Rationalism And Empiricism In Modern Medicine, Warren Newton
Law and Contemporary Problems
The roots of rationalism and empiricism in the Hippocratic tradition are explored. The triumph of the rationalists in the founding of modern medicine is emphasized. The development of clinical epidemiology and the evidence-based medicine over the last 30 years is described. The tension illuminates fundamental clinical and policy questions that doctors, the health care system, and the legal system confront today.

The expression "New Economy" is used inconsistently. This Article review the driving forces of the US boom of the 1990s, examining the changes introduced in the period and before, focusing on the IT sector and new technologies. The "New Economy" is not just the new sectors, but changes in the overall economy emanating from them. These changes will not evaporate in an economic slowdown. Comparisons of the USA with Germany and Europe illustrate that the "New Economy" will also continue to develop there on the foundations already laid.

The legal limits of drug and alcohol testing by employers in the Atlantic Canada offshore are not yet entirely clear. To shed light on where these limits may lie, the authors examine the relevant law in the United Kingdom and the United States, together with the law on testing in Canada generally and the applicable provisions of the Accord Acts.

Forum selection, choice of law and arbitration clauses are of great significance in offshore contracts, where disputes may arise in locations far removed from the fora identified in those contracts. In this article, the author provides an examination of the enforceability of these clauses in the United States, together with an explanation of the operation of the doctrine of forum non conveniens in that country.

Mandatory sentencing laws are responsible for the booming prison population in the United States. They are applied most frequently to crimes involving drugs and mandate harsh penalties of five, ten, twenty years or more behind bars for crimes involving no violence. Julie Stewart, President of the Families Against Mandatory Minimums Foundation (FAMM) and the sister of a marijuana user who spent five years in a federal prison, describes the unfairness of America’s sentencing policies, with a particular emphasis on the application of mandatory minimum sentences to drug-related convictions. The Federal Civil Defense Administration (FCDA) was created in December 1950 to prepare the civilian population of the United States to survive and recover from a nuclear attack by the Soviet Union and its allies. Contemporary civil defense theory dictated that this goal should be met by educating the American public in order to avoid a negative psychological reaction that would prevent survival and recovery. In order to evaluate the success of the FCDA's civil defense program, this study will investigate the composition of the FCDA and its public education program.

John Timon gives his account of Congregation’s development in the United States from the mission’s beginning until 1847. The narrative is largely focused on Timon’s own work and ends when he becomes bishop of Buffalo, New York. He recounts the growth of the foundation at the Barrens, his mission trips with Jean-Marie Odin in the surrounding area, and their 1824 trip through Arkansas. He recalls many conversions, including those of condemned men, his successful public defenses of Catholicism against anti-Catholic Protestant ministers, and the acquisition of the Congregation’s property and foundation of the parish in Cape Girardeau, Missouri. Encryption, understood on a basic level as the process of scrambling information to disguise its content, has been a topic of intense debate over the past decade because of Internet growth and well-founded concerns about online security. The encryption debate centers on striking an appropriate balance between national security concerns and the potential prosperity of the high-tech industry. The Clinton Administration played an important role in relaxing U.S. encryption policy. The Internet raises enhanced and unique concerns regarding informational health privacy and Internet pharmacy sales. As technology advances and the Internet changes the way people obtain medical services and products, protecting consumers and their informational health data in online pharmaceutical transactions is paramount. This Comment charts and compares the existing legal frameworks in the United States and Canada relative to informational health privacy. Following this discussion, each legal framework comes into sharp focus with regard to Internet pharmacy sales. The transformation of the American health care environment from retrospective fee-for-service to managed care has been both rapid and chaotic. This period of change has been infected by value conflict, evoking unconscious processes in system participants as they have attempted to cope with personally threatening situations. This article attempts to elucidate this process by presenting an account of events and accompanying value conflict as it occurred over time. American interpretations of the police officer's role in our society span the distance between two distinct and opposite poles. On the one hand, many Americans, especially those living in middle or upper class, non-urban, predominantly white areas, believe that a police officer is a hero, "a courageous public servant [and] a defender of life and property." If they are victimized in some way, they believe they can call the police, and that the police will come to their aid. There is however, a considerable segment of our society, often those living in poor, urban, non-white areas, that understands police officers …

An Empirically Based Comparison Of American And European Regulatory Approaches To Police Investigation, Christopher Slobogin

This article takes a comparative and empirical look at two of the most significant methods of police investigation: searches for and seizures of tangible evidence and interrogation of suspects. It first compares American doctrine regulating these investigative tools with the analogous rules predominant in Europe. It then discusses research on the American system that sheds light on the relative advantages and disadvantages of the two regulatory regimes.

"In Passion And In Hope:" The Pilgrimage Of An American Radical, Martha Dodd Stern And Family, 1933--1990, John Francis Fox Jr.

This dissertation explores the literary/political pilgrimage of Martha Dodd Stern (1908--1990), an unusually promising writer. Using Martha's writings, government intelligence files like the Venona Transcripts, I develop a narrative and analytic family biography to analyze the faith of this leftist and develop a typology of the fellow traveler that shows its roots in the Progressive Era and their radicalization under the Great Depression and growth of fascism.
Martha's father, historian William E. Dodd (1869 to 1940), imparted to Martha his Wilsonian progressivism and resentment of social distinctions. Martha's experience in Nazi Germany (1933 to 1937) radicalized these roots. She placed …

The Best Of Times And The Worst Of Times: Lessons From Recent Reforms Of The French Retirement System, Kathryn L. Moore

Principally because of increasing life expectancy and the fact that the baby boom generation is reaching retirement age and is followed by a much smaller generation, the American social security system is facing a long-term funding deficit. The Board of Trustees of the Federal Old-Age and Survivors and Disability Trust Funds predicts that unless corrective action is taken, social security benefits will exceed dedicated tax revenues by the year 2016, and the social security system will become insolvent, that is, unable to pay benefits in full, by the year 2038.
The United States is not alone in facing these circumstances. …
