Executive Summary

The mission of the National Park Service (NPS) is “to conserve unimpaired the natural and cultural resources and values of the national park system for the enjoyment of this and future generations” (NPS 1999). To uphold this goal, the Director of the NPS approved the Natural Resource Challenge to encourage national parks to focus on the preservation of the nation’s natural heritage through science, natural resource inventories, and expanded resource monitoring (NPS 1999). Through the Challenge, 270 parks in the national park system were organized into 32 inventory and monitoring (I&M) networks.

United States National Park Service: Publications

Background

The Upper Columbia Basin Network I&M (Inventory and Monitoring) program and Craters of the Moon National Monument and Preserve are collaborating to monitor winter bat use in Arco Tunnel, which is a safely accessed cave in the northern portion of the monument that consistently has been found with the largest number of bats (~30/year) among the set of caves recently inventoried. The standard operating procedures documented here and the methods described in the associated protocol narrative will also be used to periodically inventory other caves within the monument and surrounding preserve as park resources and safety (winter environmental and …

Where Policy And Practice Collide: Comparing Us,South African And European Union Approaches Toprotecting Children Online, Monica Bulger, Patrick Burton, Brian O'Neill, Elisabeth Staksrud

Articles

That children have a right to protection when they go online is an internationally well-established principle, upheld in laws that seek to safeguard children from online abuse and exploitation. However, children’s own transgressive behaviour can test the boundaries of this protection regime, creating new dilemmas for lawmakers the world over. This article examines the policy response from both the Global North and South to young people’s online behaviour that may challenge adult conceptions of what is acceptable, within existing legal and policy frameworks. It asks whether the ‘childhood innocence’ implied in much protection discourse is a helpful basis for promoting …

Copyright Law—Unique Characteristics Of Music Warrant Its Own System: How Adopting The Intended Audience Test Can Save Music Copyright Litigation, Alison P. Wynn Jan 2017

Copyright Law—Unique Characteristics Of Music Warrant Its Own System: How Adopting The Intended Audience Test Can Save Music Copyright Litigation, Alison P. Wynn

Western New England Law Review

Music has been a crux of everyday life for decades. Almost ninety-one percent of the United States population listens to music, and spends more than twenty-four hours a week listening to their favorite songs—making music one of the top forms of entertainment for most Americans. Music has unique qualities that differentiate it from other works of authorship, which must be recognized by copyright law.

The current subjective measure used to determine unlawful appropriation of copyrightable work is not sufficient. A minority of courts have expanded the current “ordinary observer” standard to consider the “intended audience” of the specific work—claiming the …

Monitoring Harm Perceptions Of Smokeless Tobacco Products Among U.S. Adults: Health Information National Trends Survey 2012, 2014, 2015, Shari P. Feirman, Elisabeth A. Donaldson, Mark Parascandola, Kimberly Snyder, Cindy Tworek

United States Food and Drug Administration: Publications

Introduction: Changes to the U.S. smokeless tobacco landscape in recent years include a change to health warnings on packages, the implementation of bans in some stadiums, and the launch of a federal youth pre- vention campaign. It is unclear whether such changes have impacted consumer beliefs about smokeless tobacco. This study examines relative harm perceptions of smokeless tobacco compared to cigarettes among adults and assesses changes in smokeless tobacco harm perceptions over time.

Methods: We analyzed data from three cycles (2012, 2014, 2015) of the Health Information National Trends Survey (HINTS). Using 2015 data, we assessed bivariate associations between smokeless …

The President's Private Dictionary: How Secret Definitions Undermine Domestic And Transnational Efforts At Executive Branch Accountability, Sudha Setty

Faculty Scholarship

The 2016 EU-U.S. Privacy Shield is an agreement allowing companies to move customer data between the European Union and the United States without running afoul of heightened privacy protections in the European Union. It was developed in response to EU concerns that the privacy rights of its citizens have been systematically abrogated by the U.S. government in the name of national security, and contains a variety of assurances that the United States will respect and protect the privacy rights of EU citizens.

How trustworthy are the U.S. assurances under the Privacy Shield? Both the Bush and Obama administrations secretly interpreted …

Laughing In The Face Of Oppression: The Nature Of Political Satire Under Different Types Of Political Regimes, Victoria Villavicencio Pérez Jan 2017

Laughing In The Face Of Oppression: The Nature Of Political Satire Under Different Types Of Political Regimes, Victoria Villavicencio Pérez

Honors Program Theses

This research examines how different types of political regimes shape the nature of the political satire produced under them. Unlike traditional journalism, the sly character of political humor may enable it to operate with more freedom than other forms of media while still providing social critique. This research examines three different case studies: the United States (democracy), Venezuela (semi-authoritarian), and Cuba (authoritarian) and evaluates their satire on how openly critical it is and what type of censorship it suffers. Through extensive content analysis of satirical work produced within the country, as well as a historical research into the censorship of …

