Using The Charter To Stop Racial Profiling: The Development Of An Equality-Based Conception Of Arbitrary Detention, David M. Tanovich
Using The Charter To Stop Racial Profiling: The Development Of An Equality-Based Conception Of Arbitrary Detention, David M. Tanovich
Osgoode Hall Law Journal
Do the police use race as a proxy for criminality, particularly, in drug cases? If so, is this a rational discriminatory practice that is based on who the usual offender is or an offensive exercise of racial prejudice? What are the consequences for those communities targeted by the police? This article investigates these questions that have gone unanswered for too long in Canada. After offering a definition of racial profiling, evidence is presented that suggests that the practice is rampant in the United States and is likely practiced by some Canadian police forces, particularly, in cities with large visible minority …

Between 1880 and 1918, thousands of women in Barre, Vermont and Trinidad, Colorado entered the paid labor force. They worked as boardinghouse keepers, domestic servants, waitresses, laundresses, prostitutes, office workers, saleswomen, telephone operators, business owners, teachers, nurses, doctors, lawyers, artists, musicians, and midwives. Carving Out A Sense Of Place: The Making Of The Marble Valley And The Marble City Of Vermont, Michael Louis Austin
Carving Out A Sense Of Place: The Making Of The Marble Valley And The Marble City Of Vermont, Michael Louis Austin
Doctoral Dissertations
The making of the Central Valley of Vermont created a sense of identity for the region. Strategically between two Native American confederations, the area was also enmeshed in European settlement to the north, south, east and west. At first conventional farming was the engine of growth in the Central Valley, but the Erie Canal and the rich soil from the Midwest undercut Rutlands agriculture. Rutland switched its economy to sheep. By the 1850s, that too had failed. With the infrastructure of railroads and technology, the rich mineral resources of the region could be exploited and organized on a national scale. …

Assessment Of Validity Of The National Public Health Performance Standards: The Local Public Health Performance Assessment Instrument., Joyce Beaulieu, F. Douglas Scutchfield
Preventive Medicine and Environmental Health Faculty Publications
The National Public Health Performance Standards Program (NPHPSP) has developed performance standards measurement instruments, based on the 10 "Essential Services of Public Health" that are being tested in several states. This article is a report on the face and content validity of the instrument designed for local public health systems. Judgments about the face validity of the standards were obtained in a survey of local public health systems that had used the instrument in a test state. The validity of each standard was addressed along the following dimensions: the importance of the standard as a measure of the Essential Service; …

Objective: We sought to compare the relations of activity energy expenditure (AEE) with adiposity and weight change in 2 black populations with different levels of obesity. Design: Total daily energy expenditure (TDEE) and resting energy expenditure (REE) were measured and AEE was calculated in 58 Nigerian and 34 US black women and men. Weight was remeasured after ≥1 y in a subset of participants. AEE adjusted for body size and TDEE adjusted for REE were calculated with the use of the residual regression method. The …

A U.S. History Model For Enhancing Essential Academic Learning Requirements In Reading, Christopher Matthew Jorgensen
All Graduate Projects
The relationship between reading strategies that enhance essential learning in both · reading and history was studied. A U.S. History model has been developed to make connections between the teaching of history content and reading comprehension. Research has been obtained that indicates a direct correlation between student learning in a content area classroom and the integration ofreading strategies within daily lesson plans. Secondary teachers must be taught by teacher preparation programs and coached by administrators on how to develop lesson plans based on their students' need to use effective reading strategies. Secondary teachers must align their daily lessons and assessments …

Exploration Of The Nature Of The Work Done By United States Marshals Service Employees In The District Of Nevada, Michael Robin Schlaerth
Exploration Of The Nature Of The Work Done By United States Marshals Service Employees In The District Of Nevada, Michael Robin Schlaerth
UNLV Retrospective Theses & Dissertations
For the first time in its 212 year history, the United States Marshals Service created a position for employees specifically designated to assist district offices experiencing administrative and operational problems. This move was promoted by a recruiting session in April of 2001 which was designed entirely to train individuals for the job entitled GS-082. This move is the result of the agency's overall need for more labor. However, while these agents carry the title of "Deputy Marshal", they do not require the same intense training of the standard GS-1811 agents, as their duties do not demand it. Employees in the …

Assessing Causation In Breast Implant Litigation: The Role Of Science Panels, Laural L. Hooper, Joe S. Cecil, Thomas E. Willging
Law and Contemporary Problems
In two recent cases, federal judges appointed panels of scientific experts to help assess conflicting scientific testimony regarding causation of systemic injuries by silicone gel breast implants. This article will describe the circumstances that gave rise to the appointments, the procedures followed in making the appointments and reporting to the courts, and the reactions of the participants in the proceedings.
Too Many Probabilities: Statistical Evidence Of Tort Causation, David W. Barnes
Too Many Probabilities: Statistical Evidence Of Tort Causation, David W. Barnes
Law and Contemporary Problems
Medical scientific testimony is often expressed in terms of two different probabilities: 1. The increased probability of harm if a person is exposed, for example, to a toxin. 2. The observed relationship is an artifact of the experimental method. This article demonstrates that neither probability, taken alone or together, measures whether the "preponderance of the evidence" test is met.
Scientific Ignorance And Reliable Patterns Of Evidence In Toxic Tort Causation: Is There A Need For Liability Reform?, Carl F. Cranor, David A. Eastmond
Scientific Ignorance And Reliable Patterns Of Evidence In Toxic Tort Causation: Is There A Need For Liability Reform?, Carl F. Cranor, David A. Eastmond
Law and Contemporary Problems
As a first step to preserving the central aims of tort law, courts will need to recognize the wide variety of respectable, reliable patterns of evidence on which scientists themselves rely for drawing inferences about the toxicity of substances. Courts may also need to take further steps to address the woeful ignorance about the chemical universe. This may necessitate changes in the liability rules.

Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown
Scientific Models Of Human Health Risk Analysis In Legal And Policy Decisions, Douglas Crawford-Brown
Law and Contemporary Problems
The quality of scientific predictions of risk in the courtroom and policy arena rests in large measure on how the two differences between normal practice and the legal/policy practice of science are reconciled. This article considers a variety of issues that arise in reconciling these differences, and the problems that remain with scientific estimates of risk when these are used in decisions.
Of Cherries, Fudge, And Onions: Science And Its Courtroom Perversion, David W. Peterson, John M. Conley
Of Cherries, Fudge, And Onions: Science And Its Courtroom Perversion, David W. Peterson, John M. Conley
Law and Contemporary Problems
The thesis of this article is that the Supreme Court decision in Daubert v. Merrell Dow Pharmaceuticals, Inc.'s focus on the scientific method, however rigorously applied, invites certain classes of abuses. There are instances in which evidence can be made to look more scientific by a process that in fact and substance makes is utterly unscientific.

Law and Contemporary Problems
This article presents empirical evidence of the ways people compare judgments of liability with judgments of causation and contribution. Specifically, the article reports the results of experiments designed to show whether people regard causation and enablement as necessary elements of liability.
