The New Politics Of Us Health Care Prices: Institutional Reconfiguration And The Emergence Of All-Payer Claims Databases, Philip Rocco, Andrew S. Kelly, Daniel Beland, Michael Kinane

Political Science Faculty Research and Publications

Prices are a significant driver of health care cost in the United States. Existing research on the politics of health system reform has emphasized the limited nature of policy entrepreneurs’ efforts at solving the problem of rising prices through direct regulation at the state level. Yet this literature fails to account for how change agents in the states gradually reconfigured the politics of prices, forging new, transparency-based policy instruments called all-payer claims databases (APCDs), which are designed to empower consumers, purchasers, and states to make informed market and policy choices. Drawing on pragmatist institutional theory, this article shows how APCDs …

Brazil’S New Path To Meaningful Intellectual Property Protection, Luiz Miranda Feb 2017

Brazil’S New Path To Meaningful Intellectual Property Protection, Luiz Miranda

University of Miami Inter-American Law Review

Today in Brazil, it takes over eleven years to receive legal rights to an invention by means of a patent. This state of affairs provides inadequate intellectual property protection for inventors and businesses, hampering Brazil’s desire to accelerate innovation, entrepreneurship, and economic growth through a national patent system. But a new Joint Agreement between the Government of the United States and the Government of the Federative Republic of Brazil could mean rescue is on the way. Both governments agreed to engage in patent work sharing programs between the two patent offices, in hopes of increased efficiency. Yet, some scholars have …

Immigrant Covering, Stella Burch Elias Feb 2017

Immigrant Covering, Stella Burch Elias

William & Mary Law Review

Over the last ten years there has been a marked shift in U.S. immigration law away from reliance upon statutory authorization and regulatory provisions to subregulatory or “liminal” rules and discretionary decision-making. This trend is apparent in both federal immigration law and in state and local rulemaking affecting immigrant communities. This Article proposes a new theoretical framework within which to analyze this phenomenon. It uses “covering,” a legal theory first developed in the context of employment discrimination and equal protection, as a lens through which to view these recent developments in immigration law and policy. It shows how immigration laws …

The rapid development of genomic sequencing technologies has decreased the cost of genetic analysis to the extent that it seems plausible that genome-scale sequencing could have widespread availability in pediatric care. Genomic sequencing provides a powerful diagnostic modality for patients who manifest symptoms of monogenic disease and an opportunity to detect health conditions before their development. However, many technical, clinical, ethical, and societal challenges should be addressed before such technology is widely deployed in pediatric practice. This article provides an overview of the Newborn Sequencing in Genomic Medicine and Public Health Consortium, which is investigating the application of genome-scale sequencing …

This case involves federal courts doubling down on the effective denial of counsel to a severely mentally impaired capital habeas petitioner on the eve of his execution, thereby preventing the full and fair litigation of an issue that demands this Court’s attention: the role played by a petitioner’s mental impairment in determining whether equitable tolling applies to the statute of limitations for filing a habeas petition. This Court should grant the petition to address whether the denial of adequate funding in this case constituted a constructive denial of the right to counsel required by the capital representation statute, 18 U.S.C. …

Border Insecurity: Reading Transnational Environments In Jim Lynch’S Border Songs, Jenny Kerber Jan 2017

Border Insecurity: Reading Transnational Environments In Jim Lynch’S Border Songs, Jenny Kerber

English and Film Studies Faculty Publications

This article applies an eco-critical approach to contemporary American fiction about the Canada-US border, examining Jim Lynch’s portrayal of the British Columbia-Washington borderlands in his 2009 novel Border Songs. It argues that studying transnational environmental actors in border texts—in this case, marijuana, human migrants, and migratory birds—helps illuminate the contingency of political boundaries, problems of scale, and discourses of risk and security in cross-border regions after 9/11. Further, it suggests that widening the analysis of trans-border activity to include environmental phenomena productively troubles concepts of nature and regional belonging in an era of climate change and economic globalization. Cet …

Forging A Bluegrass Commonwealth: The Kentucky Statehood Movement And The Politics Of The Trans-Appalachian West, 1783–1792, Christopher L. Leadingham

Theses, Dissertations and Capstones

In 1893 historian Frederick Jackson Turner first presented his frontier thesis to a group of historians at the World’s Columbian Exposition, a fair honoring the four-hundredth anniversary of Christopher Columbus’ expedition, in Chicago, Illinois. Since then, scholars have long debated the role that the frontier played in shaping the development of the United States. The Kentucky statehood movement emerged at a critical juncture in the early republic’s history, and, when viewed in a transatlantic context, becomes much more important to the development of the United States and larger Atlantic world than what has generally been recognized. Kentuckians found themselves at …

The participating international college students learned about U.S. concepts of race and racism through media, relationships, formal education, and lived experiences. They defined these concepts in varying ways and had varying racial ideologies.