The 1973 Oil Embargo And Us-Saudi Relations: An Episode In New Imperialism, Nathaniel David Sher Jan 2017

The 1973 Oil Embargo And Us-Saudi Relations: An Episode In New Imperialism, Nathaniel David Sher

Honors Papers

This thesis examines the impact of the 1973 oil embargo on US-Saudi relations. It asks how and why the US and Saudi Arabia remained long-term allies after a five-month period of economic warfare. Most prior research focuses on the factors that influenced the embargo's implementation, failing to fully explain its resolution. This thesis explores the latter issue by appealing to US government memos, OAPEC meeting transcripts, and US-Saudi telegrams. It argues that, after five months of rhetorical and material distance, the US and KSA realigned over symbiotic trade dynamics-- “arms for oil"--and mutual opposition to communism. This subject remains important …

Ethnic Differences In Risk Factors For Obesity Among Adults In California, The United States, Liang Wang, Jodi L. Southerland, Kesheng Wang, Beth A. Bailey, Arsham Alamian, Marc A. Stevens, Youfa Want

ETSU Faculty Works

Little attention has been given to differences in obesity risk factors by racial/ethnic groups. Using data from the 2011-2012 California Health Interview Survey, we examined differences in risk factors for obesity among Whites, Latinos, Asians, and African Americans among 42,935 adults (24.8% obese). Estimates were weighted to ensure an unbiased representation of the Californian population. Multiple logistic and linear regression analyses were used to examine the differences in risk factors for obesity. Large ethnic disparities were found in obesity prevalence: Whites (22.0%), Latinos (33.6%), African Americans (36.1%), and Asians (9.8%). Differences in risk factors for obesity were also observed: Whites …

Learning Race And Racism While Learning: Experiences Of International Students Pursuing Higher Education In The Midwestern United States, Donald Mitchell Jr. Et Al.

Education Faculty Publications and Presentations

Researchers have documented how race and racism influence the college experiences of U.S. citizens. However, research on the ways that race and racism affect international students warrants similar attention. This qualitative study explored how international students learned about U.S. concepts of race and racism and how such concepts shaped their college experiences. The participating international college students learned about U.S. concepts of race and racism through media, relationships, formal education, and lived experiences. They defined these concepts in varying ways and had varying racial ideologies.

United States Public Opinion And The War In Iraq: Understanding Analysis Polling Trends Through Discourse, Sam Williams Jan 2017

United States Public Opinion And The War In Iraq: Understanding Analysis Polling Trends Through Discourse, Sam Williams

Sigma: Journal of Political and International Studies

War is often thought to be a cause-and-effect dichotomy. Rather than taking a holistic view of war through examination of short-term fluctuations against macrolevel trends, historians often instead define armed conflict by a singular, decisive event and the differing responses and ramifications which stem from it. It is tempting, then, to do the same with public opinion about war: If the nature and ultimate result of a conflict stems from a collection of individual pivotal events, it is natural to think there would also be critical shifts in public opinion corresponding to these decisive events. U.S. military campaigns that are …

Competition Among Domestic Apparel Manufacturers, Mary Simpson Jan 2017

Competition Among Domestic Apparel Manufacturers, Mary Simpson

Walden Dissertations and Doctoral Studies

Apparel manufacturing characterizes a sustainable means of creating employment and encouraging economic growth; however, 86% of U.S. apparel manufacturing companies and 74.7% in North Carolina have closed since the late 1990s. Less than 3% of apparel bought in the United States is domestic. The purpose of this case study was to explore the strategies used by American apparel manufacturing business leaders who produce competitive products using Porter's diamond theory as the conceptual framework. Data were collected through semistructured interviews of 4 business leaders from an apparel manufacturer that had been in business a minimum of 5 years in North Carolina. …

Judicial Federalism In The European Union, Michael Wells Jan 2017

Judicial Federalism In The European Union, Michael Wells

Scholarly Works

This article compares European Union judicial federalism with the American version. Its thesis is that the European Union’s long-term goal of political integration probably cannot be achieved without strengthening its rudimentary judicial institutions. On the one hand, the EU is a federal system in which judicial power is divided between EU courts, of which there are only three, and the well-entrenched and longstanding member state court systems. On the other hand, both the preamble and Article 1 of the Treaty of Europe state that an aim of the European Union is “creating an ever closer union among the peoples of …

Hydraulic Fracturing In The United States: A Framing Analysis, Kenneth Stephen Cardell Jr. Jan 2017

Hydraulic Fracturing In The United States: A Framing Analysis, Kenneth Stephen Cardell Jr.

