Recent Patterns Of Testate Succession In The United States And England, Olin L. Browder Jr.

Michigan Law Review

This study purports to be in part a comparison of American and English testamentary practices. The virtual absence in England of estate records as we know them imposed limitations on the attainment of this objective. For present purposes, data concerning English practices were derived almost entirely from one hundred English wills selected at random from those filed during the year 1963 in the Principal Probate Registry in London. To the extent that these wills came from all over England and Wales, they can be regarded as representative of English practices generally. But the much smaller size of the sample in …

The Virginia Resolutions of 1798 have been praised as a defense of the basic freedoms of person, speech, and press and equally denounced as an early precedent for the principles of states rights, nullification and interposition. Involved in the crisis which arose over the Alien and Sedition Laws were such outstanding Virginians and national figures as Thomas Jefferson, James Madison, John Taylor, William Branch Giles, John Marshall, Patrick Henry, and Henry Lee. The purpose of this study was to examine the civil rights phenomena in the context of the Negro riots during the years 1963-1968. The inadequacies of this study are in part due to the material upon which it is based. The reports of the state study commissions did not deal with racism adequately, or the probability of implementation of various recommendations. Consequently, this paper could not treat these topics except perfunctorily. In turn, it was difficult to assess the practicality of various proposal since the extent of these variables was unknown. Procedural Due Process In Administrative Law: Some Thoughts From The French Experience, Richard L. Herrmann

University of Michigan Journal of Law Reform

As administrative law has grown so have the suggestions for change and reform. During the last thirty years a recurrent proposal has been that Congress create a federal administrative court. The first such bill was introduced in 1933 by Senator George Norris. In the same year the American Bar Association also championed the creation of such a court. Bills advocating an administrative court were again introduced in the Seventy-Fourth, Seventy-Fifth, and Seventy-Sixth Congress. The most recent proposal came in 1949. None were ever passed.

Tax administrators in well developed countries rarely have either occasion or opportunity to compare experiences or exchange opinions regarding procedures and practices utilized in administering complicated tax laws. Moreover, there is little comparative literature on the subject. Even the tax institutes which are internationally oriented usually focus on substantive tax principles, not procedures and practices. Hopefully, therefore, administrators in highly developed countries will find useful this analytic comparison of practices and procedures through which six of their number resolve disputable income tax questions -administratively and judicially.

The first part of my study concerns the meaning of "religious freedom" as revealed through the fundamental laws of the Constitutional period. In the course of my research, I have compiled and noted every mention of religion in the State Constitutions and Bills of Rights drafted between 1776 and 1791. I have read the Declaration of Independence, Articles of Confederation and the Northwest Ordinance; the Debates in the Constitutional Convention, the State Ratifying Conventions, and the First Congress, and extracted every significant mention of religion. At 9:30 P.M. on May 30, 1961, most United States citizens were enjoying the closing hours of a Memorial Day holiday. About this same time in the Dominican Republic an event was taking shape which was to alter greatly the lives of the people of that island nation. Rafael L. Trujillo, the dictator of the Dominican Republic, was riding with his chauffeur, Captain Socorro de la Cruz, along the highway from Santo Domingo to where the dictator's mistress waited in San Cristobal. This study attempts to trace the efforts of the Mormon people to obtain redress from the national government for the losses of life and property which they had suffered and the hardships which they had endured while residing in the state of Missouri during the 1830's. The Mormon appeals to Congress and the President are considered and an evaluation is made of the Mormon view of the national government's responsibility for the protection of individual rights.
