A Dissent From The Miranda Dissents: Some Comments On The 'New' Fifth Amendment And The Old 'Voluntariness' Test, Yale Kamisar

F the several conferences and workshops (and many lunch conversations) on police interrogation and confessions in which I have participated this past summer3 are any indication, Miranda v. Arizona' has evoked much anger and spread much sorrow among judges, lawyers and professors. In the months and years ahead, such reaction is likely to be translated into microscopic analyses and relentless, probing criticism of the majority opinion. During this period of agonizing appraisal and reappraisal, I think it important that various assumptions and assertions in the dissenting opinions do not escape attention.

A related article published in this journal, Kimball and Pfennigstorf, Legislative Control of the Terms of Insurance Contracts: A Comparative Study, 39 IND. L.J. 675 (1964), examined legislative and judicial control of the provisions of insurance policies. Ideally, it would have been better to publish all aspects of control of insurance policies in one article, but length as well as complexity necessitated division of the subject matter. The reader who wishes a more complete picture of public control of the terms of insurance contracts should consult the earlier article and other available literature.

The objective of this paper is to determine if theories of industrial location and empirical data describing changes in manufacturing employment might suggest efficient approaches in attracting industry to a particular area. This is in sharp contrast to the usual application of location theory in which the optimum location of a firm or of a particular industry is selected.

Since the end of World War II and particularly since the Korean incident, military procurement has achieved a peacetime volume never before contemplated in our history. This high level of activity and the likelihood that it will continue for a long time gives defense spending a new importance in the national economy.
