Criminal Law Revision In California, Arthur H. Sherry

The high water mark of criminal law reform in California was reached in 1872 when the legislature, after at least a decade of indifference to requests for action, adopted the Penal Code, the Civil Code and the Code of Civil Procedure.' This emergence into the company of contemporary pioneers of codification, Louisiana and New York, was a source of complacent pride, but it proved to be completely ineffective as a stimulus for continuing revision or even further codification. Renewed interest in improving and modernizing the law was not apparent until well into the twentieth century. When this interest did appear, …

Among the questions that drew attention were these. Are San Joaquin County's juvenile delinquents the sane as, or different than those found elsewhere? that happens to the youngster after the police refer him on into the corrections structure? What are the criteria by which decisions are made? Who makes the decisions? What services are offered? What facilities does San Joaquin County have in which to treat the juvenile? What services are offered in the institutions? In view of the current levels of knowledge, is our county doing an adequate job?

This study was undertaken in an attempt to present a current account of certain political aspects of California's struggle with the problem of alcoholic beverage control, with, emphasis on the work of members of the state legislature and others who, by their Intense interest in the subject, have been instrumental in the shaping of state policy. A review of past events and personalities outstanding in this field has been Included to show their interrelation to the present situation.

A statute of California forbade the transportation of automobiles from without the state for the purpose of sale within or without the state unless there be attached to each vehicle a special permit issued by the State Motor Vehicle Department, for which a fifteen dollar fee was exacted. A suit was brought to restrain state officers from enforcing this statute. Held, the statute imposed an unconstitutional burden upon interstate commerce. Ingels v. Morf, (U.S. 1937) 57 S. Ct. 439, affirming (D. C. Cal. 1936) 14 F. Supp. 922.
