Privacy In Gaming, N. Cameron Russell, Joel R. Reidenberg, Sumyung Moon
Fordham Intellectual Property, Media and Entertainment Law Journal
Video game platforms and business models are increasingly built on collection, use, and sharing of personal information for purposes of both functionality and revenue. This paper examines privacy issues and explores data practices, technical specifications, and policy statements of the most popular games and gaming platforms to provide an overview of the current privacy legal landscape for mobile gaming, console gaming, and virtual reality devices. The research observes how modern gaming aligns with information privacy notions and norms and how data practices and technologies specific to gaming may affect users and, in particular, child gamers.
After objectively selecting and analyzing …
Data Scraping As A Cause Of Action: Limiting Use Of The Cfaa And Trespass In Online Copying Cases, Kathleen C. Riley
Data Scraping As A Cause Of Action: Limiting Use Of The Cfaa And Trespass In Online Copying Cases, Kathleen C. Riley
Fordham Intellectual Property, Media and Entertainment Law Journal
In recent years, online platforms have used claims such as the Computer Fraud and Abuse Act (“CFAA”) and trespass to curb data scraping, or copying of web content accomplished using robots or web crawlers. However, as the term “data scraping” implies, the content typically copied is data or information that is not protected by intellectual property law, and the means by which the copying occurs is not considered to be hacking. Trespass and the CFAA are both concerned with authorization, but in data scraping cases, these torts are used in such a way that implies that real property norms exist …
Virtual Hatred: How Russia Tried To Start A Race War In The United States, William J. Aceves
Virtual Hatred: How Russia Tried To Start A Race War In The United States, William J. Aceves
Michigan Journal of Race and Law
During the 2016 U.S. presidential election, the Russian government engaged in a sophisticated strategy to influence the U.S. political system and manipulate American democracy. While most news reports have focused on the cyber-attacks aimed at Democratic Party leaders and possible contacts between Russian officials and the Trump presidential campaign, a more pernicious intervention took place. Throughout the campaign, Russian operatives created hundreds of fake personas on social media platforms and then posted thousands of advertisements and messages that sought to promote racial divisions in the United States. This was a coordinated propaganda effort. Some Facebook and Twitter posts denounced the …

Positive And Negative Effects Of Social Media On Adolescent Well-Being., Katie Kennedy
All Graduate Theses, Dissertations, and Other Capstone Projects
Social media use is rapidly growing among adolescents, studies cite that the rates of “constant use” doubled from 2015 to 2018 (Anderson & Jiang, 2018; Lenhart, 2015). Social media use can have a serious negative impact on areas of well-being including feelings of depression, anxiety, fear of missing out, body image, bullying and sleep. Mojtabai, Olfson and Han (2016) cite the problematic use of mobile phones and social media applications as one of the trends aligning with the increase in major depressive episodes. Conversely, use of social media can promote positive feelings of well-being including creating a sense of community, …

The Dynamics Of E-Petitioning Behavior In We The People : An Exploration Of Online Mobilized Collective Action, Catherine Dumas
Legacy Theses & Dissertations (2009 - 2024)
The purpose of this research is to gain a better understanding of the impact of e-petitioning as a collective mobilized action taken to express policy preferences and the way that signing behavior takes place. Previous studies have analyzed e-petition signature data to track and understand the relationship between signing activity, time, and success of a petition (Hale et al., 2013; Yasseri et al., 2014). By using data mining techniques, namely market basket analysis and social network analysis, this research will explore three case studies that consist of three sets of similar petitions that were initiated on the US e-petitioning platform, …
From Innovation To Abuse: Does The Internet Still Need Section 230 Immunity?, Benjamin Volpe
From Innovation To Abuse: Does The Internet Still Need Section 230 Immunity?, Benjamin Volpe
Catholic University Law Review
In 1996, Congress passed the Communications Decency Act to allow the screening of offensive material from the internet, while preserving the continued development of the internet economy without burdensome regulation. However, for years, online intermediaries have successfully used the Act as a shield from liability when third parties use their online services to commit tortious or criminal acts. This Comment argues that a wholly-unregulated internet is no longer necessary to preserve the once-fledgling internet economy. After evaluating various approaches to intermediary liability, this Comment also argues that Congress should take a more comprehensive look at consumer protection online and establish …

A Hybrid Sentiment Analysis Method For Turkish, Buket Erşahi̇n, Özlem Aktaş, Deni̇z Kilinç, Mustafa Erşahi̇n
Turkish Journal of Electrical Engineering and Computer Sciences
This paper presents a hybrid methodology for Turkish sentiment analysis, which combines the lexicon-based and machine learning (ML)-based approaches. On the lexicon-based side, we use a sentiment dictionary that is extended with a synonyms lexicon. Besides this, we tackle the classification problem with three supervised classifiers, naive Bayes, support vector machines, and J48, on the ML side. Our hybrid methodology combines these two approaches by generating a new lexicon-based value according to our feature generation algorithm and feeds it as one of the features to machine learning classifiers. Despite the linguistic challenges caused by the morphological structure of Turkish, the …

