This article summarizes the findings of the Alaska Judicial Council's most recent evaluation of Alaska's ban on plea bargaining. The study found several major differences between Alaska's pre-ban practices and current practices that could be directly attributed to the ban. First, the standard for screening of cases was tightened immediately after the ban was announced, resulting in an increase in the number of cases not accepted for prosecution. According to most persons interviewed, the present screening policy is a positive influence on the quality of cases and a useful tool for prosecutors. The Winter 1991 issue of the Alaska Justice Forum discusses the first year of work by the Alaska Sentencing Commission, which was created by an act of the Alaska Legislature to evaluate the effect of sentencing laws and practices on Alaska's criminal justice system and to recommend improvements in criminal sentencing practices. The Bureau of Justice Statistics presents a detailed examination of data on rape from the National Crime Survey for 1973 to 1987. Crime statistics for sixteen predominately Yup'ik villages in the Bethel area of Alaska for 1983–1987 are presented.

As Alaska struggles with criminal justice delivery to Alaska Native villages, many experiments have been undertaken or postulated which would reinvigorate criminal law activity in these rural places. Initial enthusiasm for alleviation of burdens on the formal system has been replaced with a state concern that village activity will be viewed as tribal activity. The author isolates areas where the needs of the state and villages can be met without feeding the flames of the conflict between state sovereignty and village tribal sovereignty.

Human Biology And Criminal Responsibility: Free Will Of Free Ride ?, Deborah W. Denno

This Comment presents three major arguments concerning biological deficiency defenses, using, respectively, a critique of biosocial science research, a statistical model of biological and sociological data, and an examination of theories and philosophies on causation and behavior. First, this Comment argues that there should be no defense to mitigate criminal responsibility except in the less that one percent of cases eligible for the insanity defense. Second, this Comment argues that social science research has not successfully demonstrated sufficiently strong links between biological factors and criminal behavior to warrant major consideration in determining criminal responsibility. There is a trend in the criminal law today to focus on the rights of victims. This trend has been manifested in actions by legislatures, courts, the President of the United States and others. Various programs have been implemented to ameliorate the crime victim's experience. For example, many states now provide compensation for victims, and victim/witness assistance programs have sprung up around the country. It has also been suggested that the victim's lot should be improved by granting them a right to participate in the prosecution of the defendant. The Risks And Rewards Of Criminal Activity: A Comprehensive Test Of Criminal Deterrence, W. Kip Viscusi

Whereas previous analyses of criminal deterrence have focused on the effect of criminal enforcement on crime rates, this study analyzes the existence of compensating differentials for criminal pursuits. By analyzing the risk-rewards trade-off, this approach represents a more comprehensive test of the criminal deterrence hypothesis. The sample consisted of black inner-city youths who reported their crime participation, crime income, and self-assessed risks from crime. The risk premiums for the three principal adverse outcomes (arrest, conviction, and prison) constituted between one-half and two-thirds of all crime income on the average, providing strong support for the criminal deterrence hypothesis

The examination of offenses rather than offenders in past research often overlooked the importance of offender characteristics and background. Indeed, a growing body of research suggests that the biological or psychological characteristics of offenders may strongly influence the outcome of particular encounters or future offense behavior. For instance, offenders with poor verbal ability or low school achievement scores may be more prone to repeat confrontational violence, irrespective of the characteristics of the victim or the situation of the offense. Thus, it is important to distinguish between those offenders with short or repeat offense histories, and those offenses which do or …

The legal reaction by Yup'ik and Inupiat Eskimos in Alaska to drunken behavior has changed over time from one that penalizes drunkenness to one that seeks to prevent drinking. This new therapeutic approach interferes with any preemptive aggressive response by persons seeking to control an intoxicated person. Moreover, since the law perceives an intoxicated person as sick rather than bad, the traditional perception that an intoxicated person is not his normal self may be reinforced by the law. Indeed, a drunken person may act aggressively without fear of later community blame. The author concludes that the law should re-orient Native …

The social history of crime and criminal justice in the nineteenth century has recently tended to emphasize two themes: first, attitudes towards crime and punishment, and the administrative reforms of institutions which grew out of those attitudes; second, the nature of criminality, particularly of serious crime and long-term trends, as revealed in case studies of offences in particular localities, including computer-based, statistical profiles of criminal populations. This study of research diffusion and use in Alaska was a major effort to generate empirical information about the connection between research and policymaking relating to the critical problem of violence, a problem which threatens the quality of life for Alaskans . Policy questions of interest centered on: (1) describing the research diffusion process in connection with human service agencies that deal with problems of violent behavior; (2) determining how research influences decisions about violence reduction policy and programming; and (3) discovering what facilitates or inhibits the use of research in making decisions about combating violence.