Theses and Dissertations

This research considers the issue of hydraulic fracturing, a controversial method of extracting natural gas from shale and coal deposits. The technology, commonly referred to as “fracking,” has only been employed on an industrial scale since the late 1990s and is increasingly becoming the focus of news coverage. In this thesis research, a representative sample of both national and regional newspaper coverage on the issue of hydraulic fracturing is analyzed, looking at several key elements of framing. This study also examines differences in issue framing between the national elite press and regional news sources, as well as based upon partisanship. …

Understanding Community Character As A Socio-Ecological Framework To Enhance Local-Scale Adaptation: An Interdisciplinary Case Study From Rural Northwest Connecticut, Joanna Wozniak-Brown

Antioch University Dissertations & Theses

Around the world, municipalities are facing new challenges, not the least of which is climate change. This is especially true for rural communities that, for a variety of reasons, will be disproportionately affected by the climatic changes and accompanying policies or programs.

This dissertation, written in manuscript-style, integrates climate change and social-ecological scholarship to address the unique character of rural communities, to communicate the complexity of rural identity through the term "rural character"; and to empower rural communities to incorporate adaptation strategies into their daily municipal operations and planning.

Specifically, this dissertation seeks to answer the following questions: What is …

The Experience Of Qigong Among Women Cancer Survivors, Jennifer Sveund Jan 2017

The Experience Of Qigong Among Women Cancer Survivors, Jennifer Sveund

Antioch University Dissertations & Theses

Research has shown that qigong can be beneficial for a variety of health related conditions; However, evidence suggests that in the United States, a lack of well designed clinical trials limits the efficacy of qigong in the context of cancer treatment. Research has indicated that careful consideration should be given to the design of randomized control trials using qigong due to the conflicting philosophical methodologies. In the United States, qigong has been under investigated, particularly lacking are qualitative inquiries into qigong use and cancer survivorship. This study is an interpretative phenomenological inquiry that sought to understand women’s experience of qigong …

AMTP Proceedings 2017

In recent years, private-label brands have become a well-established part of the global retail environment, often possessing significant market share. This study examines: (1) the proportion or percent (purchase share) of consumers’ monthly purchases for (a) private-label brands of grocery and household products in general and (b) the Great Value (Walmart, U.S.) and Migros (Turkey) private-label brands in particular; (2) the potential effects of gender, income, age, and household size on consumers’ monthly purchase shares of private-label brands; (3) if the effects of these demographic factors have similar associations in the U.S. and Turkey; (4) if consumer awareness, perceived quality, …

A Bounded Affinity Theory Of Religion And The Paranormal, Joseph O. Baker, Christoper Bader, F. Carson Mencken Dec 2016

A Bounded Affinity Theory Of Religion And The Paranormal, Joseph O. Baker, Christoper Bader, F. Carson Mencken

Sociology Faculty Articles and Research

We outline a theory of bounded affinity between religious experiences and beliefs and paranormalism, which emphasizes that religious and paranormal experiences and beliefs share inherent physiological, psychological, and ontological similarities. Despite these parallels, organized religious groups typically delineate a narrow subset of experiences and explanatory frames as acceptable and True, banishing others as either false or demonic. Accordingly, the theory provides a revised definition of the “paranormal” as beliefs and experiences explicitly rejected by science and organized religions. To demonstrate the utility of the theory, we show that, after controlling for levels of conventional religious practice, there is a strong, …

In 2015, President Barack Obama pledged to admit more than 10,000 Syrians fleeing the civil war, but with an asterisk: the near absence of religious minorities, including Christians, Yazidis and Shia Muslims. It is an omission that some have charged is discriminatory but, at the very least, has left some of the world’s most vulnerable hanging in the balance.

Role Of A Plausible Nuisance Contributor In The Declining Obesity-Mortality Risks Over Time., Tapan Mehta, Nicholas M. Pajewski, Scott W. Keith, Kevin Fontaine, David B. Allison

Department of Pharmacology and Experimental Therapeutics Faculty Papers

CONTEXT: Recent analyses of epidemiological data including the National Health and Nutrition Examination Survey (NHANES) have suggested that the harmful effects of obesity may have decreased over calendar time. The shifting BMI distribution over time coupled with the application of fixed broad BMI categories in these analyses could be a plausible "nuisance contributor" to this observed change in the obesity-associated mortality over calendar time.

OBJECTIVE: To evaluate the extent to which observed temporal changes in the obesity-mortality association may be due to a shifting population distribution for body mass index (BMI), coupled with analyses based on static, broad BMI categories. …

Applying Multiple Data Collection Tools To Quantify Human Papillomavirus Vaccine Communication On Twitter., Philip M. Massey, Amy Leader, Elad Yom-Tov, Alexandra Budenz, Kara Fisher, Ann C. Klassen

Department of Medical Oncology Faculty Papers

BACKGROUND: Human papillomavirus (HPV) is the most common sexually transmitted infection in the United States. There are several vaccines that protect against strains of HPV most associated with cervical and other cancers. Thus, HPV vaccination has become an important component of adolescent preventive health care. As media evolves, more information about HPV vaccination is shifting to social media platforms such as Twitter. Health information consumed on social media may be especially influential for segments of society such as younger populations, as well as ethnic and racial minorities.

OBJECTIVE: The objectives of our study were to quantify HPV vaccine communication on …
