the Texas Attorney General under claimed exceptions to the Texas Public Information Act. Despite the Attorney General’s claims, this Author and others maintain that any records of these …

“Freedom Lives Hence, And Banishment Is Here”: The Weaponization Of Immigration Law To Punish Political Dissidents, Ryan Scott Apr 2025

“Freedom Lives Hence, And Banishment Is Here”: The Weaponization Of Immigration Law To Punish Political Dissidents, Ryan Scott

Washington and Lee Journal of Civil Rights and Social Justice

This Note explores the long and bipartisan history of the United States government’s weaponization of the immigration system to control, exclude, and expel percieved political enemies. The near-unlimited power that the federal government has acrrued in immigration matters has been used since the Founders’ generation to purge the country of those whose ideas and speech are seen by the powers that be as threatening or subversive. This Note traces the arc of such efforts from the Alien and Sedition Acts of 1798 to the explusion of activists under President Trump. The Note also examines attempts to force the courts to …

Decay, Destruction And The Moebius Aesthetic, Yi Wu Apr 2025

Decay, Destruction And The Moebius Aesthetic, Yi Wu

Art Theses and Dissertations

For my thesis, my masteries are destruction, dynamic material, and style matching to Moebius. This project took around one year to complete. The scene takes place in an abandoned, lost clinic, where molds and fungus have escaped, parasitizing and killing the doctor. The clinic is overrun with these growths, which serve as the central focus of the scene. The fungi spread across walls, floors, and furniture. One level of the scene has a peaceful yet hopeless early morning atmosphere at its core, while the other closely matches the style of Moebius’s (Jean Giraud) artwork.

The destruction is explored through the …

Hyper Modularity And Dynamic Materials In The Style Of Thomas Kinkade, Yijou Ho

Art Theses and Dissertations

My thesis is a small treehouse village, built using hyper modularity and designed to style-match Thomas Kinkade’s art. Dynamic materials are integrated into the scene as part of style match. The village, human-sized, is constructed on a massive ancient tree. Magical elements are incorporated throughout the village, brought to life through dynamic materials.

Hyper Modular & Seasonal Tavern Design, Yujia Zhang Apr 2025

Hyper Modular & Seasonal Tavern Design, Yujia Zhang

Art Theses and Dissertations

My thesis artifact is a tavern nestled within a mountainous forest, designed in the style of traditional Chinese architecture. The main goal of this project is to faithfully translate a 2D concept into a high-quality 3D game environment. The scene emphasizes the harmony between architecture and nature, while a dynamic system presents the changes of the four seasons. Spring is bright and full of vitality; autumn features falling leaves and a more subdued, melancholic tone; winter is covered in snow, creating a quiet and tranquil atmosphere.

For a 3D environment artist, concept design, modeling, and lighting are all essential skills. …

Art Theses and Dissertations

This thesis project focused on three masteries: Historical Recreation, Static Destruction, and Dynamic Weather. The Castle Savoia is recreated in the original and the destroyed version, to be switched between different weather types. Each weather type would affect the scene dynamically, either making the castle appear wet or covered by accumulated snow.

“To Ponder And Dream”: Gettysburg’S Conflict Heritage And Cultural Constructions Of History In Its Museums, Camryn Counsil Apr 2025

“To Ponder And Dream”: Gettysburg’S Conflict Heritage And Cultural Constructions Of History In Its Museums, Camryn Counsil

Student Publications

After providing brief historical context and a review of relevant literature, this paper analyzes four overarching concerns that inform the work of Gettysburg’s museums and historical organizations: ensuring commercial success, including underrepresented stories without alienating visitors, balancing scholarly and emotional approaches, and acknowledging the larger political implications of their choices. Using an anthropological approach, this work shows how these larger economic, social, and political concerns influence the construction of history and memory in a conflict heritage site like Gettysburg, Pennsylvania.

Spatial And Temporal Trends Of Reburns In Western Us Forests, Jackson M. Boyle Apr 2025

Spatial And Temporal Trends Of Reburns In Western Us Forests, Jackson M. Boyle

Student Publications

In the Western United States, understanding the role of reburns, or repeat wildfires, has become a topic of increased interest as the damages caused by wildfires have risen. While some forests are adapted to frequent burns, others have fire regimes characterized by few or infrequent burns. While all fires alter ecosystems, reburns have been found to specifically lower seeding probability and accelerate or start the shift from forests to shrublands. Despite these ecological impacts, the temporal and spatial trends of reburns remain understudied. Using Google Earth Engine, I analyzed the Composite Burn Index (CBI) dataset to see if reburns are …

Endothelial Dysfunction Promotes Age-Related Reorganization Of Collagen Fibers And Alters Aortic Biomechanics In Mice, Liya Du, Jeffrey Rodgers, Nazli Gharraee, Olivia Gary, Tarek Shazly, John F. Eberth, Susan M. Lessner

Faculty Publications

Endothelial dysfunction, defined as a reduction in the bioavailability of nitric oxide (NO), is a risk factor for the occurrence and progression of various vascular diseases. This study investigates the effect of endothelial dysfunction on age-related changes in aortic extracellular matrix (ECM) microstructure and the relationship between microstructural adaptation and the mechanical response. Here, we used groups of NOS3 knockout (KO), NOS3 heterozygotes (Het), and wild-type (WT) B6 mice (controls) to study changes in hemodynamic parameters, collagen fiber organization, and both active and passive aortic mechanics using biaxial pressure myography over a time course from 1.5 to 12 mo. Our …

Investigating The Role Of Moringa Oleifera In Nf-Kb Inhibition In T Cells, Hayla Scott, Joshua Hayes, Tahani Alamin, Radiah C. Minor

2025 Honors College Research Symposium

Nuclear Factor of kappa B (NF-κB) is implicated in many diseases and is a target for therapeutic interventions. Many anti-inflammatory pharmacological drugs are derived from plants. Moringa oleifera or the “miracle tree” has health benefits. Moringa extracts have been shown to inhibit inflammatory responses in macrophages through a mechanism involving NF-κB. Moringa also impacts T cell function, but whether it inhibits NF-κB activation in T cells is unknown. Our lab is interested in characterizing the impact of Moringa oleifera on T cells. To specifically investigate the impact of Moringa on NF-κB activation in T cells, we will culture Jurkat E6.1 …

Alvar Aalto: Past. Present.Future, Matthew Collins

Interior Design Capstones

Alvar Aalto serves as a timeless guide for architectural and design principles. These principles are not of universal rigidness but are flexible based on the givenconditions of site, culture, and people. His traditionalmethods of sketching and drawing create a hand to mind connection to the design process. This process, much like his work, develops a mindful and thoughtful outcome of decisions. With computer technology become more increasingly apart of our lives, it is important that we not forget the human point of view rather than purely a rational mode of thinking. This capstone project address how it is possible to …

True Self: A Curriculum Evaluation Aimed At Mitigating Internalizing And Externalizing Behaviors In At-Risk Middle School Youth, Lisa M. Dailey

Doctor of Education (EdD)

The purpose of this mixed methods curriculum evaluation was to study the efficacy of a recently published curriculum, True Self, being piloted in a middle school to support students in a Tier 3 reengagement program. Given a healthy multitiered system has 5%–7% of students needing individualized support, the study consisted of three student participants. True Self offers schools a resource written by authors who have extensive experience working with at-risk youth. Moreover, using a research-based curriculum saves educators time on finding or creating material—time they should be using for case management and direct student support. Quantitative metrics to analyze the …
