How Much Does Legal Status Matter? Adoptions By Kin Caregivers, Margaret F. Brinig, Steven L. Nock

Virtually all the legislation dealing with families that include children begins with a "best interests of the child" premise.' Most, if not all, of the litigated results at least seem to maximize the outcomes for adults. This discrepancy should not be surprising, for both substantive and procedural reasons.
The substantive reason, as even the Supreme Court has noted, is that most of the time, what is good for parents will also be good for children. Moreover, having parents who possess many "rights" allow them to better exercise their parental responsibilities. From a procedural perspective, adults are usually the named parties …

In an early scene in The Terminator, the Cyborgian Arnold Schwarzenegger walks into an L.A. gun shop and asks to see the wares. The shopkeeper lays out Uzis, submachine guns, rocket launchers, and other sophisticated means of overkill, nervously understating, "Any one of these will suit you for home defense purposes." The situation is likewise in the growing child protection industry. In keeping with the shopkeeper's sly comment, these businesses feast on an all-pervasive culture of fear, while creating a mockery, alibi, and distraction out of what they are really about - to remake the home as a citadel through …

The Impact Of Family Paradigms, Domestic Constitutions, And International Conventions On Disclosure Of An Adopted Person's Identities And Heritage: A Comparative Examination, D. Marianne Brower Blair
Michigan Journal of International Law
This article examines the extent to which international law has and will potentially influence the direction of the reform and implementation of adoption disclosure norms. Though it does not yet appear that international law mandates recognition of an absolute right to identifying information when such disclosure is opposed by a birth parent or adoptee, examination of these conventions and the response of the international community underscores the critical importance of identifying information to many adoptees, and a growing movement to afford primacy to their interests.

Quality Of Life Assessment For Young Children With Developmental Disabilities And Their Families: Development Of A Quality Of Life Questionnaire., Rachel A. Bowman
Quality Of Life Assessment For Young Children With Developmental Disabilities And Their Families: Development Of A Quality Of Life Questionnaire., Rachel A. Bowman
Graduate Theses, Dissertations, and Problem Reports (ETD)
Early intervention for the treatment of developmental delays in children birth through three years is a fairly recent programmatic development. One of the goals of early intervention services is to improve child and family quality of life. However, no reliable and valid instruments currently exist to assess child and family quality of life for this particular population. The present study describes the development of the Quality of Life Questionnaire. The first step in the development of this questionnaire consisted of a comprehensive review of the developmental disabilities and pediatric chronic illnesses literatures in order to develop an interview (Quality of …

A central characteristic of our current gender arrangements is that they pit ideal worker women against marginalized caregiver women in a series of patterned conflicts I call gender wars. One version of these are the mommy wars that we see often covered in the press between employed mothers and mothers at home. Employed mothers at times participate in the belittlement commonly felt by homemakers. Also mothers at home, I think, at times participate in the guilt-tripping that's often felt by mothers who are employed. These gender wars are a central but little understood characteristic of the gender system that grew …

Women, Children And Domestic Violence: Current Tensions And Emerging Issues
Women, Children And Domestic Violence: Current Tensions And Emerging Issues
Fordham Urban Law Journal
A symposium in which the conference speakers give a clear and disturbing picture of how we ascribe a kind of omnipotence to mothers vis-a-vis their children. If children are hurt, it is assumed that those at fault must be the mothers, and they are likely to be blamed even when it is the father who strikes the blows, lands the punchers or terrifies the child. Somehow, we imagine they should have been able to snatch the children out of harms way. The answer to this problem ultimately lies in making sure the ways victims of domestic violence think about their …

Building Pediatric Law Careers: The University Of Michigan Law School Experience, Melissa Breger, Suellyn Scarnecchia, Frank E. Vandervort, Naomi Woloshin
Articles
There are several obstacles to training and supporting pediatric lawyers. Children are a relatively new group of clients and law schools have not traditionally provided pediatric training. The required training is particularly challenging to deliver because it is inherently interdisciplinary, requiring faculty and students to look outside of the law school to obtain necessary knowledge. The greatest obstacle to developing the careers of pediatric lawyers is the low pay and low prestige typically afforded children's lawyers. As a result, law students reasonably question the likelihood of developing a successful career in the field. The number of available jobs is limited …

From Family To Care: Issues For The Child, Paul Bailey
From Family To Care: Issues For The Child, Paul Bailey
Irish Journal of Applied Social Studies
It is still widely held that the traditional or conventional nuclear family is the only suitable environment in which children can grow up and that any deviation from this norm puts children at a considerable disadvantage (Kahan, 1989). The vulnerability of children and young people coming into residential care in Ireland due to their dysfunctional family experiences, and how coming into residential care and their subsequent experience therein can sometimes further increase this level of vulnerability for the adolescent child has been well documented. This paper discusses the question: What can we, as residential child care workers and agencies, do …
Mental Health, Adolescents And Children: A Comparative Analysis Of The Practice/Policy Interface, John S. G. Wells
Mental Health, Adolescents And Children: A Comparative Analysis Of The Practice/Policy Interface, John S. G. Wells
Irish Journal of Applied Social Studies
Mental health services for children and adolescents in Ireland exist in a state of ambiguity. Services operate within a context of resource constraints and increasing demand. The result is that practitioners have to prioritise the client groups according to policy dictates. In Ireland the policy priority is children at risk of physical and sexual abuse. Utilising current literature in the field, this paper discusses the potential consequences of such a focus for clients, practitioners and policy through a comparative analysis with the United Kingdom. It is argued that a lack of legislative clarity, combined with a focus on abuse has …
