"You Have The Data"...The Writ Of Habeas Data And Other Data Protection Rights: Is The United States Falling Behind?, Sarah L. Lode

Indiana Law Journal

In Part I of this Note, I will discuss the writ of habeas data that has been developed primarily, but not exclusively, in Latin American countries. I will discuss the intricacies of the writ, how it evolved, and how it is applied today. Using Argentina as an example, I will discuss how the writ would be used by an Argentine citizen to protect her personal data. Part II summarizes the previously employed data protection scheme in the European Union, the Data Protection Directive (“the Directive”), and will also discuss the new EU data protection regulation, the General Data Protection Regulation …

Revisiting The Far Right Violent Extremist Threat: Violent Extremist Plot Success From 1948 Through 2017, Jesse Austin

Honors Theses and Capstones

Far Right violent extremists have successfully executed over 150 violent plots in the United States in just the past decade. This exploratory study analyzed Far Right violent extremist plot success with the plot success of Islamist violent extremists, Far Left violent extremists, and Single Issue violent extremists based on publicly available data from the Profiles of Individual Radicalization in the United States (PIRUS) for the period of 1948 through 2017. By evaluating existing literature on Far Right violent extremism and analyzing the available PIRUS data, it was discovered that while Far Right violent extremists executed more successful violent plots than …

Towards Food Justice: Strategies Of Community Engagement For Local Food Nonprofits, Garrett Stern

School of Professional and Continuing Studies Nonprofit Studies Capstone Projects

Over the past two decades there had been a significant shift in American values around food and health. The increase of diet-related illness and the growing awareness of the local food movement have helped to shape the discourse on healthy, nutritious, sustainably grown food. Food justice advocates and organization have inserted social justice principals of equity and self-determination into the dialogue of health and food. There has been a similar shift in the nonprofit sector in regard to local food programing, with local food nonprofits advocating for equity and inclusion in nonprofit food programing. Community engagement is key to putting …

The Enforcement Of Punitive Damages Awards Between United States And Europe: An Introduction For U.S. Practitioners

The International Lawyer

This article’s objective is to introduce U.S.-based practitioners to European civil-law perspectives on whether U.S. punitive damages awards are enforceable in their jurisdictions. After a brief review concerning the birth of punitive damages within common law, valuable to better understand their cultural and legal significance, this article will outline how the prominent European jurisdictions — France, Germany, Italy, Spain, and Switzerland — have dealt with the enforcement of U.S. punitive damages awards. Through each jurisdiction’s policy principles and relevant law, this article aims to afford U.S.-based practitioners initial tips and litigation strategies about how to maximize their chances of enforcing …

Born In Dissent: Free Speech And Gay Rights, Dale Carpenter Jan 2019

Born In Dissent: Free Speech And Gay Rights, Dale Carpenter

SMU Law Review

It is no stretch to say that Justice Oliver Wendell Holmes created the modern First Amendment a hundred years ago in his opinions in Schenck and Abrams. It is equally true that the First Amendment created gay America. For advocates of gay legal and social equality, there has been no more reliable and important constitutional text. The freedoms it guarantees protected gay cultural and political institutions from state regulation designed to impose a contrary vision of the good life. Gay organizations, clubs, bars, politicians, journals, newspapers, radio programs, television shows, web sites—all of these—would have been swept away in …

Comparative Effectiveness Of Dimethyl Fumarate Versus Fingolimod And Teriflunomide Among Ms Patients Switching From First-Generation Platform Therapies In The Us., Daniel Ontaneda, Jacqueline Nicholas, Matthew Carraro, Jia Zhou, Qiang Hou, Jaanai Babb, Katherine Riester, Jason P Mendoza, Terrie Livingston, Mehul Jhaveri

Neuroscience Articles

BACKGROUND: Previous real-world comparative research of MS disease modifying therapies (DMTs) in the overall population has suggested dimethyl fumarate (DMF) to be comparable to fingolimod (FTY) and more efficacious than teriflunomide (TERI) in reducing relapses. However, there is limited comparative evidence in patients switching from platform DMTs in the US. The objective of the study was to compare the annualized relapse rate (ARR) and risk of relapse in MS patients who have switched from a platform therapy to DMF, FTY, or TERI.

METHODS: MS patients (18-65 years old) initiating an oral DMT from June 2013 to March 2015 were identified …

Barriers Of Colorectal Cancer Screening In Rural Usa: A Systematic Review, Hongmei Wang, Shreya Roy, Jungyoon Kim, Evi A. Farazi, Mohammad Siahpush, Dejun Su

Journal Articles: Epidemiology

INTRODUCTION: Colorectal cancer (CRC) screening rates are lower in rural areas in the USA. To guide the design of interventions to improve CRC screening, a systematic review was conducted to identify CRC screening barriers for rural populations.

METHODS: A search was conducted in four literature databases - Medline, CINAHL, Embase, and Scopus - for articles from 1998 to 2017 that examine CRC screening barriers in rural areas. This review included a total of 27 articles reporting perceived CRC screening barriers by rural residents or providers or examining factors associated with CRC screening of rural populations in the USA.

