Pardes Hanna-Karkur Local Council V. Ministry Of Health, Alex Stein, Noam Sohlberg, George Kara
Translated Opinions
HCJ 2233/20 Pardes Hanna-Karkur Local Council v. Ministry of Health; HCJ 2255/20 Ezra Manor v. Ministry of Health challenged the decision of the Ministry of Health to convert several departments in the Shoham Government Geriatric Center in Pardes Hanna-Karkur for the treatment of moderate to severe coronavirus patients. The Court (per Justice A. Stein, Justice G. Karra and Justice N. Sohlberg concurring) denied both petitions.
In HCJ 2233/20, the Court criticized the “not in my backyard” attitude of the Local Council, and held that “Shoham is a hospital that belongs to the State, and it may decide what …

Ohio Workers And The Covid-19 Global Health Emergency, Joseph Andre, Robert Gleeson
All Maxine Goodman Levin School of Urban Affairs Publications
The global economy has never before experienced the scale of sudden economic shock that is now underway. This is unchartered territory. Although the U.S. has many economic policies and worker support programs designed to ease dislocation during recessions, these programs were not designed for the unique circumstances of this global pandemic.
The most important program for workers is Unemployment Insurance. The first chart in this report shows the unprecedented number of new applications for unemployment insurance filed by Ohio workers during the week of March 16th. If all applicants are awarded benefits, the second chart shows that the number of …

Translated Opinions
Peshe Brook v. Ministry of Health sought leave to appeal a decision by the Administrative Affairs Court denying a request for an interim order that would prevent the transfer of the Applicants to alternative facilities while their petition against the Ministry’s decision remained pending. The request was denied in a decision by Justice U. Vogelman for lack of a sufficient cause for intervention in the lower court’s decision. Although the Court recognized the difficulty that the transfer posed for the Applicants, Justice Vogelman held that “the balance of interests tilts in favor of the Ministry of Health, which seeks to …

May Hospitals Withhold Ventilators From Covid-19 Patients With Pre-Existing Disabilities? Notes On The Law And Ethics Of Disability-Based Medical Rationing, Samuel R. Bagenstos
May Hospitals Withhold Ventilators From Covid-19 Patients With Pre-Existing Disabilities? Notes On The Law And Ethics Of Disability-Based Medical Rationing, Samuel R. Bagenstos
Law & Economics Working Papers
Thanks to the coronavirus pandemic, the threat of medical rationing is now clear and present. Hospitals faced with a crush of patients must now seriously confront questions of how to allocate scarce resources—notably life-saving ventilators—at a time of severe shortage. In their protocols for addressing this situation, hospitals and state agencies often employ explicitly disability-based distinctions. For example, Alabama’s crisis standards of care provide that “people with severe or profound intellectual disability ‘are unlikely candidates for ventilator support.’” This essay, written as this crisis unfolds, argues that disability-based distinctions like these violate the law. The Americans with Disabilities Act, the …

Armenia Combats The Coronavirus: State Capacity And The Diaspora, Shant Shekherdimian, Nerses Kopalyan
Political Science Faculty Research
Armenia's Government has taken acute measures to combat COVID-19, the novel coronavirus disease, by implementing a set of aggressive policies aimed at containing the epidemic. The perceived relative success of these measures--although it is quite premature to speak of any kind of success at this stage--also recognizes the inevitable: the virus cannot be fully contained and it is a matter of time before its transmission escalates. This is precisely what has been observed in much of Europe, Asia, and North America: containment strategies remain limited, so governments are proceeding with more complex mitigation strategies.

Special Issue Editor’S Introduction: Practical Wisdom And Institutional Transformation In An Urban Disaster, Michael A. Cowan
New England Journal of Public Policy
As I complete the editor’s introduction to these articles on institutional disruption and transformation in New Orleans triggered by Hurricane Katrina, Corona splashes her colors over maps of the earth. The hurricane pales in comparison with the pandemic, but one contrast between the two occurs to this participant/observer in both.
Prior to Katrina most institutions necessary to proper city functioning—including city administration, police department, and courts—were broken or stretched to the breaking point. As you will see in these articles, following the storm, business and civil society leaders, cooperating with government officials when possible, challenging them as necessary, led dramatic …

Bulletin of Chinese Academy of Sciences (Chinese Version)
The occurrence and rapid outbreak of COVID-19 epidemic, has posed severe challenges to China's current public health emergency legal system with the Infectious Diseases Prevention Law and Regulations on Emergency Response to Public Health Emergencies as the core. The obvious shortcomings and deficiencies are exposed in the aspects of Emerging Infectious Diseases (EID) prevention, authority allocation difference on disease control and emergency response, public information disclosure and the legality of emergency measures. According to the needs of epidemic prevention and control, it is urgent to declare a State of Emergency in Wuhan and other local areas, and to improve the …
