CRHR: Archaeology
The American Antiquities Act, Historic Sites Act, Archeological and Historic Preservation Act, National Historic Preservation Act, American Indian Religious Freedom Act, Archeological Resources Protection Act, Abandoned Shipwreck Act, and the Native American Graves Protection and Repatriation Act comprise the basis of our exploration of cultural resource legislation in the United States. Since the passage of the American Antiquities Act in 1906, 1086 cases have challenged these statutes in U.S. courts. We investigate temporal and regional patterns of the case law to establish whether these laws are uniformly prosecuted throughout the U.S. Our findings suggest that case law is complex and …

Buildings have a large impact on the planet and are tremendous consumers of electricity, accounting for projected 74.0% of the total electricity consumption in the United States in 2012. In a broader measure, buildings in the United States account for 41.0% of the nation's overall energy use.

There is vast literature on the influence of nonstate actors (NSAs) on intergovernmental organizations (IGOs). Successful cases have been documented in which transnational advocacy networks (TANs) use the platforms provided by intergovernmental organizations for their own participation in treaty making, agenda-setting, policy formation and implementation, and to change repressive and norm-violating states’ behavior. However, little has been said about IGOs engaging NSAs to influence their own member states’ preferences. The U.S. military represents a unique population within the human immunodeficiency virus 1 (HIV-1) pandemic. The last comprehensive study of HIV-1 in members of the U.S. Navy and Marine Corps (Sea Services) was completed in 2000, before large-scale combat operations were taking place. Here, we present molecular characterization of HIV-1 from 40 Sea Services personnel who were identified during their seroconversion window and initially classified as HIV-1 negative during screening. Protease/reverse transcriptase (pro/rt) and envelope (env) sequences were obtained from each member of the cohort. Phylogenetic analyses were carried out on these regions to determine relatedness within the cohort and …

Ecologically meaningful and scientifically defensible nutrient criteria are needed to protect the water quality of USA streams. Criteria based on our best understanding of naturally occurring nutrient concentrations would protect both water quality and aquatic biota. Previous approaches to predicting natural background nutrient concentrations have relied on some form of landscape categorization (e.g., nutrient ecoregions) to account for natural variability among water bodies. However, natural variation within these regions is so high that use of a single criterion can underprotect naturally occurring lownutrient streams and overprotect naturally occurring high-nutrient steams. Objectives: The primary objective was to expand upon results of a previously piloted patient perception survey with Healthcare Failure Mode and Effect Analysis (HFMEA), to identify areas within pharmacist-managed clinics needing improvement.
Methods: The survey was adapted for use in pharmacist-managed clinics. Patients completed the survey following regularly scheduled pharmacist appointments. Data were analyzed with a method adapted from HFMEA. Product scores could range from five to 25. A product of five indicates that pharmacists are doing a good job on the items that patients place the most value on, while a product score of 25 indicates that pharmacists are …

Mobile advertising creates opportunities for marketers to capture the attention of consumers on a one-to-one basis. However, there is little data proving the success of mobile advertising models. This study examined the drivers that influence consumer’s acceptance of SMS-based mobile advertisements and the differences in responses between two cultures, Finland and the United States. My questionnaire and conceptual model was taken from a study done in Finland in 2007. My results indicated that utility, context and trust are positively related to the acceptance of mobile advertising while sacrifice is negatively related. In recent years, the “American Laws for American Courts” movement has swept across the country in an attempt to ban international law from U.S. state courts. This article specifically examines the Oklahoma Save Our State Amendment and the Arizona Foreign Decisions Act. In doing so, it addresses both the constitutional and policy problems with these attempts, observing that what the states have been trying to do is neither legal nor practical. It analyzes the inability of individual states to unilaterally avoid compliance with the United States’ international law obligations. The karstic Edwards aquifer provides public supply and springflow for endangered species in drought-prone central Texas. Delineating source areas and flow paths in karst aquifers is important for understanding water availability. Groundwater divides separate the aquifer into different segments (Figure 1). It has been previously proposed that the divide between the Barton Springs and San Antonio segments migrates in response to changes in hydrologic conditions. This study evaluated historical discharge and geochemical data to characterize and quantify the hydrologic connection between recharge from the Blanco River and Barton Springs, the main discharge point for the Barton Springs segment. INTRODUCTION: Population-based data are essential for quantifying the problems and measuring the progress made by comprehensive cancer control programs. However, cancer information specific to the American Indian/Alaska Native (AI/AN) population is not readily available. We identified major population-based surveys conducted in the United States that contain questions related to cancer, documented the AI/AN sample size in these surveys, and identified gaps in the types of cancer-related information these surveys collect.

This study compared awareness of and attitudes toward celiac disease (CD) among American and Italian medical professionals, patients, and the general public in order to better understand and identify barriers to celiac disease diagnosis and patient wellbeing in the United States. Although the U.S. prevalence of the disease is somewhat higher than in Italy, the rate of diagnosis in the United States is significantly lower. U.S. employment law has traditionally disfavored bright-line rules to distinguish between traditional “employees” and independent contractors, instead relying on more flexible criteria, to be applied on a case-by-case basis. This fluidity has enabled employers to structure these relationships – and the corresponding bundle of worker rights and benefits – in ways that serve their own material and normative interests. Indeed, recent employment law literature has noted a dramatic shift towards independent contracting and contingent worker schemes in the U.S., even when the actual workplace dynamics are more akin to an employer-employee relationship. Wildlife collisions with aircraft (hereafter incidents) threaten human safety and cause substantial economic loss. Although more than 97% of wildlife incidents with U.S. civil aircraft involve birds, damage is more than 4.5 times more likely to occur during a mammal incident (e.g., deer, canids). Bats are the only mammals with the potential to be struck by aircraft outside the airport environment (at least 152.4 m above ground). We examined the Federal Aviation Administration’s (FAA) National Wildlife Strike Database from 1990 to 2010 to estimate the frequency of bat incidents with aircraft within the U.S. and the risk relative to other …

"An Ill-Judged Piece Of Business": The Failure Of Slave Trade Suppression In A Slaveholding Republic, Sarah A. Batterson

This dissertation examines the U.S. suppression of the slave trade from the ratification of the Constitution in 1789 to the onset of the Civil War in 1861. Instead of studying the slave trade in isolation, this dissertation evaluates U.S. slave trade policy within the context of the development of federal power during the early republic and antebellum period. This work assesses the disconnect between the harsh laws against the slave trade and the United States' ineffectiveness at suppressing the trade, especially since, at its founding, U.S. involvement in the African slave trade seemed to have a looming expiration date.

Modern legal systems increasingly depend on scientific testimony; but they also need somehow to ensure, so far as possible, that fact-finders aren't misled by highly speculative, poorly-conducted, or dishonestly-presented science. The Critical Common-sensist understanding of science that the author has developed in Defending Science and elsewhere sheds some light on why these interactions between law and science have proven so problematic. But Ms. Acharya's approach to these difficult issues rests on a flawed conception of the supposed "scientific method, " and an idea of legal "legitimacy" too weak to bear the weight she places on it; and her claim that …