RESULTS: The …

The New Legal Landscape For Text Mining And Machine Learning, Matthew Sag Jan 2019

The New Legal Landscape For Text Mining And Machine Learning, Matthew Sag

Faculty Articles

Now that the dust has settled on the Authors Guild cases, this Article takes stock of the legal context for TDM research in the United States. This reappraisal begins in Part I with an assessment of exactly what the Authors Guild cases did and did not establish with respect to the fair use status of text mining. Those cases held unambiguously that reproducing copyrighted works as one step in the process of knowledge discovery through text data mining was transformative, and thus ultimately a fair use of those works. Part I explains why those rulings followed inexorably from copyright's most …

Technology Education In The United States, Johnny J. Moye, Philip A. Reed, Steven A. Barbato, Shinichi Fujita

STEMPS Faculty Publications

Technology education has a long history in the United States as manual training in the 1870s, industrial arts through most of the twentieth century, and now as technology and engineering education in most states. Federal legislation has helped define and finance technology programs while organizations such as the International Technology and Engineering Educators Association, National Academies, National Science Foundation, National Assessment Governing Board, and National Aeronautics and Space Administration have shaped content and pedagogy. There are many opportunities in the U.S. such as Integrative STEM Education, growing informal education experiences in makerspaces, and expanding elementary technology education, but there are …

Dimensionality And Factorial Invariance Of Religiosity Among Christians And The Religiously Unaffiliated: A Cross-Cultural Analysis Based On The International Social Survey Programme, Carlos Miguel Lemos, Ross Joseph Gore, Ivan Puga-Gonzalez, F. Leron Shults

VMASC Publications

We present a study of the dimensionality and factorial invariance of religiosity for 26 countries with a Christian heritage, based on the 1998 and 2008 rounds of the International Social Survey Programme (ISSP) Religion survey, using both exploratory and multi-group confirmatory factor analyses. The results of the exploratory factor analysis showed that three factors, common to Christian and religiously unaffiliated respondents, could be extracted from our initially selected items and suggested the testing of four different three-factor models using multi-group confirmatory factor analysis. For the model with the best fit and measurement invariance properties, we labeled the three resulting factors …

Evaluating U.S. Counterterrorism Policy On Domestic Terrorism Using The Global Terrorism Database, Colleen Michelle Kennedy Jan 2019

Evaluating U.S. Counterterrorism Policy On Domestic Terrorism Using The Global Terrorism Database, Colleen Michelle Kennedy

Walden Dissertations and Doctoral Studies

The United States has a long history of domestic terrorism, yet U.S. counterterrorism policy has focused almost completely on the threat from international terrorism. The gap in the literature was the absence of an empirical evaluation of U.S. counterterrorism policy on domestic terrorism in general. The purpose of this quantitative study was to describe the impact of 21st century U.S. counterterrorism policy on incidence, lethality, and cost of domestic terrorism using data from the Global Terrorism Database. The multiple streams framework and the power elite theory were used. In this longitudinal trend study using secondary data analysis, domestic terrorism data …

Cultural Factors Affecting African Americans Of Caribbean Descent With Type Ii Diabetes, Ruth Runette Aguy-Paulsaint Jan 2019

Cultural Factors Affecting African Americans Of Caribbean Descent With Type Ii Diabetes, Ruth Runette Aguy-Paulsaint

Walden Dissertations and Doctoral Studies

Type II diabetes is a significant problem in the United States that had affected almost 10% of the American population and over 13% of African Americans. Although culturally competent diabetes education and treatment programs have been significantly more successful, little is known about the cultural factors affecting type II diabetes in African Americans of Caribbean descent (AACD). The purpose of this qualitative, phenomenological study was to explore the cultural factors relevant to the treatment and prevention of type II diabetes among AACD. The theoretical framework for the study consisted of cultural adaptation theory and the transtheoretical model. Data collection consisted …

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love Jan 2019

[Introduction To] Soda Goes Pop: Pepsi-Cola Advertising And Popular Music, Joanna K. Love

Bookshelf

From its 1939 “Nickel, Nickel” jingle to pathbreaking collaborations with Michael Jackson and Madonna to its pair of X Factor commercials in 2011 and 2012, Pepsi-Cola has played a leading role in drawing the American pop music industry into a synergetic relationship with advertising. This idea has been copied successfully by countless other brands over the years, and such commercial collaboration is commonplace today—but how did we get here? How and why have pop music aesthetics been co-opted to benefit corporate branding? What effect have Pepsi’s music marketing practices in particular had on other brands, the advertising industry, and popular …

The four stories in J. David Stevens’s I and You focus on immigrants and their families, characters trying to find the merge point between the China of a previous generation and America today. A divorced middle-aged woman tries to right an old wrong in the life of a man for whom she serves as caregiver. Through episodes where intimacy falters in the face of palpable distance, characters must confront unknowable details in the lives of even those closest to them: …

Parents Who Kill: Media Constructions Of Male And Female Filicide Cases, Mary Mccluskey Jan 2019

Parents Who Kill: Media Constructions Of Male And Female Filicide Cases, Mary Mccluskey

Theses and Dissertations (Comprehensive)

Often, mothers who murder their children are portrayed as “bad mothers”, as “the news media creates monsters out of [those] who transgress what is considered appropriate maternal behavior” (Goc, 2009, p. 42). This is especially important, as the media has created portrayals of females as murderers which are different from portrayals of males who murder their children. Previous research has addressed the association of motherhood in female offenders, however, there is a lack of research that compares the portrayals of females and males who murder their children, formally known as filicide. Using a social constructionist lens, this research analyzes filicide …
