Parole boards evaluate the public safety risk posed by parole-eligible prisoners to determine whether they should be released. In this Essay, I argue that this process, at least as it operates in California, is fundamentally flawed because it asks the wrong question. Rather than ask whether an inmate poses any public safety risk, parole board officials should instead ask whether this risk is worth taking.
One way to answer this question would be to make our calculations more inclusive of all the costs and benefits of release and comparing them with the costs and benefits of retention. Elementary as this …

Though the Great Recession may be officially over, economic recovery is slow and tentative, particularly in California and much of the Intermountain West. Among other challenges, the protracted downturn in these states has exposed and aggravated a huge public-sector fiscal crisis—with disconcerting implications for citizens and states’ long-term economic health. This brief takes a careful look at the fiscal situation in Arizona, California, Colorado, and Nevada, examining both their serious cyclical budget shortfalls—those resulting from the recession and its aftermath—as well as the critical longer-term structural imbalances between revenues and expenditures that have developed in Arizona, California, and, to a …

Criminal Justice Information Sharing: A Legal Primer For Criminal Practitioners In California, W. David Ball, Robert Weisberg

California criminal justice agencies need access to data in order to provide security, health care treatment, and appropriate programming, as well as to coordinate these activities with other agencies. By the same token, outside agencies—whether criminal, social service, or non-governmental—could often do their jobs more effectively with access to information generated or retained within particular criminal justice agencies. Criminal justice realignment under AB 109 has only heightened the need for inter-agency data sharing and cooperation, yet there continue to be misunderstandings about the legal framework surrounding information exchange.

Not Playing House The Way Mom And Dad Do : Same-Sex Commitment Without Marriage : A Project Based Upon An Independent Investigation, Amanda Gail Sommers
Theses, Dissertations, and Projects
This exploratory study reveals the narratives of long-term, committed same-sex couples living in the Bay area of California, who decided not to marry in 2008 when it was temporarily legal. Thirteen participants were interviewed and their responses were transcribed and analyzed. They were asked to explain personal, social, and political influences on their perspectives on marriage. They were also asked to define commitment and the commitment markers used in their relationships. Lastly, they were questioned about their relationship with the current marriage equality movement. Findings revealed that participants refrained from marrying due to negative associations they have developed toward the …