In combat, anger becomes a new baseline and is promoted by peers as an acceptable means of militaristic motivation and coping with the atrocities of war. Unable to reconcile anger upon returning home, some veterans are forced to seek help via nontraditional paths. This interpretative phenomenological study explored the lived experience of male combat veterans who struggled with anger dysregulation issues and sought help from veteran peers on social media. Research questions were developed using the modal model of emotion as a guide for emotional dysregulation. Interviewed participants were invited to share lived experience of anger dysregulation, what help-seeking meant, …

Patient Views On Social Media Communication With Their Health Care Providers, Brenda Elaine Welch
Walden Dissertations and Doctoral Studies
Communication between patients and health care providers at hospital discharge is a critical factor that determines whether a patient understands their treatment plan and self-care instructions. Lack of effective health management after hospital discharge can decrease the quality of life for a patient and increase the likelihood of costly hospital readmission. The purpose of this phenomenological study was to explore factors affecting the receptivity of patients using social media as a platform for post discharge, provider-client communication, and assessment. This was explored using social presence theory. Twenty patients between 45 to 65 years of age, who received care from hospitals …

This Article contends that the Privacy Act of 1974, a law intended to engender trust in government records, can be implemented in a way that inverts its intent. Specifically, pursuant to the Privacy Act's reporting requirements, in September 2017, the U.S. Department of Homeland Security (DHS) notified the public that record systems would be modified to encompass the collection of social media data. The notification justified the collection of social media data as a part of national security screening and immigration vetting procedures. However, the collection will encompass social media data on both citizens and noncitizens, and was not explicitly …

Alexandria Ocasio-Cortez: A Case Study Of Social Media As An Agenda Setting Tool In The U.S. House Of Representatives, Jenna Floricel Lewinstein
Scripps Senior Theses
The purpose of “Alexandra Ocasio-Cortez: A Case Study of Social Media as an Agenda Setting Tool in the U.S. House of Representatives” is to explore the impact of a politician’s social media presence on agenda setting in Congress. It was born out of the research question, “how do freshman members of the House of Representatives seek power and influence in their first term?” I answer this using Representative Alexandria Ocasio-Cortez as a case study, as she is a current freshman legislator with undeniable power and influence. I studied Alexandria Ocasio-Cortez’s tweets from two time periods: the month leading up …

From Dreaming To Believing: A Review Of Consumer Engagement Behaviours With Brands’ Social Media Content Across The Holiday Travel Process, Dean Creevey, Etain Kidney, Glenn Mehta
Articles
This paper reviews social media user engagement behaviours with brands and proposes a new stage within the travel process. Specifically, the pre-trip stage is examined and investigation into a two sub-stage split is proposed; pre-purchase and post-purchase. Dubbed the Believing phase, this paper calls for research into the patterns of engagement behaviour towards hotel brands’ content at this currently under-researched stage. Current social media-focussed research examines influence on purchasing decisions of users, social media usage on-site, and post-trip evaluation. There remains a conceptual gap highlighting the behavioural patterns of users during the period between initial purchase and subsequent departure.

Can We Reduce Social Comparison And Fear Of Missing Out With Labels On Instagram?, Taylor Martinek
Departmental Honors Projects
The rapid rise in social media platforms has led to an increase of research surrounding its uses and effects. Thus far, results are heavily mixed with researchers finding both positive and negative effects. Activist campaigns, such as Status of Mind, have chosen to highlight negative outcomes such as increased social comparison and fear of missing out (FOMO). They have proposed platforms introduce a label to be placed on edited posts to help remind viewers they have been altered and are not an accurate depiction of reality. The current study examines whether labels are effective in reducing social comparison and …

Blind Spot: The Attention Economy And The Law, Tim Wu

Human attention, valuable and limited in supply, is a resource. It has become commonplace, especially in the media and technology industries, to speak of an "attention economy" and of competition in "attention markets.” There is even an attentional currency, the "basic attention token," which purports to serve as a medium of exchange for user attention. Firms like Facebook and Google, which have emerged as two of the most important firms in the global economy, depend nearly exclusively on attention markets as a business model.
Yet despite the well-recognized commercial importance of attention markets, antitrust and consumer protection authorities have struggled …

This dissertation considers what it means to think differently, using naturalistic verbal evidence. This problem is inspired by a gap within the Wisdom of the Crowd (WoC) literature, but relevant to the study of language processes, mental models, and the vast emerging resource of social media data. I propose a methodological framework to characterize diversity of thought through the quantification of social media data. Four stages of research considered: a) the properties of a sample domain, b) how to identify and select diagnostic content using classification methods, c) how to quantify qualitative content in order to categorize and compare individuals, …
