Justice For War Criminals: The Trials Of Nazi Concentration Camp Guards At Dachau, Jarrid Trudeau Apr 2013

Justice For War Criminals: The Trials Of Nazi Concentration Camp Guards At Dachau, Jarrid Trudeau

Honors Projects in History and Social Sciences

This paper will seek to explore whether or not Nazi war criminals tasked with manning and staffing the various concentration and death camps were in any way entitled to due process of law upon their capture and trial. This concept is debated among international Holocaust scholars and often discussed with purely apodictic arguments based upon a lack of understanding of military law. This paper will discuss in detail the rights, liberties, and treatment of Nazi war criminals after World War II in relation to the trials of concentration camp guards. It will also necessarily explore and explicate the misunderstood military …

Oh, The Treatise!, Richard A. Danner Apr 2013

Oh, The Treatise!, Richard A. Danner

Michigan Law Review

In his foreword to the Michigan Law Review's 2009 Survey of Books Related to the Law, my former Duke colleague Erwin Chemerinsky posed the question: "[W]hy should law professors write?" In answering, Erwin took as a starting point the well-known criticisms of legal scholarship that Judge Harry Edwards published in this journal in 1992. Judge Edwards indicted legal scholars for failing to engage the practical problems facing lawyers and judges, writing instead for the benefit of scholars in law and other disciplines rather than for their professional audiences. He characterized "practical" legal scholarship as both prescriptive (aiming to instruct attorneys, …

Iranian Democratization Part I: A Historical Case Study Of The Iranian Green Movement, Victor H. Sundquist Apr 2013

Iranian Democratization Part I: A Historical Case Study Of The Iranian Green Movement, Victor H. Sundquist

Journal of Strategic Security

The 2009 Iranian Presidential Elections represented one of the most contentious displays of the evolving Iranian democracy since the 1979 Islamic Revolution that led to the removal of Mohammad Reza Shah Pahlavi – the nation’s last shah. This tumultuous political event not only exposed a growing rift between the political and religious ruling elite in that country; it also led to the emergence of an opposition movement that would later be known as the Green Revolution. Viewed through a Western political lens, this revolution represented yet another opportunity for the demise of the ruling Iranian Islamic Regime. Recently, some scholars …

Iranian Democratization Part Ii: The Green Movement - Revolution Or Civil Rights Movement?, Victor H. Sundquist

Journal of Strategic Security

The fundamental question of whether or not the Green Movement’s opposition leaders were successful in their attempts to change the political landscape in Iran first lies in understanding the premise behind the organization and secondly recognizing the actual goals of the leadership. Consequently, this article analyzes these questions as a framework for developing a comparative analysis between revolutions and civil rights movements as a means to understand both the intent and outcomes of the Green Movement. From this analysis, lessons learned are put forth as a means to establish a series of recommendations for future Western political engagements with Iran. …

Rediscovering The Core Of Public Health, Steven Teutsch, Jonathan E. Fielding Mar 2013

Rediscovering The Core Of Public Health, Steven Teutsch, Jonathan E. Fielding

Frontiers in Public Health Services and Systems Research

The success of public health has been its ability to understand contemporary health problems, to communicate the needs successfully, to identify solutions, and to implement them through programs and policies. In the past 50 years, those successes can be attributed largely to control of infectious disease, improved maternal and child health, delivery of other personal health care services, and changes in behaviors, particularly smoking. Yet health is primarily a product of our social, cultural, and physical environments. To continue to improve the nation’s health and reduce disparities, public health needs to return to its historical roots and engage with other …

Researching Stonewall Nation: Interdisciplinary Considerations For Lesbian, Gay, Bisexual, Transgender Historical Research, Jacob Carter Mar 2013

Researching Stonewall Nation: Interdisciplinary Considerations For Lesbian, Gay, Bisexual, Transgender Historical Research, Jacob Carter

Graduate History Conference, UMass Boston

The Alpine County Project, a climactic event in the gay liberation movement when activists took steps to create a self-governing separatist community in a remote region of rural California, is a largely forgotten topic of Lesbian, Gay, Bisexual, Transgender (LGBT) history. Though historical scholarship treated the project marginally within broader conceptual or regional contexts of gay liberation, the project had not been examined comprehensively in its own right. When approaching the topic, the initial historical problem to resolve was determining whether the project was a hoax staged to generate publicity or part of a genuine gay and lesbian separatist movement. …

Landscape, History And The Media: An Introduction, Christina E. Dando Feb 2013

Landscape, History And The Media: An Introduction, Christina E. Dando

Geography and Geology Faculty Publications

Writing from Nebraska’s eastern edge, my mind’s eye drawn to the Platte River (west and south of me), I consider landscape, history, and the media. The Oto called the river “Nebraskier” which means flat or shallow, giving us the name of the state.1 Early accounts describe the Platte as “a mile wide and an inch deep” and “too thick to drink, too thin to plow”; Washington Irving described it as “the most magnificent and useless of rivers” (Allin 1982, 1). But to dismiss this river is to judge too quickly. As the river gains momentum, growing in size, it is …