The Politics Of Homelessness In The United States, Jean Williams Jan 2017

The Politics Of Homelessness In The United States, Jean Williams

Political Science

As the United States grapples with increasing economic inequality and significant poverty, homelessness represents a thorny political and policy issue. This article explores the debates that contrast two primary responses to homelessness, Housing First and the linear, or treatment first, model. Both are employed to address homelessness, though Housing First has been directed almost exclusively to chronic homeless people who are on the streets for long periods of time and contend with mental illness and substance abuse problems. By reviewing the strengths and weaknesses of each type of policy, this article analyzes the philosophy underlying each approach and its impact …

Technological Fetishism And Us Foreign Policy: The Mediating Role Of Digital Icts, Edward Comor Jan 2017

Technological Fetishism And Us Foreign Policy: The Mediating Role Of Digital Icts, Edward Comor

FIMS Publications

This article looks back at an Obama administration foreign policy initiative called Internet freedom and discusses US responses to anti-American extremism involving digital communications technologies. It does this by using Marx’s concept of the fetish to argue that technological fetishism played a constitutive and mediating role in policymaking. Through this analysis – relating international relations with political economy and Marxist theory – the empowering implications of these technologies for American state interests are shown to be also disempowering. Most US officials were likely to be aware that digital communications technologies did not have the inherent powers that their policies implied …

Maintaining Religious Identity In Hiring In Faith-Based Schools: A Comparative Analysis Of Australia And The United States, Keith Thompson, Charles J. Russo

Law Papers and Journal Articles

Even as Australia and the United States (US) are becoming increasingly secularised, they retain a significant number of faith-based primary and secondary schools. Aware of the tension between changing societal norms and the freedoms associated with religious institutions, the main part of this paper is divided into two sections. The first part surveys the relevant constitutional and anti-discrimination laws in Australia and the US along with exemplary litigation on how these statutes are applied. The second section offers six suggestions for school administrators who are wrestling with the challenge of preserving the faith-based ethos in their schools in the face …

Gender And Domination In Prison, Terry A. Kupers Jan 2017

Gender And Domination In Prison, Terry A. Kupers

Western New England Law Review

This Article discusses gender relations in prison systems and the plight of gay, lesbian, bisexual, transgender, and gender variant prisoners within these systems, where strict conformity with narrow definitions of gender are violently policed. The dominance hierarchy, Blue Code, and toxic masculinity in male prison culture also shape the culture in women’s facilities and much of what happens to LGBT and gender variant juvenile prisoners. The Author describes gender relations in male and female prisons through the context of experiences of inmates raped by other prisoners or prison staff.

The Author argues that the horrific pain and suffering caused by …

The Next American Revolution, Timothy K. Kuhner Jan 2017

The Next American Revolution, Timothy K. Kuhner

Western New England Law Review

Scholarly literature does not provide an adequate understanding of money in politics and corporate political power, which is, ultimately, the role of concentrated capital in democracy. The United States’ rising economic and political inequalities are not properly diagnosed as the excesses of a generally legitimate capitalist democracy in need of legal reforms. Rather, these inequalities are the symptoms of an overarching flaw in our political system that requires a revolution—one of the non-violent, constitutional kind.

Action follows understanding and if the understanding of a problem is weak and superficial, the reform agenda will also be weak and superficial. Supreme Court …

It focuses on examples from women’s prisons and includes issues and advocacy work from Massachusetts and across the country.

Toward The Anthropology Of White Nationalist Postracialism: Comments Inspired By Hall, Goldstein, And Ingram’S “The Hands Of Donald Trump”, Jeff Maskovsky

Publications and Research

This article explains Donald Trump’s brutal political effectiveness in terms of his white nationalist appeal. It locates the intellectual, popular, and policy imperatives of Trumpism in a new form of racial politics that I am calling white nationalist postracialism. This is a paradoxical politics of twenty-first-century white racial resentment whose proponents seek to do two contradictory things: to reclaim the nation for white Americans while also denying an ideological investment in white supremacy. The article shows how Trump’s excoriation of political correctness, his nostalgia for the post–WWII industrial economy, his use of hand gestures, and his public speaking about race …

Anatomy Of Front Pages: Comparison Between The New York Times And Other U.S. Major Metropolitan Newspapers, Yung Soo Kim, Deborah S. Chung

Journalism and Media Faculty Publications

Using content analysis, this article compares the front-page elements of The New York Times with six major metropolitan national newspapers to assess how different news organizations package and present their most important page to the public. Findings reveal that The New York Times featured more international and national news stories, depended more frequently on its own staff for both stories and images, and used smaller headlines on its front pages compared with the other major metropolitan newspapers.
