Vincentian Studies

The lives and contributions of Felix De Andreis, Joseph Rosati, and John Timon are described. De Andreis was the Congregation’s first superior in America. He traveled extensively in his ministry to American Catholics, taught seminarians, and began the novitiate. Rosati began Saint Mary’s Seminary and became the first bishop of St. Louis. To name just a few of his projects as bishop, he built a cathedral, brought the Sisters of Charity to St. Louis, and advocated their union with the Daughters of Charity. History is indebted to him for his careful records. The Congregation achieved national prominence thanks to him. …

With minor alterations, the Rule of the Daughters of Charity was established as the Rule for the Sisters of Charity in 1812. The adoption of the Rule by Sisters of Charity in other places is described. The Emmitsburg Sisters of Charity and the Daughters of Charity were united in 1850. Some sisters did not accept the union and founded new communities elsewhere. In 1828, the Sisters of Charity arrived in St. Louis to begin the first Catholic hospital in the United States. The history of their work there and in Mullanphy Hospital is recounted. They cared for patients during cholera …

Nebraska Agricultural Experiment Station: Historical Research Bulletins

Because metropolitan areas in the United States have been expanding at a dramatic rate, there has been direct competition between rural and urban interests for land. Also, market pressures often make it most profitable for meat producers to locate as close to urban centers as possible. A resultant growing interface between rural and urban centers, coupled with inadequate understanding of the people between the two centers, provides a potential for problems to develop. This book generally summarizes one area of contention - flies: few people tolerate flies in any setting anymore.

Agricultural trade has always been particularly susceptible to governmental intervention and imposition of protectionist barriers. This Article explores the evolution of agricultural trade regulation between the United States and Mexico culminating in the proposed North American Free Trade Agreement (NAFTA). First, the Article reviews the existing regulatory framework governing United States-Mexico agricultural trade. The Article then highlights major, proposed revisions to this regime under the NAFTA and offers perspectives on the effect of these revisions upon the United States’ agricultural industry sectors. The North American Free Trade Agreement (NAFTA) will create new opportunities for United States firms and workers while simultaneously protecting United States workers over a 15-year timeframe. The benefits of NAFTA include eliminating conditions that currently encourage or require United States firms to invest south of the border, establishing free trade in services, and eliminating non-tariff barriers which impede United States merchandise exports to Mexico. Furthermore, NAFTA would provide an improved and expanded regional trade and investment base resulting in a boost to the global competitiveness of US products. While the "feminization of poverty" has been widely recognized as a global phenomenon in recent years, the term originated in the United States where the number of women and women-headed households living in poverty is growing. This is especially true in the inner cities where fewer unskilled jobs remain; likewise, in rural communities, many factories have closed, family farming is declining, and few other nonfarm options are available. Today these American women face many of the same obstacles that limit women's economic participation in all parts of the world. This Article maintains that in order to fully comprehend the politics of welfare, retirement security, and national health coverage, it is necessary to examine Machiavellian principles in relation to the variables of economic development and inter-party competition. If the principles of Machiavelli are applied in a slightly different and more constructive manner, they may facilitate reform of the American welfare, retirement, and national health systems. Negotiated Sovereignty: Intergovernmental Agreements With American Indian Tribes As Models For Expanding First Nations’ Self-Government, David H. Getches

Constitutional issues related to First Nations sovereignty have dominated Aboriginal affairs in Canada for a considerable period. The constitutional entrenchment of Aboriginal self-government has, however, received a setback with the recent failure of the Charlottetown Accord in October of 1992. Nonetheless, day-to-day issues must be accommodated, even while this more fundamental constitutional question remains unresolved. This paper illustrates the American experience with negotiated intergovernmental agreements between tribes and individual states. These agreements have, for example, resolved jurisdictional disputes over taxation, solid waste disposal, and law enforcement between state governments and tribal authorities. This article examines specific restrictions promulgated and practiced during the Persian Gulf War, provides a brief historical analysis of how the United States and other nations have traditionally accommodated the religious activities of their military personnel, and addresses the question of how far we can constitutionally limit the free-exercise rights of the people in the military in light of current Supreme Court jurisprudence.

His And Hers: Male And Female Anatomy In Anatomy Texts For U.S. Medical Students, 1890–1989, Susan C. Lawrence, Kae Bendixen

Much recent work on gender has emphasized how ideas of male and female differences underlie cultural assumptions about appropriate social relations, behavior, institutions and knowledge. This study focuses on the specific ways that anatomy texts for medical students in the United States have presented male and female anatomy between 1890 and 1989, using both numerical data and analysis of textual examples from 31 texts. Despite public debates about gender representation, anatomy texts have generally remained consistent in how “the” human body has been depicted in this century. Spacing Out: Towards A Critical Geography Of Law, Nicholas K. Blomley, Joel C. Bakan

Osgoode Hall Law Journal

The authors analyze the interconnections between space, law, and power and forge links between critical studies in law and geography. Analytical categories of space-for example, the divide between public and private space, or the concept of national citizenship-are all politically constructed. The authors analyze Canadian and American concepts of federalism and their impact on regulating worker safety. A common judicial mapping of work, local space, and state regulation determines whether local officials have enforcement authority in contexts where national worker safety regulations apply. Through this analysis, the authors illustrate the potential for future studies in critical legal geography.

Administrative And Criminal Penalties In The Enforcement Of Occupational Health And Safety Legislation, R. M. Brown

Osgoode Hall Law Journal

The sanction for occupational health and safety offences in Ontario is a regulatory prosecution in provincial criminal court. In contrast, regulatory officials assess administrative penalties in British Columbia and the United States. A larger proportion of offenders are punished under these administrative processes than in the Ontario criminal justice system, and the average administrative penalty generally is higher than the average criminal fine. In addition, a system of administrative penalties is better able to identify employers who warrant punishment because regulators apply the civil standard of proof, attach great weight to a firm's compliance history, and do not reserve penalties …
